PERFORMANCE WORK STATEMENT
PROJECT DESCRIPTION AND LOCATION
Background
The purpose of this contract is to provide vegetative management services to the Cold Springs - Poteau Ranger District of the Ouachita National Forest in west central Arkansas.
Scope of Contract
The contractor shall furnish all labor, materials, supervision, transportation, equipment, tools and supplies to perform handtool work on National Forest Lands in accordance with the specifications.
A total of 1,370 acres will be treated, however the Forest Service reserves the right to remove one or more areas from the contract based on the best interests of the Government and the availability of funds.
Project Location
The Project Areas are located in the Ouachita National Forest, Poteau Ranger District in Western Arkansas and will be administered by District Personal. More detailed maps will be given to the Contractor when work is awarded.
Project Access
a) The project area shall be accessed by Forest Service Roads. The Forest Service assumes no obligation to perform any special maintenance in order to keep roads open.
b) The National Forest’s Motor Vehicle Use Map (MVUM) for the individual Ranger Districts (available upon award) provides open road information. The Contractor will be issued a Forest Service key in order to access those roads that are seasonally closed by gates. Forest Service roads that are permanently closed by earthen berms or some other obstruction will have to be accessed by foot or, if available, UTV.
c) Contractors are subject to the same rules as Forest Service personnel regarding the use of off-road vehicles and must use only utility task vehicles (UTV) or side by sides. These vehicles differ from all-terrain vehicles (ATV) in that UTV payloads run from 800 to 1,350 pounds above the operator/passenger’s weight. UTV also have roll-over protection and seat belts unlike ATV.

The period of performance of the awarded contract is estimated from contract award through October 31, 2016.
Technical Specifications
Resource Protection Treatment applications shall not be applied within Streamside Management Zones that are comprised of a minimum one hundred feet either side of a perennial stream and thirty feet either side of a defined stream. Improvements such as fences, gates, property boundaries, corner monuments, and trees that are marked or identified with paint, signs, tags, and/or blazes shall be protected by the contractor.
Trees that are located adjacent to roads, fire lines, fences, private property, right-of-ways, or other structures and are designated for treatment shall be severed and felled so as not to damage, lean on, clog or otherwise obstruct existing structures or facilities.
The contractor will notify the COR immediately of any damaged structures and repair damages that have resulted from the contractor’s operations.
Treated vegetation will be removed from all right-of-ways unless otherwise directed by the COR.
Protect residual leave crop trees from fire through the removal of slash that lies within three feet of the bole or by a distance specified by the COR.
All treated vegetation shall be lopped and scattered to lie within two foot of the ground for approximately one hundred feet either side of a highway or trail that has been designated as having a scenic integrity objective of moderate, high or very high unless otherwise directed by the COR.
Where needed, stream crossings shall be designated by the COR.
Lead off and wing ditch structures that have been constructed for system roads shall be protected.
Vegetation Targeted For Treatment Treat all pine and hardwood stems not designated for retention that are located within the clearing limits of permanent wildlife openings. Retain existing large hardwoods stems up to thirty square feet of basal area per acre.
Treat all trees that are deformed, stunted, broken, bent over and/or otherwise damaged.
Areas that are designated for the manual felling method of treatment shall have the cut trees completely severed from the stump as close to the ground as is practical but not higher than six inches from ground level on the uphill side of the tree unless otherwise specified by the COR. The severed stems shall not lean against or hang in leave crop trees but rather they shall lie within two feet of the ground. This may require the cut trees to be bucked up into shorter segments.
Areas that are designated for a girdling method of treatment may complete the operation using any mechanical or manual hand tool so long as the tool girdles a stem to the following standard:
Girdling will form a closed circle around the stem being treated, no higher than three feet above the ground. Girdles shall go through the bark and penetrate into the cambium and solid wood a minimum of one half inch deep. That section of bark, cambium layer, and wood shall be removed completely encircling the stem forming a two-inch wide by one-half inch deep girdle into the solid wood portion of the treated stem.
If an inadequate number of snags exist within a treatment area then girdle two twelve inch or larger trees per acre.
Smaller trees may be girdled to serve as snags when there are no existing larger stems.
All stumps will be no higher than 6 inches above ground level on the uphill side unless otherwise directed by the COR. Do not leave felled trees hanging in or lodged on nearby leave trees.
Pine is the primary crop tree to be released on the Ouachita National Forest. Treat all competing vegetation that is at least one-half the height of the crop trees unless designated as leave trees. Retain at least 10 to 30 percent hardwood when possible. Priority of selecting hardwood species for retention shall be red oak, white oak, hickory, black gum, and ash. Maple, ironwood, sweetgum, and elm shall not be selected as retention trees except where no other hardwood species are available.
Treatments shall not start until thirty minutes after sunrise and will stop sixty minutes before sunset within an active RCW cluster.
Trees designated for treatments that occur adjacent to roads, pipelines, fire lines, fences, and trails will be felled away from those structures. Slash felled in ditches, roadways, or on any of the structures mentioned above will be removed.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. FAR 52.228-5 Insurance - Work on a Government Installation. (JAN 1997)
(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.
(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective -
(1) For such period as the laws of the State in which this contract is to be performed prescribe; or
(2) Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.
(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in subcontracts under this contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the contract. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting Officer upon request.
AGAR 452.228-71 Insurance Coverage. (NOV 1996)
Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:
(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.
(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.
(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.
(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury.
Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

