BASIS OF AWARD: Award will be made to the lowest responsive and responsible Contractor whose quote is technically acceptable. The information you provide in the Experience Questionnaire is equal to price or cost.

Mobilization is considered an indirect cost of this contract and will not be compensated as a separate work item. Mobilization consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site. Mobilization includes the obtaining of permits, insurance, and bonds.

All equipment and trailers shall be washed with all mud, debris, weeds, grasses, and seeds removed prior to being allowed on the project. Mower decks and equipment shall be cleaned of grasses, weeds, and seeds prior to leaving one dam area and moving to another. The Forest Service shall inspect all equipment prior to being unloaded off the transport vehicle.

52.217-5 Evaluation of Options. (July 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

52.217-7 Option for Increased Quantity-Separately Priced Line Item. (Mar 1989)

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 5 days. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

SECTION C - SPECIFICATIONS

C. 1. INTRODUCTION.

C.1.1. Background.

The Hoosier National Forest proposes to contract for technical forestry services to conduct the field phase of a Common Stand Exam (CSE) project. Its purpose is to obtain the site and setting characteristics required to identify stand conditions and capabilities in providing the Government with sound information with which management determinations for natural resources will be made.

C.1.2. Scope of Contract .

Work shall consist of locating, establishing, measuring and recording data for overstory and understory sample plots. The Contractor shall furnish all personnel, materials, services, and facilities necessary for the project and performance of this contract. Contractor will arrive on site with a data collector ready to begin work. The work performed and the data collected shall be in compliance with the terms, specifications, conditions and provisions of this solicitation and the Hoosier Field Guide, Version 1.4.

C.1.3. Location and Description.

This solicitation is for Common Stand Exams on the Hoosier National Forest, Brownstown Ranger District. Project work areas can be found on the attached vicinity area and stand maps.

Item 0001 Locations 42, 42, 43, 44, 45, 46, 47, 48, and 49 are south of Houston, IN. The specific stands to be inventoried are located on the attached stand exam contract maps. Road access is via local county roads. There are Forest Service roads in the area, but they are generally not drivable.

Optional Item 0002 Location 16 which is east of Houston, IN.

C. 2. DEFINITIONS.

The following are definitions that refer to data elements and attributes for collecting Common Stand Exam data.

2D. Receiving horizontal and vertical readings from the satellite(s).

3D. Receiving horizontal, vertical and elevation readings from the satellite(s).

Almanac Data. Satellite constellation information (including location and health of satellite) that is transmitted to your receiver from every GPS satellite. Almanac data must be acquired before GPS navigation can begin.

Acquire. Receiving satellite signals for a determined amount of time or an established amount of hits.

Coordinate system. Provides a reference of precise positioning for navigation and geographic information systems.

Datum. Geodetic datum’s defines the size and shape of the earth used in mapping the earth.

Depauperate. The undergrowth is usually of sparse conditions resulting from dense shading or thick duff. This situation requires the adjustment of canopy coverage values in the key to the next lower class (for instance, “well represented” becomes “common”), or extrapolation from the nearest nondepauperate condition occurring on a comparable site.

Differential GPS. DGPS is an extension of the GPS system that uses land-based radio beacons to transmit position corrections to GPS receivers.

Estimated Time of Arrival (ETA). ETA is the time of day you arrive at a destination.

Estimated Time Enroute (ETE). ETE is the time between your last and final destination, at your present speed.

Latitude. The north/south measurement of position that is perpendicular to the earth’s polar axis.

Longitude. An east/west measurement of position in relation to the Prime Meridian, an imaginary circle that passes through the north and south poles.

Map Projection. Map projections are attempts to portray the surface of the earth or a portion of the earth on a flat surface.

Microsites. Microsites are small areas atypical of the stand, such as wind-throw pockets, micro-drainage ways, seeps, well-rotted logs, or excessively rocky areas.

Navigation. Navigation is the process of traveling from one place to another and knowing where you are in relation to your desired course.

Plot Data Form. The Plot Data form is used to collect data at the plot level and is independent of the information collected at the setting level. This data is collected individually for all sample plots in the stand.

pdr (.pdr) File. Personal Data Record is a file format containing filed data that has been created using ExamsPC software. The file extension is .pdr.

Position. An exact, unique location based on a geographic coordinate system.

Position Dilution of Precision (PDOP). PDOP is the position error that degrades position accuracy when satellites are being tracked.

Sample Design Form. The Sample Design form contains information about how the data was collected, which trees, shrubs and cover are measured, and how the measurements shall be converted to pre-acre values.

