STATEMENT OF WORK

Lands’ End Right of Way Vegetation Clearing

PROJECT DESCRIPTION:

Masticate, grind, shred, mulch, chip, cut or mow approximately 9.3 miles of roadside vegetation made up predominately of Pinyon-Juniper, the intermountain brush species (Gamble oak, Serviceberry, sage, snowberry and other brush species), aspen, and isolated Doug Fir on the Lands’ End Road. The primary purpose and objective of this treatment is the modification and/or removal of vegetation currently encroaching upon or potentially encroaching upon the current road profile of the identified road. The project will secondarily provide a wider buffer along these roads thereby aiding in both wildfire prevention and fire control efforts within the immediate area. The completed treatment area will result in a safer travelled roadway for Forest visitors and the general public by increasing sight distances and providing areas where vehicles can pass and park in a safer manner than is currently the case.

This project is designed for completion by a track based vehicle with an extendable arm capable of using a shredder/mastication head (EX: Trac Hoe with a FECON head) to treat roadside vegetation. There are also small polygons that will require the use of a chainsaw or ground based apparatus to selectively cut/thin and prune aspen, Pinyon-Juniper and Doug Fir stands

The contractor is to treat vegetation within 15 feet of the shoulder of the road (both sides) leaving residual stumps/residual stem height at less than 10” inches or as low as possible without causing undo damage to the machine. Both cut and fill slopes will be treated unless specific cut/fill slopes are identified as “no treatment slopes”. Additionally, selected curves (switchbacks) located within the project area will have larger treatment areas identified in order to achieve maximum sight distances required for safe public road use. Plastic flagging will delineate the treatment boundaries on the curves involved.

The Forest Service representative may identify additional patches/areas of vegetation to be left untreated. The boundaries of those areas will be identified to the Contractor verbally or by flagging on the ground. If contract operations are done outside of the recommended operating season, the contractor will be responsible to provide and post all road advisory and safety features according to and as outlined in the Manual Uniform Traffic Control

Devices (MUTCD) standards publication..

LOCATION:

The Lands’ End Road project is located southeast of Grand Junction, CO on the Grand Mesa NF. From the intersection of Highway 50 and 32 Road on the southeast side of Grand Junction, travel approximately 6.9 miles through the town of Whitewater to the intersection of 50 and the Kannah Creek Road. Turn left onto the Kannah

Creek (KC) Road and travel approximately 2.9 miles to the intersection (fork in the road) of the KC Road and the

Lands’ End Road. Turn left onto the Lands’ End Road and travel approximately 6.4 miles to the Forest boundary.

The actual project site begins approximately 0.7 miles further up the Lands End Road and continues along the Lands

End Road for another 9.6 miles (ending at approximately mile marker 10.3).

ADDITIONAL REQUIREMENTS:

The following additional guidelines are required mitigation measures or specifications incorporated into project design and decision record authorizing the completion of this project.

a. Treatment specification for various vegetation types are as follows:

All brush (oak, serviceberry, sage, snowberry etc.) species will be treated within the 15 foot treatment corridor.

Aspen stems less than 5 inches DBH (diameter at 4.5’ above the ground) will be removed within the 15 foot corridor. Trees larger than 5” will be pruned unless it is not feasible to do so.

Pinyon/Juniper and Douglas fir trees less than 5 “DBH will be removed. Larger trees not inhibiting or encroaching on the travelled way but still within the 15’ corridor will be pruned up to a minimum of 1/3 of their total tree height. Trees encroaching on the roadway and are not able to be pruned, will be removed.

All sides of the trees will be pruned to the same height where possible. Limbs will be pruned as near flush to the tree trunk as possible.

All dead and dying trees within the 15’ corridor will be removed.

Masticated chips will be broadcast spread over the treatment area, but must be kept free of barrow ditches, culverts, cattleguards and live streams. It will not be piled.

Cut slash from pruning etc. will be loped and scattered to a depth of no more than 18” and free of ditches, culverts, cattleguards and live streams.

b. In order to reduce the spread of noxious weeds on to Forest lands, all equipment will be cleaned by the

Contractor prior to moving the equipment onto public lands and project area. Equipment will be cleaned of mud, dirt, and accumulations or organic material which may harbor seed or plant parts of noxious weeds.

Steam cleaning is an acceptable method of reducing the import of noxious weeds. Fluid leaks shall be repaired prior to moving onto site.

c. No Treatment areas will be marked with fluorescent orange or pink, plastic surveyor flagging.

d. Treatment will be done during periods of such time to maximize effectiveness. Environmental conditions such as wet soil, mud or snow over 1 foot deep may begin to cause resource damage to the treatment corridor as well as the road base. Dry or frozen soil is preferred. Operations will not be allowed on weekends, Federal holidays or during scheduled special use events or programs (Lands’ End Hill Climb, Color Sunday etc.). Operations during scheduled hunting seasons should be avoided if at all possible.

e. Unless otherwise provided, when operations are actively in progress, total closures of the road(s) may not exceed 30 minutes. Advisory signs must be placed at points well in advance of the treatment regarding both the treatments operations and potential delays.

