SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C1 SCOPE OF CONTRACT

The Contractor shall furnish all necessary labor, equipment, supervisions, transportation, and supplies necessary to perform the work in accordance with the specifications.

The purpose of this solicitation is to procure services for the Casner Creek Stream Rehabilitation project to be implemented in 2010. The services will include excavation, transportation and grading of fill material,, placement of biolog check dams, and planting willows/sedges (with an excavator).

The restoration will implement passive restoration by removing an earthen berm along the left (west) bank of Casner Creek and initiating meander development. The berm is a remnant of mining activities in the 1950s and is preventing overbank flow during spring runoff. The project implementation components are described below:

1. Remove berm: An excavator will be used to remove the berm’s full length, approximately 2050 feet in length, 10-20 feet wide and 1.5 feet deep or about 1500 cubic yards of material along the left (west) bank of Casner Creek. (See attachment 1)

2.

a. The existing vegetation on the berm will be retained as much as possible (by removing, temporarily storing and replacing “green side up” where feasible, see photo below).

b. The existing sedge strip at the water’s edge on the left bank of Casner Creek

(see photo above) will be retained as much as possible. During berm removal, there is expected to very limited disturbance at the water’s edge.

c. Berm material will be transported and deposited in the tailings borrow pit between Casner Creek & Bear Valley Creek. Passes by the excavator and dump truck will be concentrated and limited to a designated route.

Sedge strip at water’s edge.

AG-0261-S-10-0074 Casner Creek Stream Rehabilitation Project Page 6

3. Biolog structures:

Up to 12 biolog check dams would be installed at several locations throughout the reach. The biolog mini check dams would be installed to begin to raise the channel bed elevation. The biolog check dams would be installed with an excavator and by hand.

4. Revegetation: plant sedges, willow clumps.

Sedge mats and willows will be transplanted with an excavator from locations approved by the Botanist in the Casner Creek floodplain to the Casner Creek streambank where excavation or disturbance has created a need for revegetation.

Data available: A full topographical survey was conducted, using a total station, in 2000 and 2005, with additional high flow data collected in 2006.

C2 PROJECT LOCATION

The project area is located on Casner Creek, a tributary to Bear Valley Creek in the Middle Fork Salmon River drainage. The stream is located on the Lowman Ranger District of the Boise National Forest. Please see Vicinity Map (attachment1).

This project involves approximately 0.5 mile of Casner Creek, from approximately 0.10 mile downstream of the 582 road crossing downstream approximately 0.5 mile. It is estimated that approximately 100 feet on either side of the existing Casner Creek channel may be affected by the implementation of this project with ground-disturbing activities.

C.3 SITE INFORMATION AND LIMITATIONS

The following site conditions are considered incidental to the contract and the contractor will not be paid directly for any of the following items:

All construction equipment shall be pressure washed before entering the Site. The removal of mud and debris from treads, tracks and undercarriage, with emphasis on axles, frame, cross-members, motor mounts, and underneath steps, running boards, and front bumper/brushguard assemblies will be required.

The purpose is to reduce or eliminate the transportation of noxious weeds, which is required by Federal and State regulations. All equipment shall be free of oil, gas or fluid leaks. Equipment will be inspected before arriving on site to ensure cleanliness to prevent spills into the waterways and to prevent the spread of noxious weeds. In addition, a spill containment kit commensurate with the amount of fuel stored in the vehicles will be required onsite.

C5 TRAFFIC CONTROL AND CONSTRUCTION SIGNING RESERVED

C6 WORK CAMPS, STAGING AND STORAGE AREAS

Camping on National Forest Lands, on or near the job site, must be approved in writing by the Lowman District Ranger. If the contractor chooses to camp, a permit would be issued and the contractor would be expected to follow the permit requirements. A final inspection of the campsite would be conducted by a contract inspector or the COR prior to receiving the final payment.

C7 INSPECTION OF WORKSITE

The contractor acknowledges they have taken the necessary steps to ascertain the nature and location of work, and have investigated and satisfied themselves as to the general and local conditions that can affect the work or its cost. Any failure of the contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from the responsibility of estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expenses to the government.