Selective Availability. Selective availability is a security technique that limits the accuracy of a receiver by broadcasting GPS information that contains built-in error.

Setting Data Form. The Setting Data form in used to collect data that uniquely identifies each stand.

Shape (.shp) File. Shape file is a format developed by ESRI and used in Arcinfo and other GIS packages. The file extension is .shp.

Stand. A stand is a community, particularly of trees, possessing sufficient uniformity as regards composition, age, spatial arrangement, or condition, to be distinguishable from adjacent communities, so forming a silvicultural or management entity.

Waypoint. A specific location saved in the receiver’s memory.

WPT (.wpt) File. WPT is a file format, developed by Oziexplorer, containing a list of waypoints that have been saved in the receiver’s memory. The file extension is .wpt.

C. 3. GOVERNMENT FURNISHED PROPERTY AND SERVICES.

The Government shall provide the Contractor the following listed materials, supplies, property or services, for use in the performance of this contract, hereinafter referred to as Government-Furnished Property. This property shall be used and maintained by the Contractor in accordance with the provisions of the “Government Property” FAR clause, (Reference Clause 52.245-4).

All Government-Furnished items shall be returned to the Government upon completion of the contract. Failure to do so may result in charges for damages or replacement.

Services:

(a) At the Contractors request, the Government shall provide one review of the inspection procedures. This review shall be performed on one plot.

(b) At the Contractors request, the Government shall accompany the Contractor on one plot to review data collection procedures.

C. 4. CONTRACTOR WORK REQUIREMENTS and STANDARDS.

C.4.1. General.

C.4.1.1. Number of plots per Stand

The number of plots in which data will be collected is provided on the attached maps. Both understory and overstory data will be collected at each plot.

C.4.1.2. Site Index Trees

One site tree shall be taken per stand inventoried. Record the diameter, height, species, and age for each site tree. Select a site index tree of the proper species for the Forest Type and is one of the dominant or codominant trees within the stand. The age shall be determined by using an increment bore. Diameter of site trees shall be measured to a tenth of an inch. Age shall be the total rings counted. The increment bore should reach the pith of the tree. If the site index tree is not measured on an inventory plot, then record the GPS coordinate of the site. Increment cores shall be placed back in the hole made by the increment bore and the site tree flagged with two flags that go completely around the bole of the tree.

C.4.1.3. Contractor-Furnished Property

The Contractor shall use data recorders capable of using the Exams software to collect stand exam data in the Common Stand Exam format (.pdr). The contractor shall also collect the inventoried plot locations using GPS that has the capability to locate the plot within + 10 meters of the actual plot location. The contractor shall provide the Government all inventory work and GPS’ed plot locations in an electronic format that is acceptable to the Government. If rework needs to be done within a stand the contractor will provide flagging (color has to be agreed upon by the COR).

C.4.1.4. Performance period.

Multiple award of items shall not change the required performance period for each item. If multiple items are awarded to one Offeror, the respective performance times shall run concurrently, not consecutively. Work may be performed on each item in succession, provided the required rate of progress is maintained. The Government shall issue a Notice to Proceed as soon as the weather and ground conditions are favorable for work. The count of contract time shall start on the date specified on the Notice to Proceed.

C.4.1.5. Rate of progress.

The Contractor shall maintain the rate of progress specified in the Contractor’s Resource Plan. The minimum acceptable rate of progress shall occur when the percent of work completed falls within 10 % of the time used.

C.4.1.6. Access.

The Forest Service assumes no obligation to plow snow or do special maintenance to keep roads open. Stands are accessible by some combination of 2 or 4-wheel drive vehicle and foot travel. The Contractor shall be responsible for obtaining all necessary permission, through privately owned land, to gain access to stand locations.

C.4.1.7. Locked gates

In cases where stands are behind locked gates, authorization for limited motorized use may be granted. All requests for motorized travel of closed roads must be submitted in writing to the COR for specific roads and specific periods of time. If access is granted behind a gate, the Contractor will be responsible to ensure that gates remain closed and locked at all times and will be subject to all other restrictions of administrative use. The Contractor shall be permitted to drive from the locked gate to the stand with only the minimum number of vehicles necessary for efficient transport of the crew. No firearms are permitted behind locked gates. No access to contractors or employees will be allowed behind locked gates after periods of work. Motorized access will not be permitted behind locked gates during hunting season of turkey or deer. Contractor shall adjust work schedule to take the closure time into consideration.

