I.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days before the contract expires; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 3 years
I.4 NOTIFICATION OF SUBCONTRACTING
The Contractor shall promptly notify the Contracting Officer upon entering into any subcontract arrangement. The subcontractor shall have the experience and be equipped for such work. The written notification shall include as a minimum:
A. The name, address and telephone number of the subcontractor.
B. The date upon which the subcontract was entered into and its duration.
C. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.
D. Documentation of the subcontractor's representative authority.
Subcontracting any portion of the contract shall not relieve the Prime Contractor of any responsibility under this contract. Any subcontract agreement shall contain all terms and conditions of the prime contract.
I.5 FAR 52.222-42 STATEMENT OF EQUIVALENT RATES FOR FEDERAL HIRES
(SEPT 2009)
In compliance with the Service Contract Act of 1965, as amended, and the regulations of the Secretary of Labor (29 CFR Part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332.

1.7 AGAR 452.209-71 ASSURANCE REGARDING FELONY CONVICTION OR TAX DELINQUENT STATUS
FOR CORPORATE APPLICANTS (FEB 2012)
(a) This award is subject to the provisions contained in the Consolidated Appropriations Act, 2012 (P.L. No. 112- 74), Division E, Sections 433 and 434 regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –
(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and
(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.
(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

C.1 GENERAL SPECIFICATIONS
A. SCOPE OF CONTRACT
Provide janitorial services in accordance with the specifications and commercial practices in a manner that will maintain a satisfactory facility condition and present a clean, neat and professional appearance.
B. LOCATION AND DESCRIPTION
Location: The Snoqualmie District North Bend Office, 902 S.E. North Bend Way, Bldg. #1, North Bend, Washington.
Description: The work area consists of the Snoqualmie Ranger District Main Office (Bldg. No. 2031, approximately 3000 square feet); the Public Services Office (Bldg. No. 2133, approximately 1200 square feet);
the Conference Center (Bldg. No. 2230, approximately 2500 square feet); the Fire/GIS Office (Bldg. No. 2032, approximately 1104 square feet) and two restrooms in the Radio Shop (Bldg. No. 2231, approximately 48 square feet each). The square footage refers to net assignable and related use space, including all restrooms and inside storage areas.
C. WORK SCHEDULE
1. Work under this contract shall be accomplished outside of regular office working hours. Regular office working hours are from 6:00 AM to 6:00 PM Monday through Friday; and weekends May through October from 6:00 AM to 6:00 PM Saturday and Sunday. Not all areas will be in use during the weekend period.
2. The Contractor will not be required to perform work on National Holiday, or the day the Holiday is observed. In the event that a schedule coincides with a National Holiday, the services normally scheduled for that day shall be performed either the day before or the day after the holiday. A list of all National Holidays will be provided to the Contractor at the pre-work meeting.
D. GOVERNMENT-FURNISHED PROPERTY
The following supplies will be furnished by the Government and provided to the Contractor as needed:
1. Toilet tissue; toilet seat covers; paper towels; plastic garbage bags; hand soap; and light bulbs.
The items will be stored in an accessible space as designated by the Contracting Officer. Keys to the offices will be signed out to the Contractor and shall be returned upon termination of the contract. The Contractor shall notify the Contracting Officer when Government-furnished supplies are low.
E. CONTRACTOR FURNISHED PROPERTY AND SERVICES
Provide all labor, supervision, transportation, equipment (including vacuum cleaner), cleaning supplies, ie, furniture polish, glass cleaner, floor wax, etc. (except those provided by the Government), and incidentals necessary to perform the described work. The Contractor will be permitted to store minimal Contractor furnished supplies and equipment in the janitorial closets in the Main Office Building No. 2031 and the Conference Center Building No. 2230 without hindering entrance to these spaces. If the Contractor chooses to do so, the Government will not be liable for missing or damaged Contractor equipment or supplies.
F. WORK STANDARDS
1. The contractor shall exercise care in work methods to prevent damage to any office equipment, windows, etc.
2. All work under this contract shall be performed in skillful and workmanlike manner. The Contracting
Officer may, in writing require the contractor to remove from work any employee the contracting Officer deems incompetent, careless, or otherwise objectionable for theft, possession and/or removal of materials, supplies, equipment, or any government-owned property, or for unsatisfactory performance.
3. The Contractor shall be responsible for maintaining satisfactory standards of employee competency, conduct, appearance, and integrity, and shall be responsible for taking such disciplinary action with respect to their employees as may be necessary.
4. The contractor shall prohibit their employees from disturbing papers on desks, opening desk drawers or cabinets, or using telephones or office equipment provided for official Government use.
G. TASK FORM
The Contractor shall complete the Government furnished Task Form as directed and submit monthly to the Contracting Officer. Forms will be provided to the Contractor at the pre-work meeting.
C.2 TECHNICAL SPECIFICATIONS
District Office
A. Services to be Performed Three Times a Week: (Tuesday, Thursday and Saturday or Sunday)
1. Empty all wastebaskets. Collect all waste paper and trash and place in garbage dumpsters located outside the northwest corner of Bldg. No. 2231, Carpenter Shop.
2. Empty all blue commercial recycling containers (approximately 23 – 30 gallons). Collect all recycling materials and place in the recycling dumpster across from the garbage dumpster located outside the northwest corner of Bldg. No. 2231, Carpenter Shop. Small desk side recycling containers do not need to be emptied.
3. Vacuum all floors, including corridors and entrances to the extent necessary to remove litter from floors, and dust from under desks. Spot clean soiled areas on carpet with appropriate cleaner as necessary.
4. Dust all visible services of furniture, fixtures, equipment, walls, window sills and blinds. Use treated dust cloth for all dusting.
5. Wet mop or scrub toilet room floors. Wash all toilet fixtures with warm water and soap. Disinfect urinals and water closets. Clean toilet paper, paper towel and other dispensers. Clean all sinks, fixtures, toilet room walls and stalls with cleaners appropriate for the type of surface being cleaned.
6. Fill toilet paper, toilet seat covers, paper towel and hand soap dispensers in restrooms.

