1 BACKGROUND

The Federal Communications Commission (FCC) is an independent United States Federal Government agency established by the Communications Act of 1934, as amended, in charged with regulating non-Government interstate and international communications by radio, television, wire, satellite and cable. The FCC’s jurisdiction covers 50 states, the District of Columbia, and U.S. possessions. The FCC is currently led by a Chairwoman, and up to four Commissioners, appointed by the President with advice and consent of the U.S. Senate.

The Commission is organized into bureaus and offices, based on function. Bureaus and office staff members regularly share expertise to cooperatively fulfill responsibilities, such as:

• Developing and implementing regulatory programs

• Processing equipment applications for licensing and other filings

• Encouraging the development of innovative services

• Conducting investigations and analyzing interference complaints

• Public safety and homeland security

• Consumer information and education

In particular, the Office of Engineering and Technology (OET), Laboratory Division, manages a Commission’s Equipment Authorization program to ensure that electronic equipment marketed & sold within the United States complies with Commission’s technical regulations that are designed to minimize the potential for harmful interference to other electronic devices. As part of the OET Lab’s mandate to perform market surveillance activities (47 CFR §15.29(d)), oversight of product emissions calls for randomly selecting electronic device testing for the purpose of monitoring the products compliance to applicable rules.

In supporting the Commission’s equipment authorization program, market surveillance, and mission objectives, the FCC OET Laboratory has a requirement to obtain annual calibration for its state-of-the-art test and measurement laboratory equipment.

2 OVERVIEW

The objectives for this contract is to utilize a one-time traceable calibration agreement for the listed equipment from an accredited test equipment calibration vendor necessary to support FCC OET Laboratory testing needs. The equipment identified in the attached inventory has been identified as necessary for calibration.

This SOW identifies services that are strictly non-personal in nature, as defined by Federal Acquisition Regulation (FAR) Subpart 37.4, Non-personal Healthcare Services and to ensure there is not an appearance of an identified program manager. The Government shall neither supervise Contractor employees nor control the method by which the Contractor performs the required tasks. Under no circumstances shall the Government assign tasks to or prepare work schedules for individual Contractor employees. It shall be the responsibility of the Contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the Contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the Contractor's responsibility to notify the Contracting Officer (CO) immediately.

For this contract, the Government will not exercise any supervision or control over sub-contractors, performing herein. Such sub-contractors shall be accountable solely to the prime contractor who, in turn, is responsible to the Government.

2.1 DESCRIPTION OF SERVICES

The calibration vendor shall provide all personnel, equipment, supplies, transportation, packing, shipping, tools, materials, supervision, documentation, other items and non-personal services, necessary to perform the required calibration for this requirement, as detailed in this SOW.

The calibration vendor shall provide a pickup courier service for packing and safe transportation of all test equipment to be calibrated under contract from the FCC OET Laboratory located at 7435 Oakland Mills Road Columbia, MD 21046 to the calibration vendor’s offsite facility and back to the Government’s designated delivery location.

The calibration vendor shall establish processes and assign appropriate resources to effectively administer this contract. The calibration vendor shall respond to Government requests for contractual actions in a timely fashion. The calibration vendor shall have a single point of contact between the Government and Contractor employee assigned to support the contract.

The calibration vendor shall provide the appropriate support services as required in the SOW. The calibration vendor shall provide necessary infrastructure to support deliverables and work issued under this contract. The calibration vendor shall provide administrative support to employees in a timely fashion such as timekeeping, leave processing, pay, and emergency needs.

The calibration vendor shall accomplish assigned services by employing and utilizing qualified personnel with appropriate combinations of skill, training, and experience. The Contractor shall match personnel skills to the services with a minimum of under or over employment of resources.

The calibration vendor shall perform all calibration in accordance with the standards identified in this SOW.

2.2 TASKS

The calibration vendor shall have a valid, current ISO/IEC 17025 accreditation to calibrate, the FCC OET Lab’s test equipment to OEM specifications and calibration standards.

All calibrations shall be made in a timely manner. Calibration turnaround time is paramount to the success of the FCC OET Laboratory’s operation. Calibration efforts must be performed as expeditiously and reasonably as possible. As such, the maximum allowed period for calibration of any test equipment, including shipping/total absence from the lab for calibration services shall not exceed sixty (60) calendar days, to include transportation from the FCC OET Lab to the calibration vendor’s facility and return of the fully calibrated equipment to the FCC’s Warehouse address listed in Section 2.3 below. Calibration turnaround times exceeding sixty (60) calendar days shall not be acceptable under this contract – since only the FCC’s contracting officer has the authority to modify the contract, any special circumstances in which a calibration will exceed sixty (60) calendar days requires advance notification to the FCC’s contracting officer, who can determine whether the vendor is in breach, whether a contract modification is warranted, or whether cancellation of the calibration and/or other action is warranted. In other words, no OET employee, including the COR, has the authority to change the terms of this contract or allow for acceptance of late or non-conforming performance by the vendor. Similarly, if the calibration vendor discovers a defective item that is not within manufacture’s tolerance and unable to be calibrated to standards, and/or requires repair, the calibration vendor shall notify the FCC’s contracting officer, and shall not charge for calibration of said equipment.

