Flagstaff, AZ RMRS Lab Requirements
SECTION C
PERFORMANCE WORK STATEMENT
1 GENERAL REQUIREMENTS.
1.1 SCOPE OF WORK. The Contractor shall provide all necessary management, supervision, personnel, transportation, general and specialized tools and equipment (except as specified herein as Government furnished) required to accomplish all services identified herein at the Rocky Mountain Research Station side of the Southwest Forest Sciences Complex (BLDG 82B) as specified herein. All work shall be performed at the RMRS Flagstaff Laboratory, 2500 S. Pine Knoll Drive; and at the RMRS Greenhouse/Shop Facility located at 1800 S. Lone Tree Road. All work shall be completed between the hours of 6:00 p.m. and 6:00 a..m. local time. Contractor shall have unobstructed access to the buildings between those hours. Training and performance of this contract shall include and comply with all applicable OSHA, EPA, local, State and Federal codes, mandates, and standards. The contractor shall at all times provide adequate supervision of employees ensuring all work is accomplished in accordance with the terms and conditions of the contract, in a manner that will maintain satisfactory facility conditions and present a clean, neat and professional appearance. Attachment #1 details the frequency at which the services are to be performed.
1.2 PERSONNEL.
1.2.1 PROJECT MANAGER. The Contractor shall designate, in writing to the Contracting Officer (CO), a full time Project Manager who shall be available to address any Government concerns. This individual shall be responsible for the overall management and coordination of work required under this contract and act as a central point of contact with the Government. The Contractor shall also include in the designation letter any limitations on the Project Manager's ability to bind the Contractor to changes/adjustments. At no time shall the Project Manager perform any custodial duties. This individual and the quality control personnel cannot be the same. The Project Manager shall have experience in custodial services within the last six years and demonstrate an active knowledge of aseptic requirements and cleaning techniques.
1.2.2 OTHER PERSONNEL. The Contractor shall furnish supervisory, administrative, and direct labor personnel to accomplish all work required. The Contractor shall not hire off-duty COR's or any other person whose employment would result in a conflict with the USDA STANDARDS OF ETHICAL CONDUCT located in 5 CFR Part 2635. Personnel employed to provide the services described herein shall be competent in the performance of such services.
1.2.3 PERSONNEL LIST. In accordance with Homeland Security Presidential Directive -12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24 and Federal Information Processing Standards Publication (FIPS PUB) Number 201., the contractor shall, within five (5) working days after the start of the contract, furnish the CO a complete list of the name, address, social security number, and date of birth of each employee engaged in the performance of this contract. The Government may require additional information to establish the identity and legal employment status of each employee having access to Government buildings or facilities. In the event of a change in employees, the contractor shall inform the CO promptly of the change, normally within five (5) calendar days after new employee hire or employee dismissal.
1.2.4 EMPLOYEE IDENTIFICATION. The Contractor shall issue picture identification badges, containing the Contractor's company name and employee's name and picture at the Contractor's expense. The identification badges shall be worn in a conspicuous place on the exterior clothing whenever work is being performed under this contract.
1.3 CONTRACTOR QUALITY CONTROL.
1.3.1 GENERAL REQUIREMENTS. The Contractor is responsible for quality control and shall establish and maintain an effective quality control system. The quality control system shall consist of plans, procedures, and organization necessary to produce services that comply with the contract requirements. The system shall cover all custodial and snow removal operations. The Contractor shall be responsible for the quality of work on the job and is subject to termination for non-compliance with quality requirements specified in the contract.
1.3.2 QUALITY CONTROL SYSTEM. The Contractor shall implement and maintain a documented quality control system, including a Quality Control Plan (QCP), that identifies and results in correction of potential and actual problem areas throughout the entire scope of the contract. Three copies of the QCP shall be provided to the Contracting Officer no later than five (5) working days prior to commencement of work under this contract. The Government will consider an interim plan for the first 30 days of operation. The QCP or interim plan shall be implemented on the first day of contract performance. The Contractor's Quality Control system shall include, as a minimum, the following to cover all custodial operations and snow removal, including work by subcontractors:
1.3.2.1 Be structured to assure the individual(s) responsible for Quality Control is independent from any other parts of the Contractor's organization.
