CONSTRUCTION SPECIFICATION
409. TREE PLANTING
1. SCOPE
The work shall consist of site preparation, furnishing and planting all trees of the kinds and sizes specified, at the locations shown on the drawings and as required in the specifications.
2. MATERIALS
Plant materials shall be grown from seedlings or seed sources that originated from within plant hardiness zones 6 or 7 and from within states adjoining Tennessee.
The Contractor shall guard against the introduction of noxious weeds and pests both on equipment and plant materials brought to the site.
3. LAYOUT
The Contractor shall layout the rows of trees using the spacing and/or alignment shown in the items of work and construction details, the site map, and the coordinates shown in Attachment One to each of the site maps. If not specified in Section 9 of this specification, then tree row alignment shall be perpendicular to overland water flow. See Section 9 of this specification for within row seedling diversity requirements. The Contractor will determine the location of all known utilities that may be impacted by the work under this contract and avoid them as necessary.
4. TREES
a. Seedling Size A
(1) All bare root seedlings for seedling size A shall conform to the following minimum sizes:

(2) All bare root seedlings shall have at least 5 primary roots 1/10 inch diameter or larger. Roots shall be pruned to a length of 8 inches, as necessary.
b. Seedling Size B
(1) All advanced bare root seedlings for seedling size B shall conform to the following minimum sizes:

(2) All advanced seedlings of Size B shall have at least 5 primary roots 1/10 inch diameter or larger. Roots shall be pruned to a length of 8 inches, as necessary.
c. Seedling Size C
(1) All container grown tree seedlings of seedling size C shall conform to the following minimum sizes:

(2) All container grown seedlings shall be grown in and remain in 3 gallon biodegradable containers that shall have the ability to be slit vertically on the sides, across the bottom of the container and planted. Container grown seedlings shall not have roots bound and/or turned by the container.

d. Planting
General
a. Planting shall be done according to the method described herein, appropriate to the type of stock specified in the plant materials list. No material shall be planted when the ground or backfill is in frozen conditions, or conditions when 6 inches of surface water is present, as determined by the NRCS Contracting Officer’s Representative (COR). Seedlings shall not be planted if the atmospheric temperature is below 30 degrees or above 80 degrees Fahrenheit.
b. Bare Root Stock – Roots of bare root stock shall be spread out to their original downward position, care being taken that no roots double back toward the center of the plant nor have twisted or balled roots. All broken or frayed roots shall be cut off cleanly. The earth backfill material shall be worked in and around the roots so that each root is individually packed and air pockets are eliminated.
c. Seedlings shall be planted in a hole made with a tree planting bar, dibble, mattock, or other appropriate tool, excluding hoedads. The hole shall be large enough to accommodate the entire root system. Each seedling shall be planted at the same depth as it grew in the nursery. Each seedling shall be given a light tug to ensure proper planting. Any seedling not snug must be reset. If hand planting bare root seedlings, seedlings shall be kept in a bucket of water or a planting bag containing moist sphagnum or peat moss until planted. If machine planting bare root seedlings, seedlings shall be kept moist. Seedlings that are to be planted later in the day shall be kept in the bag or container and left in a cool, moist, shady area. Mechanical planting is acceptable unless otherwise specified in Section 9.
d. Containerized seedlings shall always be handled by the container and never by any part of the actual seedling. Soil in the area of planting shall be loosened to a minimum depth equal to the height of the container. Planting holes for container seedlings shall be dug to a width twice the diameter of the container. Container seedlings shall be planted in a vertical position with the root collar approximately 0.5 inch below the soil surface. After planting, the soil shall be tamped firmly to eliminate air pockets.
e. Containerized and bare root seedlings shall be planted perpendicular to the soil surface. No more than 20% of seedlings may lean by more than 30 degrees from vertical. This will be evaluated as part of the sample plots described in Section
8. If more than 10% of seedlings are leaning more than 30 degrees from vertical. In the event a sample plot fails to meet contract requirements, the Contractor will be required to re-work the representative 25-acre area or 50-acre area prior to re-inspection. The re-inspection sample plot shall not be the original sample plot. Seedlings must be fully replanted and not just straightened without replanting.
e. Storing
Bare root tree seedlings shall be stored in a cooler that maintains a temperature between 35 degrees and 55 degrees Fahrenheit. There is no storage requirement for the container grown tree seedlings. Both bare root tree seedlings and container grown tree seedlings shall be watered once a week during storage. Watering bare root seedlings shall be done through one end of the bundle, and excess water shall be allowed to drain. Watering container grown tree seedlings shall be done until the soil is moist, but shall not be excessively watered. There shall be no excess drainage that leaves the container after watering.
f. Transporting
Bare root seedling bundles shall be covered with a tarp or completely enclosed in a trailer during transport to the site.
