SUBJECT: ViaSat Linkway – 1 year subscription plus option years

The U.S. Army Contracting Command-APG (ACC-APG) is requesting a Firm Fixed Price Quotation for Commercial-Off-The-Shelf (COTS) ViaSat Linkway Annual Maintenance and Tech Support. The services described below are for a one (1) year base period of performance starting on July 1, 2020, plus option years. The NAICS Code applicable to this acquisition is 541519. This acquisition will be funded with FY2020 Operations and Maintenance Funds Army (OMA) based on availability of funds. The quotations are due within 1 calendar days of this notification, no later than close of business at 16:00 (EDST) on 27 August 2020.

We are looking for interested parties who can provide the same COTS products listed above or alternate commercial products. You must be able to sell the ViaSat Linkway software support and renewal to the Army. Alternate commercial products will be considered once vendor submits pricing and availability and sufficient technical information for the program office to perform an evaluation to determine that the alternate product is technical feasible and priced less than the current COTS products listed above.

Respondent Due Date – Price quotes are due within 1 calendar days of this notification, no later than close of business at 16:00 (EDST) on 27 August 2020. If you are unable to furnish a quote, respond with “no bid” and provide a detailed explanation as to why you are unable to.

Respondent Instructions – Reponses should clearly indicate the following:

· All quotes should indicate the part numbers specified under the above Product Description, with itemized pricing for each part number specified. Any deviations from the Part Numbers specified shall be explained in the Offerors response.

· Contractor CAGE Code, DUNS Number and business type / size.

· Published Commercial Price, if applicable.

· Any and all applicable discounts applied to the pricing.

· Quotes should separately identify any applicable costs associated with meeting the delivery instructions.

· PROVIDE A COPY Of END USER LICENSE AGREEMENT(s) OR SOFTWARE MAINTENANCE AGREEMENTS ASSOCIATED WITH THE ITEMS LISTED ABOVE. If no agreement exists clearly state that in the provided quote.

This document is neither a purchase order, nor a contract, nor a promise to issue an award.

The government reserves the right to issue an award in part or in whole for the items described above. The government is not obligated to make an award for all or any portion of the items described.

The contract will be awarded to the lowest bidder. The evaluation will be based upon the base year and any awarded options. The offeror must also be responsive, and responsible.

FAR 52.217-5: Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

Delivery Instructions:

The ViaSat Linkway Annual Maintenance and Tech Suppor shall be activated / delivered with inspection and acceptance at destination within 30 days of award to:

52.217-9 Option to Extend the Term of the Contract

(a) The Government may extend the term of this contract by written notice to the Contractor within 60 days, provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 10 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed four years.

52.233-2 SERVICE OF PROTEST (SEP 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from Larry Carter, Contracting Officer, at 6565 Surveillance Loop, Building 6001 Aberdeen Proving Ground, MD 21005.

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.
