SAM (System for Award Management) Entity
SAM replaces and consolidates CCR (Central Contractor Registration), ORCA (Online Representations and Certifications) and other systems. Quoters must have a DUNS Number and an Active SAM Entity to receive award.
1. Quoters WITH an Active SAM Entity shall provide their DUNS Number.
2. Quoters WITHOUT an Active SAM Entity SHALL:
a. Fill out FAR Provision 52.212-3, Offeror Representations and Certifications – Commercial Items, and return it completed as part of the quote. The Provision has been provided in full-text in the Solicitation Provisions section.
b. Quoters may submit offers before SAM Entity Registration/Activation is complete, but are advised that Activation may take 7-10 days to process after Registering and award may follow as soon as one day after the Solicitation closes. Quoters without an Active SAM Entity registration cannot receive award and will be bypassed in award decision..

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections and tests in a manner that will not unduly delay the work.
d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
e) If any of the services do not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the Government may—
1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
2) Reduce the contract price to reflect the reduced value of the services performed.
f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may—
1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
2) Terminate the contract for default.

CONTRACT DOCUMENTS, EXHIBITS AND ATTACHMENTS
5. INTRODUCTION AND BACKGROUND
The Lassen National Forest intends to secure services to mechanically alter, with mastication type equipment, ground and ladder fuels by reducing tree densities within the plantation and grinding live brush along with slash and down woody debris.
The contract area is within the Cypress Plantation Project Area on the Lassen National Forest. The Contractor shall furnish all technical expertise, labor, equipment, supervision, transportation, operating supplies (unless specified elsewhere as Government furnished), and incidentals necessary to complete the project including quality control, in compliance with the terms, specifications and requirements of this contract
The current condition of the mastication unit is 250 to 300 plantation trees per arce over most of the project area with some areas being lighter and a few areas that are heavier with a very heavy componite of six to eigh foot tall Manzanita and Snow brush with some rocky areas . The desired outcome from this contract is to reach the following objectives:
(1) Utilize Mastication to reduce inter-tree competition for moisture, nutrients and light in densely stocked Plantations;
(2) Maximize individual tree growth and vigor;
(3) Reduce the threat of major insect attack; and
(4) Re-arrange ladder fuels to reduce the potential for an extreme wildfire.
This contract includes the requirement for the use biobased products when applicable and available. The following are a list of categories for biopreferred products required for the performance of this service contract:
Equipment Lubricants, Hydraulic Fuels, Fuel Additives, and Engine Oils. Information about the Department of Agriculture Biobased Program is available at http://www.biopreferred.gov.
6. PROJECT LOCATIONS AND BOUNDARIES
Location: The project is located on the Hat Creek Ranger Districts, Lassen National Forest, in Shasta County, California. The legal description for the project area is as follows: T.34N R.3E Sec.26, 27, 34 and 35. The project areas known as unit 5 and is approximately 591.1 acres.
Boundaries: The boundaries of all work units not along roads are marked with a Pink paint stripe at Diameter Breast Height (DBH) with a pink butt mark at ground level, facing into the work unit with blue flagging. If the boundaries or non-work areas are to be marked in a different manner, the Government shall inform the Contractor.
Accessibility: The work units may be accessed from Hwy 89 to Forest road 34N19 (26 Road) to Forest road 34N60 and 34N96. (See attached maps)
Maps: The maps are intended to show only the general size, shape, and location of the unit and area. The locations on the Project Map are approximate and the locations on the ground take precedence over the locations on the Project Map. If the maps conflict with the field marking the field markings shall govern. Positions of features are approximate.
7. SPECIFIC WORK REQUIREMENTS
Mastication Prescription and Work Methods The Contractor shall mechanically masticate trees to meet management objectives as described below. The technical specifications are based on the overall composition and condition of the stand, and are intended as a guidelines to achieve a high quality final product in a professional manner. Contractor shall use silvicultural knowledge to identify and adjust to variations within the stand.
A. Contractor shall always leave Baker Cypress and disregard them for spacing purposes (no Baker Cypress shall be masticated in this project.
B. Contractor shall leave all Conifers that are larger than 10 inch DBH and shall include these trees for spacing purposes.

