AG-9AC7-S-16-0119 Westside Scott River Site Prep by Mastication work. When necessary, the Government may require the Contractor to move such telephone lines, fences or improvements from one location to another. All roads and trails designated by the Forest Service as needed for fire protection shall be kept free of logs, brush, and debris resulting from Contractor operations.
Landscape Preservation
The Contractor shall give attention to the effect of contract operation upon the landscape, shall take care to maintain natural surroundings undamaged, and shall conduct the work at all times in compliance with the following requirements.
a. Prevention of the Landscape Defacement. The Contractor shall not remove, deface, injure, or destroy trees, shrubs, lawns, or other natural features or any other improvements in the work area unless specifically authorized by the Contracting Officer. Unless otherwise provided herein, the Contractor shall confine contract operations to within the areas designated in contract documents.
b. Protection of Streams, Lakes, and Reservoirs. The Contractor shall take sufficient precautions to prevent pollution of streams, lakes, small ponds, and reservoirs with fuels, oils, bitumens, calcium chloride, silt, or other harmful materials. Mechanical equipment shall not be operated in live streams without written approval of the Contracting Officer.
Endangered Species
The Government may direct the Contractor to discontinue task order operations in the event that listed or proposed threatened or endangered plants or animals protected under the Endangered Species Act of 1973, are discovered to be present in or adjacent to the project area. Actions taken under this paragraph shall be subject to the Stop-Work Order clause FAR 52.242-15.
Preservation of Historical and Archeological Resources
If, in connection with operations under this contract, the Contractor, subcontractors, or the employees of any of them, discovers, encounters or becomes aware of any objects or sites of cultural value on the project area, such as historical or prehistorical ruins, graves or grave markers, fossils, or artifacts, the Contractor shall immediately suspend all operations in the vicinity of the cultural value and shall notify the COR in writing of the findings. No objects of cultural resource value may be removed. Operations may resume at the discovery site upon receipt of written instructions. Actions taken under this paragraph shall be subject to the Stop-Work Order clause FAR 52.242-15.
MASTICATING TREES AND BRUSH
The Contractor shall masticate trees and brush as a site preparation treatment to remove wildfire killed or damaged trees and brush in conifer plantations in individual stands, meeting Quality Standards set forth in the PERFORMANCE REQUIREMENT SUMMARY and the Detailed Unit Information sheet.
When masticating, the following guidelines will apply:
1) The masticator will be operated on slopes of 45 percent or less.
Where slopes over 45% occur they will be traversed to access the more gentle slopes of less than 45%.
The machine will remain on the 45% slope and work the arm of the machine 30 feet into the greater then 45% area as far as they may reach;
2) Masticating equipment will operate when the soil is dry down to 10 inches (Wet Weather Operating Guidelines). To determine dry soil, form a ball by squeezing the soil sample firmly in the hand.
The soil is considered dry enough to begin operations if the sample cannot be molded into a ball or falls
Amendment One
TREATMENT UNIT – A contiguous work area with designated boundaries.
SUPPRESSED TREE - Any tree with less than 30% of its total height in live green crown or with less than 3 inches of current leader growth.
CROWN RATIO - That portion of the tree bole that supports green live foliage that is effectively contributing to tree growth, expressed as a percentage of the total length of the bole.
PROJECT ACTIVITY LEVEL (PAL) – Established work restrictions and fire precautions that the Contractor must observe at each activity level. Limitations or requirements of Project Activity Level (PAL) obtained from Forest Service before starting work each day. If practicable, Forest Service will determine the following day’s activity level by 4:00 p.m. each afternoon (Phone # 530-841-4588). Activity level may be changed at any time if, in the judgment of the Forest Service, fire danger is higher or lower than predicted and such change is consistent with forest management objectives. The decision to change the activity level, and when, and how to take weather observations for that purpose, are within the discretion of Forest Service.

12. Restrictions on work
Work may be performed at an time during the period of the contract except as determined by the COR and/or as stated below:

(10) days unless cancelled sooner or extended by the Contracting Officer for an additional ten (10) days.
Variance approval can be withdrawn at the sole discretion of the Forest Service. Variance approval is contingent on the 7-day fire weather forecast, fuel conditions, site characteristics, current fire situation, state of Contractor’s equipment for prevention and suppression readiness, type of operation and social and community considerations etc. (See attached Project Activity Level Variance Agreement).
Level Project Activity Minimum Requirements and Restrictions. Restrictions at each level are cumulative.
E The following activities may operate all day:
1. Loading and hauling logs decked at approved landings.
2. Loading and hauling chips stockpiled at approved landings.
3. Servicing Equipment at approved sites.
4. Dust abatement, road maintenance (chainsaw use prohibited) or loading stock piles and rock aggregate installation (does not include pit or quarry development).
5. Chainsaw operation associated with loading at approved landings.
All other activities are prohibited.
This Project utilizes “The Project Activity Level” (PAL), an industrial operation’s fire precaution system. The following Climatology Chart indicates the Historic Activity Levels for the Project Fire Danger Rating Area or Fire Weather Station utilized on this Project. This is only a historical average of the Activity Levels for the identified Fire Danger Rating Area or Weather Station.
