Attachment 4 - FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) price; (ii)

Technical Approach; and (iii) Approach to Installation, Delivery, Training, and Warranty.

The agency will first evaluate offerors’ prices, and then evaluate the apparent lowest-priced quote to determine if it is technically acceptable. If the lowest-priced quote is determinted to be technically acceptable, then award will be made. If the lowest-price quote is evaluated as unacceptable, then the agency will consider the acceptability of the next lowest-price quote, continuing this process as necessary.

Factor 1: Technical Approach

The Contractor’s proposal shall address each area of the Purchase Description requirements in sufficient detail to demonstrate a clear understanding of the technical proposal of how it meets each of the project requirements. This shall include the ability of the vendor to deliver four in-lab sleep systems, two portable systems and two reading stations. These stations must include at least 64 referential channels, up to 12 programmable bipolar channels and 16 DC for sleep research studies. The systems must have the ability to simultaneously record additional physiological parameters during the sleep recordings.

Factor 2: Approach to Installation, Delivery, Training, and Warranty

The Offer shall detail in its technical proposal how it shall meet the delivery, installation, training and warranty requirements. All labor, materials, and shipping are to be provided by the offeror. The installation includes six days of set-up for the new sleep systems. Training must include at least 32 hours of onsite training by a certified trainer from Sleepworks and the ability to provide follow-up WebEx training. This purchase must include a 12 -month warranty which starts at time of install, not at time of purchase, and three one (1) year preventive maintenance option periods after the end of the 12- month warranty.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