FAR 52.244-6 Subcontracts for Commercial Items. (MAR 2015)
(a) Definitions. As used in this clause-
Commercial item has the meaning contained in Federal Acquisition Regulation 2.101, Definitions.
Subcontract includes a transfer of commercial items between divisions, subsidiaries, or affiliates of the Contractor or subcontractor at any tier.

(a) Contractor's Responsibility for Fire Fighting. (1) The Contractor, under the provisions of FAR clause
52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES,
AND IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. (2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor's agents or employees.
(b) Contractor's Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.
(c) Contractor's Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to fire fighting). An equitable adjustment for the temporary use of employees and equipment will be made under the CHANGES clause, FAR 52.243-4.

Technical Proposal Instructions: The technical proposal will be used to make an evaluation and arrive at a determination as to whether the proposal will meet the requirements of the Government. Therefore, the technical proposal must present sufficient information to reflect a thorough understanding of the requirements and a detailed description of the techniques, procedures and programs for achieving the objectives of the statement of work. Proposals which merely paraphrase the requirements of the Government's statement of work, or use such phrases as "will comply" or "standard techniques will be employed" will be considered unacceptable and will not be considered further. As a minimum, the proposal must clearly provide the following:
1. Technical capability to perform vegetative management services in complex management areas for habitat restoration and near endangered species.
• Organization: Provide an experience statement that provides a description of comparable projects performed by the organization. Proposals shall include a list of key personnel for work on the project, including the supervisor/foreman and other key employees, as well as proposed subcontractors to be assigned to the project, and detail their relevant experience in the type of work to be done under this contract.
• Plan of Operations: Provide a narrative that describes how the work will be organized and managed so that all activities are completed in accordance with contract specifications and within the allotted contract time. At a minimum, provide a general plan for the sequence of work across the project, including all work items.
• Quality Assurance: Identify or describe your quality assurance surveillance plan (QASP) and self-inspection procedures that will ensure objectives are being met during operations. The discussion of quality should include the inspection system used to satisfy the requirements of the contract.
2. Past Performance: Offeror shall submit 3 - 5 references for projects of similar size, scope and dollar value (completed in the past 3 years) including company names and points of contact with current/ verified telephone numbers and e-mail addresses.
3. BioPreferred® Products: The purpose of the USDA BioPreferred® program is to promote the increased purchase and use of biobased products. Offerors shall include within their proposal an affirmative statement of action(s) they would take during the performance of this contract to include the use of biobased products such as hand washing or other cleaning agents, unless precluded by performance, cost, or availability. The use/ non-use of biobased products will not be an evaluation factor in awarding any subsequent contract; however, failure to address the subject matter within the proposal may render the proposal as non-responsive to the RFP requirements.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).
Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate-
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
