RFQ: 36C24821Q0412
(i) In accordance with FAR Part 13, this combined synopsis/solicitation for commercial items is prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The Department of Veterans Affairs, North Florida/South Georgia Veterans Health System located in Gainesville, FL has a need to procure one (1) ENT Visualization Microscope.
(ii) The combined synopsis solicitation number is 36C24821Q0412. It’s issued as a Request for Quotation (RFQ).
(iii) This combined synopsis solicitation RFQ and the provisions and clauses incorporated are those in effect through Federal Acquisition Circular 2021-04 (01-19-2021).
(iv) The NAICS is 334510. Business size standard is 1,250 employees. The evaluation of offers received in response to the solicitation will use a tiered or cascading order of precedence. “Tiered evaluation of offers,” also known as “cascading evaluation of offers,” is a procedure used in acquisitions when market research is inconclusive for justifying limiting competition to small business concerns or sub-categories of small business concerns. The contracting officer –
(1) Solicits offers from business concerns that will be evaluated in the following tier order:
(a) service-disabled veteran-owned small business (SDVOSB) concerns;
(b) veteran-owned small business (VOSB) concerns;
(c) small business concerns with historically underutilized business zone (HUBZone) small business concerns and 8(a) participants having priority; and
(d) large business concerns
Note, Interested SDVOSB and VOSB offerors must be listed and registered in Vendor Information Portal (Vip.Vetbiz.gov) to be considered for Award.
(2) If an award or a sufficient number of awards cannot be made at the first tier, evaluation of offers will proceed at the next lower tier until and award or a sufficient number of awards can be made. If award cannot be made, the solicitation will be cancelled, and the requirement resolicited.
(v) This combined synopsis solicitation is for the purchase of one (1) ENT Visualization Microscope. Responses shall be on an all or none basis, no partial submissions will be accepted. The Government reserves the right to make no award at all.

Addendum Provision 52.212-2, Evaluation – Commercial Items (OCT 2014), applies to this acquisition. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price considered. Government will conduct comparative evaluations of all quotes and award to the vendor which represents the best value based on technical, delivery, and price. Once the government determines that there is a vendor that is the best suited to meet the requirements of this RFQ (i.e. the apparent successful contractor); the government reserves the right to communicate with only that vendor to address any remaining issues.

Offerors shall include a completed copy of the provision at 52.212-3 Offeror Representation and Certification – Commercial Items (JAN 2021) with their offer. Note, unless exempt per Federal Acquisition Regulation [FAR] Part 4.11, all contractors must be registered and have an active registration in the System for Award Management (SAM) to be considered for an award against this solicitation. SAM combines data that was formerly contained in the Central Contractors Registration (CCR) and Online Representation and Certifications (ORCA) systems. 52.225-18 Place of Manufacture (AUG 2018).
(a) Definitions. As used in this clause— “Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) FPSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
(b) For statistical purposes only, the offeror shall indicate whether the place of manufacture of the end products it expects to provide in response to this solicitation is predominantly—
(1) [] In the United States (Check this box if the total anticipated price of offered end products manufactured in the United States exceeds the total anticipated price of offered end products manufactured outside the United States); or
(2) [] Outside the United States.

852.212-71 Gray Market Items (APR 2020)
(a) No gray market or remanufactured items will be acceptable. Gray market items are Original Equipment Manufacturers’ (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical equipment only for VA medical facilities.
(b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.

852.212-72 Gray Market and Counterfeit Items (MAR 2020) (DEVIATION)
(a) No used, refurbished, or remanufactured supplies or equipment/parts shall be provided. This procurement is for new Original Equipment Manufacturer (OEM) items only. No gray market items shall be provided. Gray market items are OEM goods intentionally or unintentionally sold outside an authorized sales territory or sold by non-authorized dealers in an authorized sales territory.
(b) No counterfeit supplies or equipment/parts shall be provided. Counterfeit items include unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented to be an authentic, unmodified item from the original manufacturer, or a source with the express written authority of the original manufacturer or current design activity, including an authorized aftermarket manufacturer. Unlawful or unauthorized substitutions include used items represented as new, or the false identification of grade, serial number, lot number, date code, or performance characteristics.
(c) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system, verified by an authorization letter or other documents from the OEM or by an intermediary distributor authorized by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions.
