(1) Contracting Activity:

(2) Nature and/or description of the action being approved:

Restriction of competition to a brand name, Motorola.

(3) Description of the supplies/services required to meet the agency's needs:

Implement the upgrade of the current Radio Frequency (RF) site from Frequency-Division Multiple Access (FDMA) to Time- Division Multiple Access (TDMA) technology, effectively doubling RAF Fairford's capacity as TDMA technology allows for two simultaneous talk groups to operate on a single channel. This upgrade includes programming 58 Motorola FDMA-capable legacy radios augmenting the 100 recently procured Motorola 6000 TDMA-capable radios. This is primarily an application upgrade & Zone Core Licensing exercise which will double current capacity, endow legacy Motorola FDMA-capable equipment with TDMA capabilities ensuring all radios are system compatible, as well as ensure future scalability is incorporated into the existing system.

(4) Justification for restricting consideration to a brand-name item:

This is a justification for a Brand Name award. The USAF, in compliance with the Public-Safety Communication Officials (APCO) Project 25, is required to procure only Motorola or Harris Corporation Land Mobile Radio equipment. The 501st CSW's entire land mobile radio inventory, including & is Motorola equipment. Due to encryption issues, Harris equipment would be incompatible with 501 CSW's current Motorola inventory. TDMA enhancement is a license and software update at the core and attached radio frequency sites. The only company that this can be ordered from is Motorola, although any service center could implement. The use of any other vendors' equipment would require either replacing the whole of United States Air Forces in Europe infrastructure or result in RAF Fairford being isolated from the current network in contravention to APCO Project 25 requirements.

(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:

The 501 RCO intends on using the Tactical Communications Equipment and Services II (TACCOM II) contract. This contract was awarded via the Department of Homeland Security and has a total of 42 vendors, many of which provide Motorola products and services. Prices were determined to be fair and reasonable at the time the contract was awarded. With respect to brand name, Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction

(6) Other facts supporting the justification:

The AF had an enterprise-wide class Justification and Approval (J&A) which used the authority under FAR 6.302-1(c) for Motorola and Harris brand land mobile radio equipment. This class J&A expired on 30 September 2020.

(7) Actions the agency may take to remove or overcome any barriers to decreasing the use of brand-name items before any subsequent acquisition of the supplies or services:

501 CSW/RCO will procure via the US Government-wide Tactical Communications (TacCom-II) contracting vehicle. TacCom-II includes a listing of pre-approved & certified vendors who are capable of providing both Motorola Land Mobile Radio equipment and services. Under the circumstances, the best price will be considered very competitive.
