SECTION C - Description/Specifications/Statement of Work

DESCRIPTION/STATEMENT OF WORK

The Contractor shall furnish all labor, supervision, equipment & supplies necessary to complete required services, including but not limited to: cleaning compounds, polish, floor wax, stripping compound, carpet shampoo, carpet shampoo machines, floor buffer, vacuum cleaner, and any other industrial equipment and supplies necessary to perform janitorial services for the North Fork John Day Ranger District, Ukiah Oregon; approximately 10,800 sq. ft., which includes the Main Office, outside public restroom (east of main office), Fire Office, Silviculture Office (house immediately behind main office building) and the basement of the new bunkhouse building, which is a wellness center and conference room.

Work includes cleaning of (1) on-call emergency cleaning of any government facility listed including the outside public restroom.

Work includes cleaning of three (3) as-needed cleanings consisting of a 1200-1400 sq. ft. residential house on the Ukiah Compound; a 1750-2800 sq. ft. bunkhouse on the Ukiah Compound; and a 4800 sq. ft. bunkhouse located at Frazier Work Center approximately 18 miles east of Ukiah. The intent is to clean only when vacated to get ready for new tenants, no other cleaning is required.

The work shall not interfere with Government business, employees, or work being done by other contractors. The Contractor shall not disturb papers on desks, open drawers, cabinets, use telephones or other office machines. Includes reading or inspecting items found on desks or in work areas and repeating any information to others outside government facilities. No wastebaskets, cleaning supplies, or other items are to be placed on office equipment, desks or tables. The Contractor shall not confront employees about cleanliness of workspaces. The contractor shall not bring pets or any unauthorized persons into the government facilities, or allow access to anyone other than those authorized under the contract.

Janitorial service shall be performed Tuesday, Thursday and one weekend day (Saturday or Sunday) unless agreed to in writing by both parties.

From June 1 thru September 30 (fire season), the cleaning hours shall be between 6:00 p.m. and 10:00 p.m.

From October 1 thru May 31, the cleaning hours shall be between 4:30 p.m. and 10:00 p.m. on Tuesday and Thursday; and between 7:00 a.m. and 9:00 p.m. on weekend days.

Heavy fire activity may warrant a shift in these hours, which shall be agreed upon should the need arise.

Emergency janitorial services is on an on-call basis and contractor will be notified verbally by the COR or CO, followed by the issuance of a Work Order.

Contractor will be notified of the as-needed janitorial services, by the COR or CO, through the issuance of a Work Order.

Contractor shall be held responsible for security of buildings and all fixtures and appliances attached when performing on the premises. District Offices shall be locked after janitorial work is completed.

PROJECT LOCATION

Ukiah, Oregon is located approximately 50 miles south of Pendleton, Oregon off Highway 395 and approximately 1 mile east of the junction of Highways 395 & 244; the North Fork John Day District compound is on the west side of Ukiah directly off Highway 244. Frazier Work Center is located approximately 18 miles from the District Office.

BIOBASED PRODUCTS

All supplies and materials shall be of a type and quantity that conform to applicable Federal specifications and standards, and to the extent feasible and reasonable; include the exclusive use of biobased products. The Contractor shall utilize the greatest number of biobased products available that meet applicable health and environment specifications.

The following is a list of categories for products that may be required for performance of custodial duties. Each product submitted for use under this contract must be identified with at least one of these categories (some products may be listed under more than one category). Labeling shall be printed on all containers.

EMERGENCY SERVICES – ON-CALL

The Contractor shall be notified verbally by the COR or CO, followed by the issuance of a Work Order, if emergency cleaning service is needed in any of the listed government facilities, including the public restroom. Emergency cleaning service covers all unforeseen occurrences outside the normal cleaning schedule and will be listed on the Work Order. Minimum notice given to the Contractor will be 1 day. The technical specifications listed in this contract apply.

AS-NEEDED SERVICES

The Contractor shall be notified by the issuance of a Work Order, for the residence house and bunkhouses as needed. The intent is to thoroughly clean the premises once it is vacated by current tenants, getting it clean and ready for the new tenants. A minimum of one week’s notice will be given prior to the expected need of the Government. Requirements are listed in F. below.

TECHNICAL SPECIFICATIONS

Minimum Services -

A. Three times a week:

1. Clean floors and entries. Sweep tiled and linoleum areas and vacuum all carpeted areas in all listed buildings including the front entryway and sidewalk.