If repairs and/or alternative calibration to the equipment are possible, the calibration vendor shall provide information on the costs of such repair and calibration to the contracting officer, but shall NOT be authorized to proceed with such repair or calibration unless and until the FCC’s contracting officer has explicitly authorized such work and approved such pricing via a fully funded modification to the contract. In addition, the vendor will acknowledge and certify receipt of all equipment in working order, and shall note any defects or patent need for repairs when picking up the equipment for calibration. The vendor shall NOT accept any equipment in known or obvious need for repair unless and until the vendor notifies the contracting officer and the contracting officer instructs the vendor as to whether to attempt to calibrate and repair the equipment. Any equipment repair that is NOT included in the vendor’s quote/pricing will require contracting officer approval and funding prior to any repair work being done. The Government reserves the right to decline to send equipment for calibration for any reason, including that such calibration is not needed because the equipment cannot or will not be repaired.

The FCC OET Laboratory deems any equipment alteration, including the substitution of manufacturer provided or approved repair parts with other generic repair parts, to be contrary to the OEM’s original bill of materials for that item and may endanger the device’s usefulness to the FCC. As such, any alteration of the form, fit, function, and/or performance, without the expressed written consent and prior approval from both the OEM and the FCC’s contracting officer shall constitute a defective asset and all costs to replace shall be born by the calibration vendor who modified the device without prior approval.

2.3 TRANSPORTATION of DELIVERABLES

Post calibration, all test equipment (deliverables) shall be returned to the attention of the COR. Equipment calibrated under this contract shall be delivered to the FCC Warehouse.

2.4 GOVERNMENT FURNISHED MATERIALS

The Government will arrange for the calibration vendor to have access to the FCC OET Laboratory facility to pick up any test equipment requiring offsite calibration.

2.5 RECOGNIZED HOLIDAYS

Any of the listed below holidays falling on a Saturday will be observed by the Government on the preceding Friday;

holidays falling on a Sunday will be observed on the following Monday.

The calibration vendor shall coordinate with the COR in advance to pick up the test equipment listed in Section 7 for calibration. Note that access to the FCC OET Laboratory will not be available on weekends or when the facility is closed due to local or national emergencies, administrative closings, partial closing prior to federally observed holidays, or the following federally observed holidays:

3 SCOPE OF WORK

The scope of this acquisition encompasses the calibration vendor expertise to provide, non-personal, one-time calibration of test equipment for the FCC OET Laboratory.

The calibration vendor shall provide a calibration for each test equipment items, identified in Section 7 below.

4 PERFORMANCE REQUIREMENTS

The calibration vendor shall provide all requirements in the areas of calibration of FCC OET Laboratory test equipment. The calibration vendor shall return all items in a serviceable condition.

The calibration vendor shall successfully integrate and coordinate all calibration activities needed to execute the requirement, and manage the timeliness, completeness, and quality of problem identification, timely identify issues, recommend corrective actions, ensure customer satisfaction and professional and ethical behavior of all calibration vendor personnel.

In furnishing these services, the calibration vendor shall provide all necessary management, supervision, personnel, materials, supplies, packing, shipping, and equipment except as otherwise indicated, and shall plan, schedule, coordinate and ensure effective performance of, and conformance to, all aspects of the scope of work contained herein.

4.1 PERIOD OF PERFORMANCE

The period of performance for this contract shall be one year, with all equipment identified herein calibrated.

4.2 PLACE OF PERFORMANCE

The Calibration shall be performed at the equipment calibration vendor’s offsite certified calibration facility that has a valid, current ISO/IEC 17025 accreditation.

4.3 PERFORMANCE METRICS

The calibration vendor and its offsite calibration facility shall have a valid, current ISO/IEC 17025 accreditation to calibrate all FCC OET Laboratory test equipment to OEM specifications and calibration standards. All test equipment calibrations shall be performed IAW ISO/IEC 17025 accredited calibration, ANSI/NCSL Z540-1, ANSI C63.5, ANSI C63.19 HAC, CISPR 16-1-6, IEC 61094 & traceable to National Institute of Standards and Technology (NIST) standards.

Calibration time of the test equipment is paramount to achieving the FCC Lab’s mission and objectives. As such, the calibration time for any test equipment under this contract shall not exceed 60 days from date of notification in writing by the FCC to the calibration vendor, including return delivery.

The calibration vendor shall provide quality calibration documentation for each items serviced.

4.4 ACCEPTANCE OF DELIVERABLES

The vendor and COR will jointly document/verify the test equipment’s physical condition, basic successful power up and functionality, and working components prior to the acceptance of the equipment for calibration service by the calibration vendor. Upon return, the COR will inspect the equipment to verify its return in like condition, except for successful calibration. As noted above, the vendor shall not accept equipment in need of repair, but shall notify the contracting officer; neither the COR not any OET staff has the authority to authorize repairs under this contract. No equipment in need of repair may be calibrated unless and until the contracting officer determines whether such calibration is still necessary and/or whether necessary repairs can be funded and authorized. The vendor will coordinate test equipment return with the COR or his/her designee to ensure safe return of test equipment. Any damage noted upon return of the equipment will be the responsibility of the calibration vendor.

