(1) Payment for bond premiums in accordance with Clause 52.232-5, Payments under Fixed-Price

Construction Contracts, shall not be in addition to the contract price. Include bond payments under 151.01 Mobilization.

(2) Payment will be made on actual work performed as described in FP-03 109.01 unless otherwise noted.

(3) A list of documents to be submitted as part of the offer may be found in Section L.

SECTION C—DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 DESCRIPTION OF WORK

Furnish all labor, equipment, and materials, to accomplish the Work under this contract. Services consist clearing and grubbing, furnishing and installing one (1) precast pre-stressed concrete voided slab bridge (4 total members), bridge abutments, removing and disposing of the existing bridge offsite, installation of bridge and approach railing, construction of asphalt and aggregate surfaced roadways, structural excavation and backfill, and signage.

The Contractor should refer to the Schedule of Items, Project Area Map, and referenced

Specifications when making estimates of quantities or work.

C.2 PROJECT LOCATION

State of California, County of Plumas, Plumas National Forest, Mount Hough Ranger District, Storrie

7.5 Minute Quadrangle, Township 24 North, Range 6 East, Section 16.

The Jackass Creek Bridge Replacement project is located along an OHV trail that is also used by Pacific

Gas & Electric. Existing bridge is on Milepost 0.7 on OHV trail. All work is located on the Mount

Hough Ranger District of the Plumas National Forest.

Directions to the project site, from the town of Quincy, CA: Proceed westbound on CA State Highway

70 for approximately 36 miles. Turn right onto paved road and proceed for an additional 0.7 miles to the bridge site; paved road will pass large tailings pile from old rock quarry. Coordinates for existing bridge is as follows: Latitude: 39°56'9.96"N; Longitude: 121°19'7.39"W.

C.3 CONTRACT TIME

The contract time shall be 180 days, and with the expectation that all work be completed before October

20th, 2017. Contract time includes delays for weather, locating and transporting supplies and materials, and final site cleanup.

C.4 PROJECT SITE CLEAN UP

Project site cleanup includes the removal and proper disposal of all project trash, demolition debris, and residue off National Forest Land. Proper waste disposal sites shall be any local commercial landfill.

All spills of petroleum products including leak spots from parked vehicles shall be removed and properly disposed according to all Local, State, and Federal rules, regulations, and laws governing such disposal. Any Fuel Trucks staged on-site must be equipped with spill containment kits and portable berms that meet all state and federal regulations. A Spill Containment Plan must be submitted and approved prior to the start of work. If any fuel or oil are to be stored onsite (regardless of the amount), the Contractor shall prepare, and submit for review and approval, then later for implementation a Spill

Prevention and Countermeasures Plan. The (SPCC) Plan shall meet applicable EPA requirements (40

CFR 112), including required certification by a Registered Professional Engineer. Contractor is responsible for all clean-up costs of petroleum product spills within the project vicinity area caused directly or indirectly by their employees or from their contract operations.

C.5 PRICE RANGE

The price range of this project is between $250,000 and $500,000.

C.6 WORKERS COMPENSATION INSURANCE

The contractor shall provide evidence of Worker’s Compensation Insurance or a written explanation as to why the contractor is exempt from the requirement. NOTE: The Contractor working alone is not required to carry the insurance.

C.7 MAPS

C.8 SPECIAL CONDITIONS AFFECTING THE WORK

a. Physical Conditions. The indications of physical conditions on the drawings and in the specifications are the result of site investigations and surveys performed by the Government.

b. Existing Structures. The existing bridge consists of a wood rail flatcar. The load rating of the existing bridge is not known and shall be determined by the contractor. Overhead high voltage power lines are present directly above the project area. It is the contractor’s responsibility to determine the overhead clearance of the power lines.

c. Bridge Erection Plan. Due to the proximity and/or limitations of existing structures, and the limited work space, the Contractor shall submit a comprehensive bridge erection plan that outlines the proposed construction methodology of the new bridge. The Contractor is solely responsible for the development and execution of their Bridge Erection Plan.

d. Dewatering Plan. Due to the proximity of water, the Contractor shall submit a Dewatering Plan, for the purpose of protecting the abutment foundations. The Contractor is solely responsible for the development and execution of their dewatering plan.

e. Weather. Low temperatures at the project site range from less than 30 ºF in December and January to lows of 50 ºF in July and August. High temperatures range from 45 ºF in December and January to over

90 ºF in July and August. The annual precipitation at the project site is less than 30 inches per year including snowfall. Winter snow storms and freezing temperatures will occur during the winter months and will cause the project to be shutdown. Icy conditions on local roads and highways can occur during the fall, winter and spring. Highway curves in shaded areas will remain covered with ice or frost for weeks.

f. Typical Work Hours, Weekends and Holiday Hours. No restrictions.

g. Safety, Emergency Communications and Evacuation. Contractor is responsible for the safety of the

Contractor’s employees including Subcontractors employees, Government employees associated with the project, and any visitors to the site both Government and private. The Contractor shall submit a Project

Safety Plan to the Contracting Officer for review prior to commencement of Work. The project safety plan shall comply with the appropriate California OSHA and Federal OSHA rules and regulations and must include a medical evacuation and emergency communications plan.

h. Staging Areas. The contractor shall have made available to them the Tobin Quarry site, located between

Highway 70 and the project site. Refer to Vicinity Map in contract drawings for the location of the quarry.

