SAM (System for Award Management) Entity
SAM replaces and consolidates CCR (Central Contractor Registration), ORCA (Online Representations and Certifications) and other systems. Offerors must have a DUNS Number and an Active SAM Entity to receive award.

FAR 52.222-99 ESTABLISHING A MINIMUM WAGE FOR CONTRACTORS (DEVIATION 2014-
0001) (OCT 2014)
This clause implements Executive Order 13658, Establishing a Minimum Wage for Contractors, dated
February 12, 2014, and OMB Policy Memorandum M-14-09, Implementation of the President’s
Executive Order Establishing a Minimum Wage for Contractors, dated June 12, 2014.
(a) Each service employee, laborer, or mechanic employed in the United States (the 50 states and the
District of Columbia) in the performance of this contract by the prime Contractor or any subcontractor, regardless of any contractual relationship which may be alleged to exist between the Contractor and service employee, laborer, or mechanic, shall be paid not less than the applicable minimum wage under
Executive Order 13658. The minimum wage required to be paid to each service employee, laborer, or mechanic performing work on this contract between January 1, 2015, and December 31, 2015, shall be
$10.10 per hour.
(b) The Contractor shall adjust the minimum wage paid under this contract each time the Secretary of
Labor’s annual determination of the applicable minimum wage under section 2(a)(ii) of Executive Order
13658 results in a higher minimum wage. Adjustments to the Executive Order minimum wage under section 2(a)(ii) of Executive Order 13658 will be effective for all service employees, laborers, or mechanics subject to the Executive Order beginning January 1 of the following year. The Secretary of
Labor will publish annual determinations in the Federal Register no later than 90 days before such new wage is to take effect. The Secretary will also publish the applicable minimum wage on www.wdol.gov
(or any successor website). The applicable published minimum wage is incorporated by reference into this contract.
(c) The Contracting Officer will adjust the contract price or contract unit price under this clause only for the increase in labor costs resulting from the annual inflation increases in the Executive Order 13658 minimum wage beginning on January 1, 2016. The Contracting Officer shall consider documentation as to the specific costs and workers impacted in determining the amount of the adjustment.
(d) The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (c) of this clause, and will not provide price adjustments under this clause that result in duplicate price adjustments with the respective clause of this contract implementing the
Service Contract Labor Standards statute (formerly known as the Service Contract Act) or the Wage
Rate Requirements (Construction) statute (formerly known as the Davis Bacon Act).
(e) The Contractor shall include the substance of this clause, including this paragraph (e) in all subcontracts.

Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.
c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections and tests in a manner that will not unduly delay the work.
d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.
e) If any of the services do not conform to contract requirements, the Government may require the
Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the
Government may—
1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and
2) Reduce the contract price to reflect the reduced value of the services performed.
f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may—
1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or
2) Terminate the contract for default.