No Suspend Work Orders will be issued; contract time will run during this period. Any miss use of gates may constitute loss of privileges.

C.4.2. Plot Location and Establishment.

C.4.2.1. Plot Location.

. A list of sample plot locations (latitude and longitude coordinates) within each stand will be provided by the Government at the prework conference. These locations can also be provided in shape file formant at the contractors request.

Survey Technique – A global positioning system (GPS) shall be used to locate plot centers. Acceptable error is +/- 10 meters (33 feet) from plot center. Recurring errors in location of sample plots greater than the acceptable error shall make the stand survey unsatisfactory and relocation of sample plots and remeasurement shall be required.

The examiner should spend some time becoming familiar with the project area before beginning data collection. This should include a review of source documents and a general orientation to the area where the plots are being taken. At a minimum topographic maps, leaf-off photography (if available) and existing compartment records should be reviewed prior to the initial field visit.

The first field visit should include becoming familiar with major roads, streams and other physical features that can serve as reference points for future field days.

C.4.2.2. Plot Location Technique and Establishment.

The Contractor shall navigate to plot by utilizing a global positioning system. Plot centers for each plot will be identified on the ground as described below. The Government will provide coordinates for each plot after the notice to proceed. Flagging at plot center will be labeled with location number, stand number, and plot number. The flagging will be placed directly over the plot center or starting point on a branch or other available vegetation as close as possible to plot center. A stick will be placed at plot center with a 4” piece of flagging tied to it. Contractor should be sure the stick is in the ground as the plot center will be used when inspecting the contractor’s work.

Once plot center is established, the contractor shall start at True North and rotate clockwise when tallying trees. The first tree on the plot will be True North from plot center or the first tree encountered rotating in a clockwise manner from True North. The Contractor shall use the provided flagging to locate plot centers.

C.4.2.3. Plot Acquisition.

The Contractor shall acquire GPS coordinates for each plot center.

C.4.3. Common Stand Exam.

C.4.3.1. The Contractor shall locate, establish, measure and record data using variable and fixed radius subplots that shall be taken at each designated sample point. CSE data shall be collected and recorded in accordance with the Hoosier Field Guide unless specifically modified by this contract. The Contractor shall collect data necessary to complete the following forms, as specified in, Section C.4.4. – Data Collection.

C.4.3.2. The Contractor shall code all vegetation species in accordance with the Hoosier Field Guide.

C.4.3.3. A 1/750-acre plot (4.3’ radius) shall be used to determine trees < 1” DBH and > 1’ tall and 10 BAF prism shall be used to estimate the trees >1” DBH.

C.4.4. Data Collection.

The following tables demonstrate the required fields for each form that is to be collected and recorded. All data shall be taken in accordance with the Hoosier Field Guide. An “X” in the Exam Level column indicates the required fields for this solicitation.

C.4.4.1. Setting Form.

The Setting Form shall be used to record stand measurements, stand comments, sample point locations (site sketch and traverse notes), as well as design parameters and references.

C.4.4.4. Tree Data Form.

The Tree Data Form shall be used to record tree measurement information. The Contractor shall use the following criteria for selecting trees:

· The Contractor shall use the fixed subplot size used in talling trees ≤ 0.9” DBH. The Contractor fixed radius subplot tallies all live conifer and deciduous trees .01” DBH to ( 0.9" DBH; and all live conifer and deciduous trees 1.0’ tall to < 4.5’ tall.

· The Contractor shall use a 10 Basal Area Factor (BAF) to tally trees ≥ 1.0” DBH for each stand.

· All items shall be collected in accordance with the Hoosier Field Guide.

C.4.5. Work Plan and schedule.

The Contractor shall prepare a work plan and schedule that demonstrates work will be completed within the performance period described in Section F.2. - Deliveries. The Contractor shall provide a general plan with the technical proposal. A supplementary plan and schedules will be provided after contract award, but 5 days before the start of work. The Contractor shall advise the Contracting Officer or COR of any periods that the Contractor will not be working that is not specified in the accepted Work Plan. The Contractor may update the work plan when work is in progress and the Contracting Officer may accept the updated work plan.

FAR 52.246-4 Inspection of Services – Fixed Price (Aug 1996) E.2. Acceptance and Rework E.2.1.1. Acceptance will be determined based on compliance with the contract specifications. Noncompliance will result in non-acceptance of the work. If the Contractor’s work is determined to be unacceptable, the Government may initiate any remedies described in FAR 52.246-4 Inspection of Services.

