C.7 INVOICING

(a) Upon completion email the invoice to the assigned COR identified at the time of award on the contract. The invoice must include:

(a) Name and address of the Contractor;

(b) Invoice date and number;

(c) Order number and line-item number;

(d) Property Address; and

(e) Borrower Name/Account Information specified on order.

(b) In accordance with the Prompt Payment Act (31 U.S.C. 3903), payment will be made by Electronic Funds Transfer 30 calendar days after receipt of an invoice with proper documentation and confirmation of acceptable performance by the RD point of contact.

C.8 CONDUCT

During the course of this contract, the contractor will maintain the same high standards of honesty, integrity, impartiality, confidentiality of information, and conduct as Government employees are expected to maintain. The contractor will not engage in other employment which is incompatible with the duties of this contract. The contractor will not, directly, or indirectly, engage in financial transactions or any kind of business dealings relying on information obtained through the performance of this contract. The contractor will not have a direct or indirect financial or other interest that conflicts, or appears to conflict, with its responsibilities and duties under this contract.

C.9 INSURANCE AND CONTRACTOR LICENSE

The Contractor shall maintain professional liability and workman’s compensation coverage in accordance with applicable EPA regulations, and Federal, Montana and local government statutes. The Contractor shall have an appropriately classed contracting license for performing work of the type described in the Statement of Work, Attachment 1. Such license shall be issued by the state in which the work is located.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 1300EST, local time, for the designated Government office on the date that offers, or revisions are due.

(2) (i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

E.2 52.212-2 -- Evaluation -- Commercial Items (Oct 2014)

The Government will award a contract resulting from this solicitation to the responsible offeror who offers lowest overall price.

STATEMENT OF WORK (SOW) FOR

BUILDING AND SITE DEMOLITION

Workers must be properly trained, certified and supervised to execute the following work details in accordance with Federal, State and local requirements. Contractor shall be responsible to transport and dispose offsite all removed building components, debris, and excess imported fill.

Transportation of debris and waste materials shall be made in accordance with applicable local and state highway regulations. Disposal of debris and waste materials shall be made at a State-approved waste disposal site in accordance with local authority requirements. All work is to be executed in a manner that limits the spread of debris to offsite areas, protects the lives of workers and the general public, and avoids damage to adjacent private and city properties.

Contractor shall be responsible to maintain adequate liability insurance and comply with State workman’s compensation requirements during the completion of the work. Upon completion, the Contractor shall obtain and provide to USDA Rural Development lien waivers from all subcontractors and suppliers used to complete the work.

1. GENERAL PROJECT INFORMATION:

A. Property Location: Real Estate Owned (REO) Property

1410 Cabinet Avenue Libby, MT 59923

B. The legal description of the property is: LOT 15, Chapman’s Homesites, according to the plat thereof on file in the office of the Clerk and Recorder of Lincoln County, Montana. The lot is approximately 9,757sf. The home is a stick-built home constructed in 1962. The above grade gross living area is 960 sq ft. There is a crawlspace. There is a 1-car attached garage. More information is provided in the photos and portions of the Residential Appraisal Report provided with this order.

C. The work shall include the demolition and complete removal of the residential building, porch, garage, and other site improvements as described in Section 3 below. Items that do not require demolition or removal are also covered in this Section.

D. The contractor is responsible for all equipment, personnel, supplies, travel expenses and all costs associated with the completion of this order. Workers must be properly trained, certified and supervised to execute the following work details in accordance with Federal, State and local requirements.

E. The property is currently owned by the United States of America, acting through the

Department of Agriculture, Rural Development (hereinafter referred as RD or the Government).

F. The Contractor must:

(1) Contractor must contact the Lincoln County Asbestos Resource Program (406-291-5335) for an invasive inspection of the structure for vermiculite insulation and/or WR Grace mine related materials. This inspection should be completed approximately 3-4 weeks prior to demolition in case there is vermiculite found within the structure. In this case Lincoln County ARP would write a SOW for an accredited asbestos abatement contractor to remove only the vermiculite/mine related materials. The demolition contractor may perform this work if they are accredited with the state of Montana but would have to follow the SOW written by Lincoln County ARP.

(2) Contractor must hire a state of Montana accredited asbestos inspector to have the structure tested for regulated asbestos materials. This should be scheduled 3-4 weeks prior to demolition. In the case regulated asbestos is found, the demolition contractor would need to remove the regulated asbestos materials prior to demolition, either self-performed if they are accredited with the state of Montana or hire an accredited abatement contractor to remove the regulated asbestos materials prior to demolition.

(3) Contractor must fill out a PEN (property evaluation notification) form which can be found at this link: https://lcarp.org/pen-form/. The EPA did an exterior soil removal at this property in 2015. There are 3 areas around the house that have <1% Libby Amphibole asbestos left at a depth of 12” to 20” b.g.s any soils from the footprint of the house were going to be hauled off site, these soils would need to be disposed of at the Lincoln County class IV cell.

(4) apply and obtain permit(s) and pay for fees to complete building demolition and utility disconnection;

(5) complete the demolition of all above-grade buildings and structures;

(6) dispose of the building debris, its contents and yard debris;

(7) install fill materials and seed excavated and disturbed areas;

(8) fill crawlspace area with onsite gravel, broken concrete, and clean earthen material so that a 2:1 slope is constructed from crawlspace concrete floor slab to top of concrete foundation wall left in place;

(9) achieve final acceptance of the work by the Government.

