A. Items and Prices Quotes shall submit a firm-fixed price offer for all costs necessary to furnish all supplies according to the specifications in the following solicitation, for the United States Department of Agriculture (USDA) Animal Plant Health Inspection Service (APHIS), Plant Protection and Quarantine (PPQ).
Price quotes should be of sufficient detail to determine their adequacy.

This RFQ is in accordance with FAR Part 13 Simplified Acquisition Procedures.
Copy of the completed FAR 52.212-3 “OFFEROR REPRESENTATIONS AND
CERTIFICATIONS—COMMERCIAL. Vendors registered in SAM with Rep and Certs completed only complete part (b) (bolded and underlined in provisions below).
All Vendors not registered in SAM with completed Reps and Certs must do so and complete all of 52.212-3 and submit with quotation packet. SAM is located on the internet and site can be found by going to http://www.sam.gov.

Completed Schedule of items (See Part I, Section A – Services and Prices/Cost) to include the minimum lead time required by the quoter. Separate quotations will be accepted as well provided all other required information is included or the separate quotation is attached to this completed RFQ.

Electronic Brochures for each component with complete list of specifications showing that the proposed items meet the Minimum Specifications found below.
If a Vendor’s quotation package does not contain all of the items listed above, the quote may be considered incomplete for evaluation purposes and no further consideration will be given to the Vendors quote, thereby making a Vendor ineligible for award.
2. The intent of this RFQ is to make one purchase order (PO). Therefore, the awardee must be able to supply all line items in the quantities stated in the PO. In the event we are not able to make a single award, the Government reserves the right to make multiple awards.
3. The quotation packet shall be submitted via email to Jeremy.pouliot@aphis.usda.gov.
PART II - WORK STATEMENT
A. Background The USDA APHIS PPQ PDC trains federal personnel in the identification of pests and diseases.
To facilitate the development of this skill set, hardware such as binocular microscopes and external illumination lamps are used. Pest Identification training represents condition of employment for PPQ personnel and Customs and Border Protection (CBP) Agriculture Specialists. Failure to successfully complete pest identification training results in termination of the employee. The most recent and reliable hardware is required to perform this function and employees must receive training in equipment similar to that used in the field.
B. Scope of Work USDA APHIS intends to establish a firm-fixed price PO. The Government shall review the specifications found in the manufacture’s brochures to verify that the proposed items meet the minimum specifications spelled out below.
C. Period of Performance The effective period of performance (POP) for the contract shall be from date of award through sixty (60) days to allow for delivery. If a greater lead time is required to provide the quantity of items requested, USDA APHIS may find the quotation packet failing to meet the maximum lead time (non-responsive).

• Variable LED incident and transmitted illuminators
• Minimum 5 year on-site parts and labor warranty
Because employees are removed from Federal Service if they do not pass the Pest Identification course, it is critical that all scopes have the same capabilities as those in use in the field (outlined above).
Trainees may successfully file grievances based on equipment discrepancies.
USDA APHIS PPQ PDC also provides “loaner” scopes for the employees to take back to their hotels in order to study for exams. Due to this, the scopes must compact and easily transportable without need of disassembly and re-assembly. Max acceptable size shall be 17”high x 8.25” wide x 11.25” deep.
Lastly, scopes must be inter-member with one another to limit the number of spare parts need on hand.

E. Evaluation and Approval of Product
(a) The Government will award a Purchase Order (PO) resulting from this solicitation to the responsible contractor whose quote, conforming to the solicitation, will be most advantageous to the Government using the trade-off method. The following factors, will be used to evaluate quotes:

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(a) Definitions. As used in this provision--
“Commercial and Government Entity (CAGE) code” means--
(1) An identifier assigned to entities located in the United States and its outlying areas by the Defense Logistics Agency (DLA) Contractor and Government Entity (CAGE) Branch to identify a commercial or government entity, or
(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company that only changes its name.

52.212-3 -- Offeror Representations and Certifications -- Commercial Items. (July 2016)
The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through
(r) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).
Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

Disclosure Act of 1995 have made a lobbying contact on behalf of the offeror with respect to this contract, the offeror shall complete and submit, with its offer, OMB Standard Form LLL, Disclosure of Lobbying Activities, to provide the name of the registrants. The offeror need not report regularly employed officers or employees of the offeror to whom payments of reasonable compensation were made.

(1) The offeror certifies that each end product, except those listed in paragraph (f)(2) of this provision, is a domestic end product and that for other than COTS items, the offeror has considered components of unknown origin to have been mined, produced, or manufactured outside the United States. The offeror shall list as foreign end products those end products manufactured in the United States that do not qualify as domestic end products, i.e., an end product that is not a COTS item and does not meet the component test in paragraph (2) of the definition of “domestic end product.” The terms “commercially available off-the-shelf (COTS) item,” “component,” “domestic end product,” “end product,” “foreign end product,” and “United States” are defined in the clause of this solicitation entitled “Buy American—Supplies.”