2. Damp mop entrance way floor in Main office.

3. Empty all waste baskets and refuse containers into dumpsters.

4. Clean, mop and sanitize (scrub toilet bowls, seats, tanks, base and sinks) restroom facilities/floors, utility room sinks, drinking fountain, and adjacent floor and wall areas.

5. Replenish paper towels, soap, and toilet paper dispensers in restrooms.

6. Clean glass on front doors of finger prints, bird droppings. etc.

7. Replace burned out office lights.

8. Dust displays in entryway i.e. owls area.

9. In the wellness center all equipment handrails, handlebars, control panels and any other portion of the equipment that is touched shall be sanitized.

10. Empty and clean ashtrays by office entrances.

B. Weekly Service:

1. Wet mop and buff linoleum/tile. (Remove all black scuff marks from linoleum or vinyl flooring & re-wax if necessary.)

2. Thoroughly clean entrance runner of all embedded dirt and mud.

3. Damp wipe meeting room tables.

4. Dust all window blinds and dust cobwebs from ceilings/walls.

5. Clean office porches underneath overhang area of buildings, removing spider webs, bird nests and bird droppings. (clean bird droppings off railings on the front porch area with soap and water, from May thru September)

6. Clean handprints and other easily removable spots from walls and doors.

7. Dust all office furniture, door jambs, doors, window sills, door glass, floor, ceiling, vents, and heat registers.

8. Clean glass display case of finger prints and other dirt.

9. Clean all sinks, including those outside restrooms.

10. Spot clean carpet in between cleanings as needed.

C. Three times a year (October, April, and June):

1. Wash all windows inside and outside.

2. Wash restroom walls.

3. Dust light fixtures, (tops and bottoms), remove covers and clean out bugs.

D. Twice Yearly (January and June)

1. Strip all wax from floors to remove build-up, re-seal floors and apply new wax.

2. Shampoo or chemical clean carpets.

E. Emergency On-Call (Item 2 on Schedule of Items) Items required will be taken from the specifications listed above. i.e. empty garbage, clean restrooms, extra vacuuming, sweeping, etc.

F. As-Needed Services (Items 3-5 on Schedule of Items)

1. Vacuum and shampoo all carpet areas.

2. Strip and wax all tile floor areas.

3. Vinyl floors may be mopped and cleaned.

4. Wipe down all walls, window sill, door handles.

5. Wipe all shelving and cupboards inside and out, thoroughly clean all counter tops, tables, sinks.

6. Thoroughly clean all appliances present.

7. Clean bathrooms and all fixtures and furnishings.

8. Clean closet interiors, shelving, flooring, walls.

9. Wash all windows inside and outside.

10. Sweep garage floor.

Contractor shall notify COR in writing or verbally at least 1 week in advance of performance of Item C, Three times a year and Item D, Twice Yearly cleaning. Contractor will notify COR in writing or verbally by next business day when Item C or D is performed or when light bulbs are replaced.

Contractor shall use designated utility sinks in Main office, Silviculture office and Fire office for cleaning/dumping of mops, buckets and other tools. Contractor shall not use break room or kitchen sinks in Main office or Silviculture office for cleaning/dumping mops, buckets, etc.

SECTION D - Packaging and Marking

MSDS sheets for all products being used shall be posted for all employees to access.

SECTION E - Inspection and Acceptance

52.252-2 Clauses Incorporated by Reference. (FEB 1998) This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. INSPECTION

The Government will inspect the buildings to determine the acceptability of workmanship. Any deficiencies encountered will be called to the attention of the Contractor for immediate corrective action, and shall be completed and corrected at no charge to the Government.

Any Government personnel or visiting public may observe unacceptable services, incomplete work or required services not performed and may contact the CO or the COR to communicate a complaint. Customer complaints will be substantiated by the COR for validity.

Failure to correct rejected workmanship may cause the Government to take necessary action under the “Termination for Default” clause.

SECTION F - Deliveries or Performance

(FEB 1988) The period of performance of this contract is from November 13, 2015 through October 31, 2016.

Option 1 is from November 1, 2016 through October 31, 2017.

Option 2 is from November 1, 2017 through October 31, 2018.

Option 3 is from November 1, 2018 through October 31, 2019.

CONTRACTOR QUALITY CONTROL SYSTEM

The Contractor shall submit to the CO at the pre-work meeting, a quality control inspection system it shall use to ensure that contract specifications will be achieved. At no time shall the contractor rely upon Government inspections to provide notification of unsatisfactory performance. The Contracting Officer may observe the Contractor's inspection at any time.

GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN

More than two (2) customer complaints, verified by the COR as valid, per calendar month will equal minus 1%. Full payment will be made for acceptable work. Rework of unacceptable work will be permitted if the schedule allows for rework. If the unacceptable work is not reworked and accepted, a 1% deduction in payment will be made for that month and additional more stringent inspections will be performed. If a complete day of cleaning is missed, an 8% deduction will be made for that month.

BIO-PREFERRED PERFORMANCE REQUIREMENTS

Required Service - Ensure the mandatory purchasing & use of biobased products.

Task - ALL Performance Indicator – Quantitative Factor Performance Standard - Contractor compliance with FSIRA, EO 13423, and FAR Surveillance Methodology – 100% Inspection

AQL – 100%

Deduction – 1% deduction off the monthly invoice for failure to comply with biobased product use. More than 2 deductions during the year will result in a 3% deduction off all future invoices for Non Compliance of biobased product use. This could ultimately lead to a Termination for Default for Non Compliance with the contract.

SECTION G - Contract Administration Data

452.215-73 Postaward Conference. (NOV 1996) A post award conference with the successful offeror is required. It will be scheduled within 5 days after the contract award. The conference will be held at the Ukiah Ranger District.

GOVERNMENT-FURNISHED PROPERTY

The Government will furnish: toilet paper, hand soap, plastic wastebasket liners, light bulbs, and air fresheners.

All other supplies, materials and equipment needed to perform the requirements are the responsibility of the Contractor.

NOTIFICATION OF EMPLOYEES

The Contractor shall submit the name(s) of the employee(s) that will be accessing the Government facility to perform the services. If the employee(s) performing the service changes, the Contractor will notify the CO or COR at least one week ahead of time of the name(s) of the new Contractor employees. The new employees shall already have completed and passed a background check.

EMPLOYEE IDENTIFICATION

All employees of the Contractor shall be easily identified when performing their duties. This identification may be a shirt with the company logo and the employee name on the front or a name tag with the company name and employee name.

SECTION H - Special Contract Requirements

452.237-74 Key Personnel. (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: Supervisor

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit theinformation required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

SAFETY

Contractor shall provide a job specific safety plan addressing potential hazards known to the Contractor along with a mitigation plan. The plan shall be submitted to the CO for discussion at the post award conference.

Known hazards identified, but not all inclusive are, working alone at night, driving to/from office in inclement weather, late at night and heavy traffic, running cleaning equipment, electrical cords in the way, proper use of cleaning supplies, and wet floors.

52.204-9 Personal Identity Verification of Contractor Personnel. (JAN 2011)

(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24 and Federal Information Processing Standards Publication (FIPS PUB) Number 201.

(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:

(1) When no longer needed for contract performance.

(2) Upon completion of the Contractor employee's employment.

(3) Upon contract completion or termination.

(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor's employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.

52.217-9 Option to Extend the Term of the Contract. (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed October 31, 2019.

52.222-42 Statement of Equivalent Rates for Federal Hires. (MAY 2014) In compliance with the Service Contract Labor Standards statute and the regulations of the Secretary of Labor (29 CFR part 4), this clause identifies the classes of service employees expected to be employed under the contract and states the wages and fringe benefits payable to each if they were employed by the contracting agency subject to the provisions of 5 U.S.C. 5341 or 5332.

52.223-2 Affirmative Procurement of Biobased Products Under Service and Construction Contracts. (SEP 2013)

(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless-

(1) The product cannot be acquired-

(i) Competitively within a time frame providing for compliance with the contract performance schedule;

(ii) Meeting contract performance requirements; or

(iii) At a reasonable price.

(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:

(i) Spacecraft system and launch support equipment.

(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(b) Information about this requirement and these products is available at http://www.biopreferred.gov.

(c) In the performance of this contract, the Contractor shall-

(1) Report to http://www.sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and

(2) Submit this report no later than-

(i) October 31 of each year during contract performance; and

(ii) At the end of contract performance.

52.232-19 Availability of Funds for the Next Fiscal Year. (APR 1984) Funds are not presently available for performance under this contract beyond October 31, 2016. The Government’s obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond October 31, 2016, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

52.237-2 Protection of Government Buildings, Equipment, and Vegetation. (APR 1984) The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

DEVIATION 2012-1: AGRICULTURE ACQUISITION REGULATION (48 CFR Chapter 4) AGAR 452.209-71 ASSURANCE REGARDING FELONY CONVICTION OR TAX DELINQUENT STATUS FOR CORPORATE APPLICANTS

(a) This award is subject to the provisions contained in sections 433 and 434 of the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, as amended and/or subsequently enacted, regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it -

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434, amended and/or subsequently enacted.