1.3.2.2 Assure the Quality Control Manager has direct accountability to the Contractor's top management.
1.3.2.3 Contain procedures for written and verbal communication with the Government regarding performance of the contract.
1.3.2.4 Contain procedures for handling corrective action without dependence upon Government direction.
1.3.2.5 Contain, as a minimum, specific surveillance procedures for each contract service identified in the Performance Requirements Summary. These surveillance procedures shall identify who shall perform the surveillance, the frequency, the method, listing of items under surveillance, and corrective action that will be taken to correct Contractor identified deficiencies.
1.3.2.6 Include a customer complaint system. At a minimum, the customer complaint system shall contain procedures for the customer to file complaints with the COR/CO, form to be used by customers, procedures for investigation of complaint, and feedback to the customer and the Government on the results and actions, if any, taken on the complaint.
1.3.2.7 Maintain records of all Contractor quality control checks and corrective action. These files shall be maintained by the Contractor throughout the term of this contract and shall be made available to the Contracting Officer or designated representative during the term of this contract. The Contractor shall retain its quality control files for not less than one year after the completion or termination of the contract.
1.3.3 ACCEPTANCE OF PLAN. Government acceptance of the QCP is conditional and will be predicated on satisfactory performance during the custodial services. The Government reserves the right to require the Contractor to make changes in its QCP and operations including removal of personnel, as necessary, to obtain the quality specified. After acceptance of the QCP, the Contractor shall notify the Contracting Officer in writing of any proposed change. Proposed changes are subject to acceptance by the Contracting Officer.
1.4 SAFETY. The Contractor shall conduct its operations in strict conformance with all United States Department of Agriculture, United States Forest Service, and all applicable provisions of 29 CFR 1910 and 1926 of the Occupational Safety and Health Act. The Contractor shall implement a suitable safety program for employees performing work under this contract. The safety program shall be in writing and a copy shall be furnished to the CO within thirty (30) calendar days after commencement of work under the contract. Immediately after a job-connected injury, the Contractor shall prepare a report of the injury using its own accident report form or other documentation and send the report to the CO who will forward it to the Rocky Mountain Research Station Safety Officer. Any technical advice and assistance necessary for reporting and investigating accidents may be requested from the Safety Officer through the CO.
1.5. SECURITY. All outside doors shall remain locked while contractor performs work and the contractor shall ensure that all interior and exterior doors in the main building are locked prior to departure. Unnecessary lights/faucets shall be turned off and windows closed upon completion of duties. Contractor personnel shall not adjust mechanical equipment controls. Contractor shall immediately report fires and hazardous conditions to the appropriate authorities, turn in lost and found articles to the COR, and notify the appropriate authorities when an unauthorized or suspicious person is seen on the premises. Immediately report, in writing, any items that appear to be in need of repair, to the COR. Contractor shall immediately notify the COR if any problems are encountered either with the alarm or keys (including loss of keys).
1.6 OTHER REQUIREMENTS.
2 DEFINITIONS. The following special terms and/or phrases are used in this Performance Work Statement:
2.1 COMMON AREAS. This area includes hallways, waiting areas, stairs, entrances, supply room, copier rooms, break rooms, lunchroom, conference rooms, lobby areas, elevator, and library.