Due to the presence of noxious weed, the contractors operations within the Tobin Quarry shall be restricted to existing staging areas (previously flattened areas inside the quarry) or operating any equipment on the tailings piles. The existing staging areas shall not be increased in size. Additional staging areas may be used by the Contractor, but will require written approval of the Contracting Officer.

i. Highway Permits. Contractor is responsible for securing any overload or over width limit permits required for the transport of materials or equipment to the project site. The Contractor is responsible for conducting a thorough reconnaissance of all routes leading to the site.

j. Fuel Storage. The contractor shall utilize the Tobin Quarry for fuel storage. The fuel storage tank shall be set inside a fuel containment basin. The containment basin shall be large enough to hold 110% of the tanks capacity. Provide spill plan in accordance to the specifications for review and approval by the

Contracting Officer.

k. Toilets. No toilet or shower facilities are available on site. Contractor shall provide portable toilet facilities for its employees.

l. Camping. Contractor may request a permit from Mount Hough Ranger District.

m. Water. Non-potable water for the project construction can be drafted directly out of Jackass Creek. Use appropriate procedures to prevent sediment and other debris from entering the creek.

n. Security. Contractor is responsible for the Contractor’s equipment and materials owned or supplied to the site. Lost, damaged, or stolen equipment or materials shall be replaced at the contractor’s expense.

All equipment not equipped with a key lock system shall be secured in such a manner as to make it inoperable to the average person at the end of each working day. All hand tools and other equipment shall be secured at the end of each working day. The contractor shall be responsible for signing, limiting public access, and safety of the public and/or government employees at the site. All refuse shall be properly stored or removed from the site at the end of each day.

o. Traffic Control. Contractor shall submit a Traffic Control and Signage Plan for review and approval, 10 days prior to the start of operations. Construction signing for traffic control shall conform to the Manual of Uniform Traffic Control Devices (MUTCD). Traffic control signs shall be placed in areas with adequate turnaround space for a public truck pulling a fifth wheel trailer. Contractor shall not be paid directly for this item, rather it will be considered incidental to other items of work listed in the Schedule of Items. The existing bridge shall be closed to all public traffic throughout the full duration of work onsite.

p. Burning Permits. Contractor is subject to all rules and regulations governing the on-site burning of slash and other debris. Contractor shall obtain a burning permit from the jurisdiction having control over burning. The Contractor shall comply with Fire Plan for Construction and Service Contracts included in the Contract.

q. Protection of Resources. Contractor shall thoroughly clean all equipment prior to delivery to the project site, to remove weeds, seeds, mud, grease and oil buildup from all equipment surfaces. Contractor shall schedule an equipment inspection with the COR 36 hours prior to mobilization. Spills of petroleum products and other hazardous substances shall be reported, contained, and removed in accordance with all applicable rules, regulations and laws. Contractor shall submit a project spill response plan at the pre-work meeting for review by the Contracting Officer.

C.9 PRE-BID CONFERENCE OR TOURS

There will be no Pre-Bid Tour for the project. The Contractor acknowledges that they have taken the necessary steps to ascertain the nature and location of work, and have investigated and satisfied themselves as to the general and local conditions that can affect the work or its cost. Any failure of the contractor to take the actions described and acknowledged in this paragraph will not relieve the

Contractor from the responsibility of estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expenses to the government.

C.10 EQUIPMENT CLEANING & NOXIOUS WEED-FREE CERTIFICATION

Unless the entire project area is already infected with noxious weeds, the contractor shall ensure that prior to moving from one on forest location to another part of the project area all off-road equipment, which last operated in areas known by Forest Service to be infected with noxious weeds, is free of soil, seeds, vegetative matter, or other debris that could contain or hold seeds. Contractor shall certify in writing to the CO that off-road equipment is free of noxious weeds prior to each start-up of operations and for subsequent moves of equipment to other project areas. Measures taken to ensure that off-road equipment is free of noxious weeds will be identified. “Off-road equipment” includes all equipment operating off of paved roadways. A Current list of noxious weeks of concern to Forest Service is available at the Forest Supervisor’s office. Contractor shall clean off-road equipment prior to moving between project areas with known infestations with noxious weeds and other project areas, if any, which are free of such weeds. Project Area maps show areas known by Forest Service that contain specific noxious weeds species of concern. Contractor shall employ whatever cleaning methods are necessary to ensure that off-road equipment is free of noxious weeds. Equipment shall be considered free of soil, seeds, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment components or specialized inspection tools is not required.