C. Contractor shall select additional leave-trees from those live conifers at least 24” tall and up to the maximum cut DBH, to achieve average spacing of 20’ x 20’
a. Leave-trees shall be the healthiest, most vigourous, and best-formed trees of the preferred species in the stand, as evidenced by the tallest height, largest crowns and crown ratios, straightest stems, and the least amount of damage or disease.
b. The leave-tree spacing is an average and may be varied up to 25% (wider or tighter) to leave the most superior individual crop trees. It is more important to leave the best trees, than to have uniform spacing. Averaged over the stand, leave tree spacing shall not be materially increased or decreased.
c. Leave trees shall be selected within the order of species preference as listed below in paragraph D. This order of preference only applies if the trees are free of damage or defect. In most cases tree vigor will help the Contractor determine which trees will best inhabit the site.
d. Planted trees shall take precedence over natural trees.
e. No Lodgepole Pine shall be selected as a leave tree.
f. Where undamaged trees are not available, select leave-trees with the least amount of damage.
D. Selection of leave trees shall be made in following priority order: 1. Sequoia, 2. Sugar Pine, 3.
Douglas Fir, 4. Incence Cedar 5. Ponderosa/Jeffery Pine 6. White Fir.
E. All other live trees not left as leave trees shall be masticated from top down to maximum stump heightn of 6 inches above ground (this includes precommercial sized conifer trees 2.0 inches dbh to
9.9 inches dbh.
F. All other undesiresable vegetation and debris including dead trees (maximum dbh of 9.9 inches) shall be masticated to a maximum height of 6 inches above ground. .
G. Trees shall be completely severed from the stump. Trees shall be cut below the lowest live limb, except when prevented by obstacles. Stump height shall not exceed 6 inches above ground level except when prevented by natural obstacles, in which case stump height shall not exceed 4 inches above the natural obstacle.
H. No masticated piece shall be longer that four feet in length and all limbs shall be masticated off the top side of the bole of the tree.
Equipment Specifications - All mechanical equipment proposed for use on this contract shall be in good operating condition and meet the following specifications:
1) Climbing/working ability up to 35 % slope
2) Capable of moving within stands without damaging leave trees
3) Ability to masticate a standing tree from top down
4) Operator cab, engine, and arm shall be able to rotate 360 degrees
5) Non-leaking fluid systems
6) Equipment meets or exceeds OSHA specifications.
General Requirements
1) Contractor shall exercise extreme care to prevent damage to leave-trees and shall protect residual trees from damage and scarring as a result of contract operations
2) Equipment shall not operate on slopes greater than 35%.
3) Machine operations shall be conducted in such a manner as to minimize additional soil disturbance or compaction.
4) Refueling, maintenance, and repair shall be done at landings or forest roads where practicable.

5) Equipment shall not cross or operate in meadows, stream course protection, archeological sites, trails, land improvements, Habitat Conservation or other non-work areas without approval of the
COR.
6) Contractor shall avoid operating equipment when soil conditions are such that excessive damage will result. If soil moisture levels, due to adverse or unusual weather conditions, are causing excess resource damage or ruts as determined by the Forest Service. Contractor may need to construction erosion control structures and maintain the structures to protect the area. Prior to suspending operations for a season all relevant erosion control work shall be completed. This work includes but is not limited to smoothing landings, removing ruts from roads, construct cross ditches, water bars or water-spreading ditches on landings, skid trails and roads.
7) Contractor shall exercise extreme care to prevent damage to all physical improvements (fences, telephone lines, established land corners, buildings, ditches, etc.) within the contract area. Contractor shall be liable for damage to physical improvements and shall make immediate repairs to damaged physical improvements at no additional cost to the Government.
8) All roads and trails designated by the Government as needed for fire protection shall at all times be kept free of logs, brush and debris resulting from Contractor’s operations.
9) Other open roads shall be kept free of mastication operations or piling debris. This includes road surfaces, cut banks, roadside ditches, and culverts.
10) Contractor shall notify the COR when a unit is complete before moving out of the general area.
Traffic Control - All equipment shall be contained within the project boundary. When Contractor’s operation are in progress adjacent to or on Forest Service controlled roads and trails open to public travel, Contractor shall furnish, install and maintain all temporary traffic controls which provide the road user with adequate warning of hazardous or potentially hazardous conditions associated with Contractor’s operations. Devices shall be specified as in the “Manual on Uniform Traffic Control Devices for Street and Highway” (MUTCD). Devices shall be appropriate to current conditions and covered or removed when not needed.
Contractor shall be responsible to clear overhanging or fallen trees and snags across roads accessing the project area and keep roads free of activity debris.
8. NON-TREATMENT AREAS
These areas may be excluded from treatment for consideration of wildlife habitat, utilities, archeological sites, trails, land improvements, stream course protection, and/or areas with excessive rock or steep ground or areas inoperable due to the average tree diameter being greater than 10 inches DBH (such as areas where equipment cannot operate and masticate brush between 10 inch trees). If such areas are one acre in size or larger or a substantial amount of smaller areas within a work stand, then the area will be deducted from the contract acreage and no payment will be made for these acres. Should unworkable areas be encountered, that have not been delineated by the Forest Service, the contractor shall notify the COR, as soon as possible.
9. DEFINITIONS
a) Average Tree Spacing - The distance in feet between leave trees as defined in specifications.
b) Contracting Officer - The person executing this contract on behalf of the Government, including any duly appointed successor and authorized representative of the Contracting Officer acting within the limits of his authority.
c) Contracting Officer's Representative - the COR is the on-site Contract Administrator for the Contracting Officer. The duties and responsibilities of a COR are defined in the letter of designation issued by the Contracting Officer.
d) Cut Trees - Trees within the minimum-maximum cut range as defined in the specifications that are not selected as leave tree.
e) DBH (Diameter Breast Height) - Outside diameter of the tree stem at a point 4-1/2 feet above uphill side of the tree.
f) Excess Trees - Any remaining tree that should have been cut as determined by inspection.
g) Healthy Tree - A healthy tree is one that is undamaged due to defects or deformity resulting from agents such as wind, snow, animals, insects, diseases, or equipment.