2.2 RESTROOMS AND SHOWERS. This includes all restrooms and showers under this contract.
2.3 SPECIAL REQUIREMENTS CLEANING TASKS. Tasks done on an irregular basis.
3 GOVERNMENT FURNISHED PROPERTY, FACILITIES, AND SERVICES.
3.1 GENERAL. The Government will provide the facilities as set forth in paragraph 3.2.
3.2 FACILITIES. The Government will furnish the Contractor with an area to use for storage of equipment and supplies. Access key cards will be issued for the entrance to the office. A master key will be issued for access to internal areas. The Contractor shall not make any structural changes to the storage area without written approval of the COR through the CO. Structural repairs required during the term of the contract shall be reported to the COR for appropriate action. The Contractor shall reimburse the Government for repairs not attributable to fair wear and tear for the facilities provided.
3.2.1 Within five (5) working days after contract start date, the Contractor and COR will conduct a joint condition inventory inspection of the supplied Government space. Building facility condition, damage, and repair requirements will be recorded and the record signed by the Contractor and the COR.
3.2.2 Within fifteen (15) working days prior to the end of a contract period, the Contractor and the COR shall conduct a joint condition inventory of the supplied Government space. All damage (other than fair wear and tear) which was nonexistent at the time of contract start date and/or building possession date will be documented and signed by the Contractor and the COR. Any damage noted at this time, which resulted through other than fair wear and tear, shall be corrected or repaired at the Contractor's expense.
3.2.3 The Government will provide janitorial closets. These closets are located on the first and second floors of the main office/lab building and on the main floor of the greenhouse/shop. The Contractor shall not change the locks at any time and shall notify the CO immediately if items are missing from the closet or if it appears that someone other than the Contractor and his/her employees is gaining access to the space.
3.3 UTILITIES. The Government will furnish electrical power, sewer service, and water at no cost to the Contractor during performance of this contract. The Contractor shall conserve all furnished utilities. The Government will not furnish telephone service.
3.4 TRASH DISPOSAL. The Government will furnish pick up and disposal of trash generated in or associated with the performance of this contract. The Contractor shall be responsible for the placement of trash in the dumpster located outside on the north side of the building. Trash shall not be placed in dumpsters/roll-aways belonging to other contractors. If such an event occurs and results in a claim against the Government for disposal of the trash, the Contractor will be charged for the amount of the negotiated claim.
3.5 KEY CONTROL. The Government will provide access key cards and keys to the Contractor for access into locked/secured rooms, buildings, and areas to be cleaned on the contract. Keys provided to the Contractor for buildings to be cleaned are not to be duplicated by the Contractor or issued to any individual(s) to be retained in his/her possession while not physically performing work under this contract. At the beginning of this contract and every 180 days thereafter, the COR and Contractor shall jointly inventory the keys. Only the COR and Contractor are permitted to have possession of master keys.
3.5.1 Lost keys shall be reported to the COR immediately. If the COR is not available, the loss shall be reported to the CO.
4 CONTRACTOR FURNISHED ITEMS.
4.1 SUPPLIES. The Contractor is NOT required to provide paper towels, toilet tissue, hand soap, trash can liners, or florescent light bulbs for use by building occupants. The Government will provide the paper towels, toilet paper, hand soap, and trash can liners to be stocked in the janitorial closet . The Government will provide all equipment necessary for the performance under this contract. The contractor shall be responsible for notifying the COR when storage supplies get low. The COR will notify the Contractor if the supply storage locations change. The Government furnished items and supplies shall only be used in the performance of this contract.
4.1.1 All containers of cleaning chemicals, hazardous materials, and similar products shall be conspicuously marked with a factory label to identify contents. Hazardous materials shall be labeled with appropriate Department of Transportation (DOT) or Interstate Commerce Commission (ICC) hazard labels (flammable, corrosive, acid, etc.), as specified on the Material Safety Data Sheet.
4.2 MATERIAL SAFETY DATA SHEETS (MSDS). The Government, thru the COR, will make available copies of the MSDS sheets obtained from the manufacturer or dealer concerning all hazardous materials (i.e., chemicals and cleaning solutions) to be used under this contract within three (3) days after commencing work. Reference: 29 CFR 1910-1200.
