JUSTIFICATION FOR

OTHER THAN FULL & OPEN COMPETITION

PROJECT NAME:

PowerWorld

The following Justification for Other than Full & Open Competition (JOFOC) is prepared in accordance with FAR Subpart 6.303-2.

1. ORGANIZATION:

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

FERC would like to procure maintenance and license for PowerWorld Software that we currently own and is about to expire.

3. DESCRIPTION OF REQUIREMENT & VALUE:

PowerWorld is an interactive power system simulation package designed to simulate high voltage power system operation on a time frame ranging from several minutes to several days. It is used by various program offices in the Commission. Maintenance is necessary to ensure updates and technical support are available. There are risks of losing valuable functionality and current projects as well as incurring additional cost by using products other than PowerWorld software.

4. STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(2) in accordance with:

5. DEMONSTRATE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS:

This product is unique and established as one of a kind. Through PowerWorld, users have access to a mapping product, Energy Visuals Transmission Atlas. Staff uses Transmission Atlas to geographically map equipment such as substations, transmission lines, and generators, as well as to determine critical assets at station locations. Power-World's tool exceeds others by offering more accurate GIC(Geomagnetically Induced Current) calculations in addition to GIC visualization.

6. SOURCES SOUGHT EFFORTS:

PowerWorld is the sole creator of this software, and they also provide the maintenance for it.

7. DETERMINATION OF FAIR & REASONABLE PRICING:

PowerWorld was previously acquired, and SMEs determined their fair and reasonable value by reviewing previous contract pricing, pricing for similar services and current market pricing.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED & RESULTS:

Market research indicates that this is not available through any other means or resellers.

9. ANY OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION:

This is the only vendor who sells the software and provides maintenance and/or support for the software.
