52.217-5 EVALUATION OF OPTIONS (JULY 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

52.217-6 OPTION FOR INCREASED QUANTITY (MAR 1989)

The Government may increase the quantity of acreage called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor by August 31, 2015 for Item 2. Performance shall continue at the same rate as the like base items called for under the contract, unless the parties otherwise agree.

RESPONSE REQUIRED TO BE CONSIDERED FOR AWARD

SAM (System for Award Management) Entity SAM replaces and consolidates CCR (Central Contractor Registration), ORCA (Online Representations and Certifications) and other systems. Quoters must have a DUNS Number and an Active SAM Entity to receive award.

ADDENDUM TO FAR 52.212-5

Inspection of Services (FAR 52.246-4) (Aug 1996)

a) Definition: “Services” as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections and tests in a manner that will not unduly delay the work.

d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

e) If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the Government may—

1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

2) Reduce the contract price to reflect the reduced value of the services performed.

f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may—

1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or

2) Terminate the contract for default.

The contract area is within the Hat Creeek Ranger District, Bear Wallow Project Area on the Lassen National Forest. The Contractor shall furnish all technical expertise, labor, equipment, supervision, transportation, operating supplies (unless specified elsewhere as Government furnished), and incidentals necessary to complete the project including quality control, in compliance with the terms, specifications and requirements of this contract

This contract includes the requirement for the use biobased products when applicable and available. The following are a list of categories for biopreferred products required for the performance of this service contract: Equipment Lubricants, Hydraulic Fuels, Fuel Additives, and Engine Oils. Information about the Department of Agriculture Biobased Program is available at http://www.biopreferred.gov.

PROJECT LOCATIONS AND BOUNDARIES

Location: The project is located on the Hat Creek Ranger Districts, Lassen National Forest, in Shasta County, California. The legal description for the project area is as follows: T.32N R.4E Sec.3, 4, 8 and 9.

Boundaries: The boundaries of all work units are marked with white with blue polka dot along roads and unit boundaries, the corners of units are marked with a combination of white with blue polka dot and orange flagging. If the boundaries or non-work areas are to be marked in a different manner, the Government shall inform the Contractor.

Accessibility: Approximately 3 miles west of the town of Old Station, Ca. take forest road 34n78 off of State Highway 44/89 for 1/4 of a mile and turn left onto forest road 32n16 (Bear Wallow Road). Take forest road 32n54y north to units 6, 7, and 9. Units 1, 2, and 10 meet at the intersection of 32n16 and the 32n86Y roads. (See attached maps)

Maps: The maps are intended to show only the general size, shape, and location of the unit and area.

The locations on the Project Map are approximate and the locations on the ground take precedence over the locations on the Project Map. If the maps conflict with the field marking the field markings shall govern. Positions of features are approximate.

SPECIFIC WORK REQUIREMENTS

Piling Prescription and Work Methods The Contractor shall mechanically pile materials to meet management objectives as described below.

The technical specifications are based on the overall composition and condition of the stand, and are intended as a guideline to achieve a high quality final product in a professional manner.

Damaged trees that were damaged prior to contract operations and exist in those areas determined as inoperable shall not require treatment. Loose uprooted root wads shall be considered slash and treated accordingly http://www.biopreferred.gov/

All brush shall be piled to facilitate fuel reduction measures as described below: Any area greater than 1/2 acre in size a minimum of 90 percent of all brush over 2ft. tall will be piled. In "brush fields” 80% of the brush shall be piled.

All damaged trees under 10 inches D.B.H. shall be cut not more than 6 inches above the ground and piled. Damaged trees that were damaged prior to contract operations and exist in those areas determined as inoperable shall not require treatment.

A fire line shall be constructed around each pile. Fire lines shall consist of an area cleared of all fuels and at least 3 feet wide around each pile.

During piling operations in confined areas where pieces of slash are so long that undue damage to residual trees would occur, those pieces of slash shall be bucked to no longer than 12 feet in length prior to piling.

Piles shall be compact, free of dirt not exceeding 20 feet x 20 feet in width. Slash within the pile extending more than 3 feet from the edge of the pile shall be bucked and placed in the pile. Piles shall be built outside of the drip line of leave trees whenever possible.

Where logs occur in piling areas and are situated in such a way as to hamper piling operations, Contractors shall be required to cut, push, skid or otherwise manipulate those logs to facilitate piling. Any logs cut shall not exceed 12 feet in length and no more than 12 feet in heighth once piled. If during these operations portions of the log break into pieces of fuel that meet slash specifications they shall be treated accordingly.

