52.217-8 Option to Extend Services. (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 calendar days.

52.217-9 Option to Extend the Term of the Contract. (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years and 6 months.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Medical Direction Statement of Work

The purpose of this statement of work is to obtain the professional services to provide Emergency Medical Services medical direction for Forest Service employees stationed in southern Idaho. These employees are collateral duty Emergency Care Providers and as such are normally employed as wildland firefighters, law enforcement officers, wilderness rangers, recreation technicians etc. These employees are currently credentialed in Idaho, or other states, as Emergency Medical Responders (EMR), Basic Emergency Medical Technicians, Intermediate Emergency Medical Technicians, or Advanced Emergency Medical Technicians (EMTA).

These Forest Service employees occasionally provide emergency medical care for employees and visitors associated with remote outdoor recreation and high risk work activities such as wildland fire operations and law enforcement. Forests in southern Idaho have an anticipated response to Medical Emergencies of about +/- 20 calls per year.

The following number of Forest Service Emergency Medical Care Providers that will be covered under this medical direction will vary from year to year:

• 5 – 50 EMR up to EMTA

• 51 – 75 EMR up to EMTA

• 76 – 100 EMR up to EMTA

• 101 – 125 EMR up to EMTA

• 126 – 175 EMR up to EMTA

Medical personnel could be located on any of the following forests located in Southern Idaho:

1. Boise National Forest

2. Caribou-Targhee National Forest

3. Sawtooth National Forest

4. Salmon Challis National Forest

These employees are distributed across various locations on these Forests. The Boise, Caribou-Targhee, Salmon-Challis and Sawtooth National Forests are applying to the State EMS board to become licensed providers (non-transport). The Forest Service anticipates a range of employees on a yearly basis identified in the scale above, The contractor must be an Idaho licensed physician and will have overall responsibility for the medical aspects of care provided by these Forest Service emergency medical personnel within the state of Idaho.

The contractor must have the following qualifications and background:

1. Experience in providing or identifying available tactical EMS courses or emergency medical presentations.

2. Has the following current licenses and certifications:

a. American Board of Emergency Medicine board certification

b. American Board of Emergency Medicine – EMS subspecialty board certified or board eligible (preferred) Idaho State Board of Medicine license

c. Unrestricted DEA license

Medical Director Services shall include:

1. Training: The contractor or his/her designee will provide once annual face to face training at each of the four forests. The contractor will provide input for training which will cover the dynamics of emergency medical care for wildland fire operations, law enforcement activities and employees involved in remote work projects.

2. Credentialing: The contractor will support and advise Forest Service Outdoor Emergency Care

Providers, (Emergency Medical Responders, Basic Emergency Medical Technicians, Intermediate Emergency Medical Technicians, and Advanced Emergency Medical Technicians) to ensure continuing education is completed.

3. Protocol Development, Review and Approval: The contractor will assist in developing treatment protocols and will function as the medical director who will review and approve the protocols annually or as necessary.

4. Subject Matter Expert (SME): As requested by the employees under medical direction, the contractor will provide advice and guidance on emergency medical service issues affecting the Forest Service.

5. Patient Care Report (PCR) review: The contractor will review an adequate sample of PCR’s annually to determine quality of documentation for problem assessment/reassessment, treatment, and disposition. Based on this review, he/she will provide a written response with recommendations such as a change in documentation or treatment protocol and topics for continuing education.

6. Emergency Medical Direction: The contractor will be available via telephone to answer questions and provide direction to the EMS providers in the field. The contractor or his/her approved designee will provide a response within 15 minutes from initial contact from a Forest Service EMS personnel engaged in an emergency medical response. The contractor will also have a designated email address for non-urgent question from the field. The contractor or his/her designee will respond to email questions from the field within 48 hours.

7. Liability Insurance: The medical director will maintain and provide proof of liability insurance on an annual basis to the Contracting Officer (CO) or Contracting Officer’s Representative (COR).

8. Quality Assurances Performance Plan (QAPP): As the medical director, the contractor will submit twice a year written reports to the COR reporting:

a. Summary of all submitted patient care reports (PCR.)

b. Summary of issues and concerns with Forest Service emergency care providers covered under this medical direction.

WHAT ARE THE WORKERS’ COMPENSATION REQUIREMENTS?

The Idaho Workers’ Compensation Law requires that employers who hire one or more, either full or part-time employees, to perform work in the State of Idaho, carry workers compensation insurance unless specifically exempted. Failure to comply could result in monetary penalties as well as an injunction to prohibit the employer from operating the business. Failure to carry workers’ compensation insurance for employees is a misdemeanor under Idaho Law.

WHO MUST COMPLETE THIS FORM?

Any person, partnership, limited liability company, corporation or firm who is bidding on a contract for the United States Department of Agriculture/Forest Service (USFS) for work that is within the State of Idaho and who has been notified by the USFS that he/she/it has been selected for a USFS contract.

WHEN MUST THE FORM BE COMPLETED?

The form must be completed and forwarded to one of the Industrial Commission offices when you are notified by the USFS that you have been selected for a USFS contract. The approval of the Industrial Commission is required prior to the final award.

ADDITIONAL COMMENTS:

Failure to complete any part of the form that is applicable to your operations could result in a delay in processing.

If any of the work is to be performed by sub-contractors, each sub-contractor must obtain and complete a Certificate of Verification of Worker’s Compensation Insurance.
