Performance Work Statement For
Charter Bus Services at U.S. Coast Guard Training Center Cape May
Introduction TRACEN Cape May is procuring charter bus services to and from the Federal Air Marshal
Firing Range in Atlantic City, NJ (primary location) and the Cape May County Department of Public Safety Firing Range in Cape May Court House, NJ (alternate location).
1. Description of Services: The contractor shall provide all personnel, transportation, equipment, tools, labor, supplies, materials, supervision, and services necessary for roundtrip coach bus transportation services for transporting recruits and TRACEN staff to and from the Federal Air Marshal Firing Range in Atlantic City each week. On occasions when the Federal Air Marshal Firing Range is unavailable, the contractor will provide bus services to and from the contingency firing range: Cape May County Department of Public Safety Firing Range.
Services shall include, but not be limited to, providing and maintaining the necessary buses and/or other vehicles as appropriate; providing trained/qualified drivers, mechanics, and all other support personnel required to maintain the vehicles; providing scheduling coordination, reports, and other information deemed necessary.
2. Hours of Operation: The contractor shall provide bus services Tuesdays and Thursdays each week according to the dates listed in the attached schedule. The bus will depart from TRACEN Cape May at 4:00 pm on each day and then depart from the Federal Air Marshal Firing Range at 8:45 pm. The schedule for bus services may change based on the availability of primary firing range, the availability of contingency range, and/or other emergent mission-related situations. (see 3.8 below).
3. Contractor Equipment, Personnel, Safety, Other:
3.1 Vehicles Required: Contractor shall provide an adequate number of Coach Buses to transport USCG personnel per trip to and from locations during the hours specified as coordinated with USCG POCs.
Contractor shall supply an appropriate number of Coach Buses to meet the demands of the particular program. Buses shall be neat, clean, safe, and in good repair. All buses and vehicles shall be air-conditioned, heated, and equipped with a working bathroom.
3.2 Bus Maintenance
Contractor shall be responsible for all maintenance, repair and safety inspections of buses/vehicles providing services under the Agreement, as required by Federal, State, and local laws, rules, regulations, ordinances and directives. Contractor shall ensure that vehicles used to provide services under the agreement are inspected each working day before service begins. Contractor shall maintain copies of the most recent vehicle inspection reports for all vehicles. The charter bus must be in compliance with all Federal Motor Vehicle Safety Standards. Reports shall be made available to government on an annual basis or upon request.
3.3 Personnel Requirements/Qualification:
The contractor shall provide personnel licensed, trained, and experienced in the operation of motorized vehicle transportation. The contractor shall provide to the Contracting Officer a name and phone number of the designated person(s) that shall be responsible for all contracted buses. Individuals must be able to read, write, speak, and understand English. They shall present a neat appearance and carry some form of employee identification and be easily recognized. This may be accomplished by wearing distinctive clothing bearing the name of the company or wearing appropriate badges identifying the company name and employee name. The government is authorized to restrict base access to any contract employee who is identified as a potential threat to the health, safety, security, general well-being or operational mission of this installation and its population.
Bus Drivers: Contractor shall have an adequate number of substitute drivers available to respond as needed, within one (1) hour of notification by USCG designee. All assigned drivers and substitutes, must have the following qualifications a. Be fully qualified under the laws of the State of New Jersey
b. Have a valid commercial driver’s license with passenger carrier endorsement and meet the requirements for driving appropriate sized charter bus. c. Be at least 21 years old. d. Have received, at the very least, the minimum training required by New Jersey, the Dept of Transportation, and submit evidence of such training to KO/COR prior to providing services under the Agreement. e. Shall maintain all required licenses and permits required by Federal, State, and local laws. f. Be able to understand and speak English. g. Not have any prior moving violations in the last two years. h. Shall adhere to a drug test i. Shall not consume alcohol or any other unauthorized controlled substances while working under the government’s contract.
Alcohol & Controlled Substances: Contract employees shall not possess, distribute, consume, use or cause to be used any controlled substances or alcohol while performing services or on Government property. Any employee using a controlled substance prescribed by a physician shall get written permission from the Contracting Officer to continue performance of assigned duties for this contract.
