Section C: Justification for Soliciting from a Single Source or Brand Name

This is a BRAND NAME justification for the acquisition of Cold Working Kits which will enable the 309 Aerospace Maintenance and Regeneration Group (AMARG) to perform F-16 electrical / avionics repair as a joint repair / modification with post block repairs in accordance with Time Compliance Technical Order (TCTO) 1F-16-2749, TCTO 1F-16-2750, TCTO 1F-16-2749, TCTO 1F-16-2730 and TCTO 1F-16-2732. To accomplish these repairs AMARG specialists must adhere to tool requirements outlined under Technical Order (TO) 1F-16-2741 "Repair of the Upper Outboard Bulkhead Flange Fastener Holes on all F-16C/D Blocks 40/42/50/52 Aircraft; page 3 through 4.

This TO section calls out the list of cold working kit tools required, referencing the part numbers, description and authorized source. TO 1F-16-2741 specifically requires the use of BRAND NAME Fatigue Technology, Inc. parts / tools to accomplish the aircraft repairs under this effort; no other substitutes approved (see Attachment 1). Fatigue Technology, Inc. (FTI) is the original manufacturer of the requested cold working kits and primarily operates in the aircraft parts and equipment business industry within the transportation sector. The company has been in business for over 40 years offering patented aerospace products and service within the cold expansion envelope.

FTI is part of Precision Castparts Corporation's (PCC) Engineered Products Division. PPC specializes in manufacturing large, complex structural investment castings, airfoil castings, and forged components used din jet aircraft engines and industrial gas turbines. In accordance with Air Force Material Command (AFMC), Aircraft Life Cycle Management Center (AFLCMC), F-16 Program Office Lead Engineer and subject matter expert (SME); to ensure compliance with this TO the 309 AMARG must utilize only the specific tools and material called out within the repair instructions. It is not in the best interest of the government to utilize unapproved sources for these parts / tools at this time.

Section D: Efforts to Obtain Competition

Based on the limitations placed by Technical Order (TO) Technical Order (TO) 1F-16-2741 "Repair of the Upper Outboard Bulkhead Flange Fastener Holes on all F-16C/D Blocks 40/42/50/52 Aircraft; page 3 through 4; market research was primarily focused on finding sources for the specifically required tools. In accordance with FAR Part 8.002 a search of all mandatory and recommended source was accomplished to include: internal agency sources, Unicor, and Ability One (NIB) which yielded no positive results. An internet search revealed that Fatigue Technology Inc. did not list any other authorized sources for their products. A sources sought notice was placed on the beta.sam.gov site on 7 August 2020 and made available to all potential sources under NAICS 336413; this notice closed on 14 August 2020 and yielded no additional sources.

Section E: Steps to Preclude Future Single Source Awards

The goal of the 355th Contracting Squadron is to promote competition in order to ensure the Government is receiving the best value product. This is a one-time requirement to support an immediate need on the F-16 aircraft Post Block Repair efforts. The 309 AMARG Reclamation Squadron Director will continue to work with the AFMC/AFLCMC F-16 Program Managers and Engineers to identify alternate approved parts / tools and sources.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(2), that the circumstances of this contract action deem only a single source is reasonably available.