52.219-28 Post-Award Small Business Program Rerepresentation. (JUL 2013)

(a) Definitions. As used in this clause- Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(APR 1984) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

452.237-71 Pre-Bid/Pre-Proposal Conference. (FEB 1988)

(a) The Government is planning a pre-bid/pre-proposal conference, during which potential offerors may obtain a better understanding of the work required.

(b) Offerors are encouraged to submit all questions in writing at least five (5) days prior to the conference. Questions will be considered at any time prior to or during the conference; however, offerors will be asked to confirm verbal questions in writing. Subsequent to the conference, an amendment to the solicitation containing an abstract of the questions and answers, and a list of attendees, will be disseminated.

(c) In order to facilitate conference preparations, it is requested that the person named on the Standard Form 33 of this solicitation be contacted and advised of the number of persons who will attend.

(d) The Government assumes no responsibility for any expense incurred by an offeror prior to contract award.

(e) Offerors are cautioned that, notwithstanding any remarks or clarifications given at the conference, all terms and conditions of the solicitation remain unchanged unless they are changed by amendment to the solicitation. Quote Instructions – FAXES ARE NOT ACCEPTED Quotes shall be submitted in two parts - a technical and a price. Each part shall be separate and complete in itself so that evaluation of one may be accomplished independently of the other. The price proposal shall be submitted with the solicitation forms, no cost/pricing breakdown is required. The technical proposal must not contain reference to cost.

Technical.

1. Relevant Past Performance – Offerors shall submit past performance information for their firm. Performance information may be obtained from references provided.

The offeror shall submit a list of all relevant projects completed during the past three years and all contracts and subcontracts in progress. The list should include, but is not limited to, contracts and subcontracts similar in nature and complexity to that required by this solicitation. Include contracts with the Federal Government, agencies of state, and local governments, and commercial customers.

List must include name of project, amount of project, location of project, dates of project, name and complete address and phone numbers of Contracting Officer or COR, and any current contracts not completed.

If offeror fails to submit necessary information in order to complete an evaluation, the offeror will be deemed non-responsive and will not be considered.

The Office of Management and Budget (OMB) has authorized Federal agencies to collect past performance information under OMB clearance number 9000-0142.

2. Biobased Products – Offerors shall identify the biobased products to be purchased and used under this janitorial contract. For each biopreferred product listed, the Contractor shall specify the percentage of biobased content and demonstrate it meets the USDA recommendation.

3.Cost/Price: A firm’s completion and submission of Standard Form 18 marked RETURN THIS COPY constitutes the fulfillment of the Government’s price requirements under this solicitation.

SECTION M - Evaluation Factors for Award

AWARD DETERMINATION

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will determine best overall value on the basis of the factors described below.

Evaluation of Quotes

Quotes will be evaluated on the basis that the technical factors are listed in descending order of importance. When combined, all technical evaluation factors are approximately equal to price.

Each offeror will be evaluated on their performance under existing and prior contracts of a similar nature. The Government will focus on information that demonstrates quality of performance relative to the size and complexity of the procurement under consideration. The Government may research offeror performance on any federal, state, local, and commercial contract performance of the offeror that is known to the Government, but not included on the submitted by the Contractor. Additionally, personal experience and evaluator knowledge of offeror performance may be utilized.

The degree of importance of the price will increase with the degree of equality of the quotes in relation to the other factors on which selection is to be based, or when the price is so significantly high as to diminish the value of the technical superiority to the Government.

An exceeds rating would be achieved if quoter has completed projects of similar size and complexity as this project within the last 3 years and if the quality of work on all projects was rated highly by all customers contacted. Less than 3 notices of non-compliance/work orders in any past project is a minimum for consideration; 3 or more notices of non-compliance/work orders will result in an unacceptable rating.

Quoters with no record of past performance, i.e. newly formed businesses, will receive a neutral rating for past performance but should include the resume of the owner showing their experiences.

52.217-3 Evaluation Exclusive of Options. (APR 1984)

The Government will evaluate offers for award purposes by including only the price for the basic requirement; i.e., options will not be included in the evaluation for award purposes.