Any contractor or contractor employee found to be in violation of this section will be permanently prohibited from Coast Guard property. Actions taken under this section shall not relieve the contractor of the requirement to provide sufficient personnel to perform adequate and timely service as required in the contract.
The contractor shall provide personnel who meet established standards in order to effectively perform the services required herein. The personnel shall be properly trained, qualified, experienced, and demonstrate the capability of performing with minimum supervision.
Contractor Project Manager: Contractor shall provide a full-time Contactor Project Manager or designee who will act as Contractor’s liaison with Contracting Officer, COR or USCG POCs and who will be responsible for the day-to-day management of the Agreement. Specifically, the Contractor Project Manager will be responsible for the following: Have full authority to act for Contractor on all matters relating to the operation of the Agreement. Be available by telephone between 8:00 a.m. and 10:00 p.m. Ensure that substitute drivers and additional buses are provided, if deemed needed, within the time specified after notification from USCG POCs. A weekly confirmation email will be sent by the Contractor’s Project Manager to the USCG POCs confirming the next week’s pickup schedule.
Contractor fully understands the potential for last-minute cancelations or delays due to inclement weather, change of location, and/or government shutdowns/program cancelations. USCG POCs will contact Contractor’s Project Manager at the earliest known time.
3.4 Communication Devices/ Equipment
Contractor shall equip all vehicles and drivers with cellular phones. This will enable the COR or USCG POCs to contact a driver immediately, if necessary, during hours of operation or to have drivers communicate with Contractor’s office, or each other.
3.5 Proof of Insurance: The contractor shall provide the Contracting Officer with proof of insurance.
See Section 4. Such insurance shall be secured from an insurance company authorized by law to transact business in the State of New Jersey. The contractor is required to submit and maintain a certificate of insurance and shall be included in the contractor’s proposal pursuant to Federal Acquisition Regulation (FAR) and IAW Federal Motor Carrier Safety Administration (FMCSA).
3.6 Record Keeping & POC: Contractor shall maintain accurate and complete records of compliance with paragraphs above and shall make such records available to government upon request. The contractor will provide trip reports when trips are confirmed and scheduled to GMC Andrew Escola as well as post trip invoices. Email: andrew.j.escola@uscg.mil
3.7 Travel Day Expectations: The bus shall arrive 30 minutes prior to departure time and drivers are expected to be courteous, professional, and know the best route to the site before they arrive.
NOTE: Additional time may be needed during initial contract start up or if any contractor bus personnel changes occur. Contractor shall discuss this with the appropriate USCG POCs or on-base security PRIOR to these events to ensure enough time is provided.
3.8 Schedule Changes: Schedules and quantities are subject to changes. See additional information on proposed schedule. This may also be due to emergent maintenance repairs to the Air Marshal firing range. On these instances, the coach will provide transportation to Cape May County Department of Public Safety Firing Range. Further, the day and time bus services will be required will depend on the availability of this contingency range. TRACEN will notify the bus service contractor of any schedule changes at least one week prior to date of affected service. However, there will also be times when the actual company size is much smaller than anticipated and there will not be a need for a bus on Thursday for that company’s range training week. TRACEN will notify the bus service contractor of any cancellations at least one week prior to date of affected service. Additionally, the schedule for December is subject to change as a result of the TRACEN’s fluid schedule during the holidays. The contractor shall have a sufficient fleet and flexibility with their workforce to provide service in the midst of any types of fluctuations.
NOTE: Bus quantities and schedules are subject to changes due to any emergent conditions.
Contractor shall be able to modify any/all service requirements as needed by the USCG mission.
3.9 Vehicle Breakdowns: In the event the bus will be late due to a bus breakdown, mechanical failure the Contractor’s driver shall immediately notify USCG POCs or designee and Contractor’s dispatch office of the problem. Contractor shall immediately send a back-up bus(es) to enable continued and timely transportation services. Replacements to be sent in no more than 1 hour. Failure to do so will result in non-payment for that particular service. Extenuating circumstances will be considered if this time widow is not met at the sole discretion of the government.
