FAR 52.217-8 Option to Extend Services (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates, provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 Days
FAR 52.217-9 Option to Extend the Term of the Contract (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 Days; provided, that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed Four (4) Years.
FAR 52.232-18 -- Availability of Funds. (Apr 1984)
Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

AGAR 452.204-71 Personal Identity Verification of Contractor Employees (OCT 2007)
(a) The Contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of Agriculture (USDA) Directives 2620-002 series.
(b) Should the results of the PIV process require the exclusion of a Contractor’s employee; the Contracting Officer will notify the Contractor in writing.
(c) The Contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 series and to maintain a list of employees eligible for a USDA LincPass required for performance of the work.
(d) The responsibility of maintaining a sufficient workforce remains with the Contractor. Contractor employees may be barred by the Government from performance of work should they be found ineligible or have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.
(e) The Contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system.
(f) The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the COR/COTR, unless otherwise specified in this contract. The PIV Sponsor will be available to receive Contractor identity information from (hours and days) to (hours and days) at (office address for registration). The Government will notify the Contractor if there is a change in the PIV Sponsor, the office address, or the office hours for registration; however, it is the Contractor’s responsibility to meet all aspects of paragraphs (c), (d),and (e).
AGAR 452.209 – 71 ASSURANCE REGARDING FELONY CONVICTION OR TAX DELINQUENT STATUS FOR CORPORATE APPLICANTS
(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –
(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and
(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.
(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

STATEMENT OF WORK JANITORIAL SERVICES
GLOBE RANGER DISTRICT, TONTO NATIONAL FOREST
SCOPE:
Provide janitorial services among three (3) buildings totaling approximately 4,880 square feet located at the Globe Ranger District, Tonto National Forest. Buildings include Administration Office, Office Annex and Range/Fuels Office.
LOCATION:
Globe Ranger District 7680 S Six Shooter County Rd. Globe, AZ 85501
USE OF PREMISES:
The Contractor shall comply with the regulations governing the operation of premises, which are occupied, and shall perform his/her contract in such a manner as not to interrupt or interfere with the conduct of Government business. No authorized persons are to be admitted while on the premises. Contractor /agent will be exposed to various documents and/or communications. At no time will the contents of these documents be discussed or transmitted in any way to people outside the office.
REQUIRMENTS:
One night per week- on a set schedule:
· Vacuum all carpeting and dust all tile floors. Spot clean carpet as needed on a continual basis using the carpet manufacturer’s approved methods of spot removal.
· Empty and clean all waste receptacles in offices, bathrooms and conference room.
· Dust furniture, counters, cabinet or shelf tops and edges, etc., including removal of prints and stains. (Note: Desks are to be cleaned only when left clear of papers.) Suggest using a feather or other type duster that is able to get in and around items without disturbing them.
· Clean and sanitize all restrooms, clean all fixtures, mirrors, refill towel dispensers, tissue holders, mop floors and clean showers using a germicidal detergent. Disinfect all surfaces of partitions, stalls, stall doors and wall areas adjacent to urinals and toilets.
· Clean kitchen area in Office Annex and refill paper towel dispenser.
· Sweep outside walks and front entrance and empty ashtray as needed.
· Clean and disinfect all door handles.
Monthly:
· All tile floors shall be swept, dust mopped, damp mopped, dry buffed, and waxed as needed to ensure they have a uniform, glossy appearance and are free from dirt, debris, dust, scuff marks, heel marks, other stains and discoloration and other foreign matter.
· Sweep outside sidewalks, back porch and front entrance and empty ashtray and trash cans.
· Dust ledges, sills, baseboards, window blinds, etc.
· Clean and mop all plastic floor protectors in all offices.
Quarterly (every three (3) months):
· Wash windows, inside and out, removing and cleaning screens with brush. Replace screens correctly.
· Wash any shower door/curtains.
· Spot wash doors, doorframes and walls, light switches, door handles and area around door handles.
Semi-annually (every six (6) months):
· Window blinds taken down and hosed off outside, dried and rehung.

The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide bio-based products.
The Contractor shall utilize products and material made from bio-based materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the COR.
The following is an example list of products that may be used in this contract for custodial services for which bio-based products are available. The list is not all inclusive. It is desirable that contractors be able to supply the greatest number of bio-based products listed meeting the health and environmental specifications.