Contractor shall notify Forest Service at least 24 hours prior to beginning of work in area designated as a noxious weed area, unless otherwise approved by CO. Notification shall include the location of the equipment’s most recent operations. If the prior location of the off-road equipment cannot be identified, Forest Service may assume that it was infested with noxious weed seeds. Upon request of Forest

Service, Contractor must arrange with CO for Forest Service to inspect each piece of off-road equipment prior to it being placed into service. If Contractor desires to clean off-road equipment on National forest land, such as at the end of a project or prior to moving to a new unit that is free from noxious weeds, Contractor and Forest Service CO shall agree on methods of cleaning, locations for the cleaning, and control of off-site impacts, if any. New infestations of noxious weeds, of concern to Forest Service and identified by either Contractor or Forest Service, within the project area or on the haul route, shall be promptly reported to the other party.

C.11 BARRICADES, WARNING SIGNS, AND OTHER DEVICES

The Contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient lights, danger signals, signs, and other traffic control devices, and shall take all necessary precautions for the protection of the work and safety of the public. Roads closed to traffic shall be protected by effective barricades, and obstructions shall be illuminated during the hours of darkness. Suitable warning signs shall be provided to properly control and direct traffic.

The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. All road barricades, warning signs, lights, temporary signals, flagmen and pilot car operators and equipment, and other protective devices, except for special devices, shall conform to Part VI of the Manual on Uniform Traffic Control Devices for Streets and

Highways, published by the Federal Highway Administration and applicable safety codes.

The Contractor shall furnish, erect, maintain, and remove when notified, four project information signs.

Sign details and installation shall conform to the (MUTCD) standards for temporary signs on a rural highway. A sign plan shall be submitted to the CO for approval prior to fabrication or installation of the signs. Specific locations shall be designated by the COR prior to installation. All signs shall be installed prior to commencing on-site work.

Trenches and other hazards will be signed and flagged in such a way that the public will be aware of the hazard.

C.12 STANDARD SPECIFICATIONS FOR CONSTRUCTION OF ROADS AND BRIDGES

ON FEDERAL HIGHWAY PROJECTS

The Standard Specifications for this project are contained within the “Standard Specifications for

Construction of Roads and Bridges on Federal Highway Projects” FP-03 U.S. Customary Units. Copies of this document are available on-line only at the Federal Highway Administration web site at http://www.wfl.fha.dot.gov/design/specs/fp03.htm in either Microsoft Word .doc or Adobe Acrobat .pdf format.

Special Project Specifications and Supplemental Project Specifications are included in full text as an attachment in Section J of the contract and amend, supplement, or replace the FP-03 Standard

Specifications. All specifications not included in the specification listing, but referenced by listed specifications are applicable.

NOTE: Offerors are cautioned to carefully review these Standard and Supplemental Project Specifications prior to submission of proposals. All specifications in the “Standard Specifications for Construction of Roads and

Bridges on Federal Highway Projects” FP-03 U.S. Customary Units are binding on the parties signing the contract.

The period of performance of this contract is shall take place within a 180 calendar day period, and with the expectation that all work be completed before the onset of winter conditions at the project site.

Contractor shall immediately after award, plan and coordinate with the Contracting Officer the approximate project start dates.

Factors which will help determine the Approved Schedule, but are not limited to; Contractor’s mobilization of equipment, employees, and vehicles to the project site, and road closures.

Contractor shall comply with the Approved Schedule, to finish all work under this contract.

Contractor shall immediately notify the Contracting Officer of any unforeseen delay or needed change to the Approved Schedule, so adjustments to the Period of Performance can be made in a timely manner.

SECTION G—CONTRACT ADMINISTRATION DATA

Pre-work Pre-work conference. Before work begins on service contracts, a pre-work conference is normally held to discuss the contract--especially the specifications, labor provisions, plan of work, and selected standard clauses. The pre-work meeting should be attended by an officer of the firm or someone designated in writing to act on behalf of the firm. The pre-work meeting may be waived at the discretion of the Contracting Officer.

Notice to Proceed.

No work may begin on this contract until the Contracting Officer has issued a Notice to Proceed.

Payment Payments. Payment will be made for fully acceptable work at the prices bid in the schedule of items.

Payment will be made monthly or at the milestones as specified in the contract specifications.

Deductions In accordance with the inspection clause, payment may be made for less than fully acceptable work at a reduced price. Other exceptions are noted below:

Contract Release.

