JUSTIFICATION FOR OTHER THAN FULL & OPEN COMPETITION

(JOFOC)

1. Identification of Agency: The U.S. Department of Agriculture, Agricultural Research Service, intends to conduct negotiations for acquisition of a FACSMelody, BDBiosciences, San Jose, CA. Pursuant to 41 U.S.C. 253(c) (1) as contemplated by FAR 6.302-1(a), only one responsible source and no other supplies or services will satisfy agency requirements

2. Action Being Approved: The Government’s minimum needs can only be met through one responsible source, BDBiosciences Inc. Franklin Lakes, NJ.

The acquisition is being conducted on the basis of other than Full & Open competition as the needs of the requisitioner can only be met through one source, and under the Federal Acquisition Streamlining Act, simplified Acquisition Procedures.

3. Description of supplies/Services Required to Meet the Agency’s Needs: BD FACSMelody, cell sorter. Price:$249,645

4. Authority: The authority for other than full & open competition is pursuant to 41, U.S.C. 252 (c )(1) as contemplated by AR 6.302-1(a), only one responsible source and no other supplies or services will satisfy agency requirements.

5. Unique Qualifications/Nature of Acquisition:

The BD BioSciences FACSMelody is the only small cell sorter with a small footprint using a gel coupled flow cell, and the sensitivity needed in our lab. Because of the complex nature of how circulating immune cells interact and in light of the number of combination changes in cell population types can potentially change in response to an infection over time, our needs require that up to 9 different cell populations be able to be distinguished in a single rum. The FACD MELODY is the only instrument capable of this and using less capability negates the possibility of accomplishing the research goals set forth in the present research CRISs.

The FACS-Melody includes the Cell sorter, the fluidic cart, the monitor and computer, the ACDU (plate sorting, 6 well -384 well), 3 laser, 9 colors, 11 parameters.

Other salient features include:

•Sensitivity, published MESF values for FITC <80 and <30 for PE.

•QBr values (Fluorescence Detection Efficiency, published)

FITC Qr (x1000): 40 photoelectrons/ABD

PE Qr (x1000): 325 photoelectrons/ABD

•Beam size 9± 3 x 67 ±5 μm

•Laser beam alignment

Fixed and spatially separated alignment of all lasers with the cuvette flow cell

•Optical coupling

The quartz cuvette flow cell is gel-coupled by refractive index matching optical gel to the fluorescence objective lens for optimal light collection Numerical aperture 1.2. Increases sensitivity •Droplet sorting

•Purity and yield

At 23 psi and 34 kHz with an average of 10,000 events per second, a two-way sort of 5% target populations achieved a purity of 98% and a yield of >80% of Poisson’s expected yield for both populations. No limitation is imposed on the event rate (one event constitutes a selected cell being gated out of the general population, counted and collected in a receptacle vessel). However, yield decreases with higher event rates based on Poisson distribution principles.

6. Potential Sources Solicited: Bio Rad Laboratories is the only company which offers a high throughput (can run up to 96 samples at a time) instrument which is also capable of generating 20,000 uniform droplets which enables the user to obtain more accurate data with fewer runs. Competing sources offer machines that are either very low throughput (8 samples at a time) or do not offer uniform droplet technology which affects the accuracy of data generated.

7. Fair and Reasonable Costs: Fair and Reasonable has been determined using market survey techniques and comparison to Previous purchases of similar Equipment that are not as advanced as the one being purchased which has no equal.

8. Market Survey: BD Biosciences is the only company that can provide a cellsorter with 96 well plate technology that has 3 laser and 11 parameters with the sensitivity needed to sort dim populations in tubes and plates and does not have reoccurring expenses associated with have to replace the chips/flow cells every day. It also is fully automated from start up to sorting with only the introduction of start up beads into the system.

9. Other Facts Supporting Use of Other than Full & Open Competition: ___BD has a full service organization that can provide local service within 24-48 hours. ______________________________________________________________________________________________________________________________________________________
