SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
DESCRIPTION OF WORK
Furnish all material, equipment, transportation, labor, and supervision necessary to produce and haul approximately 1300 CY of crushed aggregate base course (ABC) to various locations with the Gila National Forest (see attached maps). The crushed ABC shall have a maximum aggregate size of ¾” and shall meet the specifications (hardness, gradation, etc.) of at least one of the local county (Apache, Greenlee, Catron, Grant, etc.) or state (NMDOT or ADOT) governing authorities. Delivery and acceptance of ABC shall be coordinated with the Forest Service heavy equipment operators who will be processing the crushed ABC as it is delivered. Payment will be based on certified weight tickets.

See maps for site locations. Crushed Aggregate Base Course will be needed on National Forest System Roads (NFSR) 49 (35 CY), NFSR 94 (1165 CY) and the Luna Administrative Information Site (100 CY).
Luna Administrative Site: From Luna, New Mexico, take Catron County Road B-003 to its junction with NFSR 366A. Turn left (north) onto NFSR 366A and continue for 0.25 miles to Luna Administrative Information Site (100 CY).
NFSR 49: From Reserve, New Mexico, take NM State Highway 12 north for approximately 5.2 miles to its junction with Catron County Road B-013. Turn north onto B-013 and continue 0.5 miles to its junction with NFSR 49. Turn right onto NFSR 49 and continue for 0.2 miles to the site (35 CY).
NFSR 94: From Reserve, New Mexico, take NM State Highway 12 north for approximately 12.1 miles to its junction with NFSR 94. Turn south onto NFSR 94 and continue:
16.6 miles to site 1 (~135 CY) Then 1.1 miles to site 2 (~90 CY) Then 0.8 miles to site 3 (~90 CY) Then 1.3 miles to site 4 (~550 CY) Then 0.4 miles to site 5 (~175 CY) Then 0.3 miles to site 6 (~125 CY) (1165 CY total to cover all six sites).

Work shall include, but not be limited to the following codes and standards where applicable:

FINAL SUBMITTALS
Contractor shall provide submittal of crushed ABC confirming it meets specifications of a local governing authority in accordance with section 106 FP-03. Contractor shall also provide documentation that weight scales have been certified (see section 109 FP-03).
SCHEDULE AND PAYMENT
SCHEDULE
A written schedule of work shall be required of the CONTRACTOR. The schedule will be discussed at the pre-work conference. Changes due to unforeseen weather conditions or situations will be allowed under the condition that the CONTRACTING OFFICER’S REPRESENTATIVE (COR) is given a prior notice of the deviation, and approved by the CONTRACTING OFFICER.
Work shall begin within 10 days of Notice to Proceed and completed within 30 days of Notice to Proceed.
PAYMENT
Payment shall be considered full compensation for all office and field services and materials required to complete the job. It will include all miscellaneous work that is required to complete the work. Net certified scale weights will be used as a basis of measurement. Ton is based on short ton consisting of 2000 pounds.
INSPECTION AND ACCEPTANCE
Work not completed to the standards outlined in the specifications shall be rejected and redone at the CONTRACTOR's expense.
The contractor is responsible for performing inspection services pursuant to the inspection clause and for providing and maintaining inspection records.
The government, through its COR, will be monitoring the contractor’s performance on a continuous basis. The method the government will use is random inspection of the contractor’s inspection results. The government COR will perform periodic independent inspections after the contractor has performed their inspection if questions develop regarding the results of the contractor’s inspections. Results of the independent inspections that differ from the results noted by the contractor on their inspections, the costs thereof for the re-inspection costs will be assessed against the contractor. The contractor shall be required to rework the effort until the performance standard is achieved and the added costs of re-inspection charged to the contractor.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. FAR 52.212-2 -- Evaluation -- Commercial Items (Jan 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
PRICE AND PROPOSED DELIVERY
[Contracting Officer shall insert the significant evaluation factors, such as(i) technical capability of the item offered to meet the Government requirement; (ii) price;(iii) past performance (see FAR 15.304); (iv) small disadvantaged business participation; and include them in the relative order of importance of the evaluation factors, such as in descending order of importance.] Technical and past performance, when combined, are [Contracting Officer state, in accordance with FAR 15.304, the relative importance of all other evaluation factors, when combined, when compared to price.]
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) ) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.
(b)(1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph (d) of this provision applies.

52.204-16 COMMERCIAL AND GOVERNMENT ENTITY CODE REPORTING (NOV 2014)
(a) Definition. As used in this provision – “Commercial and Government Entity (CAGE) code” means –
(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Contractor and Government Entity (CAGE) Branch to identify a commercial or Government entity; or
(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Contractor and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as an NCAGE code.
(b) The Offeror shall enter its CAGE code in its offer with its name and address or otherwise include it prominently in its proposal. The CAGE code entered must be for that name and address. Enter “CAGE” before the number. The CAGE code is required prior to award.
(c) CAGE codes may be obtained via–
(1) Registration in the System for Award Management (SAM) at www.sam.gov. If the Offeror is located in the United States or its outlying areas and does not already have a CAGE code assigned, the DLA Contractor and Government Entity (CAGE) Branch will assign a CAGE code as a part of the SAM registration process. FAR 52.222-23 Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity for Construction (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered are, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative actions obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U. S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the--
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Coos and Carrol Counties, NH.
FAR 52.225-10 Notice of Buy American Act Requirement--Construction Materials (MAY 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American—Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

EVALUATION FACTORS
1. Past Performance Offerors are required to submit past performance information for evaluation purposes on the attached Past Performance Questionnaire which must be completed and submitted. Offerors should list all contracts and subcontracts completed during the past three (3) years and all contracts and subcontracts currently in process. Contracts listed may include those entered into with the Federal Government, State and Local governments and Commercial enterprises. Offerors that are newly formed entities, which do not have past performance experience for the newly formed entity, should list contracts and subcontracts that illustrate proposed key personnel’s previous relevant experience.
2. Technical Approach Technical Approach Proposal Instructions: The technical approach narrative will be used to make an evaluation and arrive at a determination as to whether the proposal meets the requirements of the Government. Therefore, the technical proposal must present sufficient information to reflect a thorough understanding of the requirements and a detailed, description of the techniques, procedures and program for achieving the objectives of the specifications/statement of work. Proposals which merely paraphrase the requirements of the Government's specifications/statement of work, or use such phrases as "will comply" or "standard techniques will be employed" will be considered unacceptable and will not be considered further.