Seedling bundles shall not be stacked over 6 bundles high during transport. Seedling bundles shall be treated with care and shall not be thrown or dropped at any time.
Container seedlings shall be covered with a tarp during transport to the site, or completely enclosed in a trailer. If the contractor chooses to use a tarp to cover the container grown tree seedlings, the seedlings shall not be used to support the tarp. The contractor shall use a different structural component on the trailer to support the tarp above the top of the seedlings.
Each row of container grown seedlings shall be placed on horizontal surfaces for delivery. Additional container seedlings shall not be stacked on the preceding rows of container seedlings. Container seedlings shall be treated with care and shall not be thrown or dropped at any time.

5. SITE PREPARATION
Mechanical site preparation may be on the entire planting area, or in a continuous 5 feet wide row centered on planned tree planting rows. Chemical site preparation shall be on the entire planting area. The Contractor is responsible for notifying the COR or the Inspector at least 72 hours before performing any site preparation under Section 5, SITE PREPARATION, Methods 2-10.
a. Method 1 – No Site preparation required.
b. Method 2 – Mowing. Mow or bush hog all vegetation down to a height of 6 to 10 inches above the natural ground surface.
This includes all woody plants up to 1.5 inches in diameter.
c. Method 3 – Disking. Disc area until 90% of surface area is bare mineral soil material. All disking shall be completed no later than 20 days prior to tree planting. This will allow the soil to settle and become firm prior to planting. Soil firmness is determined by the depth of an average man’s footprint being ½” or less. If an average man’s footprint is greater than ½”, then the area shall not be planted at that time, and more time shall be allowed for firmness and settling to occur. If more firmness is still required, the Contractor shall be required to use a cultipacker to meet the firmness requirement. Disking shall not be performed within 20 feet top of bank of water body or water conveyance.
d. Method 4 – Prescribed Burning.
(1) Prescribed fire shall remove a minimum of 85% of all plant material above the soil surface.
(2) The contractor shall develop and implement a prescribed fire plan that meets TN NRCS Prescribed Burning (338) conservation practice standard. The plan shall be submitted to the COR at least 5 days prior to implementation.
(3) The contractor shall acquire all burn permits. Burn permits are always required from the TN Division of Forestry from
October 15 through May 15. Permits may be required during other times as conditions warrant. Other municipalities require special permissions for burning within their jurisdiction. All of these permits will be acquired as well.
Compliance with all requirements, ordinances, or restrictions from all permits is the contractor’s responsibility and is mandatory. The COR shall be given copies of all permits received.
(4) The contractor shall make all required notifications, such as but not limited to adjacent landowners and local fire departments as required by TN Division of Forestry rules and regulations.
(5) The contractor is solely responsible and liable for any and all damages and costs resulting from the contractor’s burning operations and any resultant wildfires.
(6) The contractor shall continuously watch all open burning operations until all fires have been extinguished by water or covered by soil.
(7) A traffic hazard shall not be caused by the air contaminants generated by the fire.
(8) All additional requirements specified in Section 6, DISPOSAL (a) of this specification shall be followed in addition to the requirements listed above.
e. Method 5 – Wood Mulching. A forestry mulcher shall be used to remove and mulch identified woody species to within 1 inch of the soil surface. The Contractor shall evenly spread the mulch product across the entire WRP project site, or the mulch shall be burned as specified in Section 6 of this specification, Method 1. The depth of mulch shall not be greater than 3 inches.
f. Method 6 – Chemical Application.
General – Applications must be made by an herbicide applicator employed by a licensed, chartered company with a current AGE license in Category 1 certification issued by the Tennessee Department of Agriculture or other agency with a reciprocal agreement. All chemical applications shall follow manufacturer’s label, including, but not limited to application rates, water setbacks approved for use near water surfaces when required, surfactant use, minimum and maximum temperatures for application, and maximum allowable wind speeds during application. The chemical application shall effectively contact sufficient foliage for control of all targeted species. Special care shall be taken to prevent chemical application to untargeted species. The practice shall not be accepted as complete by NRCS until 95% of all targeted species are controlled. The government or its agents chemical inspection shall only occur Monday-Friday. No inspection shall take place on Saturday or Sunday unless approval is given by the Contracting Officer. No chemical application shall occur until chemical mixture inspection (tank mix) has occurred.
