Notice Information Notice of Intent: AT 24104 Title: NBIB Data Encryption Project Description(s):

This NOTICE OF INTENT TO AWARD A NON COMPETITIVE CONTRACT is conducted in accordance with Federal Acquisition Regulation (FAR) Part 12, Commercial Items. The authority for this award is FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

The Chief Information Officer/Operations Technology Management/Data Center (CIO/OTM/Data Center) provides support to the Office of Personnel Management (OPM) by enabling OPM to perform critical business and information processing activities. The Data Center provides infrastructure services to the National Background Investigation Bureau (NBIB) operations and Retirement Services (RS) processing Lines of Business.

An Enterprise License Agreement (ELA) contract (OPM3216C0005) was established with Software AG on December 31, 2015 and is set to expire December 30, 2020. The current ELA cannot be modified or extended as the additional software would increase the scope of the contract and it does not include the technical support services required to install, configure, and deploy ADABAS SAF Security, Natural SAF Security, and Event Replicator. The new Adabas products must be under a maintenance license agreement until the migration from the mainframe is completed in 2020. As a result, this effort will be established to co-term with period of performance of the corresponding ELA so they may expire concurrently.

Communications and market research performed confirmed Software AG does not allow for reselling of their products and services via small business providers and is not currently available via their GSA Schedule contract; as a result open market procurement is the only viable option. These services will be procured from the manufacturer - Software AG Government Services, Inc., 12950 Worldgate Drive, Herndon, VA 20170 – for the following:

Install and/or configure the following Software AG Products as necessary including:

· ADABAS SAF Security (ADASAF)

· ADABAS Security Utility (ADASCR)

· ADABAS SQL Gateway/CONNX

· Natural SAF (NATSAF)

· Natural Security (NSC)

· Event Replicator

· Other Products as necessary

The team will propagate the above products and necessary configurations to the following OPM environments including:

· Sandbox

SWAG-AG is the original developer and owner of the copyrights of the computer codes embodied in the Adabas products used by OPM and is the only known vendor capable of providing the support of these products. There are no authorized SWAG-AG resellers. OPM determined that no other offeror could immediately perform all of the services required without incurring substantial unacceptable delay. Any other contractor would cause OPM schedule risk to provide the required services.

THE PURPOSE OF THIS NOTICE IS TO SATISFY THE REQUIRMENTS OF FAR SUBPART 5.2. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, all responsible parties who identify their interest and capability to satisfy this requirement will be considered. No solicitation will be issued, therefore, all requests for the solicitation will be considered non-responsive. A determination not to compete this action based upon responses received is in the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via e-mail to Jessica Guadalupe, jessica.guadalupe@opm.gov , within three (3) days of the published date of this notice. Verification of receipt of electronic transmission is the sole responsibility of the contractor. All OPM contractors are required to register in the System for Award Management (SAM) database prior to execution of award.