The following will be discussed with the Contractor at the pre-work meeting:

Excessively rocky areas are to be avoided to prevent damage to equipment.

Provision for buffer zones along cliff edges, streams, or other features deemed as requiring protection by the COR/PI.

Areas flagged or mapped to be avoided or to protect other resource values.

Signs, road object markers, road milepost markers and culverts will be protected from damage during treatment operations and retained.

Additional areas not yet identified may be encountered during treatment operations. The contractor will notify the COR or Inspector regarding location and reasoning for no treatment in these areas. The COR will make the final judgment as to whether to treat or not and in what fashion a treatment will occur.

GOVERNMENT FURNISHED PROPERTY:

The government will provide project maps and specifications to the Contractor.

DELIVERY, STORAGE AND HANDLING:

The Contractor will provide transportation for equipment, operator, fuel and supplies to and from the site. The

Contractor shall be responsible for providing the necessary material handling equipment to on-load and off-load materials as well as provide appropriate security for equipment left on site.

LUBRICATING, SERVICING AND REPAIRS OF EQUIPMENT:

The Contractor shall be responsible for the service and repair of all equipment including service and support vehicles. The use of welding equipment for equipment repair may be limited by fire restrictions. It is the

Contractors responsibility to keep current on any current fire restrictions. The contractor shall keep the equipment in proper functioning condition to insure objectives for the project are met.

INSPECTION AND ACCEPTANCE:

Inspection

Periodic inspections may be performed by the Government while work is in progress. Inspection for payment and acceptance may be conducted by the Government as work progresses.

Inspection for payment will be made within five working days after the date on which the Contractor requests payment for the job and provides documentation of work completed.

Acceptance

Units will be considered satisfactorily completed by visual inspection when vegetation treatments are complete.

Rework

If the unit(s) inspected does not meet the previously described acceptance levels, the contractor shall rework the area to conform to specifications. For example, if stump heights are above 10 inches, they will have to be recut.

Deficiencies

Specific deficiencies detected as a result of Government inspection shall be corrected so that the work complies with the contract specifications

PAYMENT:

Payment will be made by line item for completed and accepted work.

PREPARATION AND EVALUATION OF OFFERS

All offerors shall submit a technical proposal that will be evaluated to determine the contractor’s ability to perform the required work on time, on budget, and without an inordinate amount of Government oversight.

As a minimum, the proposal must clearly provide the following:

1. Technical capability to perform the required work.

Organization: Provide an experience statement that provides a description of comparable projects performed by the organization; include a list of key personnel with a brief summary of their experience.

Equipment: Provide a list of equipment to be available for this contract and a narrative describing how the equipment will be used. The list should include type, model, make, age, and ownership of equipment (contractor, subcontractor, or leased).

Plan of Operations: Provide a brief narrative that describes how the work will be organized and managed so that all activities are completed in accordance with contract specifications and within the allotted contract time.

Quality Control: Identify or describe your quality control and self-inspection procedures that will ensure objectives are being met during operations.

2. Past Performance: Offeror shall submit 3 references for projects of similar size, scope and dollar value

(completed in the past 3 years) including points of contact with current/verified telephone numbers and e-mail addresses.

3. BioPreferred® Products: The purpose of the USDA BioPreferred® program is to promote the increased purchase and use of biobased products. Offerors shall include within their proposal an affirmative statement of action(s) they would take during the performance of this contract to include the use of biobased products such as hydraulic fluid, lubricants, two-cycle engine oil, or cleaning agents unless precluded by performance, cost, or availability. The use/ non-use of biobased products will not be an evaluation factor in awarding any subsequent contract; however, failure to address the subject matter within the proposal could render the proposal as non-responsive to the solicitation requirements.

Proposals will be rated either technically acceptable, or not technically acceptable. The technical proposal must present sufficient information to reflect a thorough understanding of the requirements noted in the statement of work. Proposals which merely paraphrase those requirements, or use such phrases as "will comply" or "standard techniques will be employed" will be considered unacceptable.

Award will be made to the lowest priced, technically acceptable offer.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records - Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. “Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the

Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic

“Service-disabled veteran-owned small business concern”—

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

The offeror shall list as foreign end products those end products manufactured in the United States that do not qualify as domestic end products, i.e., an end product that is not a COTS item and does not meet the component test in paragraph (2) of the definition of “domestic end product.” The terms “commercially available off-the-shelf (COTS) item,” “component,” “domestic end product,” “end product,” “foreign end product,” and

“United States” are defined in the clause of this solicitation entitled “Buy American—Supplies.”
