Sites 1 and 2 must be planted between May 6 and May 19 to avoid a state threatened species.

Sites 3 and 4 planting may start when trees are available and site conditions allow and shall be completed prior to May 19, 2010.

AG-5F48-S-10-0005 12 Green County Tree Planting – 4 sites

This procurement is funded with American Recovery and Reinvestment Act funds. Reporting is required. Visit www.FederalReporting.gov for additional information.

The United States Department of Agriculture, Natural Resources Conservation Service (NRCS), Wisconsin, is seeking a Contractor to furnish all labor, equipment, materials, and incidentals required for tree planting and herbaceous weed control of approximately 53 acres consisting of four (4) sites for the NRCS Emergency Watershed Protection Program – Floodplain Easements. All work shall be done in accordance with the Tree Planting Plan.

Planting will be suspended during flood events. Do not plant trees in standing water.

THIS PROCUREMENT IS A SMALL BUSINESS SET-ASIDE. The Small Business size standard is based on the North American Industry Classification System (NAICS) code 115112, Soil Preparation, Planting, and Cultivating, which is $7.0 million average annual income.

Award of a purchase order is subject to the availability of funds.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. INVOICES

Contractor shall submit invoices to NRCS for review and acceptance. Upon completion and acceptance of each line item, an invoice may be submitted.

Invoices must be readable and include:

· date of the invoice

· invoice number

· description of supplies, quantity and prices

· payment amount

· name, phone number and e-mail address of Contractor point of contact for invoice questions

PAYMENTS

Payments will be made either by electronic deposit to the Contractor’s banking institution or by Government Purchase Card.

No site showings are planned and/or scheduled.

FAR 52.212-3 Offeror Representations and Certifications—Commercial Items (AUG 2009)

ALL OFFERORS MUST COMPLETE THE ANNUAL REPRESENTATIONS AND CERTIFICATIONS AT HTTP://ORCA.BPN.GOV.

(2) The offeror has completed the annual representations and certifications electronically via the ORCA website at http://orca.bpn.gov. After reviewing the ORCA database information, the offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications—Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation).

A complete response includes:

This project is 100% set aside for small business. If teaming arrangements occur, the small business awarded the purchase order must provide 51% of the labor required for the project. The Small Business Administration determines small business size standards, visit www.sba.gov for additional information.

All employees must be US citizens.

The Service Contract Act is applicable to this project. Minimum hourly rates exist for tree planters. The wage determination shall be publicly posted at the job site. Certified weekly payroll shall be provided to the COTR.

No action will occur until a pre-work meeting has occurred between the Contractor and the NRCS Inspector.

Contractors may invoice once an individual line item is complete and accepted.