B. Services to be Performed Weekly:
1. Keep walls, ceilings and air vents free of cobwebs.
2. Remove old wax from linoleum floors by mopping or scrubbing with a neutral cleanser, rinse thoroughly and apply one coat of slip resistant water emulsion wax.
C. Services to be Performed Quarterly (at equal three month periods)
1. Wash windows, inside and out, (including storm windows and window tracks), leaving no streaks or unwashed places. Wipe water spots from sills and frames. Lay drop cloths as required to protect adjacent surfaces, fixtures, and furniture. Wash windows at approximately equal intervals of time, weather permitting.
2. Clean, wash and polish visible tops of all wood and metal desks. An appropriate cleaner and wax is to be used for each type of desk.
3. Notify the C.O.R. when above items have been accomplished for the quarter period.
D. Services to be Performed Five Times Weekly: (Monday thru Thursday with choice of Saturday or Sunday for fifth day) for the months of June, July, August and September)

C.3 QUALITY CONTROL
Contractor Quality Control Plan
The contractor shall develop and maintain a quality program to ensure custodial services are performed in accordance with commonly accepted commercial practices. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. As a minimum, the contractor shall develop quality control procedures addressing the areas identified in C.6 Service Delivery Summary.
Contractor Quality Control Inspection
The Contractor shall assure themselves that performance meets contract specifications, in accordance with clause FAR 52.212-4, Contract Terms and Conditions – Commercial Items, paragraph (a), Inspection/Acceptance prior to requesting the Government to inspect for payment or acceptance. Upon completion of a monthly services, the Contractor shall contact the Contracting Officer to set a mutually agreed upon date for inspection of completed work.

E.2 MEASUREMENT AND PAYMENT
Payment shall be made on a monthly basis at the unit bid price per month. If janitorial services begins or ends mid-month, payment for that period shall be prorated based on a 30-day month.
E.3 INSPECTION AND ACCEPTANCE
1. Services performed under this contract shall be subject to inspection and acceptance by the Government.
2. The Contracting Officer will furnish contractor with written notice of any item not meeting contract requirements. If deficiency is not corrected immediately, contractor may be considered in default of the contract.
E.4 GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN AND ACCEPTANCE
REQUIREMENTS
A. Government Quality Assurance Inspection
The Government will, at its convenience, make periodic inspections of the work to assure itself of contract compliance and to perform Quality Assurance Inspections to determine confirm that the Contractor is performing quality control in accordance with its QCP and that Contractor monitoring results in quality performance of contract objectives.
B. Acceptance
Acceptance of the work under the contract will be made after steps in (A) above have been taken and the Contracting Officer has made the determination of satisfactory compliance with the specifications. For acceptance purposes, complete procedures as defined in (a) above, or work shall be satisfactorily completed before acceptance will be made. Acceptance will not be made for segments broken by unacceptable portions of work.
C. Rework and Reinspection after Rework
When inspections indicates that the performance objectives were not met, the work will be deemed unsatisfactory and payment will not be made until the Contractor has assured the Government that its Quality Control measures have corrected the deficiencies. Inspections after rework will be made in the same manner as the first inspection.
The cost to the Government for inspections necessitated by the rework will be deducted from any payments to the Contractor.

E.6 QUALITY ASSURANCE SURVEILLANCE PLAN FOR CUSTODIAL SERVICES
This Quality Assurance Surveillance Plan (QASP) has been developed to evaluate contractor actions while implementing this SOW. It is designed to provide an effective surveillance method of monitoring contractor performance for each listed objective on the Service Delivery Summary (SDS) in the maintenance contract.
The QASP provides a systematic method to evaluate the services the contractor is required to furnish.
This QASP is based on the premise the government desires to maintain a quality standard in operating, maintaining, and repairing facilities and that a service contract to provide the service is the best means of achieving that objective.
The contractor, and not the government, is responsible for management and quality control actions to meet the terms of the contract. The role of the government is quality assurance to ensure contract standards are achieved.
In this contract the quality control program is the driver for product quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a “self-correcting” contract is to ensure that the quality control program approved at the beginning of the contract provides the measures needed to lead the contractor to success.
Once the quality control program is approved, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.
QUALITY ASSURANCE SURVEILLANCE PLAN FOR CUSTODIAL SERVICES