3.10 Unavailability: In the event the contractor fails to provide the manpower and/or equipment necessary to accomplish the work requested, the Government reserves the right to obtain services elsewhere. The contractor shall contact GMC Andrew Escola several days in advance, allowing ample time for alternative arrangements.
3.11 SAFETY: The contractor is solely responsible for the safety of personnel and the safe operation of the contracted buses. All buses must be Department of Transportation certified.
3.12 APPLICABLE STANDARDS/DOCUMENTS:
The Contractor shall comply with the Federal Motor Carrier Safety Regulations (FMCSRs) as prescribed by the U.S. Department of Transportation (DOT), Federal Motor Carrier Safety Administration (FMCSA) and all other applicable federal, state, local and municipal laws, regulations, and requirements in performance of work under the contract. The Contractor shall maintain an active Operating Authority from the FMCSA and required insurance coverage to provide interstate transportation for passengers, as required by FMCSA, throughout the entire contract period of performance.
4. INSURANCE 4.1 Requirements: (a) Workers’ compensation and employer’s liability. Contractors are required to comply with all applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers. (b) General liability. (1) The USCG shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence. (2) Property damage liability insurance shall be required only in special circumstances as determined by the agency. (c) Automobile liability. The contracting officer shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.
5. State & Federal Laws: The contractor, while in performance of its duties under this contract, shall comply with and observe the laws of the State of New Jersey and all other municipal laws including Department of Transportation Rules and Regulations. Contractor shall comply with all Federal, State and local laws, rules, regulations, ordinances and directives, and shall maintain all required licenses and permits as related to buses, vehicles, and other equipment used to provide services under the Agreement.
6. Liability: The contractor, by acceptance of this contract, agrees that the United States, the United States
Coast Guard, TRACEN Cape May, their officers, agents and employees, shall not be responsible for damages to property or injuries to persons which may arise incident to this contract, or for damages to the property of the Contractor, or for to the property or injuries to the Contractors employees, officers, agents, or servants, or others which may arise from or be indecent to this contract. The Contractor further agrees by acceptance of this contract to hold harmless and indemnify the United States, the United States Coast Guard, the United States Coast Guard TRACEN Cape May, their officers, agents and employees, from any and all liability, loss, damages, costs or expenses which are sustained, incurred, or required arising out of the actions of the Contractor in the course of this contract.
7. Estimated Quantities: The schedule for this contract is attached.
SCHEDULES ARE SUBJECT TO CHANGE AND SHALL BE USED AS AN ESTIMATE ONLY.
8. Government Quality Assurance Requirements: The Contracting Officer’s Representative (COR) or the designated USCG POCs are responsible for representing the Contracting Officer in all facets of quality for the services required. The designated personnel will handle reviews and deficiencies on behalf of the Contracting Officer.
9. Period of Performance: The period of performance for this contract is a twelve-month period beginning on or shortly after 01 August 2021 through 31 July 2022. Contract will be a Firm Fixed-Price Service Contract, using Best Value. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government in price and other factors, e.g., past performance history, SAM registration (DUNS), depots, etc.
FAR 52.216-18 Ordering – Task Orders may be authorized with services to be furnished under this contract that are not part of the normal schedule. All task orders are subject to the terms & conditions of this contract. Such orders may be issued during the 12-month contractual period of performance. The projected task orders are so integrally related that only a single contractor can reasonably perform the work.
10. Invoicing: Informational copies only of invoices will be e-mailed to the Contracting Officer at Shirley.L.Green@uscg.mil and to GMC Andrew Escola at andrew.j.escola@uscg.mil and alternate GM2 Jarred Haynie Jarred.L.Haynie@uscg.mil for the previous month services to be reviewed and validated on a monthly basis. Simultaneously the Contractor will also be responsible for submitting/uploading the monthly invoices to the USCG Finance Center’s Prompt Payment Centralized Invoice Submittal website. Detailed instructions for submitting monthly invoices will be provided with government order/contract.