The Contractor shall comply with the provision at FAR 52.223-1, Bio-based Product Certification. The Contractor shall comply with the clause at FAR 52.223-2, Affirmative Procurement of Bio-based Products under Service and Construction Contracts.
The Contractor shall submit in writing for COR approval the following:
· The Contractor’s written policy stating its commitment to the use of bio-based products, employee health and safety, and sound environmental management practices.
· Detail on how the Contractor intends to keep abreast of the development and increasing availability of bio-based products and how any new or improved products will be incorporated on an ongoing basis into contract performance.
· A complete list of bio-based products, indicating the name of the manufacturer and the intended use of each of the materials that are to be used in carrying out the requirements of the contract.
Seven days prior to an employee starting work, the Contractor shall submit for each employee working on government premises for this contract:
· I-9, Employee Eligibility Verification Form, with a copy of the documents that establish employment eligibility and identity. This information may be used for an initial background check.
· Full Name of Employee with a valid email address and telephone number. This information will be submitted to the Department of Agriculture’s Human Capital Management (HCM) department who may then contact the employee and require the employee to provide their full name, date of birth, place of birth, social security number, working contact phone number, and working email address. The employee may then be required to complete a background investigation package as requested by HCM.
The Government reserves the right to remove any Contractor employee that is, in the Government’s estimation, found to be unsuitable or deemed a security risk for the Government. If such a finding occurs, either by the Government or the Contractor, the employee shall be immediately dismissed from duty and shall not be permitted to enter the buildings. The Contractor shall immediately inform the CO of any such issues.
The Contractor shall, within 10 days from start of contract, submit for the CO’s approval the following:
· Complete list of all personnel employed under this contract with a designated on site working supervisor. This list shall include individual tours of duty (such as 6:30pm – 12:00 midnight) and scheduled work assignments.
· Schedule for contracted services to be performed bi-monthly, quarterly, and semi-annually.
· Quality Control Plan ensuring contract compliance.
· Submittals as detailed under Contractor-Furnished Property, bio-based products.
• Material Safety Data Sheets (MSDS) and chemical lists in a notebook for chemicals stored in Government- Furnished storage spaces. MSDS notebooks shall be kept up-to-date and stored in storage spaces with chemicals.
Submittals must be reviewed and updated as required by the COR. SAFETY:
| • | The Contractor shall be responsible for instructing his/her employees in appropriate safety measures. Employees must not place mops, brooms, machines, and other cleaning equipment at locations in such a manner as to create safety hazards. Cautionary signs shall be displayed in areas where cleaning operations are in progress which necessitate the use of any equipment or supplies such as buckets, wires, ladders, water, wax, wet floors etc., which could cause a personal hazard. Contractors shall comply with all Federal, State, and Local regulations, laws, codes, and requirements relating to safety. |
| • | Fire prevention shall be exercised at all times by the Contractor’s employees. Janitor’s closet, etc. shall be kept clean and free from odors and fumes. All combustible material shall be used and stored in a safe manner. The Contractor shall report to the COR any fire hazards, and if possible, correct them. |
| • | The Contractor shall be responsible for maintenance and upkeep of the MSDS forms and chemical list for all chemicals used and stored on site. |
INSPECTION AND PAYMENT:
Work performed under this contract shall be subject to inspection by the Contracting Officer’s Representative (COR). Sub-standard performance shall be brought to the attention of the Contractor, who, if he/she fails to correct deficiencies as directed shall be subject to termination.
Monthly partial payments are authorized, in the amount of 100% of the monthly quoted price.
MATERIALS AND WORKMANSHIP:
Unless otherwise provided in the contract specifications, the contractor shall furnish all materials and equipment necessary for satisfactory contract performance. When not specifically identified in the specifications, such materials and equipment shall be of the most suitable type and grade for the purpose. Each item or article shall be subject to inspection and/or test and approval by the Contracting Officer or his/her representative, when he/she so requires. All workmanship shall be first class and also shall be subject to the inspection and approval of the Contracting Officer or his/her representative. Contractor shall be in sufficient physical condition to be able to climb ladders, etc., in order to accomplish the work in a satisfactory manner.
CONTRACTOR FURNISHED:
The Contractor shall furnish any equipment or supplies not listed above that are necessary to accomplish the required janitorial services and ensure they are performed in a manner that will maintain a satisfactory facility condition and present a clean, neat and professional appearance.
The Contractor shall be liable for all loss or damage of Government Furnished Property until completion and final acceptance of work required under this contract. It the Government fails to delivery of such property suitable for its intended use, and upon written request from the Contractor, the Contracting Officer (CO) may make an equitable adjustment of contract delivery or performance dates or contract price, or both pursuant to the “Changes” clause or the general provisions of this contract.
GOVERNMENT FURNISHED:
The Government shall provide the following materials, supplies, property or services (hereinafter referred to as “Government Furnished”)
· Garbage Bags
· Paper towels
· Toilet tissue
· Hand Soap Supplies will be stocked/restocked on an inventory basis. The Contractor will be responsible for communication with the delegated Contracting Officer Representative (COR) or assigned Point of Contact (POC) at the Globe Ranger District when more supplies are needed or if any broken or faulty facilities or equipment are found.
The Government will change large florescent tubes.
QUALITY CONTROL The contractor shall develop and maintain a quality program to ensure custodial services are performed in accordance with the commonly accepted commercial practices. The contractor shall develop and implement procedures to identify, prevent and ensure non-recurrence of defective services.

52.212-1 -- Instructions to Offerors -- Commercial Items. (Jul 2013)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show --
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, e-mail address and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)
(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(2) The overall evaluated cost or price and technical rating of the successful and debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