C8 START DATE

The approximate start date for the project is August 2, 2010. All in channel and streamside work MUST be completed August 30, 2010.

C9 RESERVED

C10 TECHNICIAL REQUIREMENTS

Equipments Requirements: The excavator operator must be skilled and excavator must have adequate equipment (i.e. bucket with thumb) to perform fine-scale work near a stream. (Fine-scale work in this context would be similar to finished landscaping). Removal of the berm material will include carefully removing (and setting aside for replacement) the top layer of sod from the berm. It is estimated that at least 1 excavator, at least 1 dump truck and at least 2 operators will be needed. The excavator should be tracked with a minimum of 90 horsepower, minimum bucket size of 0.5 cubic yard and equipped with a hydraulic thumb for placement of boulders. The dump truck should have a minimum capacity of 10 cubic yards.

The contractor is expected to provide the necessary heavy equipment and operators needed to complete the work as described above and as summarized below:

“Central Contractor Registration (CCR) database” means the primary Government repository for Contractor information required for the conduct of business with the Government.

“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

“Data Universal Numbering System+4 (DUNS+4) number” means the DUNS number means the number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) AG-0261-S-10-0074 Casner Creek Stream Rehabilitation Project Page 15

“Registered in the CCR database” means that—

(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the CCR database; and

(2) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record “Active”. The Contractor will be required to provide consent for TIN validation to the Government as a part of the CCR registration process.

(b)

(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the offeror’s name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(1) An offeror may obtain a DUNS number—

(i) Via the internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or

(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.

(2) The offeror should be prepared to provide the following information:

(i) Company legal business name.

(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(iii) Company physical street address, city, state and Zip Code.

(iv) Company mailing address, city, state and Zip Code (if separate from physical).

(v) Company telephone number.

(vi) Date the company was started.

(vii) Number of employees at your location.

(viii) Chief executive officer/key manager.

(ix) Line of business (industry).

(x) Company Headquarters name and address (reporting relationship within your entity).

(d) If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering.

Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(f) The Contractor is responsible for the accuracy and completeness of the data within the CCR database, and for any liability resulting from the Government’s reliance on inaccurate or incomplete data. To remain registered in the CCR database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the CCR database to ensure it is current, accurate and complete. Updating information in the CCR does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(g)

(1)

(i) If a Contractor has legally changed its business name, “doing business as” name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day’s written notification of its intention to:

(A) Change the name in the CCR database;

AG-0261-S-10-0074 Casner Creek Stream Rehabilitation Project Page 17

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the CCR record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims). Assignees shall be separately registered in the CCR database. Information provided to the Contractor’s CCR record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the “Suspension of payment” paragraph of the EFT clause of this contract.

(h) Offerors and Contractors may obtain information on registration and annual confirmation requirements via the Internet at http://www.ccr.gov or by calling 1-888-227-2423, or 269-961-5757.

(2) Does not include bulk cargo, as defined in section 3 of the Shipping Act of 1984 (46 U.S.C. App. 1702), such as agricultural products and petroleum products.

“Component” means an article, material, or supply incorporated directly into a construction material.

“Construction material” means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

“Cost of components” means--

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

AG-0261-S-10-0074 Casner Creek Stream Rehabilitation Project Page 18

“Domestic construction material” means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

“Foreign construction material” means a construction material other than a domestic construction material.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements the Buy American Act (41 U.S.C. 10a-10d) by providing a preference for domestic construction material. In accordance with 41 U.S.C. 431, the component test of the Buy American Act is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to the construction material or components listed by the Government as follows: None.

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American Act to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American Act.

(1)

(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including--

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

AG-0261-S-10-0074 Casner Creek Stream Rehabilitation Project Page 19

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American Act applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American Act applies, use of foreign construction material is noncompliant with the Buy American Act.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

Foreign and Domestic Construction Materials Price Comparison

Construction material description Unit of measure Quantity Price (dollars) * Item 1 Foreign construction material Domestic construction material Item 2 Foreign construction material Domestic construction material

[List name, address, telephone number, and contact for suppliers surveyed. Attach copy of response; if oral, attach summary.]

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