(1) Option 1 – Active ingredient Glyphosate (41%). Treat all herbaceous vegetation in the area with 64 ounces per acre of
Glyphosate. The application shall take place from October 15 to December 1 for tall fescue control. The application shall occur a minimum of 14 days prior to any mechanical treatment that is specified in Section 9 of this specification.

(2) Option 2 – Active ingredient Glyphosate (41%). Treat all herbaceous vegetation in the area with 32 ounces per acre of Glyphosate. The application shall take place within dates and for targeted species as specified in Section 9 of this specification. The application shall occur a minimum of 14 days prior to any mechanical treatment that is specified in Section 9 of this specification.
(3) Option 3 – Dupont Escort XP or equivalent (Active ingredient Metsulfuron methyl (60%)). Treat all woody vegetation in the area with 1 ounce per acre of Metsulfuron methyl. The application shall take place from June 1 to September 1 with tree planting to follow and occur from February 1 to April 1. This method shall only be applied when existing tree stands are less than 5 years old.
(4) Option 4– Dow AgroSciences Garlon 3A Specialty Herbicide or equivalent (Active ingredient triclopyr 61.6%). Treat all woody vegetation foliage with 6 quarts per acre of active ingredient. The Contractor shall ensure that the entire foliage canopy is wet, but the application shall not wet the foliage to the point of creating runoff. The application shall take place from July 1 to September 1. The application shall be applied a minimum of 42 calendar days prior to mechanical treatment. This method shall only be applied when existing tree stands are less than 5 years old.
(5) Option 5 – Dow AgroSciences Garlon 3A Specialty Herbicide or equivalent (Active ingredient triclopyr 44.4%). Cut-stump treatment. The Contractor shall treat all cut stumps that are greater than 3 inches in diameter with 50:50 mixture of Garlon 3A and water by spraying the surface of freshly cut stumps within 4 hours of when the stumps were cut. The Contractor shall ensure that the entire cambium is treated. The Contractor shall use a squirt bottle. There shall be no chemical runoff allowed with this method. This option shall be used only in combination with Site Preparation for Mechanical Clearing of Noxious Plants.
(6) Option 6 – Basal Application. The Contractor shall use this method to control woody plants less than 4 inches in diameter. The mixture to be used shall contain the equivalent of 10 gallons of Dow AgroSciences Garlon 4 Specialty Herbicide or equivalent (Active ingredient triclopyr (61.6%)) There shall be no chemical mixture runoff allowed with this method. This method shall not be applied to stems that are wet to the touch. This chemical application can occur during all months and temperatures. This chemical application shall not be applied in water, snow, or when there is any type of precipitation falling to the ground or located on the ground.
g. Method 7 – Mechanical clearing of noxious plants.
(1) A tracked piece of equipment shall clear noxious woody vegetation and stumps from the soil surface to a depth of 24 inches below the soil surface. Native woody vegetation species shall be avoided where possible.
(2) The area to be treated shall be evaluated by the NRCS Biologist prior to commencement of clearing operations to evaluate potential Threatened, Endangered, and/or TN state listed species. The NRCS Biologist shall define all areas to be treated and all areas to be omitted from this treatment method. Mechanical clearing shall not be performed within 20 feet of top of bank of water body or water conveyance.
(3) This method shall not be used on areas that the U. S. Army Corps of Engineers, Tennessee Valley Authority, or Tennessee Department of Environment and Conservation consider jurisdictional wetlands without the corresponding appropriate permits from each agency. This method requires permits for all existing tree stands that are a minimum of 5 years old or older.
h. Method 8 – Subsoiling. The subsoil shall be ripped to a minimum depth of 14 inches on a 12 feet spacing centered on the planned bare root tree planting row locations. Subsoiling shall not be performed within 20 feet top of bank of water body or water conveyance.
i. Method 9 – Post tree planting chemical application. Apply 1 ounce of Oust XP, or equivalent (Sulfometuron methyl (75%)) per acre. Application shall be after March 1 shall follow label requirements and all applications shall be completed prior to tree seedling buds breaking dormancy. Under no circumstances shall Oust XP, or equivalent (Sulfometuron methyl (75%)) application be done after the tree seedlings break dormancy.
6. DISPOSAL
a. Method 1 – Burning. If required in Section 9 of this specification, burning of all waste woody material shall be required on all project sites at locations specified on the drawings or as approved in the field by the COR.
(1) Burn locations shall be chosen to protect existing vegetation, the environment, public and private property, and the public.
