Statement of Work

CEDAR GROVE SOLID WASTE COLLECTION

Sequoia and Kings Canyon National Park

1. DESCRIPTION

1.1. The work of this contract consists of providing all labor, equipment, and material necessary to collect and dispose of solid waste in National Park Service (NPS) administrative areas, campgrounds, and residential areas in the Cedar Grove area of Kings Canyon National Park. Approximately 124 tons of solid waste is removed from this location yearly.

2. LOCATION

2.1. The locations of this contract are in the Grant Grove Sub-District of Sequoia and Kings

Canyon National Park, at the eastern end of California State Route 180 in Fresno County. The general service address is 108532 Cedar Lane, Kings Canyon National Park, CA 93633.

2.2. The subject location is an exclusive federal jurisdiction under the United States

Department of the Interior, NPS, and is under management of Sequoia and Kings Canyon National Park (hereby referred to as “Park”), 47050 Generals Highway, Three Rivers, California, 93271.

3. SCOPE

3.1. The Contractor shall provide all labor, equipment, supplies, materials, and incidentals, except as otherwise noted herein, necessary for the collection and disposal of solid wastes as outlined in this Statement of Work.

3.2. Intermittent service may be ordered prior to, during or immediately following scheduled periods when service is needed less frequently, or fewer service areas and /or containers need service. Intermittent service may also be ordered as an addition to scheduled service at selected service areas because of heavy visitation or other factors. Number of collections shown on the Price Schedule is an estimate only. Actual numbers of collections will depend upon need.

4. CONTRACTOR-FURNISHED SOLID WASTE BINS

4.1. The Contractor shall furnish all solid waste bins required for use during the term of this

Contract, and any extensions thereof. Minimum bin size shall be 1 cubic yard (CY) capacity. Maximum bin size shall be 3 CY capacity. The Contractor shall furnish the bin capacity and quantities as specified for each service area in the Price Schedule.

4.2. The Government anticipates that the following numbers and capacities of bins will be required:

4.2.1. 3 cubic yard capacity – 33 each

4.2.2. 2 cubic yard capacity – 7 each

4.3. Bin changes: The Government may, at its sole discretion, request the change in capacity or quantity of up to three bins per year without incurring a bin change fee. Changes in the quantity or capacity of more than three bins per year will result in the assessment of a bin change fee provided in the Price Schedule multiplied by the number of bins above the three requested to be changed.

4.4. Bin relocations: The Government may, at its sole discretion, direct the move of a bin from its established location to a new location on a regular scheduled service day.

Relocations shall be charged at the rate provided in the Price Schedule.

4.5. The Contractor shall bear-proof the solid waste bins and maintain them to prevent bear entry. Each bin placed in service shall meet the following minimum specifications:

4.5.1. All metal construction.

4.5.2. Watertight to prevent leakage of liquid or other wet waste.

4.5.3. Lid material not less than 1/8" and not more than 3/16" thickness.

4.5.4. The unhinged edges of the lid shall be reinforced with 3/4"x3/4"x1/8" angle iron to provide rigidity if such reinforcing is not part of the lid as manufactured.

4.5.5. Each bin shall have a lid-locking system that will secure the lid in a closed position. The device furnished can be a locking system that will engage automatically when the lid is lowered to the closed position (latch must have ease of opening), or a chain and latch assembly consisting of 1/4" chain, 5/8" snap hook, 1/4" U-bolt (minimum sizes) securely attached to prevent bear entry.

4.5.6. Lids shall be equipped with handles to facilitate opening and shall be light enough to be raised by most park visitors, including children.

4.5.7. Handles shall be functional and shall not have sharp edges. Four-part, hinged lids are recommended; and bins must be equipped with a device, such as a chain and snap hook for securing to post, chocks, or wheel locks, to prevent rolling when unattended (skid-mount bins excluded).

4.6. The Contractor shall perform all needed maintenance and upkeep on Contractor-owned bins. Bins shall be painted a brown color compatible with surroundings, and both the exterior and interior shall be kept clean. Frequent cleaning by square point shovel or washing before disinfecting Contractor-owned bins may be necessary to reduce odors, eliminate flies, and discourage attraction of wild animals. Any defacement or damage will be repaired or repainted immediately.

4.7. The Government will not be responsible for defacement or other damages resulting from acts of vandalism or malicious mischief caused by visitors to the Parks.

4.8. The Government reserves the right to stencil bins with instructions for use as deemed necessary. The Government will remove or repaint the stenciling at the end of the Contract period.

5. METHOD OF OPERATION

5.1. The Contractor will service each container at each service area in accordance with the appropriate pickup schedule in effect. When Contractor-owned bins are serviced, care will be taken to secure the bear- proofing mechanism immediately following service, and to secure bins to posts where provided.