4.3 CONTRACTOR'S EQUIPMENT. The Government may inspect Contractor's equipment at any time.
4.3.1 For protection of walls and doors, all wheeled and movable equipment shall be equipped with protective non-marking wheels and rubber bumpers or guards around the entire perimeter. No part of the equipment (except fixed handles) shall protrude beyond the rubber bumpers.
4.3.2 The Contractor shall establish a communication paging and/or cell phone system whereby key personnel (Project Manager, Assistant Project Manager, Quality Control Inspector, Day and Night Supervisors, etc.) may be contacted by the CO or COR.
5 SPECIFIC CUSTODIAL TASKS.
5.1 GENERAL. The Contractor shall provide all management and labor necessary to ensure that custodial services are performed at the RMRS Flagstaff Laboratory and Greenhouse/Shop Facility. The Contractor shall ensure that tools and equipment necessary to clean the restrooms and shower facilities are clearly identified and utilized only for cleaning those areas (i.e. mop used to clean bathroom floor shall not be used to clean kitchen floor). The Government will ensure that adequate tools and equipment are available to prevent cross contamination. The Contractor shall perform the required custodial services of this contract between the hours of Monday – Friday 6:00 p.m to 6:00 a.m. and between Saturday morning at 6:00 a.m. and Sunday night at midnight in accordance with the terms of this Performance Work Statement (PWS). The tasks and frequencies of the work are listed in the Task and Frequency list.
5.1.1 AREAS UNDER REPAIR/REMODELING. The Contractor shall not be required to perform custodial duties in an area that is under repair or being remodeled. These areas will be clearly marked by the Government as not requiring services.
5.1.2 AREAS MARKED WITH “NO CUSTODIAL SERVICES REQUIRED”. The Contractor shall not be required to perform custodial duties in any lab marked “No Custodial Services Required”. This demarcation will only be issued when entry to the laboratory is unsafe due to the presence of chemical compounds.
5.1.3 FREQUENCY OF CUSTODIAL SERVICES. All regular services shall occur in accordance with the cleaning schedule proposed by the contractor for all custodial services. At a minimum the tasks outlined in Section 1 of the Task and Frequency chart shall be performed daily. These days shall remain unchanged through the life of the contract except as the Government and Contractor shall otherwise agree. The Contractor is not required to perform custodial services on Federal holidays. A list of Federal holidays is provided in Section G – Contract Administration Data. If the Contractor chooses not to perform the scheduled service on the Federal holiday, the scheduled service must be performed on the next calendar day.
5.1.4 MANAGEMENT. The Contractor shall provide the service of work scheduling. The Task and Frequency chart shall be the basis for scheduling cleaning tasks in the specified buildings and areas. The Contractor shall provide adequate supervision of its employees to ensure complete and satisfactory performance of all work in accordance with the terms and conditions of the contract.
5.1.5 CLEANING SCHEDULES. The Contractor shall submit a written schedule to the COR of the days and times the building(s) on the contract is to be cleaned. This schedule shall include planned projection timelines of all tasks outlined in Attachment 1 – Task and Frequency List, with the understanding that daily requirements will not have to be denoted on the proposed schedule. This schedule shall be submitted within five (5) working days after the start of the contract. A new schedule will be submitted within five (5) working days before changes to the schedule are made.
5.2 CLEANING TASKS. All cleaning tasks shall be accomplished as stated below.
5.2.1 FLOORS. All floors accessible to floor machines, unless otherwise shown in Task and Frequency Chart as having carpet, shall receive floor maintenance. After receiving floor maintenance, the entire floor shall have a uniform, glossy appearance, and be free of scuffmarks, heel marks, and other stains and discolorations. All floor maintenance solutions shall be removed from baseboards, furniture, trash receptacles, corners, wall abutments, doors, and areas behind radiators and pipes, etc. Chairs, trash receptacles, and easily removable items shall be moved to maintain floors underneath these items. All moved items shall be returned to their proper position when all operations have been completed. Floor maintenance includes sweeping, dust mopping, damp mopping, wet mopping, and buffing as required to achieve the above stated results.
