B.1 DESCRIPTION OF AGREEMENT

Learning Review Technical Specialist (LRTS) support is required for incidents that meet the threshold of the Forest Service Chief’s level review or investigation. When this threshold is reached the Director of the Office of Safety and occupational Health (OSOH) will select teams based on a list of technically qualified personnel. This list will be forwarded to the Chief's Office and a letter of delegation will be prepared assigning individuals to positions on the team. Throughout the duration of the learning review process needs may arise for a technical expertise and team lead.

B.2 TASKS

The LRTS will often travel to the incident area, or to another specific meeting location to provide support directly to the learning review team lead, or Coordinated Response Protocol (CRP) effort. LRTS’s duties will range from providing leadership to the team, sharing writing expertise, interview expertise, human factors expertise, or a host of other unique skills that are required by team, as dictated by the details of the incident. An LRTS may be requested at any point in the learning review process, and may be expected to do a variety of work either in the field, or at the home or unit. All this information must meet the criteria established by the Learning Review Guide and the Agency Administrator or their designee.

LRTS may be asked to engage in the evaluation of the information obtained in any phase of a learning review. This can include assembling focus groups, deliberation with academic specialists, creating recommendations and writing report(s) as required, to meet the needs of the Learning Review Board. This work will be reviewed by the Response Coordinator, Director of the Office of Innovation and Organizational Learning and/or The Director of the Office of Safety and Occupational Health (or their designees).

B.3 MINIMUM QUALIFICATIONS

Learning Review Technical Specialist (LRT) shall possess four or more of the following:

A master’s degree in Human Factors and Systems Safety or a field related to the investigation/review of accidents with specific emphasis on social interactions.

Significant work experience, professional skills, certificates, or background related to Human Factors and Systems Safety as they pertain to Agency accidents or incidents.

An operational background in wildland firefighting or working knowledge of Forest Service wildland fire operations

Previous experience with the Coordinated Response Protocol (CRP) and/or Learning Review.

Working knowledge of the National Forest System and Forest Service operations.

B.4 DELIVERABLES

(a) Deliverables and other requirements will be stated in each BPA Call, and will generally include

(1) Provide reports, feedback, ideas, questions and/or learning tools for the field and leadership.

(2) Provide leadership, facilitation, or expertise in an area of their specialty to the learning review team such that the expertise can lead to, or be captured in, the final learning products.

(b) All designs, drawings, notes and other works developed in the performance of the contract shall become the sole property of the Government and may be used on any other projects without additional compensation.

B.5 ACCEPTANCE

Acceptance of the deliverables will be evaluated by the Contracting Officer or the appointed Contracting Officer Representative (COR) according to the following criteria:

Thoroughness and timeliness in complying with all of the elements in the tasks specified.

Quality and clarity of analyses and work produced.

Timeliness and efficacy of communications with relevant counterparts in the US Forest Service and other relevant organizations.

All reports and written deliverables are to be submitted in English in hard and electronic copy (in MS Word 11 point font), with tables, data and calculations in MS Excel.

B.6 EXTENT OF OBLIGATION.

(a) The Government is obligated only to the extent of authorized purchases actually made under the BPA. This agreement may be terminated upon 30 days written notice by either party.

(b) Orders against this BPA become binding once the contractor has agreed to an assignment and services from an authorized caller.

B.7 PURCHASE LIMITATION.

(a) No single BPA call under this agreement shall exceed $25,000 in amount.

(b) The intention that once an incident occurs with definitive times and locations the contracting officer will submit a request for quote to the contractor and negotiate the actual price of each incident support action (to be charged against that emergency funding P-code).

The contractor will then bill against the appropriate line item for services for that incident.

B.8 PROJECT LOCATION.

Multiple locations throughout the country, TBD at the time of incident. On-site locations may be remote and require heightened level of physical effort to access.

B.9 PERIOD OF PERFORMANCE.

This agreement covers a period of one (1) base year plus four (4) option years from time of award.

B.10 INDIVIDUALS AUTHORIZED TO PURCHASE UNDER THE BPA.