5.2. The Contractor shall be responsible for the pickup of all loose trash within a 10-foot radius of the collection site, including any trash scattered by wild animals, Park visitors, wind, or other unknown elements.

5.3. The Contractor shall remove tree and shrub pruning, brush, and grass clippings, which will normally be tied in bundles or placed in disposable containers at the pickup site.

Christmas trees shall be removed whether tied in bundles or not.

5.4. The Contractor shall exercise reasonable care in handling trash containers to insure against undue damage. Bins or covers damaged through negligence on the part of the Contractor or the Contractor's employees shall be repaired or replaced at the Contractor's expense.

5.5. The Contractor shall conduct operations to have minimum impact on visitor activities, and to impose minimum interference with the normal use of roads, structures, utilities, or other Park facilities. Special care shall be exercised to prevent damage to natural features of the Parks and to protect the natural surroundings. The Contracting Officer's Representative in each area will designate a site for storage of collection vehicles and/or bins, if necessary.

5.6. The Contractor shall always practice safe work habits while performing under this contract. All contract operations will be in accordance with the applicable standards of the Occupational Safety and Health Act (OSHA) and other appropriate federal or state safety regulations. The NPS safety officer shall have the right to inspect the Contractor's operations in the park at any time.

5.7. The Contractor and all his employees are subject to, and shall comply with, all NPS rules and regulations applicable to Sequoia and Kings Canyon National Park.

5.8. The Contractor shall comply with all legal load restrictions in the hauling of equipment or materials on public roads beyond the limits of this project. Rules and regulations for vehicular traffic on NPS roads are promulgated by the NPS superintendent and are available to the public. A Special Permit will not relieve the Contractor of liability for damages resulting from its operations.

6. CONTRACTOR PERSONNEL

6.1. The Contractor shall provide all personnel necessary to perform the services required under this contract in a timely manner. Individuals currently employed by the Government will not be utilized by the Contractor as part-time or contractual employees, or in an advisory capacity, or any other capacity during the period of this contract.

6.2. Driver Qualifications: All drivers shall be trained and qualified in the operation of collection vehicles and must have in effect a valid license of the appropriate class with appropriate endorsements issued by the California Department of Motor Vehicles. All collection vehicle drivers must also complete a Contractor's in-house training program, which includes education on the use of all vehicles in the collection fleet, collection programs, and route information as well as customer service practices and safety information.

6.3. The Contractor assumes direct supervision over and full responsibility for all employees engaged in the performance of work under this contract. The rights and privileges of Park visitors and others who may be using Park facilities must always be recognized.

The Contractor shall not permit any employee to perform work on Park premises who is determined to be intoxicated, or under the influence of narcotics, or otherwise deemed unfit to perform the work of this contract.

7. CONTRACTOR WORK SCHEDULE

7.1. All collection and disposal services shall be performed during daylight hours. Collection services shall be performed in accordance with the contracted schedules. If the contractor is unable to accomplish any collection, the Contractor shall immediately notify the Contracting Officer or the Contracting Officer’s Representative (COR).

7.2. The Government anticipates that service will be necessary on weekends and holidays, as indicated on the service schedule so to prevent overflows and unsanitary conditions.

Service on the days provided on the service schedule is understood to be the most efficient distribution of services to meet the needs of the Government and shall be the foundation for pricing.

7.3. The Contractor may propose an alternative distribution of services, including variation of service frequency, collection days, and bin number and capacities, so to avoid service on weekend and holiday days, if it remains within the total price for service agreed to. If accepted by the Contracting Officer, implementation will be agreed to by modification of this contract. However, if bins overflow on weekends, greater than two occurrences per season, it shall be grounds for the immediate restoration of the original schedule upon written direction by the Contracting Officer.

7.3.1. Bin overflows occurring on weekends or holidays, beyond two per season, under an alternative schedule shall be collected and cleaned up at no additional charge to the government. Collection and clean-up shall be completed within one day following notice to the Contractor or their Representative.

8. CONTRACTOR VEHICLES

8.1. The Contractor shall use vehicles equipped with compactor-type units for the collection and transportation of solid wastes as the preferred type of collection vehicle. These units must be sealed to prevent leakage of liquid or other waste materials. Contractor shall immediately clean up any leakage or spills resulting from Contractor's vehicles or operations. Vehicles must be equipped to handle bins when used in areas where this type of container has been specified.

8.2. Contractor vehicles shall be operated only on designated roadways, driveways, and parking areas.

8.3. All vehicles used in the performance of this Contract shall be kept clean, in good mechanical condition, painted to present a good appearance, meet all applicable California State Department of Motor Vehicles Codes, show evidence of annual safety inspections performed by the California Highway Patrol, and display proper registration and license. All Contractor vehicles shall be equipped with approved backup alarms.