5.2.1.1 Sweep/Dust Mop Floors. All accessible floor areas shall be swept or dust mopped. After the floor has been swept or dust mopped, the entire floor surface, including corners and abutments shall be free of litter, dust, and debris. Chairs, trash receptacles, and easily movable items shall be moved to maintain floors underneath these items. All moved items shall be returned to their proper position when all operations have been completed.
5.2.1.2 Mop Floors. All accessible floor areas shall be damp and/or wet mopped. Chairs, trash receptacles, and easily movable items shall be moved to maintain floors underneath these items. All moved items shall be returned to their proper position when all operations have been completed. After being mopped, the floor shall have a uniform appearance with no streaks, swirl marks, detergent residue, or any evidence of soil, stains, film debris, or standing water. There shall be no splash marks or mop streaks on furniture, equipment, walls, baseboards, etc., or mop stands remaining in the area. Do not wet mop wood or carpeted floors. All floors shall be free of all grime, soils, perspiration marks, water spots, scuffmarks, and lotion residue and free of odor. Mop bucket shall be emptied and rinsed at the end of each day.
5.2.1.3 Strip, scrub, seal, and wax floors. Strip, scrub, seal, and wax floors according to the Task and Frequency Chart, maintaining a glossy appearance. A uniform glossy appearance is free of scuffmarks, heel marks, wax buildup, and other stains and discolorations. Floor surfaces requiring no wax application shall be maintained in accordance with industry standards. Moveable objects shall be moved prior to waxing and returned to the proper position after waxing.
5.2.1.4 All floors shall be re-waxed or spray cleaned and buffed according to timeframes listed in the Task and Frequency Chart.
5.2.1.5 Sealing of floors shall be done according to industry standards. Floors shall be sealed and over-coated with non-skid wax or floor finish.
5.2.1.6 All carpeted surfaces shall be vacuumed and free of all visible lint, litter, soil, and imbedded grit. Area and throw rugs are to receive service also. Rugs, mats, and runners in excess of 20 pounds shall be moved by more than one person and cleaned underneath.
5.2.2 TRASH. All trash receptacles shall be emptied and returned to their original location. Any obviously soiled or torn plastic trash receptacle liners in such receptacles shall be replaced. A spare liner shall be kept in the bottom of each receptacle. Boxes no larger than two (2) cubic feet, cans, and papers placed near trash receptacle shall be removed if clearly marked "trash". All debris or liquids remaining in trash receptacle due to a leaky plastic bag shall be removed. Trash shall be disposed of in a secured plastic bag. The Contractor shall pick up any trash that may fall onto the facility or grounds during the removal of such trash collection. All refuse collected shall be disposed of in the nearest trash dumpster outside the building. Trash shall be emptied from all wastebaskets. Dirty trash receptacles shall be washed inside and out and shall be odor free. At a minimum, all trash receptacles should be damp wiped once semi-annually.
5.2.3 LOW DUSTING AND HIGH DUSTING. Low dusting shall be performed in accordance with the Task and Frequency Chart and includes areas under six (6) feet in height. High dusting shall be performed in accordance with Task and Frequency Chart and includes areas six (6) feet to twelve (12) feet in height. Any area requiring dusting above twelve (12) feet in height will be a special task cleaning requirement. All surfaces, such as window sills, window blinds, hand rails, wood strips, door frames, exposed piping, light fixtures, covers and diffusers, ceilings, walls, lockers, pictures and plaques shall be free of lint, dust, dirt, cobwebs, and other accumulated soils. Fluorescent light fixtures shall be free of cobwebs and insects.
5.2.3.1 Dust cleaning and polish furniture shall be performed in accordance with the Task and Frequency Chart
5.2.4 LUNCH ROOM AREA. Clean and sanitize lunch room area, to include the counter top, sink, table, microwave, and refilling of the paper towel dispenser.