Calibration services shall not be invoiced unless and until the equipment has been returned; all related test equipment documentation, such as calibration data and calibration certificate or calibration sticker has been provided; and such equipment and documentation has been inspected, and successful calibration has been confirmed by the COR or his/her designee.

The Government shall have fifteen (15) business days after delivery of the calibrated test equipment and required documentation to complete the review of each deliverable and accept or reject the deliverable by giving written notice to the calibration vendor. If the Government fails to complete the review within the review period, the deliverable will be deemed accepted, unless a reasonable extension of the review period has been requested within the period.

The calibration vendor shall have five (5) business days to correct any rejected deliverable and return it to the FCC’s COR or his/her designee. An extension of this correction period may be approved by the COR only under special circumstances advantageous to the Government, approved in advance and documented by the Contracting Officer.

The calibration will be considered complete when accepted by the Government as set forth herein, and, at a minimum, only after the calibration vendor safely returns each test equipment asset back to the COR, successfully calibrated as evidenced by inspection and along with provision of the calibration data/report for each item calibrated, a front panel affixed calibration sticker, and detailed calibration certificate, and the Government has inspected and accepted the calibration as complete/successful. Notwithstanding such acceptance, should the Government identify a latent defect in the calibration services as rendered, the Vendor will promptly address any such deficiencies promptly; further payment under the contract may be impacted by the Vendor’s failure to address any such deficiencies in a timely manner.

4.5 DOCUMENTATION REQUIREMENTS

The Calibration Reports delivered to the Government will be evaluated against the following acceptance criteria:

(a) Standards. The document shows conformity to ANSI/NCSL Z540-1 & ISO/IEC 17025, ANSI C63.5, ANSI C63.19 HAC, CISPR 16-1-6 where applicable.

(b) Data. The document shall provide traceable calibration data or repair information for each item serviced.

(c) Completeness. The document covers all aspects of the subject matter.

(d) Clarity. The document is understandable by the intended user/recipient of the document.

(e) Consistency. The document is logically presented, both internally and in relation to companion documentation.

(f) Accuracy. The document is functionally and technically accurate.

(g) Editorial Accuracy. The document is free of typographical and grammatical errors, logically organized, and follows consistent formatting styles.

4.6 CONSTRAINTS – APPLICABLE PUBLICATIONS (CURRENT EDITIONS)

Contractor accreditations shall be IAW ISO/IEC 17025, General requirements for the competence of testing and calibration laboratories.

Test equipment calibrations shall be performed IAW: ISO/IEC 17025 and ANSI/NCSL Z540-1, American National Standard for Calibration - Calibration Laboratories and Measuring and Test Equipment.

Test antenna calibrations shall be performed IAW: ANSI C63.5, American National Standard for Radiated Emission Measurements and Electromagnetic Control - Calibration and Qualification of Antennas, and CISPR 16-1-6, Radio Disturbance and immunity measuring apparatus- EMC antennas.

Hearing Aid Compatibility (HAC) calibrations shall be performed IAW: ANSI C63.19, American National Standard Methods of Measurement of Compatibility between Wireless Communication Devices and Hearing Aids

5 DELIVERABLES

All deliverables shall become the property of the Federal Communications Commission and shall not be released by the calibration vendor or its employees, agents, or assigns to any party outside the Office of Engineering & Technology (OET).

Each calibration certificate/report shall be submitted in electronic format to the COR or his/her designee using Microsoft Word and/or PDF. The calibration vendor shall be responsible for preparing, reviewing, and indexing documents supporting the required deliverables. All documents shall be reviewed and approved by the COR.

Following confirmation of receipt of all deliverables applicable to calibration of the equipment listed in Section 7, then and only then may the vendor submit their invoice in IPP for payment processing.

5.1 DELIVERABLE DOCUMENTATION - FORMATTING

The calibration vendor shall generate, distribute, and maintain all the calibration reports. The calibration vendor shall submit proposed report formats to the COR for review, remark, or approval within five (5) business days after calibration of items are complete. The COR will provide remarks and determination regarding acceptability of the report format(s).

Deliverables identified in the table below are reports prepared by the calibration vendor to reflect the calibration vendor activities and presented to the Government for quality assurance purposes. Government personnel will review the materials presented and evaluate them for accuracy and completeness. Delivery will be as stated in the table below unless otherwise directed. Format will be as proposed by the Contractor and approved by the Government unless otherwise directed in this MR.

6 CALIBRATION SCHEDULE

The calibration vendor shall provide the Government with the calibration schedule within ten (10) business days after award, identifying tasks to perform and with progress reports to assist with the monitoring of the contract in accordance with this SOW. The equipment listed in Section 7 below shall be used to create a calibration schedule that completes calibration of the equipment, within 60 days, and in any event before the end of the period of performance of this contract.
