Submission of Quotes There is no need to return any portion of the solicitation that is not part of a quote.

Submission of quotes by email is preferred, to svincent02@fs.fed.us.

Submission of quotes by fax of up to 20 pages is acceptable to 530-226-2474.

Quotes may be mailed or delivered to USDA FS NCASA (c/o SVincent) | 3644 Avtech Parkway | Redding, CA 96002.

SAM Entity Required to Receive Award SAM replaces and consolidates CCR (Central Contractor Registration), ORCA (Online Representations and Certifications) and other systems. Quoters must have a DUNS Number and an Active SAM Entity to receive award.

1. Quoters with an Active SAM Entity shall provide their DUNS Number.

2. Quoters without an Active SAM Entity shall fill out FAR Provision 52.212-3, Offeror Representations and Certifications - Commercial Items, and return it completed as part of the quote. The Provision has been provided in full-text in the Solicitation Provisions section. Quoters may submit quotes before SAM Entity Registration/ Activation is complete, but are advised that Activation takes 7-10 to process after registering and that the Government is not obligated to delay award while an Entity becomes Active.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims

C - Contract Documents

Description of Work

Scope of Contract

The services resulting from this quotation require performance of food handling and storage, menu preparation, kitchen set up and maintenance, meal preparation and cooking services for an 18 person Conservation Corps Crew performing trail maintenance/ rehabilitation/ construction work between April 17 and September 22, 2017. Dates are estimated and are subject to change based on crew availability.

Contract Time and Estimated Start Date

Contract time will be 115 work days with an estimated start date of April 17, 2017 and end date of End Date September 22, 2017. The Contractor is not expected to work Saturdays or Sundays unless an exception is made to accommodate a change of schedule. Schedule changes will be communicated to the Contractor as soon as possible. Additional work days beyond the 115 awarded may be added during Contract performance if Clause 52.217-8 is exercised or as mutually agreed between the Contractor and the Contracting Officer (CO). Due to the remote nature of the contract performance, the CO's agreement to additional days may be communicated to the Contractor via the COR, Inspector or pack crew.

Work during 2017 Federal Holidays shall occur as follows:

Monday, May 29 Memorial Day The Contractor will NOT be expected to work.

Tuesday, July 4 Independence Day The Contractor will be expected to work.

Monday, September 4 Labor Day The Contractor will be expected to work.

Location and Schedule

Backcountry camp sites will be established in the Trinity Alps Wilderness of the Shasta-Trinity National Forest. Throughout contract duration, camp will relocate at various times - roughly, between 2 to 4 times -to different locations in the Trinity Alps Wilderness where the CCC will be accomplishing work and requiring camp cook services. Only one camp will require services at any given time. Camp locations and dates are subject to change based on weather and project completion dates. Contractor will be expected to adhere to all wilderness laws and regulations while performing this contract. No motorized equipment may be used within designated Wilderness areas. Contractor will comply with all fire restrictions imposed by the Forest Service and will adjust operations accordingly.

Throughout the entire project timeframe, the Contractor is not required to stay in the wilderness during unpaid weekends. However, travel to and from worksites is the responsibility of the Contractor.

Technical Specifications

The Contractor prepares and serves two appetizing, well-balanced, hot, nutritious meals each workday.

Meat entrees will be provided with supplemental non-meat protein (vegetarian) dishes provided as requested. Sack lunches will be made by each crew member, but contractor is responsible for laying out all lunch items for preparation.

The Contractor shall have knowledge and experience cooking and baking in Dutch ovens, cooking over a fire, and cooking in the ground as this will be required for preparing meals for the crew. No motorized

Trinity Alps Backcountry Cook 2017 Page 14 of 42 equipment, including chainsaws and motorcycles, may be used within designated wilderness without expressed written authorization.

The Contractor plans menus, controls food supplies through weekly inventories and orders food based on projected needs after reconciling with supplies on hand. Food costs shall not exceed $1,500 per food order.

For planning purposes, CCC crew menus will start on Tuesday and end the following Monday. Contractor shall also plan weekend and holiday meals that will be prepared by crewmembers. Menus are subject to Government approval.