SURVEILLANCE: The Contracting Officer’s Representative (COR) will receive complaints from Forest Service personnel and pass them to the contractor's quality control inspector (QCI) for correction.
STANDARD: 95% of all facilities are without customer complaints for the month or service period. For the purpose of these 4 services, a facility may never have more than two customer complaints. The QA shall notify the contracting officer for appropriate action in accordance with FAR 52.212.4, Contract Terms and Conditions-Commercial Items (March 1999) or the appropriate Inspection of Services clause, if any of the above service areas exceed five customer complaints.
PROCEDURES: Any employee that observes unacceptable services, either incomplete or not performed, for any of the above performance objectives should immediately contact the COR and the COR will complete appropriate documentation to record the complaint. The COR will consider the customer complaint valid upon receipt from the customer. The COR should inform the customer of the approximate time the unacceptable performance will be corrected and advise the customer to contact the COR if not corrected. The COR will consider customer complaints as resolved unless notified otherwise by the customer. The COR shall verbally notify the Contractor’s Quality Control Inspector (QCI) to pick up the written customer complaint. The QCI will be given one day after verbal notification to correct the unacceptable performance. If the QCI disagrees with the complaint after investigation of the site and challenges the validity of the complaint, the QCI will notify the COR. The COR will conduct an investigation to determine the validity of the complaint. If the COR determines the complaint as invalid, he will document the written complaint of the findings and notify the customer. The COR will retain the annotated copy of the written complaint for his/her files. If after investigation the COR determines the complaint as valid, the COR will inform the QCI and the QCI will be given an additional day to correct the defect. A defect will not be recorded if proper and timely correction of the unacceptable condition(s) is accomplished. The QCI shall return the written customer complaint document, properly completed with actions taken, to the COR, who will file the complaint for monitoring future recurring performance. Recurring customer complaints are not permitted for any of the above service items. If a repeat customer complaint is received indicating the same deficiency during the service period (month, quarter, etc.), the COR should contact the Contracting Officer for appropriate action.
SURVEILLANCE: The COR will evaluate the services required by each task to ensure compliance.
STANDARD: The contractor shall perform all work required by the task in a satisfactory manner in accordance with the appropriate SOW paragraph. The COR shall not consider the task complete until all deficiencies have been corrected.
PROCEDURES: The government COR will inspect all work tasks required to ensure contractor compliance with the appropriate paragraphs of the Statement of Work (SOW) each time the service(s) is performed. Record the results of inspection, noting the date and time of inspection. If inspection indicates unacceptable performance, notify the contract manager or QCI of the deficiencies for correction. The Contractor shall be given two hours after notification to correct the unacceptable performance.

F.2 PERIOD OF PERFORMANCE
1. The Contractor shall be required to commence work under this contract within three calendar days after receipt of the Notice to Proceed by the Contractor.

SECTION G--CONTRACT ADMINISTRATION DATA
G.1 PRE-WORK CONFERENCE
The Contractor shall meet with the Government to discuss contract terms and work performance requirements, Work Progress Schedule, and Fire Prevention and Suppression plans (reference clause AGAR 452.215-73. Post Award Conference.
The Contractor designated representative or foreman (whomever the Contractor will have on the site) shall be present at the prework conference.
G.2 DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE (COR)
A. The Contracting Officer will designate an individual as Contracting Officer's Representative (COR) at time of award.
B. The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by a proper contractual documents executed by the Contracting Officer prior to completion of the contract.
C. The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)
D. On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer.
Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
E. The COR's major duties and responsibilities are contained in the Forest Service Handbook of Contract
Administration. The COR is delegated full authority under this contract except for the following actions which are reserved for the Contracting Officer:
1. Approve Change Orders and Modifications
2. Take action to terminate the contract for default or Government convenience.
3. Make contract adjustments under the Differing Site Conditions clause.
4. Grant extensions of contract time.
5. Approve assignment of claims.
6. Make final decisions under the Disputes clause.
7. Make final acceptance under the contract.
8. Make final decisions under the Suspension of Work clause.
9. Make equitable adjustments.
10. Authorize change in amount of Payment Retention.
11. Approve subcontractors.
12. Approve payments with deductions or final payment.
13. Approve use and possession prior to completion.
14. Enforce the warranty provisions.
SECTION H--SPECIAL CONTRACT REQUIREMENTS
H.1 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE:
The Contracting Officer will designate a Contracting Officer’s Representative (COR), who will provide on-the-ground administration of the contract.
H.2 PERMITS AND RESPONSIBILITIES:
1. The Contractor shall be responsible for all damages to persons or property that occurs as a result of the
Contractor’s fault or negligence. The Contractor shall take proper safety and health precautions to protect the work, the workers, the public, and the property of others during the performance of the work.
