CONTRACTING OFFICER DETERMINATION

Brand Name

TEMA Software Update

1. Identification of Agency and Contracting Authority: The ERDC Contracting Office (ECO) is located at the U.S. Army Engineer Research and Development Center (ERDC), 3909 Halls Ferry Road, Vicksburg, MS 39180-6199.

2. Nature and/or description of the action being approved: This justification seeks approval to award a new Firm-Fixed-Price (FFP) supply contract on a brand name basis pursuant to procedures at Federal Acquisition Regulation (FAR) 13.106-1(b) to purchase a software update for the current version of the TEMA video tracking program. The purchase will also include a service agreement upgrade from T2020 to T2025 for the currently owned TEMA license spanning over the next five years.

3. Description of supplies or services: The vendor shall provide the following software upgrades:

• TEMA Pro 3D with Wand Calibration and dongle – Service Agreement Upgrade from T2020 to max version T2025

• TEMA Pro 3D with Wand Calibration and dongle, second license – max version

T2025

All software shall be delivered fourteen (14) days after award of contract. The period of performance for service agreements shall be five (5) years.

4. Authority Cited: FAR 13.106-1(b), Soliciting from a single source (1) For purchases not exceeding the simplified acquisition threshold (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

5. Reason for Authority Cited: Extensive research was conducted to determine the best commercially available software that can measure 3D projectile trajectory data useful for penetration research conducted at the ERDC. As a result, the software “TEMA” was determined the best for the requirements of the projects. At the time of the initial purchase in 2017 for the Impact Explosion Effects Branch (IEEB), the requirement was for a 2D analysis capability. This purchase was procured through a DLA with Noble that provided the initial high-speed camera equipment and software through the vendor Specialised Imaging, Inc. In 2020, another procurement was made to update the existing software through a brand name contract, W912HZ20P0076.

The TEMA software upgrade is requested due to the compatibility with the IEEB’s current high-speed cameras and TEMA motion plane wands. These annual software upgrades will provide necessary improvements to the current equipment by enabling the wands to be calibrated to collect object trajectory data in a 3D environment. Current as well as future projects conducted at PPRF by the IEEB have a need for this upgraded tracking capability. The upgraded software requires additional hardware to reach the level of precision needed to fully exploit the enhanced capabilities. Overall, it has been determined that it is more advantageous for the government to upgrade the existing TEMA software as well as calibrate the current motion plane wands than it would be to purchase all new software and hardware.

6. Efforts to Obtain Competition: This brand name justification will be provided with the solicitation as required by FAR 5.102(a)(6). This software is sold by several different companies, therefore adequate competition is anticipated.

7. A determination by the Contracting Officer that the anticipated costs to the Government will be fair and reasonable: The independent government estimate, adequate competition, catalog prices, and the laboratory’s technical representative’s knowledge of the industry will be used to determine if the quoted price is fair and reasonable.

8. Market Research: Based upon the market research provided, it is determined that this requirement is a commercial item and it is recommended that the required TEMA brand name software upgrade be solicited restricted, 100% set aside to small business.

9. Contracting Officer Determination: Based on the above and in accordance with FAR

13.106-1(b), it is hereby determined that TEMA software is in the best interest of the Government.
