FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity.

Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS&IMF), Industry Management Department (Code 400), Bremerton, WA 98314.

2. Description of Action Being Approved.

The contemplated action for approval is the award of a sole source contract to for on-site technical representative repairs and replacement parts on (9) High Pressure Air Compressors (HPACs) and (1) Ships Service Air Compressor (SSAC) to Original Equipment Manufacturer (OEM) standards, in accordance with proprietary drawings and specifications. is the OEM and is the only source with design drawings and specifications required to restore the compressors and dehydrators to OEM standards.

3. Description of Supplies/Services.

PSNS&IMF, in support of a US NAVY NIMITZ class aircraft carrier, as part of ship repair and maintenance, requires OEM repairs/replacements to (9) HPACs and (1) SSAC. is to perform the OEM technical repair; provide all parts and supplies; deliver and install all replacement parts; complete inspection and operational testing of the Ship’s equipment in accordance with the Original Equipment Manufacturer (OEM) drawings and OEM repair standards. All repairs must be completed and unit successfully restored and tested by 05/03/2024 for No. 4, 5, 6, 7, 8, 9, 10, 11 and 12 HPACs and No. 2 SSAC in order to return the ship back to the Fleet and meet mission scheduling. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C 3204(a)(1): Only one responsible source and no other supplies will satisfy agency requirement (FAR 6.302-1).

5. Rationale Justifying Use of Cited Statutory Authority.

Pursuant to FAR 6.302-1, the requirement described above has been determined to be achievable by only one source. is the only source with proprietary design drawings and specifications required to restore the HPACs and SSAC. has the technical expertise to perform required repairs and testing. All components and parts are proprietary to and cannot be purchased from other vendors.

is the NAVSEA authorized provider for aircraft carrier HPACs and SSAC. Existing units are compressors (HPAC and SSAC). These complex and highly engineered units are mandated by NAVSEA for aircraft carrier applications. All parts must be OEM provided to ensure proper operation of the units.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with FAR subparagraph 5.203(a) (1), this requirement was synopsized on SAM.GOV publicizing the Government’s intent to sole source on 29 November 2023. The Sources Sought posted on SAM.GOV resulted in “No Responses”. In accordance with 10 USC 3204 (a)(1) FAR subparagraph 6.302-1, the requirement is only available from a single source which possesses capability, knowledge, rights in data, patents, drawings and copyright rights. Therefore, no other source will satisfy the needs of the Government.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, PSNS&IMF has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, PSNS&IMF will assess whether competition for future requirements is feasible.