Alarms shall always be maintained in operating conditions.

8.4. All advertising or other slogans, logos, or pictures, other than the Contractor's firm name, are prohibited.

8.5. In the event of serious mechanical breakdown, the Contractor must have reserve equipment available to continue performance as called for in this Contract.

8.6. The Contracting Officer may approve an alternate vehicle type in specific areas where use of a compactor unit is considered unsafe, or when its use could otherwise affect the safe flow of traffic. Such approval is contingent upon receipt of evidence that the vehicle proposed for alternate use meets the same standards of appearance, inspections, registrations, licensing, and backup alarms required for the primary, compactor-type, collection units.

8.7. Solid waste, which is collected in authorized alternate vehicles, shall be transferred directly from these vehicles into compactor-type units as soon as possible. Under no circumstances will trash be temporarily stored at other collection sites or placed in other containers for later pickup by the compactor. When authorized, alternate vehicles shall be equipped to prevent leakage of liquid or loss of materials while collecting or transporting garbage.

9. DISPOSAL SITES, FEES, REPORTING

9.1. All solid waste collected as a result of this contract shall be disposed of outside of these

Parks, at disposal sites meeting state of California sanitation standards. The Contractor shall identify disposal sites used in conjunction with this contract prior to issuance of a Notice to Proceed.

9.2. The Contractor is responsible for paying all fees levied for the disposal of waste. A current fee schedule for the disposal site to be used will be submitted prior to beginning performance under this contract.

9.3. Tonnage of waste and disposal location(s) shall be submitted to the NPS concurrent with billing information preparatory to invoicing through the Internet Payment Platform

(IPP).

9.4. Substantiation of invoices: The Contractor shall submit service records for each month concurrent with billing information preparatory to invoicing through IPP. This service record shall indicate, at a minimum:

9.4.1. the service area as described in the Price Schedule,

9.4.2. the date and time for, and at, which service was performed,

9.4.3. the status of service, and

9.4.4. driver’s identification

9.5. Separate from requirements put forth by the Government, the Contractor shall comply with requirements put forth by the State of California, and as implemented by the County in which disposal is performed, for recycling of wastes and reporting of disposals.

9.6. The Contractor shall provide the Contracting Officer a report detailing the total tonnage of waste collected and the quantities of materials diverted from landfill for recycling, or composting, as a percentage of the total waste stream and by weight for each type of material diverted upon contract completion.

10. PRE-SERVICE MEETING

10.1. Following award and prior to initial service, the Contracting Officer Representative together with the Contractor and any designated representatives, shall meet jointly to discuss the details of this contract. The purpose of this meeting will be to mutually discuss the intent, clarify all terms, conditions, and special provisions, and to resolve any misunderstandings. The date and time of this meeting will be mutually agreed upon as soon as possible after contract award. The Contractor can present his tentative work schedule and other, required submittals, at this meeting.

11. REMEDIES- UNSATISFACTORY SERVICE

11.1. Failure of the Contractor to pick up and remove waste as required by the Price

Schedule, or other Contractor activities in violation of this contract may be cited as a violation of 36 CFR Chapter 1, Sec 2.10(d), resulting in remedy under 11.2 and 11.3 herein. In addition, monthly payments to the Contractor will be reduced under the following conditions and in the amounts indicated below:

11.2. Unsanitary containers, including leaky compactor and container seals and drains- Contractor-owned:

11.2.1. Conditions must be corrected within forty-eight (48) hours after verbal or telephone notice to the Contractor or the Contractor's Representative.

11.2.2. Failure to correct within the time allowed will result in a reduction of 1% of the

Contractor's total monthly compensation for each 24-hour period (or portion thereof) condition continues to exist beyond the initial correction period.

11.3. Missed collections and/or failure to clean-up:

11.3.1. To the extent possible, Contractor will be notified in person or by telephone of missed collections and/or failure to clean up around collection site and will be afforded the opportunity to correct. Correction must be accomplished within one day of notice the deficiency exists.

11.3.2. If, for any reason, Contractor fails to make any collections, total monthly compensation will be reduced by the amount provided for the collection in the Price Schedule and, in addition, Contractor will be billed actual costs incurred by the Government for providing the service.

12. DELIVERABLES

12.1. The Contractor shall provide the Contracting Officer a report detailing the total tonnage of waste collected and the quantities of materials diverted from landfill for recycling, or composting, as a percentage of the total waste stream and by weight for each type of material diverted upon contract completion.

13. PERIOD OF PERFORMANCE

13.1. The period of performance is July 1, 2024, to October 28, 2024.