5.2.5 GLASS. Glass shall be cleaned on all exposed glass surfaces in accordance with the Task and Frequency Chart. All Lucite, plastic, or any transparent materials used will be considered glass. After cleaning, there shall be no traces of dust, dirt, smudges, film, tape, streaks, watermarks, or other foreign matter.
5.2.5.1 Glass shall be cleaned on hanging pictures and mirrors.
5.2.6 METAL SURFACES. Brass, aluminum, stainless steel, and other metal surfaces, such as push plates, metal plates, etc., shall be cleaned and polished with a polish that does not contain surface-damaging abrasives.
5.2.7 DRINKING FOUNTAINS. Clean and disinfect all porcelain and polished metal surfaces, including the cabinet, percolator orifices and drains. After cleaning, the entire drinking fountain shall be free from streaks, stains, spots, smudges, scale, and other obvious soil.
5.2.8 RESTROOMS AND SHOWER ROOMS. All restrooms and shower rooms shall be thoroughly scrubbed and disinfected as required in the Task and Frequency Chart. Completely damp clean and disinfect all surfaces of sinks, wash bowls, toilet bowls and seats, urinals, lavatories, showers, shower mats, dispensers, plumbing fixtures, partitions, doors, walls, polished exposed piping, mirrors, and other such surfaces, using germicidal detergent. After cleaning, the entire surface shall be free from streaks, stain, scale, scum, urine deposits, mineral deposits, and rust stains. Disinfect all surfaces of partitions, stalls, stall doors, entry doors (to include handles, kick plates, ventilation grates, metal guards, etc.), and wall areas adjacent to wall mounted lavatories, urinals, and toilets. After cleaning, receptacles will be left free of deposits, dirt, smudges and streaks, soap film, dust, soils, graffiti, scum, and odors. All bright metal finishes such as faucets, pipes, fittings and hardware shall be kept in a bright and clean condition.
5.2.8.1 Sweep and mop floor. After sweeping and mopping, the entire surface shall be free from litter, dust, and foreign debris, including grout. Grout on wall and floor tiles shall be free from dirt, scum, mildew, residue, etc. Floors shall have a uniform appearance without streaks, swirls, marks, detergent, residue, or any evidence of soil, stain, film, or standing water. Easily movable items shall be tilted or moved aside to sweep and damp mop underneath. Restroom floors shall be stripped, scrubbed, waxed, etc., to maintain sanitary conditions and a clean, uniform appearance. Every time the restrooms and showers are cleaned, floors will be swept and mopped.
5.2.8.2 Strip, scrub, seal, and wax floors. Strip, scrub, seal, and wax floors according to the Task and Frequency chart, maintaining a glossy appearance. A uniform glossy appearance is free of scuffmarks, heel marks, wax buildup, and other stains and discolorations. Floor surfaces requiring no wax application shall be maintained in accordance with the manufacturer's recommended application procedures. Moveable objects shall be moved prior to waxing. This task will be performed in accordance with the requirements set forth in the Task and Frequency Chart.
5.2.8.2.1 All floors shall be re-waxed or spray cleaned and buffed according to timeframes listed in the Task and Frequency chart .
5.2.8.3 Remove trash. All trash receptacles, to include those receptacles used for feminine hygiene waste, shall be emptied and returned to their original location with Government provided plastic liners. Any obviously soiled or torn plastic trash receptacle liners in such receptacles shall be replaced. Boxes no larger than two (2) cubic feet, cans, and papers placed near trash receptacle shall be removed if clearly marked "trash." All debris or liquids remaining in trash receptacle due to a leaky plastic bag shall be removed. Trash shall be disposed of in a secured plastic bag. The Contractor shall pick up any trash that may fall onto the facility or grounds during the removal of such trash collection. All refuse collected shall be disposed of in the nearest trash dumpster outside the building. Trash shall be emptied from all wastebaskets. Dirty trash receptacles shall be washed inside and out and shall be odor free. Every time the restrooms and showers are cleaned, trash will be removed.