No pile shall be built within 25 feet of any Forest Service road.

The Contractor or his employees shall not damage any residual trees.

Waterbars in skid trails, fire lines, and spur roads disturbed or damaged by the contractor shall be reconstructed by the contractor. Any roads opened by contractor shall closed after piling operations.

To avoid erosion, soil compaction, or damage to residual stands, the Forest Service may suspend operations in whole or in part for inclement weather periods as necessary until conditions exist where damage shall not occur.

Planted trees shall take precedence over natural trees.

Equipment Specifications - All mechanical equipment proposed for use on this contract shall be in good operating condition and meet the following specifications:

1) Excavator with Brush Grapple

2) Weight shall not exceed 30 tons gross.

3) Machine width shall not exceed 12 feet

4) Conform to all applicable state laws for industrial operations.

5) Pivot operator cab, engine, and attachment arm shall be able to rotate 360 degrees while the working base remains stationary.

6) Climbing/working ability up to 35 % slope

7) Capable of moving within stands without damaging leave trees

8) Machine shall be equipped with a brush grapple capable of grasping material to be piled. This implement must also be capable of uprooting brush by pulling or scraping with minimal soil disturbance.

9) Attachment arm (boom) shall have a minimum reach of 25 feet.

10) Non-leaking fluid systems

11) Equipment meets or exceeds OSHA specifications.

12) Auxiliary Equipment:

The following auxiliary equipment is a minimum requirement for machine piling operations. Other auxiliary equipment may be attached as long as equipment meets requirements under Items 1-5 above.

13) Approved Roll Over Protection System (R.O.P.S.) or Safety Canopy complying with O.S.H.A.

standards. R .O.P.S. must be maintained at its designed level of effectiveness.

General Requirements

1) Contractor shall exercise extreme care to prevent damage to leave-trees and shall protect residual trees from damage and scarring as a result of contract operations

2) Equipment shall not operate on slopes greater than 35%.

3) Machine operations shall be conducted in such a manner as to minimize additional soil disturbance or compaction.

4) Refueling, maintenance, and repair shall be done at landings or forest roads where practicable.

5) Equipment shall not cross or operate in meadows, stream course protection, archeological sites, trails, land improvements, Habitat Conservation or other non-work areas without approval of the COR.

6) Contractor shall avoid operating equipment when soil conditions are such that excessive damage will result. If soil moisture levels, due to adverse or unusual weather conditions, are causing excess resource damage or ruts as determined by the Forest Service. Contractor may need to construction erosion control structures and maintain the structures to protect the area.

Prior to suspending operations for a season all relevant erosion control work shall be completed. This work includes but is not limited to smoothing landings, removing ruts from roads, construct cross ditches, water bars or water-spreading ditches on landings, skid trails and roads.

7) Contractor shall exercise extreme care to prevent damage to all physical improvements (fences, telephone lines, established land corners, buildings, ditches, etc.) within the contract area. Contractor shall be liable for damage to physical improvements and shall make immediate repairs to damaged physical improvements at no additional cost to the Government.

8) All roads and trails designated by the Government as needed for fire protection shall at all times be kept free of logs, brush and debris resulting from Contractor’s operations.

9) Other open roads shall be kept free of piling debris. This includes road surfaces, cut banks, roadside ditches, and culverts.

10) Contractor shall notify the COR when a unit is complete before moving out of the general area.

Traffic Control - All equipment shall be contained within the project boundary. When Contractor’s operation are in progress adjacent to or on Forest Service controlled roads and trails open to public travel, Contractor shall furnish, install and maintain all temporary traffic controls which provide the road user with adequate warning of hazardous or potentially hazardous conditions associated with Contractor’s operations. Devices shall be specified as in the “Manual on Uniform Traffic Control Devices for Street and Highway” (MUTCD). Devices shall be appropriate to current conditions and covered or removed when not needed.

Contractor shall be responsible to clear overhanging or fallen trees and snags across roads accessing the project area and keep roads free of activity debris.

NON-Treatment Areas- These areas are in consideration of wildlife habitat, utilities, archeological sites, trails, land improvements, stream course protection, and/or areas with excessive rock or steep ground. Said areas that are one acre in size or larger or a substantial amount of smaller areas within a work stand, will be deducted from the contract acreage and no payment will be made for these acres.

Should unworkable areas be encountered, that have not been delineated by the Forest Service, the contractor shall notify the COR.