(2) The contractor shall keep sufficient labor and equipment in the immediate vicinity of his open burning operations that are capable of quickly containing and extinguishing wildfires that occur. The contractor shall continuously watch all open burning operations until all fires have burned out or have been extinguished by water or covered with soil.
(3) Appropriate permits shall be obtained before burning. Burning permits are normally required from the TN Division of Forestry from October 15 through May 15. Permits may be required during other times as conditions warrant. Other municipalities require special permissions for burning within their jurisdiction. All of these permits shall be acquired as

well. Compliance with all requirements, ordinances, or restrictions from all permits is the contractor’s responsibility and is mandatory. The COR shall be given copies of all permits received.
(4) Open burning locations shall be greater than two hundred feet (200’) from any building.
(5) The guidance in the brochure “Safe Debris Burning” from the TN Division of Forestry shall be followed.
(6) Only wood waste (See definition of “wood waste” below) shall be burned. Non-woody materials, such as but not limited to the following shall not be burned – tires and rubber products; vinyl siding and shingles; asphalt shingles and other asphalt roofing materials and demolition debris; building material; construction debris and mobile homes;
plywood, oriented strand board and treated wood, including railroad ties; asbestos-containing materials, aerosol cans and food cans, copper wire and electrical wires, plastics and other synthetic materials; paper products, cardboard and newspaper; household trash; leaves, branches and trees not grown on-site.
(7) Priming materials used to facilitate such burning shall be limited to #1 or #2 grade fuel oils.
(8) A traffic hazard shall not be caused by the air contaminants generated by the fire.
(9) No fire shall be ignited while any air pollution emergency episode is in effect in the area of the burn.
(10) Any debris and/or ashes left from burning operations shall be buried and the residue covered as specified in Section
6(b), Method 2 of this specification listed below.
(11) The Contractor is solely liable and responsible for any and all damages and costs resulting from the burning operation and any resulting wildfire.
(12) A fire-proof zone at least 20 feet wide shall be created around all burn piles of the width recommended by the TN
Division of Forestry before burning is commenced.
Open burning - “Open burning” is defined as the burning of any matter under such conditions that products of combustion are emitted directly into the open atmosphere without passing directly through a stack. Open burning includes, but is not limited to, fires located or burning in a pile on the ground, a barrel, a fire pit, or other semi-enclosure.
Wood Waste – “Wood waste” is defined as any product which has not lost its basic character as wood, such as bark, sawdust, chips and chemically untreated lumber whose “disposition” by open burning is to solely get rid of or destroy. Plant life of an herbaceous nature, such as leaves, whether attached, fallen, and/or collected, evergreen needles, and grasses, are not considered “wood waste”. Additionally, manufactured lumber products, such as plywood, fiberboard, particleboard, and paneling, are not considered “wood waste”. Painted or artificially stained wood is not considered “wood waste”.
b. Method 2 – Burying. If required in Section 9 of this specification, burying of all waste woody material shall be allowed on all project sites at locations specified on the drawings or as approved in the field by the COR.
(1) All woody vegetation (Herbaceous vegetation is not included.) that is the remnant from Site Preparation operations specified in Section 5 of this specification, and/or all remnants from burning operations specified in Section 6, Method 1 listed above shall be buried in an excavated pit within the WRP restoration site. The material that requires burial shall be ashes, cinders, partially burned woody material, all stumps that didn’t completely burn, and any other woody material that remains after Site Preparation and Burning disposal operations. No material shall be removed from this WRP project site to any other site. If burial isn’t an option on this site, then the remnants shall be hauled to a licensed landfill and disposed of as specified in Method 3 below.
(2) The burial pits shall have a minimum of 2 feet of compacted earthfill cover over the buried material. The earthfill cover shall be spread in lifts not to exceed 6 inches in thickness. Each lift shall be compacted by at least three passes of the tracks of the placement equipment over the entire fill surface. The earthfill cover shall be placed a few inches higher than the surrounding ground surface and graded to drain and transition into the surrounding ground.
(3) The burial pit locations shall not occur on a US Army Corps of Engineers, Tennessee Valley of Authority, or Tennessee Department of Environment and Conservation jurisdictional wetland. The burial pit locations shall not be placed in drainageways, streams, or other areas where concentrated flow could affect the burial pits. The COR shall designate burial locations that meet the conditions listed above.
c. Method 3 – Hauling to Licensed Landfill. If required in Section 9 of this specification, burying of all waste woody material shall be allowed on all project sites at locations specified on the drawings or as approved in the field by the COR.
