The Government reserves the right to award to the offeror providing the Best Value to the Government. Award may not necessarily be made to the offeror submitting the lowest price. It is the Government’s intent to make a contract award.

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

SCOPE OF CONTRACT

The purpose of this contract is to provide lookout services. This includes furnishing all necessary labor, equipment, supervision, transportation, operating supplies, and incidentals.

LOCATION AND DESCRIPTION

The Hickman Lookout tower is a 41 foot wooden tower with L-4 cab. It is located at 4385 feet elevation and approximately 30 miles north of Zigzag, Oregon. The Lookout is in the Bull Run Watershed. The Bull Run Watershed is closed to public entry, special access gate is required. From the Zigzag Ranger District go north one mile on Lolo Pass Rd. Take Barlow Trail Rd. heading West 5 miles. Take FS road 14 heading north four miles. There are two gates on the 14 road. Access past the gate must be coordinated with the Zigzag Ranger District Office (503-622-3191). Take FS road 12 heading east six miles. Take the 400 Rd. three miles to the Lookout. The 400 Rd. is a primitive Forest road and a high clearance vehicle is recommended.

TECHNICAL SPECIFICATIONS

The work shall consist of lookout services to detect and report smokes or fires within and adjacent to the Mt. Hood National Forest, to monitor and forward radio messages, and collect, record, and report daily fire weather observations. All communications and reports shall be in English.

Working/living at lookout requires physical demands. The L-4 cabin is only accessible by wooden steps, approximately 60. Access to the open walk-around deck is through the trap door which weighs approximately 40 pounds. Supplies can be hoisted on the walk-around deck with pulley and rope. The restroom facilities consist of an outhouse adjacent to base of the tower. Environmental conditions can vary during the summer and fall.

The L-4 cabin is furnished with bed, desk, chair, fire finder, dresser and shelves. Cook stove, heater and refrigerator are powered by propane system and 300 gallon tank. The tower is equipped with 4 solar panels, 3 storage batteries, inverter and 3 outlets with 12 volt and 120 amps plugs. The tower is protected by lightning with a braided copper grounding system.

Facilities maintenance may be performed at the option of the contractor using Government supplies and equipment. The contractor will coordinate necessary maintenance with Contracting Officer or Contracting Officer Representative.

This is a performance based service contract and the contractor shall be in compliance with all established standards and requirements of this contract to be successful.

Definitions for the Protection Unit:

1. “Detect and report wildfires”: Visual surveillance for smoke and lightning strikes, recording their location and reporting them to Columbia Cascade Communications Center according to the established standards.

2. “Monitor and forward radio messages”: Remain close to the radio and record all incoming and outgoing messages in the radio log. The Government-furnished radio shall not be used by the contractor for personal purposes except in case of emergency. The radio will remain on and audible 24 hours per day while the site is occupied by the contractor so the Government can establish contact at any time if needed.

3. “Record and report fire weather observations”: Take readings from weather instruments as instructed including temperature, relative humidity, wind direction, wind speed and general visibility. Reporting the readings by radio to Columbia Cascade Communications Center at 1000, 1200, 1400 and 1600.

4. “Lookout Tower” or Lookout Site”: The actual structure and the geographic location.

ESTABLISHED STANDARDS

1986 Firefighter Guide and Ops Plan (see section G-2, a.14 of Handbook) lists the established standards and procedures against which performance shall be measured. The applicable section of this handbook will be made available for review at the Ranger District.

GOVERNMENT-FURNISHED TRAINING

1. The Government will conduct a workshop the first 2 days that the Lookout is on duty to explain the lookout instruction guides to the Lookout at no charge to the contractor. The workshop will be conducted at the lookout site.

2. The workshop is mandatory for all primary and relief Lookout persons. Attendance will be at no cost to the contractor.

3. Persons furnished by the contractor after the initial workshop will be trained by the Government at the contractor’s expense. The cost of the 2-day workshop is $1000.00 and must be coordinated well in advance of initial duties.

CONTRACTOR-FURNISHED EQUIPMENT

A.

The contractor shall furnish:

1.

A minimum of one Lookout person and one relief Lookout person

2.

All bedding

3.

All transportation to and from the lookout tower site

4.

House cleaning supplies

5.

Drinking water and water containers

6.

Lookout shall have on hand at all times, a 3-day supply of food and water

7.

Cooking utensils

8.

Garbage can and proper disposal

9.

Sanitary supplies

10.

Cellular phone

11.