April 17 through April 20, the Contractor shall report to Hetch Hetchy camp in Yosemite NP to assist in cooking dinner.

-April 18 and 19: The Contractor shall participate in staff meetings and crew reviews throughout the day as well as participate in evening programs and activities to include the "Behind the Kitchen" crew cook meetings nightly.

-April 20: The Contractor will be expected to contribute to the group cleaning of area and travel to Weaverville.

April 24 through 26 are days wherein the Contractor shall be oriented, prepare camp kitchen supplies, create the first shopping list (to be submitted to the Government on 4/25/2017), shop for and pack supplies for the first trip into the backcountry. These preparations will be performed at the Forest Service barn in Weaverville, California.

April 27, the Contractor shall prepare the evening meal, and on April 28 the morning meal plus the provision of supplies for lunch, in Weaverville. Subsequent meals will be provided in the backcountry.

Once the crew and Contractor are in the backcountry, food will be supplied once a week by pack stock.

The Contractor will present the weekly inventory of supplies and the grocery list and menu to the Contracting Officer's Representative (COR), Inspector, or the Forest Service Mule Packer by noon on Monday of each week.

A majority of the time a Kitchen Patrol (KP) will be assigned to the contractor for assistance. Crew members will rotate into this role during the contract period. Contractor directs assigned helpers, if available, in the performance of sanitation, maintenance and food preparation duties. Contractor's operations shall comply with the Health and Safety Code Handbook; Chapter 50, Employee Safety, Security, and Health, Section 55, Temporary Camps (Attached - See Exhibit A).

Camps are drug, alcohol and weapon-free. No alcohol, drugs or firearms will be allowed in camp or around corps members. Failure to comply with this drug, alcohol and weapon -free environment will be cause for default of this contract.

Hours worked shall be those necessary to start a warming fire by 5:15 AM to coincide with the morning meal, provide sack lunch supplies by 5:30 AM, serve prepared breakfast at 6:00 AM, and dinner by 5:30 PM, each work day, unless otherwise agreed between the Contractor and the COR (Contracting Officer's Representative) or CO (Contracting Officer). The workweek shall be Monday through Friday including certain Federal Holidays as described elsewhere in the contract. While a day off will be given to crew members for each of these holidays, it may not occur upon the actual holiday. For CCC Crews, the workweek will be Monday through Friday.

The Contractor is expected to be present for the camp moves, and will be involved in set up of new camps, particularly the kitchen and food storage areas. Meal planning and food supplies shall be managed so that a minimum amount of food is relocated during camp moves.

Standard Menu Minimum Requirements

Standard menu items and minimum quantities to be available per person are listed below for each type of meal: i.e., hot breakfasts, sack lunches, hot dinners. The food shall meet or exceed the quality and quantity standards cited herein and shall be selected and cooked to minimize health hazards.

Hot Dinners

Hot dinners shall be prepared and served at the camps. Hot dinner menus shall include the items and minimum quantities identified below. Contractor may elect to serve an entrée such as lasagna or casseroles. However, these entrees must have a meat side dish which ensures meals attain the total minimum meat quantity standard cited below is attained. Dinners shall consist of the following standard menu requirements:

Whole/Full Muscle Meat: boneless beef or pork, 8 oz.; boneless poultry or fish, 10 oz.

Non-meat protein dish, 6 oz. of a non-meat substitute protein, such as BBQ beans, veggie patty, vegetarian hot dog, tofu, beans, soybean products, cottage cheese, eggs, or equivalent Vegetables - 4 oz.

Potatoes - 6 oz. or equivalent starch Bread - two 1-1.5 oz. slices Milk - 1 pint Dessert - 4 oz

Lunch

Contractor shall order lunch supplies in sufficient quantity, quality, and variety to provide crewmembers adequate lunches. The Contractor must make available, at a minimum, the ingredients necessary to make the following items:

Sanitation

The Contractor shall keep clean, sanitary kitchen at all times, providing a readily available supply of soap and hot water for washing, insuring that wash water container is filled each evening. The Contractor shall

Trinity Alps Backcountry Cook 2017 Page 16 of 42 store all food and foodstuffs in a sanitary manner, protected from weather, flies, and rodents. Food storage coolers are to be cleaned as they are emptied all food storage devices shall be sanitized and disinfected once a week at a minimum. The hot water heating container shall be cleaned each Thursday.

