1.0 DETAILS OF SOLICITATION
1.1 DESCRIPTION OF AGREEMENT: This is a solicitation to establish one or more Blanket Purchase Agreements (BPAs). Pursuant to Federal Acquisition Regulation (FAR) 13.303, Blanket Purchase Agreements, the Contractor agrees to the following terms of a
BPA EXCLUSIVELY WITH UNITED STATES DEPARTMENT OF AGRICULTURE (USDA),
ANIMAL PLANT HEALTH INSPECTION SERVICE (APHIS). The contractor shall provide feed in accordance with the specifications outlined in Section 2.0 when requested by the Contracting Officer or the authorized representative of the Contracting Officer.
1.2 TERM OF AGREEMENT: USDA anticipates one or more five (5) year Blanket Purchase Agreement(s) (BPA). The effective period of this BPA is date of award through five years.
1.3 EXTENT OF OBLIGATION: The Government is obligated only to the extent of authorized call orders actually placed against this BPA.
1.3.1 Review for compliance to new statute or directive shall be completed, at least annually, before the anniversary of the BPA’s effective date. Any revisions to the BPA, as a result of this review, shall be accomplished by a bi‐lateral modification.
1.3.2 This agreement may be unilaterally terminated at any time by either party with a thirty (30) day notification and may be rewritten or revised at the option of the Contracting Officer.
1.3.3 Purchases after the specified period or exceeding the aggregate total dollar limitation shall not be authorized, nor considered an obligation.
1.3.4 The aggregate dollar limitation for the life of this contract is six hundred fifty thousand dollars $650,000.00. There is no minimum order guarantee under this BPA.
1.4 PRICING: The prices to the Government for all supplies under this BPA shall be as low as, or lower, than those charged the supplier’s most favored customer for comparable supplies under similar terms and conditions.
Prices for items listed on the Price Schedule (Section 3.0) will be solicited when a call order is anticipated. The intent is to order a bulk load not exceeding 30 tons approximately once per month. However, the amount and frequency may vary.
Contractors will compete for individual call orders. Call orders will generally range from $2,000 to $40,000. No single call order award may exceed $75,000. Call order requirements will be competed among at least three of the BPA awarded contractors and will be awarded to the lowest priced offeror that can deliver the feed in the requisite time frame indicated by USDA personnel.
1.5 PURCHASE LIMITATION: Call orders placed by individuals authorized under this BPA shall not exceed the dollar limitation listed on the Individuals Authorized to Place Calls, and under no circumstances shall calls exceed $75,000.00.
1.6 LIMITATIONS OF INDIVIDUALS AUTHORIZED TO PLACE CALL ORDERS AND
DOLLAR AMOUNT: Any USDA authorized purchase card holder is allowed to place calls under this agreement up to their authorized purchase limit. Copies of each call must be submitted in writing to the Contracting Specialist, Leah Schultz at leah.h.schultz@aphis.usda.gov.
1.6.1 Orders under the BPA will be issued as a Firm Fixed Price, although the quantity of items required may vary.
1.7 RECEIPT AND ACCEPTANCE OF PURCHASES: Receipt of purchases shall be indicated by signature and date on the appropriate form by the authorized Government representative. This shall be subject to acceptance by the assigned inspector or customer when compared to the documentation of the original call. A sales slip, delivery ticket, and/or SF Form 1449 may be used for receipt and acceptance.
1.8 INVOICES: The Contractor shall submit an original invoice for each call order (or an electronic invoice copy, if authorized) to the address designated in the contract to receive invoices. An invoice must include—
(1) Name and address of the Contractor;
(2) Invoice date;
(3) BPA number, contract line item number and, if applicable, the order number;
(4) Description, quantity, unit of measure, unit price and extended price of the items delivered;
(5) Terms of any prompt payment discount offered;
(6) Name and address of official to whom payment is to be sent; and
(7) Name, title, and phone number of person to be notified in event of defective invoice. Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. 3903) and Office of Management and Budget (OMB) Circular A‐125, Prompt Payment. Contractors are encouraged to assign an identification number to each invoice. The invoice will be verified by the customer and the customer will make payment using the government purchase card.
1.9 DELIVERY: All items will be FOB Destination. For delivery, the amount shall be one bulk load (capable of carrying approximately 25‐28 tons of feed) depending on the transportation and as indicated on the call order.
1.10 POINT OF CONTACTS (POCs): When BPA call orders are issued, the contractor will submit invoices to the following POCs or to the specific invoicing address indicated on the BPA call issued against the BPA:

2.0 SPECIFICATIONS
The USDA APHIS Veterinary Services Tick Fever Program in Texas has a need to purchase cattle feed for the new import facility located in Presidio, TX. The estimated amount of feed needed each month is a bulk load (25‐28 tons). This is only an estimate and will depend on the amount of cattle imported at any given time. The required ration will need to be delivered an augured into an overhead bin. Feed will be ordered on an as needed basis.
2.1 COMPOSITION
The following are three possible compositions that will be needed depending on the time of year:
Ration A Milo 1050 lbs Peanut Hull Pellet 550 lbs Salt 100 lbs ‐ 5% Cottonseed meal 150 lbs Molasses 150 lbs
Ration B Milo 1100 lbs Peanut Hull Pellet 550 lbs Salt 50 lbs ‐2.5% Cottonseed meal 150 lbs Molasses 150 lbs
Ration C Milo 1150 lbs Peanut Hull Pellet 550 lbs
Salt 0 lbs ‐ 0% Cottonseed meal 150 lbs Molasses 150 lbs
***Please note that you may submit alternative ingredients for review by a USDA Veterinarian to determine whether it is an acceptable replacement. Any alternative ingredients must be submitted for approval by January 15, 2013. Please send an email to Leah Schultz at leah.h.schultz@aphis.usda.gov and identify the new ingredient and which ingredient it would replace. We will let you know if the proposed alternative is acceptable within 7 days. If it is acceptable, you may submit your formal proposal including the alternative as an acceptable replacement. If the proposed alternative is not approved and is included with the proposal, the proposal will not be considered for award.
2.2 DELIVERY
The feed will need to be augured into cattle feed bins upon delivery. The feed must be delivered to the following address:

2.3 INSPECTION
Inspection will take place at the time of delivery. Feed that is deemed not to be in compliance with the specifications will not be accepted.
3.0 PRICING

4.0 EVALUATION & SUBMISSION REQUIREMENTS
4.1 EVALUATION
In this acquisition, the Government will obtain best value by using the Low Priced Technically Acceptable (LPTA) source selection approach which requires the Government to award to the lowest priced offerors who certify that they can meet the specifications outlined in the solicitation in Section 2.0.
4.2 SUBMISSION REQUIREMENTS
In order to be considered responsive for this solicitation, offerors must submit the following:
1. A signed copy of the SF 1449 Form. Please complete Block 17a including vendor name, address, phone number, Federal Tax ID number, and DUNS number. Then, sign in block 30a. By signing the SF1449, it is a certification that the contractor can meet the specifications outlined in Section 2.0.
2. Completed Section 3.0
3. A “submitted” or “active” registration at https://www.sam.gov/portal/public/SAM/. Please note that if you had an active CCR registration that transferred to SAM and did not have an ORCA registration, you must either complete the certifications and representations in SAM.gov or complete the paper version FAR clause 52.212‐5 below.
4.3 SUBMISSION DEADLINE
Proposals are due via email, mail, or fax no later than 3:00 PM CT on 14 February 2013.
It is the contractor’s responsibility to ensure proposals are received on time. If submitting via email please note that file size limitations, formatting, or other problems may hamper receipt so please verify that the contracting officer has received your quote.

452.209 –71 Assurance Regarding Felony Conviction or Tax Delinquent Status for Corporate Applicants Alternative 1 (FEB 2012)
(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L.
No. 112‐74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –
(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and
(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.
(b) If the awardee fails to comply with these provisions, APHIS may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.
6.0 CONTRACT PROVISIONS
52.212‐2 Evaluation —Commercial Items (JAN 1999).
(a) The Government may award multiple blanket purchase agreements resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) In this acquisition, the Government will obtain best value by using the Low Priced Technically
Acceptable (LPTA) source selection approach which requires the Government to award to the lowest priced offerors who can meet the specifications outlined in the solicitation in Section 2.0.
b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the
Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212‐3 Offeror Representations and Certifications—Commercial Items (DEC 2012)
An offeror shall complete only paragraphs (b) of this provision if the offeror has completed the annual representations and certificates electronically via https://www.acquisition.gov . If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (c) through (o) of this provision.
(a) Definitions. As used in this provision‐‐
“Economically disadvantaged women‐owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women‐owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Inverted domestic corporation,” as used in this section, means a foreign incorporated entity which is treated as an inverted domestic corporation under 6 U.S.C. 395(b), i.e., a corporation that used to be incorporated in the United States, or used to be a partnership in the United States, but now is incorporated in a foreign country, or is a subsidiary whose parent corporation is incorporated in a foreign country, that meets the criteria specified in 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). An inverted domestic corporation as herein defined does not meet the definition of an inverted domestic corporation as defined by the Internal Revenue Code at 26 U.S.C. 7874.
“Manufactured end product” means any end product in Federal Supply Classes (FSC) 1000‐9999, except—
(1) FSC 5510, Lumber and Related Basic Wood Materials;
(2) Federal Supply Group (FSG) 87, Agricultural Supplies;
(3) FSG 88, Live Animals;
(4) FSG 89, Food and Related Consumables;
(5) FSC 9410, Crude Grades of Plant Materials;
(6) FSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) FSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) FSC 9610, Ores;
(9) FSC 9620, Minerals, Natural and Synthetic; and
(10) FSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil‐related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110‐174).
Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service‐disabled veteran‐owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service‐disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service‐disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service‐ disabled veterans or, in the case of a service‐disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service‐disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service‐connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Veteran‐owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
