FAR 52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (APR 2010)
(a) Definitions. As used in this provision—
“Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of
Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
“Federal contracts and grants with total value greater than $10,000,000” means—
(1) The total value of all current, active contracts and grants, including all priced options; and
(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).
“Principal” means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(a.) Awards made under this solicitation are subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. To comply with these provisions, all offerors must complete paragraph (1) of this representation, and all corporate offerors also must complete paragraphs (2) and (3) of this representation.

(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –
(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and https://www.acquisition.gov/ https://acquisition.gov/far/current/html/52_200_206.html#wp1137850

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.
SECTION M--EVALUATION FACTORS FOR AWARD
AWARD DETERMINATION
M1.0. Basis for award: The Government reserves the right to award under the Multiple Award Schedule guidelines. A minimum of two (2) IDIQ contracts is anticipated to be awarded. Offers will be reviewed by an Evaluation Panel set forth by the Contracting Officer. The Evaluation Panel will determine best value to the Government by using the Evaluation Factors below:
1) Technical Capability
2) Past Performance
3) Price
The Government will award the contract(s) resulting from this solicitation to those offerors: (1) whose proposal is technically acceptable, incorporates the use of Biobased Products that are applicable to this type of service, and (3) whose technical/price relationship is the most advantageous to the Government. Award may not necessarily be made for technical capabilities that would appear to exceed those needed for the successful performance of the work. Award may not be made to the lowest price. The Government reserves the right to make price/technical trade-offs that are in the best interest and to the advantage of the Government. The Government may reject any or all offers if such action is determined by the Contracting Officer to be in the best interest of the Government.
When Technical Capability and Past Performance are combined, are approximately equal to cost or price.
Responses to this RFP need to address the following Evaluation Criteria from Section M:
1. Technical Capability—Detailed explanation of what equipment your firm has, how many employees, what training your employees have completed, a work or quality control plan (in general terms, how to perform the work) to plant seedlings.

REQUIRED – Submit with your offer a sample Work Plan that outlines how your firm handles and plants seedlings.
2. Past Performance—Submit the completed mandatory form (following page) for each reference of past jobs similar to this work for past 3 years, with complete references. Include any letters of commendation or recommendation from past jobs.
3. Price—Provide your best price up front. Contracting Officer intends to make award without discussions.