The ability to connect to internet B.

The Government may, at its option, move the lookout contractor and contractor-furnished equipment into the lookout site when road conditions do not permit vehicular passage.

SPECIAL CONTRACT REQUIREMENTS

A.

Contract time will start on the effective date of award, and continue to be in effect until October 15 each year unless terminated or extended in accordance with other provisions contained herein. The period during which the contractor will be required to furnish lookout services is from approximately July 1 through approximately October 15

B.

The Government will allow the Lookout to occupy the site three days prior to the starting date for the purpose of setting up housekeeping. Coordination must be effected with the Contracting Officer (CO) and or Contracting Officers Representative (COR).

C.

The site shall be vacated by the Contractor and all supplies and equipment removed within five days of the last day services were required. The Contractor shall return all Government-furnished items within this time period.

D.

The lookout services shall be furnished seven days per week from 0800-1800 unless extended due to critical need.

E.

Midday meals shall be scheduled without interference with current activities or scheduled weather reporting.

F.

When not required to maintain lookout services, the Contractor shall establish communication procedures with the Government that will provide these services within two hours after the first attempt to make contact.

G.

The Contractor shall keep the lookout site clean and orderly. The windows shall be washed every seven days or whenever the visibility is impaired. Garbage shall be kept in closed containers and disposed of by the Contractor to an acceptable disposal location. If the Contractor is not maintaining the cleanliness of the facility, the Government may impose more stringent sanitary guidelines.

H.

The next day’s staffing schedule will be given to the Contractor by 1800 hours daily. In the event of the Contractor is not at the lookout site, the Contractor shall contact the Government for the next day’s staffing schedule by 1800 hours. The Contractor shall supply a phone number where they can be located. (see F, communication procedures) I.

Adjustments in Lookout staffing schedule may be made when the weather changes severely.

J.

All communications via radio, telephone and writing shall be conducted in English.

K.

The contractor will be issued two (2) Bull Run Watershed cyber keys. The cyber keys must be periodically updated throughout the summer, updates can be coordinated with the Contracting Officer Representative (COR). The contractor is responsible for the security and management of the keys to relief personnel.

GOVERNMENT ACCESS

A.

For the convenience of the Government, an employee of the Government may be placed at the site in the event of abnormal workload or when unable to make contact with the contractor.

B.

The lookout structure and other facilities will be kept accessible to the Government for the purpose of building or equipment repairs.

SAFETY PLAN

Prior to issuance of the Notice to Proceed, the Contractor shall have a safety plan for the activities involved with lookout services, in accordance with State OSHA regulations. The safety plan will be mutually agreed upon with the Contractor, Contracting Officer (CO) and the Contracting Officer Representative (COR).

SUPERINTENDENCE BY THE CONTRACTOR (FAR 52.236.6) (APR 1984)

At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the Contracting Officer and has the authority to act for the Contractor.

USE OF PREMISES

A.

The Contractor shall comply with the regulations governing the operation of premises which are occupied and shall perform this contract in such a manner as not to interrupt or interfere with the conduct of Government business.

B.

Before any camp, quarry, borrow pit, storage, detour, or bypass site, is opened or operated on National Forest land or lands administered by the Forest Service written permission shall be obtained through the Contracting Officer. A camp is interpreted to include the camp site or trailer parking area of any employee working on the project for the Contractor. Such permission, if granted, will be without charge to the Contractor but may include restrictions.

C.

Forest Service Regulations for Use of Campgrounds prohibits occupancy of developed recreation sites for other than primarily recreation purposes.

D.

At no time shall the Contractor allow unauthorized personnel or pets on the premises without express permission from the Contracting Officer.

E.

Conduct of illegal or improper activities (or those otherwise not conducted on a Government installation during the conduct of Government business) shall be grounds for termination of this contract. The Contractor is reminded that they are acting as a representative of the Government and shall conduct themselves accordingly. Any question of proper conduct can be referred to the Contracting Officer for resolution. At no time shall the Contractor be present at the site during other than normal duty hours as defined by the Preparedness Level and/or without Contracting Officer’s approval.

FIRE PREVENTION AND CONTROL

The Contractor shall be governed by the following, in addition to any fire plan contained in the contract:

A.

