(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.217-8 Option to Extend Services (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract.

These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 15 calendar days.

52.217-9 Option to Extend the Term of the Contract (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days (60 days unless a different number of days is inserted) before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

452.228-71 Insurance Coverage (NOV 1996)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy.

The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

452.237-74 Key Personnel (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel:

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

STATEMENT OF WORK

LANDSCAPE SERVICES

RUBY MOUNTAIN RANGER DISTRICT OFFICE

AND FOREST SERVICE TOWNHOUSE, WELLS, NV

1. SCOPE OF CONTRACT: The contractor shall provide all personnel, equipment, tools, and supervision, services necessary to performed grounds maintenance at the Ruby Mountain Ranger District Office and Forest Service Townhouse, Wells, NV, in a manner that will maintain healthy grass, trees, shrubs, and plants and present a clean, neat, and professional appearance.

2. LOCATION: Ruby Mountain Ranger District, Humboldt-Toiyabe National Forest, 140 Pacific Avenue, Wells, NV 89835 and Forest Service Townhouse, 550 Second Avenue, Wells, NV.

2.1 DISTRICT OFFICE LOCATION: The Offices is located on the corner of Humboldt Ave and Pacific Avenue, Wells, NV. The landscaping area to be maintained will be from Humboldt Ave west to the Fleet parking and corral fence and from Pacific Ave south to the first horse pasture fence.

2.2 FOREST SERVICE TOWNHOUSE LOCATION: The house is located on the Northwest corner of Second Avenue and Ruby Avenue. Area to be maintained is from the fence line on North to the property line on the South where the grass edges the street and from the sidewalk in the front to the alley behind the garage.

3. MAINTAIN GROUNDS AND AUTOMATIC SPRINKLER SYSTEMS WEEKLY

3.1 Mow grounds. Contractor will be required to mow grounds weekly with irrigation. The grass clippings shall be removed or mulched after mowing. To maintain a uniform, neat and professional appearance at all times, the contractor shall maintain grass height between 2 and 2 ½ inches after mowing.

3.2 Edging. Sidewalks, driveways, curbs, and other concrete or asphalt edges located on the grounds will be edged at the time of mowing. Edging will include removal of vegetation from cracks in sidewalks, driveways, and curbs within a half-inch of the edged surface.

3.3 Trimming. Grass and weeds shall be trimmed around trees, shrubs, buildings, fence lines, sign posts, decks, water spigots, etc. Trimming height will match surrounding area grass heights. The grounds will be trimmed at the time of mowing. Damage to trees, shrubs and bushes from trimming will be repaired or replaced by the contractor at no cost to the government. If a tree, shrub or bush on the grounds should die or become unhealthy, the contractor will be responsible for replacing the damaged plant with a plant of same size and type. The cost to replace damaged trees, shrubs or bushes on the grounds with irrigation will be the responsibility of the contractor. The plant replacement will occur within 15 days of noticed damage. Contractor will not plant a tree, shrub or bush without the approval of the Contracting Officer and the COR.

3.4 Trimming and Pruning Shrubs/Bushes. The Contractor must maintain a neat and well maintained appearance of all plants, shrubs, and trees by proper pruning, clipping, pinching back, digging out new growth, and shape maintenance. To be completed at time of mowing.

3.5 Automatic Sprinkler System. Check, maintain, and adjust the automatic sprinkler systems. Sprinkler systems; Rain Bird System. Services of any problems should be completed within one week of time of discovery.

3.6 Repair Damaged Areas. Areas damaged by vehicles erosion, drought or insect/diseases will be seeded, sprigged, or sodded to maintain a uniform, neat and professional appearance. Contractor shall notify the COR when the areas noted above appear, and shall repair the damaged areas within seven (7) calendar days.

3.7 Remove Debris/Police Grounds. The Contractor must perform general litter patrol on all grounds. Responsibilities will include, but will not be limited to, the removal and disposal of all natural debris (tree limbs, dry brush, rodent habitats, dead animals, etc) and manmade debris. All grass clippings must be properly removed and disposed of offsite. Sidewalks and paved areas must be cleaned of all lawn clippings after each mowing. Curb-gutter, sidewalks, and concrete flat-work must be kept debris free (includes bark debris, dust, and dirt) with the debris properly removed and disposed of offsite. Removal of debris and policing of grounds will be concurrent with mowing schedule.

4. MANUAL WATERING

4.1 Watering Un-irrigated Lawn (Townhouse): Four times per week. The strip of lawn located next to the Townhouse which is not irrigated requires manually watering with hoses and/or sprinklers. Water shall not run in one place for periods of more than two hours. It is the Contractor’s responsibility to move the waterlines by hand and requesting help from the occupants is only allowed on an emergency basis.

5. PERIODIC MAINTENANCE

5.1 Apply Fertilizer (May and early August). The contractor shall perform an effective commercial fertilizer application for all grounds. Approved fertilizers shall be applied in accordance with the manufacturer’s instructions. Contractor shall apply fertilizer within least seven (7) calendar days from notification by the COR’s request of the application.

5.2 Aerate Soil. Aerate soil on the grounds to maintain a healthy state as required.

5.3 Weed Control/Removal. The Contractor must keep all lawns (includes semi-improved grassed areas), shrub beds, ground-cover beds, flower beds, graveled areas, and all other adjacent areas free of weeds at all times. Any herbicides must be applied by certified personnel and should take place at the appropriate times based on the weather/climate.

6. CONTRACTOR PROVIDED EQUIPMENT AND SUPPLIES.

6.1 Contractor-Furnished Equipment: The contractor shall provide and maintain all equipment necessary to perform the requirements of this contract.

6.1.1 All equipment used in the performance of this contract shall be in good operable condition and carry a U/L (Underwriters Laboratory) listing. Equipment found to be unsafe and unable to function as designed, shall not be used in performance of this contract. The contracting officer or designated representative may inspect the contractor’s equipment and direct the removal of any unsafe or unusable equipment or vehicle from the installation.

6.1.2 Contractor will supply all fertilizers, grass seed, and herbicides, etc. required to meet the requirements of this contract at no additional cost to the government, except those items listed in paragraph 7, Government Furnished Supplies and Equipment.

7. GOVERNMENT FURNISHED SUPPLIES AND EQUIPMENT

7.1 Government Furnished Supplies and Equipment: Water system pipe fittings for maintenance of automated water systems and furnish hoses or sprinkler attachments for watering un-irrigated lawn at the Townhouse property. Should the Government decide to enlarge the sprinkler system; the government will purchase and install the necessary items. After the system has been installed, maintenance of the new system will become the contractor’s responsibility.

8. GENERAL INFORMATION

8.1 Hours of Operation. The contractor shall perform the services required under this contract during the following hours.

The contractor is not required to perform services on Federal Holidays.

8.1.1 Normal Work Hours. The contractor shall perform services on TBD UPON AWARD OF CONTRACT no earlier than TBD a.m. and no later than TBD p.m. If the Contractor finds it necessary to deviate from the normal work day or hours of operation to ensure timely completion of work under this SOW at no additional cost to the government coordination is required with the COR.

ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:

HEALTH & WELFARE: $3.50 per hour or $140.00 per week or $606.67 per month

VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor; 3 weeks after 5 years, and 4 weeks after 15 years. Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility.
