ADDENDUM TO FAR 52.212-2 – EVALUATION – COMMERCIAL ITEMS (NOV 2021)

1. Methodology. This acquisition will utilize the Lowest Price Technically Acceptable (LPTA) approach, in which, the Government intends to award to an offeror with a technically acceptable quote at the lowest overall total evaluated price. The LPTA approach does not permit tradeoffs between price/cost and past performance, and will include an evaluation for technical acceptability.
2. Relative Importance. The Government’s evaluation will be based on the following factors:
a. Factor 1 – Price
b. Factor 2 – Technical Acceptability
Price and Technical, when combined, are equal when evaluated.
3. Offers which are unrealistic in terms of technical acceptability or price may be rejected at any time during the evaluation process. The Government reserves the right to make an award without discussions; however, discussions may be conducted with all, some, or none of the offerors. Offerors may be required to participate in telephone discussions.
4. The Government intends to award a Firm-Fixed Price (FFP) Contract as a result of this solicitation.
5. Offerors are cautioned to follow the detailed instructions in the Addendum to 52.212-1 and
Addendum to 52.212-2 fully, as the Government reserves the right to make an award based on initial offers received, without discussion of such offers.
a. Technical Evaluation. Offers shall be evaluated independently of the cost/price quote evaluation to determine the offerors’ compliance with the technical requirements of this solicitation. The Government may make a final determination as to the rating of an offer based on the quote as submitted without requesting any further information. The technical factor will receive an overall rating of either “Acceptable” or “Unacceptable” using the rating description in Table 1 below. The Government’s technical evaluation team shall evaluate the technical quotes on a pass/fail basis, assigning one of the ratings described below. Any factor evaluated as “Unacceptable” will render the entire quote
“Unacceptable”; therefore, un-awardable. Only those quotes determined to be technically
“Acceptable”, either initially or as a result of discussions, will be considered for award.
However, the offeror is cautioned that the Government reserves the right to award this effort based on the initial quote, as received, without discussion. Evaluators shall assign a rating, which fails within one of the following ranges according to the degree to which the offeror meets the minimum requirements described below in Table 1.

Rating Description
ACCEPTABLE
Quote meets the requirements of the solicitation. The offeror’s documentation clearly demonstrates their capability and understanding of all aspects of performance in accordance with the TRD and can meet requested delivery.
UNACCEPTABLE
Quote does not meet the requirements of the solicitation. The offeror’s documentation does not clearly demonstrate their capability and understanding of all aspects of performance in accordance with the TRD or cannot meet delivery.
The technical factor will be rated ACCEPTABLE when the offeror’s documentation clearly demonstrates their capability to accommodate all aspects of performance in accordance with the TRD.
The technical factor will be rated UNACCEPTABLE when the offeror’s documentation does not clearly demonstrate their capability and understanding of all aspects of performance in accordance with the TRD.
5.1. The Government will review the offer for technical acceptability and will conduct market research to determine price fair and reasonableness. Accordingly an award will be made after both metrics are met and the offer is determined to be both technically acceptable and providing the best value to the Government.
6. Basis for Contract Award. By submission of its quote, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications. The
Government intends to award a contract to the offeror deemed responsible in accordance with
FAR 9.104, as supplemented, whose proposal conforms to the Request for Quote (RFQ) requirements including all stated terms, conditions, representations, certifications, and all other information required by the RFQ and is judged, based on the evaluation criteria, to represent the best value to the Government. The Government intends to award one contract to the offeror whose Technically acceptable quote is the lowest priced of those quotes received.
