VENDOR QUESTIONS/GOVERNMENT RESPONSES
Vendor Question: Can you please advise on the requested warranty terms and conditions for this RFQ. We have sold similar orders to this account and quoted the user for the equipment this RFQ was based around. In our quote it calls for a 5 year parts and ON SITE LABOR with 24 hours response times. The RFQ just released does not stipulate any specific warranty terms or conditions.
Government Response: Cart pricing include a 5 year, next day ON-SIGHT labor and parts warranty excluding weekends and holidays. Warranty terms also includes the batteries.
Vendor Question: The RFQ (p. 4) states a requirement for CAPSA Healthcare (“CAPSA”) brand Model M48 Medical Carts, but the RFQ does not include a formal brand name justification limiting responses to the CAPSA brand or CAPSA Model M48, as would be required if the RFQ intended to restrict competition to proposals for the CPASA brand / Model M48. See FAR 13.501(a)(iv) / FAR 5.102(a)(6). Based upon this RFQ structure, we understand that the RFQ permits offerors to propose “equal” products built by manufacturers other than CAPSA, so long as such products meet or exceed the RFQ’s specified salient characteristics listed at page 4.
See FAR 52.211-6, Brand Name or Equal. Would the Government please confirm that this is a correct interpretation of the RFQ’s structure?

1. Contracting Activity: Department of Veterans Affairs, VISN 09, James H Quillen Veterans Affairs Medical Center, to be used in EG, E1, Cardiology, and Radiology areas. 621-22-1-091-0062
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This is a request to purchase Capsa M48 medical carts to distributed medication to patients in the EG, E1, Cardiology, and Radiology areas. The current inventory of carts within the facility have reached the end of their lifecycle. The estimated amount of this requirement is

Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The requested Capsa Healthcare M48 medical carts will be used in the EG, E1, Radiology, and Cardiology, and they are the same carts that are used throughout the medical center. The M48 medical cart is designed to provide ergonomic support, secure storage, and patient evaluation capabilities to end users in medical facilities. Additionally, the medical cart will assist end users with medication distribution to patients who require treatment in routine and emergency circumstances. The cart can support portable computers that collect, store, and disseminate patient information to physicians who are intimately familiar with patient conditions that have been recently diagnosed or are currently being treated. Moreover, these carts can be utilized in spaces where patients are recovering from non-invasive and invasive medical procedures and require medication to prevent any deterioration in their short-term or long-term health. The James H.
Quillen VA Medical Center currently uses 117 of the exact same carts; therefore, only Capsa brand medical carts will suffice. The continuity of medical cart throughout the facility results in a better customer experience and a consistent level of service quality for the customers. The existing carts have reached their end of lifecycle and must be replaced.
4. Description of market research conducted and results or statement why it was not conducted: The VA National Acquisition Center, Federal Procurement Data System, System for Award Management, GSA eLibrary, GSA Advantage, Dynamic small Business Search and the Vendor Information Pages were queried using the search terms “Capsa Cart” and “medication cart,” NAICS code 339113, and product service code 6515. Capsa Healthcare responded to a request for Service-Disabled Veteran- Owned Small Business Distributors. Michael Raney, the Government Sales Manager for Capsa Healthcare, responded with two distributors: i3 Federal and AB Martin Services. A Request for Information was posted on the System for Award Management under 36C24922Q0114 on January 7, 2022 and closed on January 12, 2022. Three vendors responded. Two are Small Disabled Veteran Owned Businesses certified in VIP, therefore, the Rule of Two can be met.