(a) The following personnel are authorized to issue Calls under this BPA:

• A Kay Steffey, WO ISB Ops Contracting Officer

• Shannon Spies, WO ISB Ops Administrative Contracting Officer

(b) Since the contractor will be required to be available for emergency mobilizations, the following individuals are authorized to contact the contractor to initiate that mobilization process using the available funding:

• Steve Schlientz, Director OSOH

• Ivan Pupulidy, Human Performance Specialist, Risk Management and Human Factors RD&A

(c) The Contracting Officer is the only individual authorized to make changes to the calls.

Therefore, unless changes are received in writing by the Contractor from the Contracting Officer, the Contractor assumes all risks involved in any change made to the call placed in accordance to this BPA.

B.11 ORDERING

(a) The Chief's Office will issue a letter of delegation authorizing the creation of a CRP (Coordinated Response Protocol) team.

(b) The Director of OSOH, in coordination with the Office of Innovation and Organizational Learning (IOL), will identify specific, the technical expertise that is needed for a learning Review or other IOL project or function, as well as a suggested source for that expertise.

The Government will create a BPA Call to the contractor(s) whose technical expertise best aligns with the specific technical expertise needed, while also considering price for service.

(b) The Government does not guarantee any calls for service under this agreement and the contractor is not obligated to accept any orders. However, once the contractor accepts an order, the contractor is obligated to perform in accordance with the terms and conditions stated herein.

(c) Individual BPA Calls shall include, but are not limited to the following information:

(6) “Submit Invoice to” address

(d) All work performed shall be contingent on the issuance of a written Call and the payment terms within the Call will be on an hourly fixed price basis as described in the Call plus reimbursement of actual travel costs when applicable.

(e) Except in the case of emergency mobilizations, the contracting officer will issue a Request for Quotation regarding the BPA Call. The purpose of the request is for the contractor to coordinate with the Contracting Officer to establish the period of performance, estimated number of hours, and other incurred costs to perform/deliver the task set forth in the BPA Call.

(f) When emergency mobilizations are necessary, as stated in the previous section, authorized individuals may initiate the mobilization process. These individuals must still coordinate with the CO to ensure the terms of the BPA Call are negotiated with the contractor and ultimately set forth in the Call created for each incident support action and funded using the appropriate fire P-code.

B. 12 FIRM-FIXED PRICING

The hourly rate, as specified in Section B, Schedule of Items, forms the basis for pricing;

however all Calls shall be priced and paid as a firm fixed price plus cost reimbursement for travel expenses when applicable. The Government reserves the option of ordering services on an hourly basis when determined necessary by the Government. When orders are placed on a firm fixed-price basis, the order shall include a not to exceed amount and the Contractor shall not exceed that amount without written authorization via modification

Additionally, if in the performance of an order, the Contractor finds it cannot deliver as required, the Contractor shall promptly notify the Contracting Officer by letter or e-mail, and shall indicate when delivery will be accomplished. If the Government grants an extension to the delivery schedule, the Government will require consideration adequate to affect the change.

The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of the last day of the agreement.

C.7 OPTION TO EXTEND THE TERM OF THE CONTRACT (FAR 52.217-9) (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. C.9 NOTICE OF CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM

(JULY 2010)

(a) The US Forest Service has implemented the Contractor Performance Assessment Reporting System (CPARS) for reporting all past performance information. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.

(b) The past performance evaluation process is a totally paperless process using CPARS.

CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm’s past performance evaluation(s) for the contract no later than 60 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.

(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS are available at http://www.cpars.csd.disa.mil/. The CPARS User Manual, registration for On Line Training for Contractor Representatives, and a practice application may be found at this site.

(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation and the report will be accessible at http://www.cpars.csd.disa.mil/. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment.

Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official’s narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 – 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions.

If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating “No comment” in Block 22, and then signing and dating Block 23 of the form.

Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: “The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment.” Your response is due within 60 calendar days after receipt of the CPAR.

(f) The following guidelines apply concerning your use of the past performance evaluation:

(1) Protect the evaluation as “source selection information.” After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.

(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, preaward surveys, responsibility determinations, production readiness reviews, or other similar purposes.

(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.

(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.