Maintenance

Contractor shall maintain the stoves, utensils, water filter system, and all other equipment in good working order.

Camp Environment

Backcountry camp crews are comprised of a Crew Supervisor, crewmembers varying in age from 18-24 and a Forest Service representative. The crewmembers come from diverse backgrounds, many from inner cities, with varied levels of education and work experience. Getting to know each other and learning to live together in a unique situation is a large part of the backcountry experience.

The role of the cook within the social environment is to help oversee the welfare and morale of the crew and to create a comfortable, positive atmosphere in the camp. The cook interacts with the crew on a daily basis, solicits feedback and suggestions from them (e.g., food likes/dislikes, allergies, special needs), and gives direction and tracks crewmember work accomplishments in camp. The cook participates in the weekly camp staff meetings, where issues are aired, and suggestions and praise are encouraged.

Camp locations are remote and the access by foot can be arduous, which can serve to give the cook an idea of the work the crews perform on a daily basis. The cook needs to instill a sense of respect in the camp, particularly in relation to diversity of background, opinion, etc. The presentation, quality, and quantity of food, as well as the cook's attitude, are integral to a successful backcountry experience.

In the Event of Fire Restrictions

In the likely event that fire restrictions are imposed during the term of the contract, water heating and waste disposal methods would need to be adjusted. Additional propane and a heavy-duty propane burner would be provided for heating water, and additional animal-proof containers would be provided for the temporary storage of garbage. A warming fire will not be required or allowed under fire restrictions.

Contractor-Furnished Components

Contractor shall furnish a sleeping bag, tent and all personal items needed to live in a backcountry camp.

Contractor shall furnish own transportation to and from trailheads. Contractor is responsible for walking into campsites and transporting all personal supplies after the initial trip into camp.

Access to the worksite is by foot. The Government will transport the Contractor's personal gear to the worksite. However, personal gear transported shall not be in excess of 150 pounds.

Government-Furnished Components

The Government will furnish all food, kitchen equipment and tent, stoves, cooking utensils, food storage (coolers and rodent-proof boxes) and sundries necessary to prepare and serve meals. The Contractor's meals shall be included as part of the food budget. If available, corps members will assist in kitchen cleanup duties. If no one is available from the crew, contractor shall be responsible for all cleanup and preparation of meals. The Government will purchase and deliver all food and miscellaneous items needed for the project. Contractor is responsible for loss, damage, or destruction of property provided by the Government.

Pre-Work Conference

Attendance at a pre-work conference to discuss the terms and conditions of the contract may be required after award. The conference shall be at a place and time agreeable to both parties.

Authorities

No Government personnel other than the CO, COR, and other officials as designated under this contract have authority. The Government is not responsible for costs incurred during the performance of work not covered under this contract or resulting from direction by non-authorized persons.

Proposed scope changes which alter contract time or cost may occur by mutual agreement between the Contractor and the Contracting Officer only. If the Contractor is given direction that is considered to be outside of the scope of the contract, the Contractor should advise the Contracting Officer.

Government Personnel

1) Contracting Officer (CO) - The Contracting Officer has full authority for the administration of the contract and will personally handle all matters beyond the authority of the COR. No other person is authorized to make changes to clauses, provisions, terms or requirements of the contract.

Mutual agreement between the CO and Contractor is required for changes of time or cost to commercial services contracts.

2) Contracting Officer's Representative (COR) - The COR is the on-site contract administrator for the Contracting Officer, whose duties and responsibilities include full authority for the day-to-day administration of the contract, except for matters pertaining to changes in contract price and time. A copy of the COR Designation Form, which lists tasks for which a COR has authority, shall be provided to the Contractor.