Contractor’s Responsibility in Fighting Own fire. The Contractor, under the direction of the Forest Supervisor or in the absence of said officer, acting independently, shall immediately extinguish without expense to the Government, all fires on or in the vicinity of the project which are caused by him or his employees whether set directly or indirectly as a result of the work on this project. The Contractor may be held liable for all damages resulting from fires set or caused by his employees or resulting from the operation of this contract. If the amount and character of labor, subsistence, supplies, and transportation which the Contractor is in a position to furnish promptly, for fire suppression, prove inadequate the Forest Supervisor is authorized to procure such items and services as they may deem necessary and charge to the Contractor.

B.

Use of Contractor Employees to Fight Other Fires. For the purpose of fighting forest fires on or in the vicinity of the project which are not caused by the Contractor or his employees, the Contractor, when requested by the Contracting Officer shall place his employees (if Red Card qualified) and equipment temporarily at the disposal of the Forest Service. Payment for such services will be made by the Government at not less than the current rate for fire-fighting services established by the Forest Service in the area concerned.

C.

Any employees and equipment furnished will be relieved from fire-fighting as soon as the Forest Service finds that it is practicable to employ other labor and equipment adequate for the protection of the area.

D.

An equitable adjustment in contract time may be made for this period.

INSPECTION AND ACCEPTANCE

A.

Inspection Procedure for Critical Services

1.

Government may periodically ignite a simulated smoke at a location known to be visible to the lookout. The lookout will be expected to respond within 15 minutes and plot within +- 3 degrees +- ½ mile distance and tied to nearest landmark.

2.

Lookout must relay radio transmissions without any material change to content or meaning.

3.

Lookout must respond to radio calls from known contact locations within no more than 3 calls within a 3-minute period.

B.

Other inspections and acceptance of work will be in accordance with the appropriately named clauses elsewhere in this contract.

C.

Acceptance will be performed by the COR with written approval by the Contracting Officer.

MEASUREMENT AND PAYMENT

A.

Payment will be made on the basis of Daily Rate and Extended Hours worked as listed in the Schedule of Items. The Contractor may submit monthly invoices, preferably at the end of each month, or one invoice for the entire season, which must be approved by the COR prior to submission. Any additional charges will be itemized on the invoice for supplies, extra hours or services. The Contractor will be paid for all days of the Season; payment will be based on the daily rate core hours and extended hours worked for the period of the invoice.

B.

Extended hours may be ordered at any time during the course of any shift, depending on the lightning activity level or current activities. The Government will pay for extended hours ordered by the Government at the rate listed in the Schedule of Items for one-quarter (1/4) hour increments.

C.

By mutual agreement, the Contractor may furnish trained Lookout relief persons at sites to be designed as needed. The relief Lookout will be paid at the daily rates shown in the Schedule of Items.

D.

Approved final payment for services will be submitted for payment upon return of the two (2) Bull Run Watershed cyber keys.

AVAILABILILTY OF FUNDS FOR THE NEXT FISCAL YEAR (FAR 53.232-19) (APR 1984)

Funds are not presently available for performance under this contract beyond the Base Year as shown in the Schedule of Items. The Government’s obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond October 31, 2017, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

(a) The Government may extend the term of this contract by written notice to the Contractor by May 25th of each year; provided that the Government gives the Contractor a preliminary written notice of its intent to extend by April 25th of each year. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed Five (5) years.

Protection of Government Equipment – The Contractor is responsible for maintaining and securing the equipment, facilities, and supplies under their control. Damage and/or destruction of these items may incur a charge for replacement or repair to the Contractor.

There shall be no personal liability upon the Contracting Officer or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them, by, or with the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.

NOTIFICATION OF INTENT TO SUBCONTRACT

The Contractor shall promptly notify the Contracting Officer if it’s intent is to enter into a subcontract agreement. The written notification shall include, as a minimum:

1. The name, address and telephone number of the intended subcontractor, including their qualifications as they relate to the requirements listed in this Contract.

2. The date upon which the subcontract will be effective and its duration.

3. A detailed description of the work being subcontracted including a listing of contract items, units, etc., as appropriate.

4. Documentation of the subcontractor's “Designation of Representative” as it relates to their authority to act in the Contractor’s behalf.

The contractor is reminded that the terms and conditions of this contract shall also be included in any subcontract they enter into with a third party. The subcontractor is bound by the same terms and conditions contained in the original contract.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

(a) The Contractor shall assign to this contract the following key personnel: __________________

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

AGAR 452.228-71 INSURANCE COVERAGE

If occupants other than the Contractor and relief lookout person(s) occupy the premises, Contractor will be required to sign an "Immunity from Torte Liability", covering the effective period of the contract.

