Sole Source Memorandum Protected Species Observer (PSO) Database Development
The United States Department of Interior, Bureau of Ocean Energy Management (BOEM) is proposing to award a Firm Fixed Price (FFP) Purchase Order to Mysticetus LLC. BOEM has a requirement to purchase software to assist BOEM in developing a Protected Species Observer (PSO) database. Period of performance shall be 36 months from date of award. The total estimated cost for this requirement is $226,666.56.
This justification is hereby prepared in accordance with FAR 13.106-1(b)(1)(i) – Soliciting from a Single Source. The required PSO software is solely available through Mysticetus LLC.
The PSO software provided by Mysticetus LLC is the primary software application currently being used by offshore wind developers. The software meets BOEM’s need to monitor protected species and provide information to ensure they are not harmed during surveys and construction activities.
Sighting data collected by Mysticetus LLC can be instantly shared with other vessels using the software to ensure nearby projects and surveys are aware of whales, dolphins, etc. and can further reduce the impacts to protected species. Additionally, with the detection of North Atlantic Right whales, National Marine Fisheries Service (NMFS) is requiring instant reporting (within an hour), and the software has the capability to meet that requirement via email.
Furthermore, the software ensures data quality and integrity by maintaining a keystroke log, thereby protecting the developer and BOEM from potential "data manipulation" issue and questions that could reduce the validity of the data. Therefore, all data archived for BOEM will be QA/QC’d for data integrity moving forward and meets DOI requirements for Scientific Integrity.
There is no other software available that has these capabilities and meets BOEM’s needs. Market research did not reveal any other software that will meet BOEM’s requirement. Mysticetus LLC is the only source available to procure the software. There are no third-party resellers of the software. A FBO notice will be posted in accordance with FAR 5.2.
I certify that this justification, in accordance with FAR 13.106-1(b), is accurate and complete to the best of my knowledge and belief.