G. All work is to be done in a timely, orderly manner in accordance with industry accepted standards, applicable local and National standards, and Rural Development regulations and policy. All materials used shall be new. Work shall be performed by skilled craftsmen that are regularly engaged in the work identified herein.

H. The Contractor shall maintain professional liability and workman’s compensation coverage in accordance with applicable EPA regulations, and Montana or local government statutes. The Contractor shall have an appropriately classed contracting license for performing work of the type described herein. Such license shall be issued by the state in which the work is located.

I. The Contractor shall be liable for any loss from or injury to, any property resulting solely from the Contractor's negligence and/or failure to perform the services provided for herein.

J. The Contractor waives, releases, and discharges the Government from any and all claims, demands, and causes for action for damages to person(s)/or property which may arise in any manner incident to the execution of the purchase order, except his/her rightful claim for payment or compensation, as provided herein.

K. The Contractor shall obtain the services of qualified employees in all instances, and the

Contractor is responsible for actions or omissions of employees in performance of work under this purchase order. The Contractor shall not commit, nor permit others to commit any waste, or unlawful acts of nuisances upon property assigned.

L. The Contractor is responsible for security of the property. Such responsibility shall continue until the Contractor completes all work and the Government makes acceptance.

2. UTILITIES DISCONNECTION:

The work described in this section shall include the disconnection of all existing onsite utility services, including water, natural gas, and electrical supplies, and wastewater disposal as required.

A. Upon notification by RD of contract award, the Contractor shall obtain the necessary permits from the town of Libby, Lincoln County, State of Montana, and from the Landfill, as required for the work to be accomplished. Prior to initiating the demolition action, the Contractor shall provide copies of all required permits from regulating authorities and/or provide a statement that authority/permits are not required. Posting of onsite public notices, if required by the town, shall be made. Written notification of demolition activities to adjacent property owners shall be made as required with the permit application. Whenever a condition of approval for any permit may prevent or delay execution of the work and other requirements of the contract with RD, the Contractor shall contact the Contracting Officer and Contracting Officer’s Representative (COR) to communicate any pertinent information.

B. The Contractor is responsible for determining the location of connection points for all overhead wiring and underground service boxes, piping, conduit, and wiring with the appropriate authorities to enable he shutoff of electricity, water, and gas supplies, and wastewater disposal lines. Should the Contractor find that the condition of existing shut-off valves and terminal devices are inadequate to complete the process the Contractor shall notify the COR immediately providing with such notification the estimated cost to repair.

The Contractor shall not make repairs without approval from the Contracting Officer.

Disconnection of these services shall be made in accordance with industry standards.

3. DEMOLITION AND REMOVAL OF BUILDINGS, FOUNDATIONS, CONCRETE

FLATWORK, AND UTILITY SERVICE LINES:

The work in this section shall include the onsite demolition, removal, and disposal of property improvements described below. The Contractor shall complete a checklist prior to starting demolition. All items containing mercury must be removed prior to starting work. A copy of the completed checklist shall be provided to the Government.

A. Building improvements to be demolished and removed offsite shall include:

960 square foot, ranch style single family dwelling (built 1962) and all contents.

According to the assessor’s record there is no attic.

Concrete and wood building additions, including porches, all onsite concrete flatwork including stoops, garage, steps, sidewalks, and driveway/parking slabs, any fencing belonging to the property and existing onsite yard debris;

B. The following items do not have to be removed unless deemed necessary by the Contractor for accomplishment of the work:

The below-grade foundations, site concrete flatwork and footings may be left intact.

Holes shall be drilled in the foundation to allow for drainage.

Onsite utility service lines between connection, saddle, or curb box and the residential structure, including water, sewer, gas, electrical, and telecommunications must be turned off and capped. They do not have to be removed.

Onsite gravel shall be used to partially fill the foundation area.

Broken concrete material may be used to fill the foundation area if it is no larger than 12 inches in any dimension and is covered with 6-inches of clean fill material.

C. A Lead-Based Paint Inspection and Visual Assessment Report was not done on the property.

Contractor to assume there is lead-based paint and follow lead-based paint safe practices.

D. Offsite utility connections (curb stops, sewer saddle or meter boxes) and landscape improvements (trees and shrubs) are to be left in place in an as-is condition, capped or disconnected as required by the Utility provider. Onsite improvements including concrete driveway areas, sidewalk along the town street, fences, and all onsite landscape materials, including trees, shrubs and ground cover shall be left in place in an as-is condition, to the extent possible, unless the Government provides written direction to remove such site improvements. The property is on city water and sewer.

E. Disposal of construction debris, shall be completed in accordance with applicable State, Federal, and/or local Highway and waste disposal regulations. No burning of building materials shall be allowed on the property or offsite by the Contractor or any subcontractor.

No disposal of building materials shall be allowed within the excavation area, except for broken concrete material no larger than 12 inches in any dimension. Salvage and recycling of building materials by the Contractor shall be acceptable to RD under the condition it is the sole responsible of the Contractor without liability to the Government.

F. Upon completion of all demolition and disposal work, the Contractor shall photograph the bottom and sides of the excavation providing photos to the Contracting Officer and COR. If required by permit, the town shall be notified for inspection of the excavated area.