Pursuant to Clause, "Insurance--Work on a Government Installation (FAR 52.228-5)", the Contractor shall be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

AGAR 452.226-77 EMERGENCY RESPONSE (NOV 1996)

(a) Contractor’s Responsibility for Fire Fighting. (1) The Contractor, under the provisions of FAR Clause 52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part t of the work. (2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor’s agents or employees.

(b) Contractor’s Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.

(c) Contractor’s Responsibility for Responding to Emergencies. When directed by the Contracting Officer or Contracting Officer Representative, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to fire fighting.) An equitable adjustment for the temporary use of the employees and equipment will be made under the CHANGES clause, FAR 52.243-4.

52.204-7 System for Award Management.

As prescribed in 4.1105(a)(1), use the following provision:

(a) Definitions. As used in this provision—

“Electronic Funds Transfer (EFT) indicator” means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

“Registered in the System for Award Management (SAM) database” means that—

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record “Active”.

“Unique entity identifier” means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “Unique Entity Identifier” followed by the unique entity identifier that identifies the Offeror’s name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in the SAM database.

(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

(1) Company legal business name.

(2) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(3) Company Physical Street Address, City, State, and Zip Code.

(4) Company Mailing Address, City, State and Zip Code (if separate from physical).

(5) Company telephone number.

(d) If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:

HEALTH & WELFARE: $4.27 per hour or $170.80 per week or $740.13 per month

VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor; and 3 weeks after 10 years. ** UNIFORM ALLOWANCE **

If employees are required to wear uniforms in the performance of this contract

(either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:

The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.

** NOTES APPLYING TO THIS WAGE DETERMINATION **

Under the policy and guidance contained in All Agency Memorandum No. 159, the

Wage and Hour Division does not recognize, for section 4(c) purposes, prospective wage rates and fringe benefit provisions that are effective only upon such contingencies as "approval of Wage and Hour, issuance of a wage determination, incorporation of the wage determination in the contract, adjusting the contract price, etc." (The relevant CBA section) in the collective bargaining agreement between (the parties) contains contingency language that

Wage and Hour does not recognize as reflecting "arm's length negotiation" under section 4(c) of the Act and 29 C.F.R. 5.11(a) of the regulations. This wage determination therefore reflects the actual CBA wage rates and fringe benefits paid under the predecessor contract.

The duties of employees under job titles listed are those described in the

"Service Contract Act Directory of Occupations", Fifth Edition (Revision 1), dated September 2014, unless otherwise indicated.

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE

Standard Form 1444 (SF‐1444)

Conformance Process:

The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined (See 29 CFR 4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees (See 29 CFR

4.6(b)(2)(ii)). The Wage and Hour Division shall make a final determination of conformed classification, wage rate, and/or fringe benefits which shall be retroactive to the commencement date of the contract (See 29 CFR

4.6(b)(2)(iv)(C)(vi)). When multiple wage determinations are included in a contract, a separate SF‐1444 should be prepared for each wage determination to which a class(es) is to be conformed.

The process for preparing a conformance request is as follows:

1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).

2) After contract award, the contractor prepares a written report listing in order the proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.

3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the

Wage and Hour Division, U.S. Department of Labor, for review (See 29 CFR

4.6(b)(2)(ii)).

4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.

5) The contracting officer transmits the Wage and Hour decision to the contractor.

6) The contractor informs the affected employees.

Information required by the Regulations must be submitted on SF‐1444 or bond paper.

When preparing a conformance request, the "Service Contract Act Directory of

Occupations" (the Directory) should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember, it is not the job title, but the required tasks that determine whether a class is included in an established wage determination. Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination.

FIRE PROTECTION AND SUPPRESSION

1.

Fire Period and Closed Season

Specific fire prevention measures are listed below and shall be effective for the period April 1 to October 31 of each year. The Forest Service may change the dates of said period by advance written notice if justified by unusual weather or other conditions. Required tools and equipment shall be kept currently in serviceable condition and immediately available for initial attack on fires.

2. Fire Plan

Before starting any operations on the project, the Contractor, Permittee, Licensee, or Purchaser, hereinafter referred to as the "Contractor," shall prepare a fire plan in cooperation with the Contracting Officer providing for the prevention and control of fires in the project area.

The Contractor shall certify compliance with fire protection and suppression requirements before beginning operations during the fire period and closed season, and shall update such certification when operations change.

The Contracting Officer may by written notice authorize substitute measures or equipment or may waive specific requirements during periods of low fire danger.
