(iv) Each offeror’s price proposal must be based on the offeror’s own technical proposal, the Government’s specifications, and other contractual requirements. If the prices are to be based on established market prices, not otherwise published, or are prices applicable only to the proposed contract, the offeror shall so state.

(v) The Government expects that this contract will be awarded based upon adequate price competition. However, in order to determine that offered prices are fair and reasonable, the Government reserves the right to request that the offeror provide cost breakdowns to support proposed prices.

Section D, Attachment 2, Page 128: The experience description for a Scientist Grade IX is incorrect. The text should read as follows:

Grade IX – Bachelor's degree, or higher, from an accredited college or university with a major directly related in a field of study as related to the requirements of specific task order with emphasis in fisheries, oceanography, social science, natural science, mathematics, or hydrology, plus seven (7) years of experience in related field or

AMENDMENT 1

SOLICITATION QUESTIONS AND ANSWERS

Question 1: After reviewing the RFP we realized that section L and M were not included in the RFP or attached documents. Would you please let us know when they would be posted?

Answer: Solicitation AB-133F-14-RP-0158 is being solicited according to FAR Part 12’s commercial item solicitation format. As such, specific sections L and M do not appear in this document.

Question 2: Would you please clarify what is meant by multiple award in Section E? Does multiple award mean that one company would receive an award for Schedules A through E, and another company would receive an award for Schedule F, or does multiple award mean multiple award within Schedules A through E, for example?

Answer: Multiple awards can cover all of those situations. One or more offerors may be awarded Schedules A through E, Schedule F, or Schedules A through E and F. The Government is also reserving the right to award the entire contract to one offeror, or to no one at all.

Question 3: Can you clarify the 100% Small Business Set Aside requirement in the above-listed solicitation number? Can a small business subcontract to a larger business under this set-aside as long as the small business completed 51% of the annual work?

Answer: The solicitation is 100% set aside for small business. Only small businesses at or under the $15,000,000 size standard may compete. A small business that meets this requirement may subcontract to a business over this size standard, so long as the prime contractor is performing at least 50% of all work across all orders received by NOAA.

Question 4: We understand the requirement for the hard copies as well as the email copy. Our question relates to the sending of the email.

What is the date/time preference for receipt of the email? For example, if we ship the proposal so that it arrives no later than 2 PM PDT on 24 October, is it your anticipation that we would send the email at the same time as the shipment?

Answer: All components of an offeror’s proposal, whether printed/hard copy or electronic versions, are required to be received by NOAA no later 2:00 PM Pacific Time, October 24, 2014.

It does not matter whether electronic and printed/hard copies are sent at the same time.

Question 5: Is the Service Contract Act applicable to any of the Labor Category/Grades specified in RFP Section D Attachment 2?

Answer: No.

Question 6: For the Excel spreadsheet for the pricing, may we password protect that file, and send the corresponding password in a separate email?

Answer: Yes.

Question 7: Pricing Schedule, pp. 5,7,10,12,15 – We are being asked to quote unit prices for Local and Traditional Knowledge Specialists for Hawaii for the AFSC. Is this correct or should these blocks also be shaded?

Answer: This is correct. The blocks for Local and Traditional Knowledge Specialists for Hawaii for the AFSC should NOT be shaded.

Question 8: Regarding pricing, are the fully loaded labor rates considered ceiling rates?

Answer: The proposed labor rates shall be considered the maximum rate the Government may be billed for any given order.

Question 9: Should the pricing hourly rates be based on Contractor Site locations or Government Site locations?

Answer: Government site locations.

Question 10: Will the Government identify the labor categories from the pricing schedule to be used to perform the work when issuing task order request for proposals under the contract, or will the contractor(s) be allowed to determine the labor categories required to perform the work for each task order?

Answer: The Government will identify the labor categories.

Question 11: Why do Items 0003 through 0010 in the RFP Pricing Schedule Summary indicate 0.00 in the Quantity column?

Answer: Items 0003 through 0010 in the RFP Pricing Schedule Summary are for option periods which will not be exercised at the time of award.

Question 12: Pricing Schedule, p. 3 – No quantities are listed on the schedule for any option years. Are we to include unit prices for

option years on the schedule and extend out at a zero amount? Should quantity amounts be added for option years?

Answer: Please include unit prices for the option years and extend out to a zero amount. Quantity amounts will not be added to the option years list on page 3 of the solicitation.

Question 13: Does the Unit Quantity of One (1) in the RFP Pricing Schedule mean 1 person-hour OR 1 standard person-year of billable hours (e.g. 1880)?

Answer: The Unit Quantity of One (1) in the RFP Pricing Schedule equates to 1 hour per labor category (per person).

Question 14: Pricing Schedule, pp. 4 to 16 – No quantities or hours are listed for any of the position categories. Are we simply to sum and total all unit prices of the listed position categories for each base and option year and move the sum of the individual unit prices for each position category by base and option year to page 3?