(1) All woody vegetation (Herbaceous vegetation is not included.) that is the remnant from Site Preparation operations specified in Section 5 of this specification, and/or all remnants from burning operations specified in Section 6, Method 1 listed above shall be loaded and hauled to a licensed landfill. The material that requires disposal shall be ashes, cinders, partially burned woody material, all stumps that didn’t completely burn, and any other woody material that remains after Site Preparation and Burning disposal operations.
(2) The COR shall be given copies of all landfill receipts.
(3) The contractor is responsible for all tipping fees.
(4) If there are no areas within the WRP project site that are not jurisdictional wetlands, then this method shall be used to dispose of all remnant waste.

d. Method 4 – No disposal required. As specified in Section 9 of this specification, burning, burying, or hauling to licensed landfills of all waste woody material shall not be required. The Contractor shall leave the existing woody debris in the locations that it currently exists following the completion of Site Preparation activities.
7. MEASUREMENT AND PAYMENT
Method 1
The acreage figure for each site, noted in the items of work and construction details, section 8, is an estimate(s) that was made from an aerial photograph. Payment will be made on a lump sum basis. The Contractor is responsible for site preparation as specified in section 9, and for providing and planting the number of trees necessary to achieve the specified spacing and required number of trees per acre. Such payments will constitute full compensation for all costs of labor, plant materials, other materials, and equipment necessary to satisfactorily complete the work as described in the specification.
8. INSPECTION REQUIREMENTS
NRCS will no longer inspect seedlings at the nursery. The tree planting contractor shall be responsible for quality control of all seedlings and chemicals. Failure of the seedlings to meet or exceed the minimum specification criteria as stated in the following two paragraphs will result in the contractor providing seedlings that meet the specifications and replanting.
Inspection of the bare root tree seedlings and the container grown tree seedlings quality by the government or its agents shall be performed at each individual site under this contract prior to planting. The government or its agents shall be given at least 10 days of notice of the anticipated delivery of all tree seedlings to each site to facilitate the completion of this inspection requirement. Government or its agents seedling inspection shall only occur Monday-Friday. No inspection shall take place on Saturday or Sunday unless approval is given by the Contracting Officer. No seedlings shall be planted until inspection of seedlings has occurred.
Inspection of the bare root tree seedlings shall be performed under this contract by measuring the container grown tree seedlings prior to delivery. A minimum of 5% or at least 50, whichever is less of each species of tree seedling to be planted shall be inspected to verify that the contract specifications are met. The seedlings inspected shall be randomly sampled. In the event that at least 5% of the bare root tree seedlings for any 1 individual tree seedling species fails to meet the NRCS contract specifications, then the entire number of bare root tree seedlings for this species shall not be allowed to be planted. In this instance, the Contractor shall obtain additional bare root tree seedlings. The same inspection requirements listed above shall be required of these additional seedling sources. Any additional expenses incurred by the Contractor to obtain additional seedlings shall be the sole responsibility of the Contractor, and shall not be reimbursed by the Government.
Inspection of the container grown tree seedlings shall be performed under this contract by measuring the container grown tree seedlings prior to delivery. A minimum of 10% or at least 50, whichever number is less to verify that the contract specifications are met. The seedlings inspected shall be randomly sampled. In the event that at least 5% of the container grown tree seedlings for any 1 individual tree seedling species fails to meet the NRCS contract specifications, then the entire number of container grown tree seedlings for this species shall not be allowed to be planted. In this instance, the Contractor shall obtain additional container grown tree seedlings. The same inspection requirements listed above shall be required of these additional sources. Any additional expenses incurred by the Contractor to obtain additional seedlings shall be the sole responsibility of the Contractor, and shall not be reimbursed by the Government.
Inspection of the tree planting by the government or its agents shall be performed under this contract by measuring sample plots.
A sample plot is defined as a 1/20th acre sample, with one sample plot taken for every 25 acres planted for each site (easement) where less than 200 acres of tree planting is to occur. Where more than 200 acres of tree planting is to occur, one sample plot taken for every 50 acres planted for each site (easement) shall occur. A minimum of three (3) samples shall be taken for each site (easement). The 25-acre areas and 50-acre areas represented by the sample plot will be considered adequately planted when a minimum of 80 percent of the trees in the sample meets contract specifications. In the event a sample plot fails to meet contract requirements, the Contractor will be required to re-work the representative 25-acre area or 50-acre area prior to re-inspection.
The re-inspection sample plot shall not be the original sample plot.
9. ITEMS OF WORK AND CONSTRUCTION DETAILS
Items of work to be performed in conformance with this specification and the construction details are:
