DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

False Island Dock Repairs and Barge Moorage

SCOPE OF WORK

Provide all labor, materials, facilities, and equipment necessary to deliver one (1) 20’x24’ float structure to the USFS False Island Field Camp near Sitka, Alaska. Work includes fabrication, shipping, assembly, and delivery in the water during the specified time frame.

Provide all labor, materials, facilities, and equipment necessary to deliver two (2) bumper float assemblies to the USFS False Island Field Camp near Sitka, Alaska. Work includes fabrication, shipping, assembly, and delivery during the specified time frame.

Provide all labor, materials, facilities, and equipment necessary to complete the following various dock repair tasks:

i. Relocate and re-anchor a 32’x85’ barge structure.

ii. Relocate and re-anchor a 8’x80’ float structure.

iii. Supply and install 80 lineal feet of tire bumper detailing to an existing float structure.

DESCRIPTION OF STRUCTURES

20’ X 24’ FLOAT STRUCTURE

The 20’x24’ float structure will be tied off to larger, Government-owned support floats that are secured to piles and are intended to aid in the loading and off-loading of government personnel from float planes and boats as they carry out Government missions. Uses include docking for float planes, docking for boats up to 28 feet in length, for emergency egress from the larger accommodation barges, for crew staging and loading, and for fuel storage.

The float shall be 20'x 24' and shall consist of four (4) foam-filled polyethylene pipes with an attached wood frame deck. The unloaded freeboard of the float in salt water shall be approximately 18 to 20 inches. Floats shall be joined together using smaller polyethylene cross-member pipes fused to the larger pipes in a transverse direction. Full length timber deck stringers shall be bolted to polyethylene tabs which shall be fused to the larger pipes. All pipes shall have mounting tabs for timber stringer attachment and shall be raked on one end. All wood is pressure-treated and all metal fasteners and hardware are stainless steel.

BUMPER FLOAT ASSEMBLY

The 6’x26’ bumper float assembly will be attached around the existing steel piles and will act as a separating mechanism between the steel piles and the steel barge to prevent damage to either structure. The HDPE bumper floats are intended to provide a smooth surface for the barge to be moored against without the threat of damage to the barge hull. There shall be two floats per bumper float assembly connected by stainless steel pile collar. The floats on the bumper float assembly shall be 18” in diameter and 26’ feet in length and shall consist of foam filled polyethylene pipes. The unloaded freeboard of the float assembly shall be at least nine inches.

WORK SCHEDULE

The Contractor shall prepare and provide a Work Schedule showing starting and completion dates for the major portions of the work; including, but not limited to, float fabrication, shipping, float assembly, and storage location. The schedule shall be submitted to the Contracting Officer (CO) at the Prework Meeting which will be held prior to work beginning.

SUBMITTALS

Where submittals are required in subsequent sections, Contractor shall provide the complete set of submittal drawings in pdf format to the CO. The CO will review the submittal and return with comments or approved within 15 days of receipt. If comments require changes to the submittal, the review period will restart upon receipt of the modified submittals.

OPTIONAL REQUIREMENTS

Where a choice of material and/or methods is specified herein, the Contractor may exercise the option unless stated specifically otherwise in the Contract. Where "or approved equal" is specified, or a material substitution is proposed, the CO's approval must be obtained in writing before proceeding.

GOVERNMENT INSPECTION

Contractor shall facilitate all CO inspections, providing access to all aspects of the work. Manufacturing plant will be open for Government inspection during production of HDPE floats.

STORAGE and HANDLING

Contractor may store the floats/bumper assemblies either in the water or on land. If Contractor chooses to hoist the assembled floats from land to the water, use shall be made of slings; floats shall not be hoisted from the pad eyes. Contractor shall submit a plan for CO approval showing the proposed storage location and method of moving the float from storage into the water.

DELIVERY LOCATION

The contractor shall deliver all contract items to the United States Forest Service False Island Field Camp Dock. The False Island Field Camp is located on the Northern shore of Peril Strait approximately 30 air miles North of Sitka, Alaska. The field camp can be accessed by water or float plane only. False Island cannot be accessed by road from any community and there are no facilities available.

INSTALLATION on SITE

Contractor is required to submit for approval a moorage plan for the moorage of the new and existing components shown in the plans. Moorage plan must show how all components will be secured and how anchor lines will be kept at a safe depth for boats utilizing the dock.

Contractor shall keep access for float planes and boat moorage throughout the duration of the installation at False Island unless otherwise approved by the CO.

COMPLETION and ACCEPTANCE The Government will make a final inspection of the float and bumper float assembly when assembly is complete, prior to launch into the water. The Government will make final inspection of the dock repair work once all work is completed. The Government will consider the final work acceptable when all floats are in the water and adequately anchored and when all dock repair work is completed per contract requirements. Progress payment on materials may be made once materials have been inspected by the CO on site.

CONSTRUCTION and ASSEMBLY

DESCRIPTION

This Specification contains requirements for the complete construction of the float and bumper float assemblies; including the polyethylene floats, cross-members, wooden deck, and steel fabrications and fasteners.

SUBMITTALS

Contractor shall submit shop drawings showing all dimensions and details of the following assemblies

2. Bumper Assemblies

MATERIALS

HDPE MATERIALS

A.

Pipe for main floats and cross-members: ASTM D 3350-93 Class PE345434C; PLEXCO PE 3408, SDR 26.0, high-density polyethylene or approved equal.

B.

Flat stock for end caps, flanges, and mounting tabs: ASTM D 3350-93 Class PE345434C; Poly-HI Industries Pipe Grade HDPE or approved equal. Connection flanges shall be "Fishpen Flange" by Familian Plastics or approved equal.

FOAM FLOATATION LOGS

INSULFOAM, Type 1 closed-cell expanded polystyrene foam log conforming to ASTM C578, or approved equal. Foam log shall be sized to fill pipe as much as practical.

STEEL FASTENERS and FABRICATIONS

All metal fasteners and float pad eyes shall be 316 stainless steel. Deck screws shall be square drive #10 x 3-1/2" stainless steel or approved equal.

All fabricated steel shapes, plates and bars shall be 316 stainless steel or structural steel meeting the requirements of ASTM A36 & galvanized in accordance with ASTM A153.

WOOD DECK and SUPPORT STRUCTURE

A. Decking: WCLB Standard and Better Douglas Fir-Larch or Hem-Fir, and shall be pressure preservative treated with CCA in accordance with AWPA U1(Commodity Specification A, Use Category 4C). WCLB Standard and Better Alaska Yellow Cedar is also acceptable and is not required to be pressure-treated. Rough-sawn or S4S sizes and finishes are acceptable.

B. Skirting and Blocks: WCLB Standard and Better Douglas Fir-Larch or Hem-Fir, and shall be pressure preservative treated with CCA in accordance with AWPA U1(Commodity Specification A, Use Category 4C). WCLB Standard and Better Alaska Yellow Cedar is also acceptable and is not required to be pressure-treated. Rough-sawn or S4S sizes and finishes are acceptable.

C. Support Structure: WCLB Select Structural Douglas Fir-Larch or Hem-Fir, pressure preservative treated with Creosote in accordance with AWPA U1 (Commodity Specification A, Use Category 5A). Select structural Alaska Yellow Cedar is also acceptable and is not required to be pressure-treated. Sizes and finish to be rough-sawn. Timber stringers (6x6) shall be full length to span the width of the float; splicing is not allowed.

EXECUTION

GENERAL

Float shall be shop-fabricated to the greatest extent possible. All heat fusion welds shall be done in the shop and shall be full surface welds using heat and pressure; extruder welding is not allowed. All bolt holes shall be pre-drilled in the shop prior to shipping. The design accommodates freight size limitations and must be field-assembled. Pre-assemble HDPE portion of each float in the shop to assure no field modification of HDPE components or welds is necessary. Float shall be fabricated to minimize work associated with field assembly.

FLOAT SUBSTRUCTURE

A. Main Float Pipes: Forward ends shall be raked as shown on the Drawings. Stern ends shall be perpendicular to the length of pipe. Caps shall be heat fused to end of pipe for a complete watertight seal. Caps shall be finished smooth to match pipe.

Rake bow end of foam log to match rake on pipe and insert foam into pipe. Stern end shall be cut off square to match pipe. All four main float pipes shall be fitted with mounting tabs for bolted connections to timber stringers.

B. Cross-Members: Where cross-members are attached to the main pipes, the cross-member shall be cut for a clean fit and side wall fused to main float pipes such that the centerlines of all pipes are in the same plane. Bolt flanges or "Fishpen Flanges" shall be butt-welded to the ends of the cross-members as shown on the Drawings.

C. Mounting tabs: Mounting tabs are required on each main float pipe and bumper float assembly. All mounting tabs shall be sized and configured as shown on the Drawings. Stiffeners are full surface heat fused to the tabs and the entire assembly full surface heat fused to the pipe. Drill all holes to allow for bolt head and washer clearance. Holes for bolts may be oversized as necessary up to 1/8-inch.

FLOAT SUPERSTRUCTURE

With float substructure assembled, 6x6 stringers may be bolted to the mounting tabs. Bolt holes in wood may be oversized by 1/8-inch for clearance. All bolt holes and end cuts in pressure-treated wood shall be field treated using two (2) coats of copper napthanate.

Attach 4x6 blocks to bow and stern stringers as shown on the Drawings. Lag screws shall be in the center of the block and each lag shall be 3 inches from the end of the block. Lag screw lead holes in 4x6 blocks shall be oversized enough to allow the screw to turn freely in the hole. Drill appropriate size pilot hole in 6x6 stringer to accept lag screw threads. Countersink screw head for flush fit.

Attach 2x6 skirt to blocks at bow and stern using 6 each #10 x 3-1/2" stainless steel screws in each block. Attach 2x6 skirt to ends of stringers on each side of the float using 4 each

#10 x 3-1/2" stainless steel screws slightly angled for greater pullout resistance. One (1) splice will be allowed in each skirt and shall be centered on a block or stringer.

Attach decking to stringers using 4 each #10 x 3-1/2" stainless steel screws. Attach decking to bow and stern skirt using 2 each #10 x 3-1/2" stainless steel screws, and to side skirt using 1 each #10 x 3-1/2" stainless steel screw at 12" o/c. Decking shall be applied in a uniform pattern such that no single 2x6-decking member has to be ripped. Gaps between succeeding courses shall be uniform, not exceed 3/8-inch, and be at least 1/4-inch in width. End splices in decking shall be centered over a 6x6 stringer and shall be staggered with successive boards, no closer than 8 feet in adjacent courses. Decking shall be installed in maximum practical lengths but, in no case shall length be less than 8 feet. Ends shall be cut uniformly and shall be eased for a smooth finish. End cuts in pressure-treated decking shall be treated with two (2) coats of copper napthanate.

AGAR 452.211-72 Statement of Work/Specifications (FEB 1988) The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified), to perform the Statement of Work/Specifications referenced in the attachments Section.

Applicable Specifications Standard or Special Project Specifications shown in the specification listing contained in the attachments are applicable to this contract. All specifications not included in the specification listing but referenced by listed specifications, are applicable. The Special Project Specifications shown on the specification list are physically attached.

PACKAGING AND MARKING

Project Labeling for Official Correspondence

The Government singularly identifies each project with a contract number at time of award. The contract number is a unique identifier to purposely and permanently represent an awarded project. The Government issued contract number is to be referenced on all official communication starting upon notice of award.

FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1) CLAUSES

52.242-14 Suspension of Work (APR 1984)

FAR 52.211-10 Commencement Prosecution and Completion of Work (APR 1984) The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 60 calendar days. The time stated for completion shall include final cleanup of the premises.

Once contractor begins work on site, all work must be completed within a 60 day period which may, upon approval of CO, be divided into two work periods that together equal 60 days. If two work periods are desired, the contractor shall submit a work plan to the CO for approval within 15 days of contract award and two weeks prior to commencement of site work.

In either case, the contractor shall provide a site work schedule to the COR two weeks prior to start of work on site to allow the Forest Service time to post a site closure notice in the local newspaper.

CONTRACT ADMINISTRATION DATA

AGAR 452.215-73 Post Award Conference (NOV 1996)

A post award conference with the successful offeror is required. It will be scheduled and held within 5 days after contract award. The conference will be held via teleconference after award.

Reminder of Invoicing Requirements

(a) The Contractor is reminded that the elements of a proper invoice are listed in the clause at FAR 52.232-27 in Section I.

(b) It is the sole responsibility of the Contractor to submit proper and timely invoices using its own invoice form or to request and complete the Microsoft Word format (Pay Estimate FS-6300-30) received from the contracting office. Improper invoices (i.e. errors in extensions, quantities, or other base information) will be returned to the Contractor for correction and subsequent resubmission.

(c) In addition, when submitting the invoice the Contractor shall submit a copy (either electronically, hard copy, or via fax) to the Contracting Officer along with timely payrolls, if applicable and subcontractor payment information (see FAR 52.232-5 Payments Under Fixed Price Construction Contracts).

All matters related to the performance of this contract shall be coordinated through the Contracting Officer.

Designation of Contracting Representative (COR)

The Contracting Officer designates the Contracting Officer's Representative(s) (COR). The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)

On all matters that pertain to the contract terms, the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

Public Officials not Personally Liable

There shall be no personal liability upon the Government or officer in charge, their agents or employees, for any act performed in the discharge of any duty imposed or the exercise of any power or authority conferred upon them by, or within the scope of the contract, it being understood that in all such matters they act solely as agents and representatives of the Government.

Contractor’s Designated Representative

It is required that the Contractor have a designated representative available on the project during the entire project and that the representative be able to speak and understand English. When designating a representative, the Contractor shall furnish a copy of the designation in writing to the Contracting

Officer. Such designation shall clearly indicate the name and limitations (if any) of authority of the representative. If the Contractor intends to designate a representative prior to the pre-work meeting, the representative is strongly encouraged to attend that meeting.

Suspensions for other than Government’s Convenience The Contracting Officer may issue orders to suspend the work wholly or in part for such period of time as deemed necessary because of: (1) Weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads to the project, or adjacent property. Such action would include but not be limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to become muddy or unsuitable; or (2) Failure of the Contractor to comply with Specifications such as but not limited to placement of frozen material in fills, placing of asphalts at temperatures lower than those specified, performing work prior to prerequisite approvals, operating equipment not meeting fire requirements, or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by his/her operation, whether inside or outside project limits, at no cost to the Government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14, Suspension of Work, and shall not qualify for equitable adjustment.

AGAR 452.236-73 ARCHAEOLOGICAL OR HISTORIC SITES (FEB. 1988)

If a previously unidentified archaeological or historic site(s) is encountered, the Acontractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

LANDSCAPE PRESERVATION

(a) Confine operations to within the clearing limits or other areas designated in contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Unless otherwise agreed to by the COR, retrieve material which falls outside of these limits and either incorporate the material in the work or dispose of the material as directed by the COR.

(b) Schedule and conduct operations to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.). Install silt fencing around areas immediately next to streams and ponds to mitigate suspended sediments when designated on the drawings.

Do not discharge pollutants such as raw sewage, and other harmful materials into or near rivers, streams, and impoundments or into natural or manmade channels leading thereto. Do not allow wash water or waste water from concrete or aggregate operations to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

Collect and return waste motor oils, fuels, lubricants, bitumens and similar hydrocarbons to the supplier. Comply with the requirements of 40 CFR 279, Standards for the Management of Used Oil. Do not discharge hydrocarbon products on the ground, use them for road oiling, or bury them in a landfill.

Do not operate mechanized equipment in live streams without written approval of the Contracting Officer.

Obtain necessary permits for floating camps, floats, shore ramps, and other appurtenances associated with project operations from the following State of Alaska and Federal Agencies:

1. ADNR - Alaska Department of Natural Resources.

2. ADEC - Alaska Department of Environmental Conservation.

3. ADGC – Alaska Department of Governmental Coordination.

4. EPA – US Environmental Protection Agency.

5. DA, COE – US Army Corps of Engineers.

6. USCG – US Coast Guard.

USE OF PREMISES

(a) Obtain written approval from the Contracting Officer before opening or operating on National Forest land or lands administered by the Forest Service any camp, quarry, borrow pit, storage area, detour, or bypass site, other than SHOWN ON THE DRAWINGS. A camp is interpreted to include the camp site or trailer parking area of any employee working on the project for the Contractor. Such approval, if granted, will be without charge to the Contractor.

(b) Sanitation Facilities: Provide and maintain the following facilities for the work force at the camp, unless provided otherwise.

1.

Meet State of Alaska drinking water regulations 18 AAC 80 regarding potable water supplies for drinking, washing and cooking.

2.

Comply with State of Alaska wastewater disposal regulations 18 AAC 72 for domestic sewage.

3.

Ensure that the design, operation, and maintenance of all solid waste systems under Forest Service jurisdiction meet all Federal, State, and local requirements. Meet State of Alaska solid waste management regulations (18 AAC 60) and Federal regulations contained in 40 CFR 243, 40 CFR 245, 40 CFR 257, and 40 CFR 258. Remove solid wastes and/or residues and dispose of in approved commercial landfills.

4.

Meet the requirements of 40 CFR 112 (Oil Pollution Prevention) for fuel storage. Meet the requirements of 33 CFR 150 and 33 CFR 154 for facilities transferrring oil or hazardous materials in bulk.

(c) Do not begin any camp development, either land based or floating, until a plan for development, occupation, and cleanup is submitted and approved by the Contracting Officer. Include the following informationon this plan:

1.

Location and size of the proposed camp development, including a map.

2.

Wastewater system.

3.

Number of people who will use the site and proposed dates of occupancy.

4.

Power supply system.

5.

Water supply system.

6.

Building layout, shop area, living quarters.

7.

Road and trail layout.

8.

Clearing limits and slash disposal locations.

9.

Borrow areas.

10.

Dock and access location.

11.

Equipment and fuel storage area and Spill Prevention Control and Countermeasure (SPCC) plan.

12.

Incinerator location and ash disposal plan.

Forest Service will review plan as submitted for completeness and applicability. Proposed modifications of Contractor's plans will be discussed with the Contractor prior to approval. Any modifications agreed upon will be incorporated in a revised set of plans.

EMERGENCY CONTROL

(a) Immediately extinguish without expense to the Government all fires on or in the vicinity of the project which are caused by the Contractor's employees, whether set directly or indirectly as a result of construction operations, with or without direction by the Forest Service. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government resulting from fires set or caused by Contractor's employees or resulting from construction operations.

(b) Contractor's Responsibility for Controlling Other Emergencies - When requested by the Contracting Officer, allow the Forest Service to temporarily use employees and equipment for emergency control work. Payment will be made at not less than the current area rate established by the Forest Service.

(c) Fire fighting equipment will be required during the fire season from May 10 to August 31, and during any other period of fire danger designated by the Contracting Officer.

Furnish rust-free fire tools to equip all workers employed in Contractor's operations at each separate work site. Maintain tools in serviceable condition and keep tools in one or more weather-tight fire tools boxes. Paint fire tools boxes red, mark "tools for Fire Only" with letters at least 3” high, and keep sealed. Post a list of the contents inside each fire tool box so as to be visible when opened.

Equip each internal combustion engine with a spark arrester qualified and rated USDA-Forest Service, Standard 5100-1, unless it is:

(a) Equipped with a turbine-driven exhaust supercharger such as the turbocharger. There shall be no exhaust bypass.

(b) A multi-position engine, such as on a chain saw, which is equipped with screen arrester, as described in the Forest Service Spark Arrester guide.

A spark arrester, which does not meet the requirements in this guide may be approved upon submission of acceptable proof that the arrester is at least 80 percent efficient in retention, attrition, or destruction of carbon particles. Such arrester may be required to meet higher standards as improvements in design and efficiency are discovered.

(c) A passenger-carrying vehicle or light truck intended primarily for use on roads, and equipped with a factory designed muffler and exhaust system.

(d) A heavy duty truck, such as a dump or log truck, or other vehicle used for commercial hauling, used only on roads and equipped with a factory designed muffler and with a vertical stack exhaust system extending above the cab.

Properly install and constantly maintain in serviceable condition all exhaust equipment described in this Subsection, including spark arresters and mufflers.

Equip each unit of mobile or stationary power equipment, including trucks, with one shovel, and at least one fire extinguisher meeting one of the following specifications:

1. 2-1/2 pound size or larger dry chemical type.

2. 4-pound size or larger carbon dioxide type.

Test or check each extinguisher for proper functioning prior to the beginning of fire precautionary period.

Provide each gasoline power saw with one chemical-pressurized fire extinguisher of not less than 8-ounce capacity by weight. Maintain the extinguisher in good working order at all times.

Do not burn camp refuse, brush, slash, or debris such as that resulting from clearing around camps or on rights-of-way, without the written approval of the Contracting Officer. Submit written requests for burning to the Contracting Officer at least 48 hours in advance of intended burning. The Contracting Officer will approve routine camp refuse disposal incineration in the camp development proposal.

AGAR 452.236-77 Emergency Response (NOV 1996)

(a) Contractor’s Responsibility for Fire Fighting. (1) The Contractor, under the provisions of FAR clause 52.236-9, Protection of existing vegetation, structures, equipment, utilities, and improvements, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. (2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contactor or the Contractor’s agents or employees.

(b) Contractor’s Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.

(c) Contractor’s Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to fire fighting). An equitable adjustment for the temporary use of employees and equipment will be made under the Changes clause, FAR 52.243-4.

(NOTE: See Fire Plan Requirements referenced in the attachments).

Conformity with Drawings and Specifications Unless working tolerances are specified, all work performed and materials furnished shall be in reasonably close conformity with lines, grades, cross sections, dimensions, and material requirements shown on the drawings, indicated in the specifications, or designated on the ground. "Reasonably close conformity" is in compliance with reasonable and customary manufacturing and construction tolerances.

A.

Definition. "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

B.

The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

C.

Government inspections and tests are for the sole benefit of the Government and do not--

1.

Relieve the Contractor of responsibility for providing adequate quality control measures;

2.

Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;

3.

Constitute or imply acceptance; or

4.

Affect the continuing rights of the Government after acceptance of the completed work under paragraph (I) below.

D.

The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.

E.

The Contractor shall promptly furnish, without additional charge, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

F.

The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

G.

If the Contractor does not promptly replace or correct rejected work, the Government may (1) by contract or otherwise, replace or correct the work and charge the cost to the Contractor or (2) terminate for default the Contractor's right to proceed.

H.

If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

I.

Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

Final Cleanup The following is in addition to FAR Clause 52.236-12. Contractor shall remove and dispose all of its own trash and refuse from the contract area. Material to be removed includes, but is not limited to camp refuse such as tin cans, aluminum foil, glass, paper, garbage, used engine oil, oil filters, oil cans, grease cartridges, etc. The Contractor shall also remove and dispose of upon completion of the trail construction, all stakes, old culverts, flagging, and similar debris within the project area. This cleanup is a subsidiary item for which no special payment will be made. All debris shall be disposed off National Forest Land and in accordance with State and Local disposal requirements.

OTHER CONTRACTS

The Government may undertake or award other contracts for additional work near the site of the work under this contract. The Contractor shall fully cooperate with the other contractors and with Government employees and shall carefully adapt scheduling and performing the work under this contract to accommodate the additional work, heeding any direction that may be provided by the Contracting Officer. The Contractor shall not commit or permit any act that will interfere with the performance of work by any other contractor or by Government employees.

FAR 52.204-7 Central Contractor Registration (FEB 2012)

(a) Definitions. As used in this clause—

“Central Contractor Registration (CCR) database” means the primary Government repository for Contractor information required for the conduct of business with the Government.

“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

“Data Universal Numbering System +4 (DUNS+4) number” means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

“Registered in the CCR database” means that—

(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the CCR database; and

(2) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record “Active”. The Contractor will be required to provide consent for TIN validation to the Government as a part of the CCR registration process.

(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror’s name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(1) An offeror may obtain a DUNS number—

(i) Via the Internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or

(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.

(2) The offeror should be prepared to provide the following information:

(i) Company legal business.

(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(iii) Company Physical Street Address, City, State, and ZIP Code.

(iv) Company Mailing Address, City, State and ZIP Code (if separate from physical).

(v) Company Telephone Number.

(vi) Date the company was started.

(vii) Number of employees at your location.

(viii) Chief executive officer/key manager.

(ix) Line of business (industry).

(x) Company Headquarters name and address (reporting relationship within your entity).

(d) If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.