Answer: The Unit Quantity of One (1) in the RFP Pricing Schedule equates to 1 hour per labor category (per person). For further instructions on completing Schedule B and the Pricing Schedule see the Revised Pricing Schedule and the Example Revised Pricing Schedule as attached.

Question 15: A project manager is listed under key personnel, but not included in the pricing schedule. Please confirm that a rate is required for the project manager, and whether this would be a billable labor category under the contract.

Answer: The Project Manager(s) is/are NOT a direct billable labor category, so a labor rate is not required on the Pricing Schedule.

Question 16: How should we price positions that might reside outside of the Schedule headquarters locations?

Answer: Positions may be filled in any area identified in the Statement of Work for each schedule. Bearing this in mind, offeror’s pricing should be at the offeror’s best judgment. The offeror’s proposed rate will serve as the maximum rate the Government may be billed on a given task order. At the task order level, the contractor may elect to offer a discounted rate depending on the precise location of the work being performed in the specific task order.

Question 17: Proposal preparation instructions are presented beginning on Page 50 and again beginning on page 71. It appears they are

somewhat similar but in some cases are not. Please clarify which instructions are the ones to be used.

Answer: The instructions are complementary, and should be reviewed in both sections.

Question 18: RFP Page 50 specifies two proposal volumes (Technical Proposal and Business/Price Proposal). RFP Page 72 specifies two proposal volumes (Volume I – Business Proposal and Volume II – Technical Proposal). Are the Business Proposal and the Business/Price Proposal the same document? What are the correct Volume numbers and titles?

Answer: The Business Proposal is also referred to as the Price Proposal, or the Business/Price Proposal. They are the same document. The Proposals should be named as specified per CAR 1352.215-70 PROPOSAL PREPARATION (DATE) (b) on page 72.

Question 19: Section E under CAR 1352.215.70 (b) (1) (i) or (ii), p.72 – These sections do not list any spacing requirement or page limitation for preparation of the Business Proposal. Are we to follow the standard under Section E.2, p. 50 for proposal preparation of this volume?

Answer: The Business Proposal is to consist of the completed Standard Form 1449 and the pricing schedule (pages 1 through 16 of the solicitation)(See Example Revised Pricing Schedule). The page count may vary depending upon if an offeror has already completed the Representations and Certifications online at www.sam.gov, or if they are submitting the information with the business proposal.

Question 20: Section E.2, p. 50 – In this section, it is stated that the proposal should be double spaced but in Section E under CAR

1352.215.70 (b) (2) (i) (C) for Technical Proposal Preparation on page 73, the text lists that the proposal should be single-spaced. Which standard is to be applied to the Technical Proposal? Section E.2, p.

50 – In this section, no page limitation is established for the Technical Proposal but in Section E under CAR 1352.215.70 (b) (2) (i)

(C) for Technical Proposal Preparation on page 73, a 40-page limitation is mentioned. What is the page limitation that we should adhere to? Please confirm if the cover, cover letter, table of contents and appendices are inclusive or exclusive of the 40 page limit.

Answer: The Technical Proposal should be typed, single-spaced, with a 40 page limit per CAR 1352.215.70 (b) (2) (i) (C) and the revised text of ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (a)(2). The Technical Proposal appendices are included in the 40 page limitation. The Technical Proposal cover, http://www.sam.gov/

cover letter, table of contents, graphics, charts and exhibits do not count towards the 40 page limitation.

Question 21: In the proposal preparation section of the RFP it states the offeror must use size 12-font or equivalent. In exhibits, is smaller font permitted?

Answer: Headers, Footers, Exhibits and Tables should all meet the size 12 font specifications.

Question 22: Please confirm that the Project Manager(s) is the only required Key Personnel.

Answer: The Project Manager(s) is/are required Key Personnel.

Other persons/job positions may be proposed as Key Personnel, but are not required.

Question 23: Is there a limit to the number of past performance descriptions we can use in the Technical Discussion Subfactor B?

Answer: No, provided the 40 page limit for the Technical Proposal is not exceeded.

Question 24: Past Performance appears to be outside the three technical Subfactors. How will it be evaluated within the overall technical volume?

Answer: See CAR 1352.215-75 EVALUATION CRITERIA (APR 2010) (c) on page 77 for evaluation information.

Question 25: Do contractors need to submit past performance write-ups, or will past performance be evaluated only on the questionnaires submitted by references?

Answer: No, offerors do not need to submit past performance write-ups. See CAR 1352.215-75(c) on page 77 and ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (b)(2) on page 53.

Question 26: Should contractors provide a list of the past performance references to the Contracting Officer when it’s finalized (sometime before the proposal due date), or include the list of references in the proposal?

Answer: Yes. See ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS

– COMMERCIAL ITEMS (b)(2) on page 53.