E.2.1.2. When the Contractor’s inspection results fall below the performance standard of < 4.99% for Form Score and < 9.99% for Total Score; based on the Government inspection, acceptance and payment will not be made until the deficiency(s) has been corrected.

E.2.1.3. Payment will be made only on completed plots unless otherwise agreed upon by the Contracting Officer.

E.2.1.4. The Government shall initiate a pass-fail check of specified standards and procedures for each inspection block. Inspection blocks deficient in the following specifications are unacceptable on a "pass-fail" basis and the entire inspection block shall be returned to the Contractor for rework. The determination of noncompliance with these items may be made during the office edit or during field inspection

a. All completed forms and electronic data not submitted to the Forest Service in a timely manner.

b. Forms that are illegible or cannot be reproduced.

c. Stands submitted with incomplete and/or inaccurate information on any form, paper or electronic.

d. Electronic data that cannot be read by Government computers.

e. Any error found in the Sample Design.

f. Any stand having less than the prescribed number of sample plots examined.

g. Any stand with plots not evenly distributed throughout the stand.

h. Any sample plot center < 1 chain from the stand boundary, any sample plot center falling outside the stand boundary, and/or overlapping data. ie: the same vegetation measured on more than one plot.

i. Any sample plot center which cannot be located because of improper labeling, improper reference point labeling, improper GPS referencing or for any other reason attributable to noncompliance with specifications.

j. Any tree with a discrepancy in tree status between live and dead.

k. Any tree with a missing or incorrect tree species on live trees ≥ 1.0” DBH.

E.3.1 Rework.

E.3.1.1. Upon notification to the Contractor of a failed From Score of ≥ 5.00%, the Contractor shall be required to rework all forms on every plot within the inspection block before beginning work on another inspection block.

E.3.1.2. Upon notification to the Contractor of a failed Total Score of > 10.00%, the Contractor shall be required to rework all plots within the entire inspection block before beginning work on another inspection block.

E.3.1.3. At the Governments option, during a rework the Contractor may be required to use a different colored ribbon at each plot center. The COR shall specify the color of the ribbon. If a different color of flagging is called for it shall be at the contractor’s expense.

E.3.1.4. The Government is not required to provide more than 2 inspections on any single inspection block. Results of the last inspection will supercede any prior results for determining acceptability and payment. Failure to pass 2 inspections on a single inspection block may result in contract default.

E.3.1.5. The Government will assess the Contractor the actual costs of conducting any additional inspections. Items that may be included in the actual damages include but is not limited to: wages of the COR and Government inspector(s), costs of vehicles, meals and lodging.

SECTION F--DELIVERIES OR PERFORMANCE

FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1) CLAUSES

AGAR 452.211-74 Period of Performance (FEB 1988) The period of performance of this contract is from June to October 2015.

F. 2. DELIVERIES

F.2.1. Contract Performance Time and Required Rate of Progress

The Contractor shall maintain progress at a rate that will assure completion within the performance period. The minimum acceptable rate of progress shall occur when the percent of work completed falls within 10% of the time used.

F.2.2. Contract Time. The Contractor shall start work promptly after receipt of Notice to Proceed unless otherwise agreed with COR. The Contractor shall maintain progress at a rate that will assure completion within the stated contract time.

It is required that Contractor(s) submit a minimum of 10% of work for inspection/acceptance within 30 calendar days of effective date of Notice to Proceed, and, 50% of the respective Contractor's work must be completed and submitted for inspection/acceptance within 90 calendar days of effective date of Notice to Proceed unless otherwise agreed with COR. The Government will issue A Notice to Proceed as soon as weather, vegetation, and ground conditions are favorable for work on one or more of the areas. Contract time will start (1) on the date specified on the Notice to Proceed, if the notice is hand-delivered; Or (2) Contract Time will start on the third-day after the post office has issued a Notice of Certified Mail to the Contractor. Failure of the Contractor to pick-up Certified Mail will not be considered excusable.

F.2.3. Work Completed after the performance period. Whenever the Contractor fails to complete work within the performance period, and is allowed to work beyond that period, the Contractor will be assessed actual damages. Items to be included in the actual damage includes but is not limited to: wages of the COR and Government inspector(s) for quality assurance after the performance period, costs of vehicles, meals, and lodging that are incurred while administering the contract after the performance period.

F. 3. FAR 52.236-6 SUPERINTENDENCE BY THE CONTRACTOR.

At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor.