AGAR 452.236-74 CONTROL OF EROSION, SEDIMENTATION, AND POLLUTION (NOV 1996)
A. Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).
B. Pollutants such as fuels, lubricants, bitumen’s, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.
C. Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.
ON-SITE REPRESENTATIVE
Before work starts, the Contractor shall designate in writing, a representative to act for the contractor during his absence. The Contractor’s representative shall read and speak fluent English.
The Contractor shall list the extent of authority the designated representative will have on the job.
The Contractor or acting authorized Representative shall receive orders from the COR/Inspector as required to keep the job in progress and adherence to technical specifications, as needed, to finish the job.
CAMPING
There shall be no camping on National Forest lands in execution of this contract.
CONTRACT DOCUMENTS, EXHIBITS AND ATTACHMENTS
1. DESCRIPTION OF WORK:
The purpose of this contract is to secure services for performing timber stand improvement on national forest land, by means of Chainsaw thinning and piling of conifer trees, dead brush and surface fuels.
223.4 total acres within 3 treatment units. Contractor shall, considering the specific tasks and critical subtasks involved, develop a plan of operations to accomplish the tasks and critical subtasks, and organize and direct all of the operations and personnel needed to fully accomplish the work. The
Contractor shall furnish all technical expertise, labor, equipment, supervision, transportation, operating supplies, and incidentals necessary to complete the project, except for that which the contract clearly states is to be furnished by the Government.
2. DESCRIPTION/ACCESS
The project is located on the Hat Creek Ranger Districts, Lassen National Forest, and Shasta County, California. The legal for the project is as follows: T.32N. R.3E. Sec. 6, 7,8,17 and 18. The project area is 223.4 acres. Road access is primarily dirt surfaced roads. The locations on the Project Map are approximate and the locations on the ground take precedence over the locations on the Project
Map.
Boundaries:
The boundaries of all work units not along roads are marked with a Pink paint stripe at
Diameter Breast Height (DBH) with a pink butt mark at ground level, facing into the work unit with blue flagging. Should the boundaries or non-work areas be marked in a different manner, the Contractor shall be informed so by the COR.
Accessibility:
The work units may be accessed from HWY 89 to Clarks Creek Road to Forest Road 36N15 and 36N14 and 36N14C. Road access is primarily dirt surfaced roads. Note: snow, rain, ice, or wet roads may limit vehicle access during fall and winter months See maps (Separate
Attachment) for location of unit.
Maps
The maps are intended to show only the general size, shape, and location of the areas. If the maps conflict with the field marking the field markings shall govern. Positions of features are approximate.
3. SPECIFIC WORK REQUIREMENTS
Conifer thinning or removal shall consist of selecting leave trees with consideration for health, vigor and spacing and cutting all other trees less than 10 inches DBH on a 20 x20 spacing with a 25% variance in spacing to allow for the best crop tree selection. Thinning, removal, and burn pile location shall be done in a manner that does not damage the leave trees. All dead brush ¾ of an inch or larger shall be cut and piled.
Selection of Leave Trees:
Select leave trees from healthy conifers as necessary to achieve the average spacing. Leave all conifers larger than 10” DBH. Leave all Black Oak trees. Leave any tree if there is no other tree within 20 feet.
1) If selection criteria for two adjacent trees are equal, leave trees in the following order:
(1) Sugar Pine.
(2) Douglas-fir.
(3) Ponderosa/Jeffrey pine.
(4) Incense Cedar.
(5) White fir.
The cut-tree selection order is as follows:
1. All suppressed and intermediate crown position trees.
2. All trees with less than a 50% crown ratio, including those trees with crowns on only one side of the bowl.
3. All trees exhibiting disease or damage from disease, i.e. mistletoe infections.
4. All trees with broken or dead tops.
5. All leaning trees.
6. All butt and/or bole scared white fir.
7. All junipers regardless of size will be cut.
8. All live large trees (trees equal to or greater than 10.0 DBH) unless otherwise designated by the
Forest Service shall be left undamaged.
9. All leave trees shall be pruned to shoulder height. This will be done to reduce the area ladder fuels.
This will also be conducted without scarring the tree bole.
10. No Blaze Tree Shall Be Cut. These trees shall be left regardless of spacing. This will be considered by the COR as well as Contract Inspectors.
Tree Felling:
All trees shall be felled into the treatment units, and away from identified control areas or property lines.
Stump height shall not exceed 4 inches measured from the ground on the uphill side, or 4 inches above natural obstacles (boulders, wildlife logs, etc.). All live limbs below the cutting point shall be severed from the stump. Stumps shall be cut flat or with a minimal angle to avoid creating a sharp stump. No felled material shall lean against or be suspended by a leave tree.
Brush Cutting:
All dead brush down to ¾ of an inch in diameter shall be cut and piled. Unless a designated island has been marked and/or identified by COR or Agency Rep. If designated after work has started the area will be considered as cut and will be paid as such. Brush shall be cut to within 4 inches of the ground or any obstacle. Remaining stems shall be cut flat as to prevent any type of sharp edges.
Slash and Cut Brush Treatment:
All cut material, existing dead/down slash, and cut brush shall be hand piled to the following standards:
1. All felled trees, limbs, and cut brush will be bucked and piled.
2. All piles consisting of mainly brush shall be compacted as much as possible by hand.
3. All existing down dead slash within a range of 3 – 12 inches in diameter at its largest point will be bucked and piled.
4. No piles will be placed within 10 feet of dry creek beds.
5. No piles will be placed within 10 feet of control areas.
6. No piles will be placed within 10 feet of standing snags
7. No piles will be placed within 10 feet of remaining downed logs greater than 20 inched in diameter.
8. No piles will be placed within 20 feet of the private property boundaries.
9. Piles will be located outside the drip line of leave trees whenever possible.
10. Minimum acceptable size of pile will be 4 feet by 4 feet.
11. Maximum pile height will be 6 feet and maximum diameter will be 10 feet.
12. No material will protrude more than 3 feet outside the pile.
13. Each pile shall be covered by enough plastic or comparable material placed in the upper third and top of the pile to cover at least 60% of that pile. Cover material will be sufficiently anchored with slash or brush so that it will not blow off in high winds.
14. Piles will be constructed with boles and limbs laid parallel to slope to reduce roll-out and to maintain pile compactness.
15. All piles will be somewhat uniform in size and shape.
16. When possible cut brush should be piled with larger woody material, but extra transporting of cut material is not necessary to meet this…
