PERFORMANCE WORK STATEMENT

ABLE BODIED SEAMAN (AB) / PROFICIENCY IN SURVIVAL CRAFT (PSC)

LIFEBOATMAN TRAINING FOR

MSC CIVIL SERVICE MARITIME EMPLOYEES (CIVMARS)

1. BACKGROUND

Able Bodied Seaman (AB) and Proficiency in Survival Craft (PSC) courses provide Military Sealift Command (MSC) Civil Service Mariners (CIVMARS) the training to qualify as AB Seaman and PSC/Lifeboatman. The AB and PSC rating endorsements are required by the United States Coast Guard (USCG) and are necessary for operating MSC ships.

2. SCOPE OF WORK

The Contractor shall provide each MSC CIVMAR attending Deck training classes with relevant up to date training materials. The Deck training courses include: 1) AB; 2) PSC. A classroom and laboratory environment shall be provided for applicable lectures, hands-on experience, and the application of practical knowledge within a real-world shipboard environment. The Contractor shall provide each MSC CIVMAR attending USCG approved AB and/or PSC classes the relevant up-to-date training course materials.

3. PLACE OF PERFORMANCE

The AB and PSC training shall be conducted within a 30-mile radius of MSC CIVMAR Support Unit (CSU) East in Norfolk, Virginia, located at 471 East C Street, Building SP-312, Norfolk, VA. 23511, or within a 30-mile radius of MSC CSU West in San Diego, California, located at 140 Sylvester Road, San Diego, California 92106. Only a single location is sought. The proximity of the training to the MSC locations assists with the logistics of MSC CIVMARS daily commutes to/from MSC contracted quarters for the CIVMARS.

4. REQUIREMENTS

4.1 The Contractor shall provide the AB and PSC courses to accommodate a total of 120 MSC CIVMARS each. The Contractor shall offer each course a minimum of monthly with each course being offered over a consecutive two week period. An authorized MSC Technical POC will be appointed and will schedule course convening dates at the beginning of the contract with the Contractor, as well as special class convenings. Special class convenings are additional courses that were not scheduled at the beginning of the contract but may be required to support an unanticipated student surge.

The training courses must be USCG approved and meet the requirement of Paragraph 6 below.

4.2 The Contractor shall provide each MSC CIVMAR student with a course completion survey.

The Contractor shall ensure that students have the opportunity to complete the survey for constructive feed-back on each course. The Contractor shall provide a PDF scanned copy of all completed student surveys to the MSC Technical POC, via email, within two (2) business days of completion of each course.

4.3 The Contractor shall provide each student, who successfully completes the course of instruction, with a certificate of completion. Additionally, the Contractor shall provide a PDF scanned copy of roster to the MSC Technical POC, via email, within two (2) business days of completion of each course for the students' training records.

4.4 The Contractor shall notify the MSC Technical POC immediately if any students do not show up for class, or if any student is not expected to pass the course.

4.5 The Contractor shall provide MSC CIVMAR students that do not receive a final passing grade an opportunity for re-tests in accordance with the USCG regulations to obtain a passing grade and certificate of completion. The Contractor shall provide the re-test results to the MSC Technical POC, via email, within two (2) business days of completion of re-testing.

4.6 The Contractor shall not allow any unregistered MSC CIVMARS into a class before receiving approval from MSC Technical POC who is authorized to enroll students. If the Contractor allows an unauthorized MSC CIVMAR student to attend, the Contractor assumes financial responsibility of the unauthorized student.

4.7 The Contractor shall provide daily transportation for MSC CIVMARs during training, to and from the MSC-contracted hotels to the training location(s).

5. TRAINING CLASSROOMS/FACILITIES AND MATERIALS

The Contractor shall provide access to a safe and furnished facility and shall provide all materials required to instruct the AB / PSC training courses. Specifically, for proficiency in Survival Craft, the Contractor shall provide training on full-size lifeboat and davits. MSC is not providing any facilities or materials.

6. AB / PSC TRAINING COURSES

6.1 AB Course shall be approved by the USCG and will satisfy the written examination requirements of 46 C.F.R. § 12.405(a) and the Practical Marlinspike Seamanship Demonstration requirement of 46 C.F.R. § 12.405(c). Title 46 was last amended December 27, 2021

6.2 PSC Course shall be approved by the USCG and will satisfy the examination and practical demonstration requirements of 46 C.F.R. § 12.407(b)(3) for endorsement as Lifeboatman, and meet the training and standards of competence requirements of 46 C.F.R. §12.613(b)(3); Section A-VI/2-1 and Table A-VI/2-1 of the STCW code for endorsement as Proficiency in Survival Craft and Rescue Boats Other Than Fast Rescue Boats. Title 46 was last amended December 27, 2021.

7. QUALIFIED INSTRUCTORS REQUIREMENTS

The Contractor shall provide the USCG certified instructors. The Contractor will provide the curriculum and all necessary course materials.

MSC strongly prefers, but does not mandate, that certified instructors have experience at sea on board ships equipped with lifeboats while serving in positions of responsibility such as Licensed Deck Officers or Able Seaman-Unlimited, minimally, or other comparable experience while serving with the US Navy, USCG, or Merchant Marine.

9. CONTRACT ADMINISTRATION AND DATA

Functions and Limitations of the MSC Technical POC: An authorized MSC Technical POC shall be appointed and will represent the Contracting Officer (KO) in the administration of technical details within the scope of this contract and will manage inspection of all deliverables. The MSC Technical POC is not otherwise authorized to make any representations or commitments of any kind on behalf of the KO or the Government. The MSC Technical POC does not have the authority to alter the Contractor's obligations, change the specifications in the contract, or issue contract modifications. If, as a result of technical discussions, it is desirable to alter contract obligations or the Performance Work Statement, a modification must be issued in writing and signed by the KO. The MSC Technical POC is responsible for reviewing all Acceptable Quality Levels (AQL) submissions by the Contractor and for informing the KO of areas where exceptions are to be taken. The MSC Technical POC authority is non-delegable. The MSC Technical POC may be personally liable for unauthorized acts.

10. AUTHORIZED CHANGES BY THE CONTRACTING OFFICER

Except as specified below, no order, statement, or conduct of Government personnel who visit the Contractor's facilities or in any other manner communicates with Contractor personnel during the performance of this Contract shall constitute a change under the Changes clause of this Contract.

10.1 The Contractor shall not comply with any order, direction, or request by Government personnel unless it is issued in writing and signed by the KO.

10.2 The KO is the only person authorized to approve changes in any of the requirements of this contract and notwithstanding provisions contained elsewhere in this contract, said authority remains solely the KO. In the event the Contractor effects any change in the direction of any person other than the KO, the change will be considered to have been made without authorization. Therefore, no adjustments will be made in the contract price to cover any increase incurred as a result thereof. Any MSC warranted KO within his/her warrant can act in the administration of this Contract. The identity thereof shall be made known to the Contractor via separate correspondence so as not to unduly require excessive contract modifications should warranted KOs be reassigned during the normal seminar of the performance of his/her duties during the life of the Contract.

11. INITIAL MEETING

11.1 An initial contract meeting will be held within fifteen (15) business days after award.

11.2 The Contractor, the MSC Technical POC, and the KO shall arrange a mutually agreeable time and place to meet in person or virtually via a teleconference or phone conference to discuss the work requirements and details.
