BRAND NAME JUSTIFICATION FOR

ACQUISITIONS UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

1. In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), I hereby determine that the listed on Diamond Piers is available from only one brand, and competition is precluded for the reasons indicated below. There are no substitutes available.

2. This acquisition is restricted to the following brand name materials:

Company: Diamond Piers Make/Model/Part Number: Diamond Piers and 1 1/2" x 5.25' HDG Steel Pins

3. The Diamond Piers, is estimated to cost $18360 and is required to be delivered by August

15th 2023.

4. The Diamond Pier is specialty item which is designed to support a board walk in a marshy area which the water rises and falls depending on the season.

5. Specific characteristics of the Diamond Piers, that limit the availability to a sole-source are these products are specific to being load baring in a dynamic environment which is specific to a boardwalk in a marshy environment. Only this suggested source can furnish the requirements, to the exclusion of other sources, because these products meet the specification to the project. These products are designed to withstand the wet changing environments.

6. Check and fill in all that are applicable:

The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The Dimond Piers match the equipment existing on the boardwalk, and the new item/service must coordinate, connect, or interface with the existing system.

These product were the materials which were referenced in the engineered plans to support the complexity of the project. The changing environment requires these piers to support the Boardwalk.