Question 27: Is there a limit to the number of Past Performance Questionnaires we send out?

Answer: No.

Question 28: What is the time frame for Past Performance contract acceptability?

Answer: Past performance information should be based on recent, relevant experience. See ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (b)(1) on page 52.

Question 29: Is Section 2: Past Performance included in the stated page limit?

Answer: No, Past Performance Questionnaires described under

ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

(b)(2) do not count toward the stated page limit.

Question 30: Section D.1.10, pp. 99-100 – Insurance requirements for sea days and aircraft days vary dramatically from the standard insurance coverages that apply when work is performed on land. While it appears that the intent is to cover such differences by applying a multiple of 1.5 to the hourly bill rate applied to the position category, how will task orders that require sea and air days but do not require overtime account for the different insurance coverages that will need to be included in the budget for task orders requiring sea and air days but not necessarily overtime? Is it assumed that any task orders requiring sea and/or air days during performance will automatically require overtime in the development of a budget for such task orders within the RFP provided to the Contractor by the CO?

Answer: Offerors may elect to propose a Sea-Day Premium. If an offeror intends to invoice at a different hourly rate for work performed at sea (Sea-Days), the offeror shall provide the proposed factor that will be applied to their hourly rate (the Sea-Day Premium) and justify/explain how this factor was derived and include the explanation in the offeror’s Business Proposal. The explanation of how the factor is derived shall not exceed one page in length at 12-font. The proposed factor shall be based on the standard (land based) regular hourly rate. Overtime is applicable to Sea-Days, however the Sea-Day Premium shall not be calculated on the overtime hourly rate. See the last page of Revised Pricing Schedule as attached.

Question 31: What is the relationship between the recently awarded NOAA Fisheries, Alaska Region IDIQ for NEPA compliance support (Solicitation Number AB133F-12-RQ-0014) and potential task orders providing NEPA support as described D.1.3.1.27?

Answer: None.

AMENDMENT 1

Question 32: Please confirm that site Project Managers as described in the Project Manager labor category description are required at the headquarters of each of the five centers/offices (AFSC, NWFSC, WCR, PIRO, and PIFSC) and not at each supported site/lab under them.

Answer: The Project Manager(s) will be located at the contractor’s choice of contractor facility, not in a Government facility. The Project Manager(s) are required to be available to the contractor’s employees and National Marine Fisheries Services (NMFS) staff during normal operating hours, but are NOT hosted at any of the NMFS headquarters or offices, including the Regional Offices, and Fisheries Science Center offices or headquarters. See PROJECT MANAGER (KEY PERSONNEL) General Description on page 120.

Question 33: Will any contractor staff be required to drive boats as part of their duties? This will require special insurance and if so, how big are these boats and how often will they be responsible for doing so?

Answer: Contractor staff may be required to operate (coxwain) very small boats on an infrequent, as needed basis.

Question 34: Will any contractor staff be required to have longshoreman/Jones act insurance for working dockside or on the ocean?

Answer: At this time the Government does not believe Longshoreman’s Insurance and/or Jones Act requirements to be applicable to this solicitation. Longshoreman’s Insurance and/or Jones Act related costs should not be built in to the offeror’s pricing.

Question 35: Scientist Grade IX -- says BS+6 to total 12 years combined education/experience. Is it supposed to be BS+8? Grade VIII said BS+6 to total 10.

Answer: The description for Scientist Grade IX is incorrect. It should state “plus seven (7) years of experience in related field or combination of such totaling twelve (12) years combined education and experience”.

Question 36: We request that the proposal submission date be extended by two weeks.

Answer: The due date is NOT extended and remains 02:00 PM Pacific Time, October 24, 2014.

SEA-DAY PREMIUM CALCULATION

SEA-DAY CALCULATION EXAMPLE:

Regular Hourly Rate: $10.00

Sea-Day Premium: 1.10% Sea-Day Hourly Rate: $11.00

Regular Hourly Rate: $10.00 Overtime Premium: 1.50%

Overtime Hourly Rate: $15.00

Overtime Hourly Rate on Sea-Days: $16.00

OFFEROR'S PROPOSED SEA-DAY PREMIUM FACTOR:

(State as a percentage, i.e.; 1.05%, or 1.10%)

Offerors may elect to propose a Sea-Day Premium. If an offeror intends to invoice at a different hourly rate for work performed at sea (Sea-Days), the offeror shall provide the proposed factor that will be applied to their hourly rate (the Sea-Day Premium) and justify/explain how this factor was derived and include the explanation in the offeror's Business Proposal. The explanation of how the factor is derived shall not exceed one page in length at 12-font. The proposed factor shall be based on the standard (land based) regular hourly rate. Overtime is applicable to Sea-Days, however the Sea-Day Premium shall not be calculated on the overtime hourly rate. Overall liability will be covered by vessel operators and should be excluded from any proposed Sea-Day Premium.
