4. Identification of the statutory authority permitting other than full and open competition.

FAR 6.302-1 – Only One Responsible Source and no Other Supplies or Services will Satisfy Agency Requirements Citation: 41 U.S.C. 3304(a)(1).

FAR 6.302-1, “Only one Responsible Source and no Other Supplies or Services will Satisfy Agency Requirements at the level of quality required because the supplies or services ordered are unique or highly specialized”. In this case a brand name justification is being provided for the 100,000 units of TydenBrooks EZ-Loc 1/16” x 12” tanker cable seals.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

Brand Name Justification TydenBrooks EZ-Loc 1/16” x 12” tanker cable seal is a specialized security product for the food safety industry. USDA/FSIS management determined that TydenBrooks’ tamper-proof seal is a mandatory requirement to transport egg products in a safe and secure manner. The tanker/cable seals are used by all Egg Plants around the United States.

The tanker seals are used to seal and/or secure the back of an egg tanker carrying liquid product. When the tanker arrives at the next egg processing establishment, the FSIS employee at that establishment ensures the tanker of egg product has not been compromised. The EZ-Loc 1/16” x 12” tanker cable seal is necessary in order to safeguard egg products during transport. The TydenBrooks’ EZ-Loc 1/16” x 12” tanker cable seal brand product provides a satisfactory tanker seal so that the egg products remain tightly seal to prevent anyone from tampering with the eggs.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

This requirement is being posted on FedBizOps and will be open to all sources.

7. Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable.

Price will be determined to be fair and reasonable prior to award. The CO will compare prices to the IGCE, market prices and costs previously paid under a Blanket Purchase Agreement to determine reasonableness.

8. Description of the market survey conducted.

Per the previous incumbent we learned that the items are no longer available on the General Service Administration’s Federal Supply Schedule and they are no longer made in the United States. Therefore, we must post this requirement to allow a fair opportunity.
