52.212-2 Evaluation—Commercial Items.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical Capability (Viewed as a measure of contractor’s relevant experience and past performance)

2. Price

Technical Capability is comprised of an offerors past performance and experience. The Experience Questionnaire Form shall be completed by each offeror or provide the same information in an alternative format.

Furnish a list of three projects of relevant and similar magnitude completed by the firm within the last five years. For each project cited, provide:

a) the name of the project,

b) the location of the project,

c) the total cost of the project,
d) brief narrative of the project (less than ½ page per project),
e) name of the Government Agency or company contracting the work,
f) the name and phone number of the Contracting Officer or project Engineer (if a non-
government project) administering the project, and
g) any evaluation that you received.

The information from this form will be used to evaluate recent experience performing contract work. It will also provide contact information for previous projects that will be utilized in evaluating each offeror’s past performance.

Past performance is a measure of the degree to which an offeror, as an organization, has: (1) satisfied its customers, and (2) Met required delivery date(s). The Government will inquire about the following elements, which are all of equal importance in relation to each other, (1) quality of the offeror’s work; (2) customer satisfaction; (3) timeliness of the Firm during performance and the final completion of the project; and (4) overall business relations.

The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
