CONTINUATION OF STANDARD FORM 1449

1. Continuation of Blocks 19 through 24 (Schedule of Services):

BASIC SERVICES – Provide all management, supervision, supplies and labor (except as otherwise specified herein); and plan, schedule, and coordinate as necessary to ensure effective performance of all required services.

The Contractor shall be fully responsible for providing Technical Welding Training at:

Prices for all years shall be based on wages compliant with the applicable Department of Labor Wage Determination in Exhibit 1.

Contractor personnel will perform all work required in the Performance Work Statement (PWS) for the amounts agreed to in the Schedule of Items below

PART II – CONTRACT CLAUSES

FAR 52.212-4 CONTRACT TERMS AND CONDITIONS – COMMERCIAL ITEMS (MAY 2015) (TAILORED)

(As stated in Block 27 of the SF 1449, this clause is Incorporated by Reference; however, in accordance with FAR 12.302, the following paragraph of this clause has been tailored, all other paragraphs remain unchanged.)

(c) Changes (tailored). Changes in the terms and conditions of this contract may be made only by written agreement of the parties. NOTE: Modifications to exercise contract options may be issued unilaterally at the Government’s sole discretion in accordance with the terms of FAR clauses 52.217-8 or 52.217-9 listed below.

2. FAR 52.217-9 Option to Extend the Term of the Contract (Mar 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor at any time prior to expiration of the current contract period; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years and 6 months.

3. AGAR 452.209–71 Assurance Regarding Felony Conviction or Tax Delinquent Status for Corporate Applicants—ALTERNATE I (FEB 2012)

(a) This award is subject to the provisions contained in sections 433 and 434 of the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, as amended and/or subsequently enacted, regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434, amended and/or subsequently enacted.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

SCOPE OF WORK-Welding Instructor-Vocational Training Department

Introduction Job Corps is a national residential training and employment program administered by the Department of Labor to address the multiple barriers to employment faced by disadvantaged youth throughout the United States. The Economic Opportunity Act of 1964 originally established Job Corps; current authorization for the program is Title I, Chapter 6, Subtitle C, of the Workforce Investment Act of 1998.

Background Job Corps provides educational and occupational skills training and support services to youth between 16 and not yet 25 years of age. The unique combination of services provided in the Job Corps program is intended to better prepare youth to obtain and hold gainful employment, pursue further education or training, or satisfy entrance requirements for careers in the Armed Forces. The Workforce Investment Act (WIA) mandates that Job Corps graduates be provided with transition, placement, and support services for one year following initial placement. WIA also requires that the placement status and wages of graduates be measured at six- and twelve-month intervals after the graduates are placed, and that Job Corps operator be evaluated in part on the basis of these performance measures.

The U.S. Department of Agriculture Forest Service operates 27 Job Corps Center nationally, through an interagency agreement with the Department of Labor. The talents of Job Corps students are enlisted in a diverse array of Forest Service programs, although its students are most widely known for their program contributions in Welding, hazardous fuels reduction, construction and firefighting.

Approximately 174 students live full-time at Great Onyx Job Corps Center. The students attend classes in our accredited high school and in hands on trade areas. The Center has a cafeteria, health services, recreational facilities and dormitories.

Purpose Great Onyx Job Corps has need for a Welding instructor.

The primary purpose is the vocational training, providing work experience, and placement of students involved in the Welding program. The Welding instructor will reinforce and support the Center’s Career Development Services System (CDSS) plan throughout a student’s tenure in the program. At all times the instructors teach, mentor, and model good employment skills and work habits. Instruction and discussion of customer service will be included in daily tasks and assignments. Instructors will consistently teach the impact of actions and behaviors on employability so that the students will come to view themselves as desirable candidates in today's workforce.

Invoicing procedures

Invoices. In addition to the clause language in FAR 52.212-4, the following direction is provided:

1) Invoices shall be submitted on a monthly basis, no later than ten (10) days following the period being invoiced;

2) Invoices shall include only those products provided during the billing period;

3) Invoices shall bill by Line Items as listed in the Schedule of Items;

4) Billing rates shall be in accordance with the firm-fixed rates listed in the Schedule of Items.

Effective February 24, 2014 all invoices are required to be submitted through the Department of Treasury’s Invoice Processing Platform (IPP). The contractor must follow the instructions on how to register and submit invoices via IPP as prescribed in the previous communications from USDA and Treasury. The Contractor shall maintain insurance as outlined in FAR 52.228-5 Insurance-Work on a Government Installation, AGAR 452.228-71 Insurance Coverage, FAR 52.225-10 Vehicular and General Public Liability Insurance. Roof of insurance will be required prior to contract award and prior to each time an option is exercised.

The Contractor shall provide vocational training services in accordance with:

In addition, the Contractor shall adhere to any such standards as may be established by the Office of the Director, Job Corps, US Department of Labor, and the Contractor. The Contractor shall be responsible for the direct supervision of the Contractor Personnel on the Center. Contractor’s on- Center staff will coordinate work with the Work Program Officer on all matters of program operations and coordination with other Center activities. The Welding instructor(s) are responsible for providing training in accordance with the Job Corps Welding Training Achievement Record (TAR’s listed in section A below), on- and off-center work experiences. In addition, contractor will be required to assist with placement services as outlined in the next section in training (section 2, A,

14) for students assigned to their programs. Finally, they are required to model, mentor and monitor appropriate workplace behaviors for students.

Welding Instructor Services Great Onyx Job Corps Center

A. Training

The Contractor will provide vocational training services towards the achievement of an Apprentice Level Welder. The training program has to follow these steps outlined in the current Training Achievement Record toward completion:

2. The Contractor will operate a full-day vocational program configuration.

Students who enter the program without a high school diploma or GED certificate will be assigned a Bi-weekly schedule rotating weeks between vocation and education programs.

Students with a high school diploma or GED will be assigned to the trade full time. Vocation classes will operate on a daily schedule determined by the Center Director.

3. Identify certification testing opportunities and collaborate with the graduate to ensure progress toward certification(s) and/or licensure(s) within 30 days of a student completing the trade.

4. The Contract Personnel will monitor student activities daily at on-Center Career Technical Skills Training (CTST) sites and off-Center (Work Based Learning and Forest) sites

5. Training shall be a combination of classroom and work experience for the purpose of acquiring specific fundamental skills. Students shall perform all work normally performed by the craft.

6. All training performed under this contract shall be in an environment similar to that found in the industry and similar to training required for Apprentices, as outlined in the Craft Apprenticeship and Training Standards published by the Department of Labor.

7. The training provided shall be a combination of work experience and related training, divided approximately seventy percent (70%) practical and thirty percent (30%) related instruction. During the time spent in the program, the students will receive instruction in the manipulative skills and related knowledge necessary for entry-level apprenticeship positions.

8. The Welding Training Achievement Record (TAR/eTAR) are vehicles for providing and documenting the training provided for under this contract, as well as other types of competency based training such as: industry required practice and performance testing, classroom required curriculum, and mock-up training.

9. The contractor will use professional contacts to assist in establishing Work- Based- Learning (WBL) sites and agreements with local employers.

10. Contractor placement assistance functions shall be coordinated through the COR. The following are the guidelines for this function:

Use labor market information and other resources to work with each graduate to develop placement strategies tailored to meet his or her individual needs and career goals.
