SECTION 1 – INTRODUCTION

1.1 GENERAL INFORMATION

The Small Business Administration (SBA) is issuing this solicitation (SOL) # 73351020Q0029 as a Request for Quote (RFQ). This RFQ is pursuant to Federal Acquisition Regulation (FAR) Part 12—Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This requirement is for the purpose of entering an order for the Statement of Work (SOW) entitled, “CETE DynamicPDF Renewal”.

This is a notice that the resultant contract is for a total small business set-aside requirement. Only quotations submitted by Small Businesses will be accepted by the Government. Any quotation that is submitted by an Offeror that is NOT a Small Business will not be accepted.

If your firm is interested in this acquisition, you may participate by submitting your response in accordance with the requirements and instructions contained herein.

The Government anticipates that most of this effort may be performed under NAICS Code 541519 – Other Computer Related Services and Product Service Code 7030 ADP Software.

1.2 RFQ QUESTIONS:

Offeror must submit all technical questions concerning this solicitation in writing by e-mail to the Contracting Officer, Tracy.Lambert@sba.gov and the Contract Specialist, Patrick.Ferguson@sba.gov All questions must be submitted via e-mail, and received no later than 1:00 PM Eastern Time (ET) on April 23, 2020.

1.3 RFQ DUE DATE:

The due date for response to this RFQ at the addresses specified below is on or before 1:00 PM ET April 27, 2020. Each volume shall be clearly marked by Volume Number and Title. The Government reserves the right to not accept quotes received after the closing date and time. It is the responsibility of the offeror to get their submission in on time and ensure successful delivery to the Government. Submission shall be submitted via e-mail to the Contract Specialist Patrick Ferguson at Patrick.Ferguson@sba.gov and the Contracting Officer Tracy Lambert at Tracy.Lambert@sba.gov.

1.4 INSTRUCTIONS

Offeror shall submit a Technical and Price Quote.

Your Quote MUST include the following information on the title page of each volume:

1. TYPE OF SUPPLIES OR PRODUCT(S)

This Statement of Work (SOW) was prepared for the procurement of The Cete Dynamic PDF software that is the used by ELA to generate PDF documents for the forms that users complete online. The PDFs contain the user's data and have barcodes to facilitate automated scanning. The PDF documents can be downloaded by the users and are stored in DCMS.

This SOW was prepared specifically for maintenance of CETE DynamicPDF licenses and extended support services for 1 year plus the maintenance renewal of Developer Licenses and Viewer Licenses.

2. QUANTITY OF SUPPLIES OR PRODUCT(S)

Quantity of product includes 1-year maintenance renewal for 5 enterprise server licenses (DynamicPDF Core Suite v8.0 for .NET DPS-BONES). Additionally, this includes maintenance renewal of 3 Developer Licenses and 3 viewer licenses. *See exhibit A for serial numbers.

3.1 PLACE(S) OF PERFORMANCE

3.2 INVOICE INSTRUCTIONS:

As of October 1st, 2018, the Small Business Administration is using the Invoice Processing Platform (IPP) to facilitate the electronic exchange of invoices and payment information to its suppliers of goods and services. IPP is a service provided by the US Treasury’s Bureau of the Fiscal Service designed to help your organization streamline the order-to-pay process.

As a vendor to the Small Business Administration, IPP is available for you to use at no cost to your company.

3.3 Payment for Unauthorized Work

No payments will be made for any unauthorized supplies and/or services or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.

3.4 SECTION 508 COMPLIANCE REQUIREMENTS

All Electronic and Information Technology (EIT), as defined at FAR 2.101, supplied under this contract, must conform to the Architectural and Transportation Barriers Compliance Board Electronic and Information Technology Accessibility Standards (36 CFR Part 1194). 3.5 Authority to Obligate the Government

The Contracting Officer is the only individual who can legally commit or obligate the Government to the expenditure of public funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific authorization from the Contracting Officer.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