F. 4. PERFORMANCE BASED INCENTIVES

This contract contains both positive and negative incentives. The Contractor shall perform work in accordance with the specifications contained in this contract, and their technical proposal (Hoosier Field Guide) that is incorporated by reference. These performance based incentives apply to initial submissions with acceptable work, those items that are rejected or have previously been rejected and corrected do not fall into this population. If by chance an Individual Form Score and the Total Score fall within different incentive percents then the lower incentive percent will be used. These incentives will apply on a per stand bases.

SECTION G--CONTRACT ADMINISTRATION DATA

AGAR 452.215-73 Post Award Conference (NOV 1996) A post award conference with the successful offeror is to be arranged at time of award.

G.1. SUBMISSION OF DATA AND INVOICES

G.1.1. The Contractor shall submit completed payment items within fourteen (14) days after completion of work.

G.1.2. The unit of measure shall be the plot. At least 10% of the plots will be inspected in each compartment.

G.1.3. The Contractor shall submit with each inspection block the following, reference Figure 1, Typical CSE Process with Deliverables.

· Electronic field data in ExamsPC (.prd) file format.

· Upon completion of each inspection block, the Contractor shall ensure that completed data is unique.

· Inspection block shall be by location unless otherwise agreed to by the COR.

G. 2. METHOD OF MEASUREMENT

G.2.1. The Government’s inspection will not be initiated until the Contractor submits all data for the inspection block (usually by compartment). All linear and area measurements under this contract are measured on a horizontal plain within the established boundaries.

G.2.1.2. Plots selected for field inspection shall be checked for accuracy in latitude and longitude coordinates. If the coordinates are not within tolerance as stated in this contract, all plots in the inspection block shall be returned to the Contractor for rework plus the incorrectly located plots shall be relocated and remeasured.

G.2.1.3. If during the office inspection, the COR determines a discrepancy trend is occurring, the COR shall notify the Contractor of the finding.

G.2.1.4. If during the field inspection, the COR notices a discrepancy trend developing, the Government may visit additional plots, to review the field(s) in question. These plots will be used to determine if a discrepancy trend does exist. The COR shall notify the Contractor of the findings.

G.2.1.5. If any discrepancy trend continues in any inspection, the inspection block(s) will be returned for rework.

G.2.2. Re-measurement. If the COR’s original inspection results are unacceptable to the Contractor; the Contractor has the option to request, in writing, a re-measurement. Upon the requested re-measurement the Government will conduct a minimum 2% sample. Requests for re-measurement shall be made within five (5) calendar days after receipt of non-compliance and shall contain documentation to support the probability that an error exists. The contractor may accompany the Contracting Officer’s Representative during the re-measurement.

G.2.2.1. If re-measurement supports a variance of < 5%, there will be no adjustment and the Government’s final results will supersede the original assessment and be used for the basis of pay determination. The Contractor shall pay for the actual cost of re-measurement.

G.2.2.2. If re-measurement results supports a variance of > 5%, payment shall be based on the re-measurement results and the Government shall pay for the re-measurement.

G. 3. METHOD OF PAYMENT

G.3.1. Payment Calculation. A point deduction is given for each deficient entry or procedure within an inspection block. Acceptable tolerance levels for individual measurements are shown on the Common Stand Exam Inspection Form. Any item or measurement indicated by inspection to be outside these tolerance levels shall be assigned a point deduction. Point deductions shall be calculated for each form within the inspection block and then totaled for a Total Score. An inspection block may fail based on a Form Score or the Total Score.

G.3.1.1. Form Scores for each field form and Total Score for the overall inspection block; will be calculated using the Point Score Calculation Form. Form Scores are determined by entering the total number of errors, corresponding to each field, found during the inspections of the inspection block and recorded in Column B-Total Number of Errors. Column C- Point Deduction, is calculated by multiplying Column B-Total Number of Errors by Column A- Point Value. The Point Deductions are then totaled in Field D-Total Deductions. Field F-Total Form Score is calculated by dividing Field D- Total Deductions by Field E- the total number of stands or points that were actually inspected for that Form.

Point Deduction Column C = Column B-Total Number of Errors x Column A- Point Value

Total Form Score Field F = Field D- Total Deductions ÷ Field E- the total number of inspected attributes

G.3.1.2. The Total Score is calculated by summing all the Form Scores; see Total Form Score Calculation on the cover of the CSE Inspection Form. Errors in any field that has a Point Value of "unacceptable" will fail and the entire inspection block shall be returned to Contractor for rework.

Form Score.

· All Form Scores < 5.00 and Total Score < 10.00 = acceptable, 100% payment.