3) Inspector(s) - Inspectors may be designated by the COR who are responsible for checking the Contractor's compliance with the contract requirements. If any Inspectors are designated, a copy of each Inspector Designation Form will be provided to the Contractor.

Subcontracting

The Contractor shall request and receive approval from the Contracting Officer prior to entering into any subcontract arrangement. The Subcontractor shall have the required experience and be sufficiently equipped for the work. The written approval request shall include as a minimum:

a) The name, address and telephone number of the Subcontractor.

b) The date upon which the subcontract would be entered into and its duration.

c) A detailed description of the work to be subcontracted.

Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.

Contractor Submittals

The following submittals occur after contract award. Other submittals may be required after award as directed by the Government.

The Contractor shall submit weekly food inventory, grocery list and menu to the Government as described in the Technical Specifications section.

Invoicing and Payment Invoices shall be submitted monthly, bi-weekly or at another frequency as agreed to by the Government.

Use of the Invoice Processing Platform (IPP) is required for all invoices submitted for payment of services under this contract. Contractors must enroll at https://www.ipp.gov/ in order to submit invoices.

Contractors are encouraged to enroll in IPP as soon as possible after contract award to prevent payment delay. IPP Training for Contractors is available via Webinar and an IPP Help Desk is available by phone or email.

Due to the remote location of the performance of work under this contract, the Contractor may submit paper invoices to the pack team for delivery to the COR or other designated person. The Government will enter invoices into IPP on behalf of the Contractor. The paper invoice shall include an invoice number, the invoice creation date, contract number, Contractor's name, a listing of the service dates, and the total dollar amount invoiced.

Payment will be made by Electronic Funds Transfer (EFT) to the bank account specified in the Contractor's SAM Entity. An Active SAM Entity is required for payment by EFT.

Wage Determination

Wage Determination No. 95-0573, Revision 32, dated 1/5/2016, is applicable to this contract and is incorporated as an attachment. The full text of any Wage Determination may be accessed electronically at www.wdol.gov.

NOTE: Sole proprietors or owner-operators are not required to use WD rates, which apply to the payment of employees. A single cook is appropriate/ acceptable for this project.

(a) Definitions. As used in this provision-

Administrative merits determination means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

Arbitral award or decision means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. OSHA-approved State Plan, but only to the extent that the State agency is acting in its capacity as administrator of such plan. It does not include other Federal agencies which, in their capacity as contracting agencies, conduct investigations of potential labor law violations. The enforcement agencies associated with each labor law under E.O. 13673 are-

(1) Department of Labor Wage and Hour Division (WHD) for-

(i) The Fair Labor Standards Act;

(ii) The Migrant and Seasonal Agricultural Worker Protection Act;

(iii) 40 U.S.C. chapter 31, subchapter IV, formerly known as the Davis-Bacon Act;

(iv) 41 U.S.C. chapter 67, formerly known as the Service Contract Act;

(v) The Family and Medical Leave Act; and

(vi) E.O. 13658 of February 12, 2014 (Establishing a Minimum Wage for Contractors);

(2) Department of Labor Occupational Safety and Health Administration (OSHA) for-

(i) The Occupational Safety and Health Act of 1970; and

(ii) OSHA-approved State Plans;

(3) Department of Labor Office of Federal Contract Compliance Programs (OFCCP) for-

(i) Section 503 of the Rehabilitation Act of 1973;

(ii) The Vietnam Era Veterans' Readjustment Assistance Act of 1972 and the Vietnam Era Veterans' Readjustment Assistance Act of 1974; and

(iii) E.O. 11246 of September 24, 1965 (Equal Employment Opportunity);

(4) National Labor Relations Board (NLRB) for the National Labor Relations Act; and

(5) Equal Employment Opportunity Commission (EEOC) for-

(i) Title VII of the Civil Rights Act of 1964;

(ii) The Americans with Disabilities Act of 1990;

(iii) The Age Discrimination in Employment Act of 1967; and

(iv) Section 6(d) of the Fair Labor Standards Act (Equal Pay Act).

Forced or indentured child labor means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