5.2.8.4 Restock restrooms, as necessary, in accordance with the Task and Frequency chart.
5.2.9 STAIRWELLS AND/OR LANDINGS. Clean stairwells and/or landings, to include floors, railings, and glass in the doors. All floor surfaces shall be maintained and free of lint, dust, dirt, and debris. Grease and grime shall be removed from metal or rubber stair guards, handrails, and baseboards. The Contractor shall remove all marks, dirt, smudges, scuffs, and other foreign matter from adjoining stairwell walls to provide or maintain a clean, uniform appearance.
5.2.10 BUILDING ENTRANCES: Clean building entrances, to include floors, mats, and glass doors.
5.2.11 GENERAL SPOT CLEANING: Contractor personnel shall perform spot cleaning on a continual basis. Spot cleaning includes, but is not limited to the removing of, or cleaning of smudges, fingerprints, marks, streaks, spills, etc., from washable surfaces of all walls, partitions, vents, grillwork, doors, door guards, door handles, push bars, kick plates, and fixtures. Germicidal detergent shall be used in restrooms, locker rooms, break areas, and drinking fountains. After spot cleaning, the surface shall have a clean, uniform appearance, free of streaks, spots, and other evidence of removed soil. Janitor's closets used by the Contractor shall be kept neat, orderly and odor free.
6. INSPECTIONS. In accordance with the Performance Requirements Summary, random inspections shall be carried out by the COR. Inspection items include all items listed in the Task and Frequency chart.
6.1 When the number of defects in the Contractor’s performance discovered by the COR exceeds the acceptable level, the Contracting Officer will issue a non-compliance report. The non-compliance report requires the Contractor to explain in writing why performance was unacceptable, how performance will be returned to acceptable levels, and how recurrence of the problem will be prevented in the future.
6.1.1 Upon receipt of a non-compliance report, the Contractor shall immediately inspect the area in question. Under FAR 52.212-4 the Contractor will not be paid for services not rendered in accordance with the standards set forth in this contract (i.e., unsatisfactory performance) unless satisfactory re-performance is accomplished.
6.1.2 At the sole election of the Government and upon notification to the Contractor by the Contracting Officer, the Contractor may be required to re-perform or perform late any or all defective work disclosed by the Government inspection including defective and incomplete work performance except where timeliness is an element. This re-performance shall be at no additional cost to the Government. Where the Government so elects, the Contractor shall be notified promptly after inspection that specified defective services will be re-performed/performed late and completed within a reasonable time specified by the Government. In such cases, the Government shall re-inspect work designated for re-performance, and the Contractor may be held liable for any damages sustained by the Government including, for example, the costs associated with re-inspection.
7 REGULATIONS. Full compliance with all Federal, State, Local, USDA and Forest Service regulations is required. Fire prevention shall be exercised at all times by the contractor and employees. All combustible material shall be used and stored in a safe manner. Contractor shall report to the COR/CO any fire hazards.
7.1 TOBACCO CONTROL. The contractor and its employees shall observe the Tobacco Control requirements contained in DR4400-006, 5 U.S.C. 301; 5 U.S.C. 7901; 29 U.S.C. 668; 41 CFR 101-20.105-3; and 41 CFR 101-39.300(d) whenever performing services in or visiting Government facilities/buildings.
7.2. OCCUPATIONAL SAFETY AND HEALTH ACT (OSHA). Full compliance with Federal Law, USDA, and Forest Service Regulations concerning safety and health is required.
7.3 ENVIRONMENTAL PROTECTION AGENCY (EPA). Full compliance with environmental and hazardous waste management laws and regulations promulgated by the Federal, State, and local Governments, USDA, and Forest Service is required.