Before final payment will be made the Contractor shall sign a release of all claims against the

Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically accepted from the operation of the release. A release may also be required of the assignee if the Contractor's claim to amounts payable under this contract has been assigned under the

Assignment of Claims Act of 1940 (31 U.S.C. 3727 and 41 U.S.C. 15).

Invoices Invoices.

Payment will be made from the contractor’s invoice. All invoices are to be submitted via the electronic

Invoice Processing Platform (IPP). This is a mandatory requirement initiated by the U.S. Department of

Treasury and you can find more information at this website https://www.ipp.gov/index.htm. There is no pre-award registration.

After award of a contract, please make sure that your company registers promptly at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish your account. PRIOR to starting the

IPP enrollment process, please verify that the point of contact’s (POC’s) email address is up to date in your company’s System for Award Management (SAM) account at www.sam.gov and that any recent update(s) have been allowed time to process resulting in an “Active” status on the SAM account. Invoices shall be accompanied by the signed contractor certification, using the exact wording in the clauses, FAR 52.232-5, and be up-to-date on certified payrolls for the invoiced timeframe, FAR 52.222-

8. (See next page for invoice certification language.) Invoices that do not meet these requirements will be rejected.

The Contractor shall submit payrolls weekly for each week in which any contract work is performed.

The copies shall be sent to the COR. SECTION H—SPECIAL CONTRACT REQUIREMENTS

Emergencies Fire Plan

Area of Responsibility for Fire. Unless otherwise noted elsewhere in the contract, the following define the limits of a contractor's area of responsibility for fire under the terms of the Fire Plan (Section J):

Superintendence by Contractor The name and the specific authorities of the foreman or superintendent must be designated in writing to the

Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of

Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run. The Contractor shall have a person on-site that is fully conversant in the

English language.

Key Personnel Offeror’s shall provide a list and qualifications of key personnel specifically designated for this project.

The contractor shall adhere the requirements set in AGAR 452.237-74 “Key Personnel (FEB 1988)”, as listed below:

(a) The Contractor shall assign to this contract the following key personnel: __________________

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The

Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

The key personnel specified in the Offeror’s Technical Proposal are considered to be essential to the work being performed hereunder. Prior to diverting any of the specified individuals to other programs, the Contractor shall notify the Contracting Officer reasonably in advance and shall submit justification

(including proposed substitutions) in sufficient detail to permit evaluation of the impact on the contract.

No diversion shall be made by the Contractor without the written consent of the Contracting Officer:

Provided that the Contracting Officer may ratify in writing such diversion and such ratification shall constitute the consent of the Contracting Officer required by this clause. The contract may be amended from time to time during the course of the contract to either add or delete personnel, as appropriate.

Incidental Payment Items The intent of the contract is to provide for the complete construction of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment for items shown.

Conformity with Drawings and Specifications Unless working tolerances are specified, all work performed and materials furnished shall be in reasonably close conformity with lines, grades, cross sections, dimensions, and material requirements shown on the drawings, indicated in the specifications, or designated on the ground. "Reasonably close conformity" is compliance with reasonable and customary manufacturing and construction tolerances.

Samples, Tests, Cited Specifications Reference made in the contract to specifications, standards, or test methods adopted by AASHTO, ASTM, GSA, or other recognized National technical associations, shall mean specifications, standards, or test methods (including interim or tentative issues) which are in effect on the date of the solicitation.

Camping Permit Compliance Contractor shall comply with all terms and conditions of any camping permit issued to allow use of premises. Any non-compliance will result in suspension of work until compliance is achieved.

Archaeological and Historic Sites Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC

433)--will be identified for the contractor before work commences.

Spill Plan If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of

660 gallons, the Contractor shall prepare and implement a Spill Prevention and Countermeasures (SPCC)

Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer. The Contractor under the direction of the Contracting Officer, or in the absence of said officer, acting independently, shall immediately take action to contain and clean up, without expense to the Government, all petroleum products spills on or in the vicinity of the project which are caused by the Contractor's employees directly or indirectly as a result of contract operations. The

Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and cleanup of petroleum products spills caused by Contractor's employees or resulting from contract operations. The

Contractor shall immediately report all petroleum products spills to the Contracting Officer.

Erosion Control Erosion Control Devices shall be installed and maintained through the duration of the contract. A

Erosion Control Plan shall be provided by the contractor, in accordance to the Clean Water Act, and the requirements outlined in the specifications and the drawings. The erosion control plan shall outline how pollution (i.e. construction debris, such as trash and soil) will be prevented from entering waterways in close proximity to the project.

Equipment Cleaning All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.

Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer at least five days in advance of moving equipment in so that arrangements can be made for inspection.

If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.

(a) Definitions. As used in this clause—

Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph © of this clause. Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the

Contractor shall represent its size status according to paragraph © of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts—

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall represent its size status in accordance with the size standard in effect at the time of this representation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. (d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor’s current status.