· Any Form Score ≥ 5.00 = unacceptable, all forms from entire inspection block, shall be returned for rework. No payment.

Total Score.

· Total Score ≥ 10.00 → ≤ 14.50 = acceptable/unacceptable, The contractor may either rework the entire inspection block or submit the work at a reduced price as outlined in paragraph G.3.1.3 below. This option is at the contractor’s discretion. The contractor shall provide a written determination to the COR prior to reworking a block.

· Total Score > 14.50 = unacceptable, all work from entire inspection block, shall be returned for rework. No payment will be made until the work meets acceptable criteria.

G.3.1.3. The following reduced payment schedule may be implemented at the Contractor’s request if the Contractor’s Total Score is ≥ 10.00% and ≤ 14.50%.

≥ 10.00 → ≤ 11.50% = 90% payment

≥ 11.51 → ≤ 13.00% = 80% payment

≥ 13.01 → ≤ 14.50% = 70% payment

G.3.1.4. An inspection block is considered complete when all work has been assessed for quality assurance and accepted for payment.

SECTION H - SPECIAL CONTRACT REQUIREMENTS

H. 1. KEY PERSONNEL

H.1.1. The Contractor shall assign to this contract the key personnel identified in their technical proposal and that list may include the following:

· CONTRACTOR REPRESENTATIVE

· FOREMAN/WOMAN

H.1.2. The Contractor shall make no substitutions of key personnel without notifying the Contracting Officer within a reasonable timeframe and in advance, and shall submit justification (including proposed substitutions) in sufficient detail to permit evaluation of the impact on the contract. Proposed substitutes should have comparable qualifications to those of the persons being replaced.

H.1.3. The Contractor shall make no diversion of personnel without the written consent of the Contracting Officer.

H.1.4. The contract will be modified to reflect any approved changes of key personnel.

H. 2. PREWORK CONFERENCE

Prior to commencement of work, the Contractor shall attend a meeting to discuss the contract terms, work performance requirements, and safety. Also at this meeting such items as work progress schedule, camping/worksite plan and communications shall be finalized in writing. A prework meeting location will be determined once the contract is awarded.

H-3 .

PERSONAL PROTECTIVE EQUIPMENT

1. The contractor will train in the safe operation and use of equipment to all workers using such equipment.

2. Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards or processes encountered in a manner capable of causing injury or impairment in the function of any part of the body.

3. Defective or damaged personal protective equipment shall not be used.

4. The contractor shall assure that each employee wears foot protection that provides adequate traction and ankle support.

5. The contractor shall provide, at no cost to the employee, and assure that each employee who works in an area where there is potential for head injury from falling objects or flying objects wears a hard hat that meets the minimum requirements of American National Standards Institute (ANSI) standard Z89.1-1997.

6. The contractor shall provide, at no cost to the employee, eye protection where there is potential for eye injury due to flying objects. This eye protection must meet the minimum requirements of ANSI standard Z87.1-2003.

7. The contractor shall provide, at no cost to the employee, hearing protection where there is a potential for hearing loss due to high intensity noise e.g., chain saw operation.

52.223-1 Biobased Product Certification. Biobased Product Certification (May 2012)

As required by the Farm Security and Rural Investment Act of 2002 and the Energy Policy Act of 2005 (7 U.S.C. 8102(c)(3)), the offeror certifies, by signing this offer, that biobased products (within categories of products listed by the United States Department of Agriculture in 7 CFR part 3201, subpart B) to be used or delivered in the performance of the contract, other than biobased products that are not purchased by the offeror as a direct result of this contract, will comply with the applicable specifications or other contractual requirements

52.223-2 Affirmative Procurement of Bio based Products Under Service and Construction Contracts.(Sept 2013)

(a) In the performance of this contract, the contractor shall make maximum use of bio based products that are United States Department of Agriculture (USDA)-designated items unless—

(1) The product cannot be acquired—

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(b) Information about this requirement and these products is available at http://www.biopreferred.gov.

(c) In the performance of this contract, the Contractor shall—

(1) Report to http://www.sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated bio based products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and

(2) Submit this report no later than—

(i) October 31 of each year during contract performance; and

(ii) At the end of contract performance.

AGAR 452.209 – 70

Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction. (FEB 2012)

(a.) Awards made under this solicitation are subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. To comply with these provisions, all offerors must complete paragraph (1) of this representation, and all corporate offerors also must complete paragraphs (2) and (3) of this representation.

(b) The Offeror represents that –

52.212-1 Instructions to Offerors—Commercial Items. (Apr 2014)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the…
