CONTRACTOR POLICY FOR ACCESS TO THE PUEBLO OF ZIA DURING COVID-19

The following information outlines our policy for contractor access to the Pueblo of Zia during

COVID-19. The following policies are in place to prevent the spread of COVID-19 within the jurisdictional boundaries of the Pueblo.

Until further notice, it is the policy of the Pueblo of Zia that all tribal employees and tribal members have a documented negative COVID-19 test that is current (a current test is one that is less than

21 days old) on an ongoing basis. In addition, it is the policy of the Pueblo of Zia to request proof of a negative COVID-19 test results that are less than 21 days old for contractors and their employees who wish to conduct business on or within the boundaries of the Pueblo of Zia.

The coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health

Organization. COVID-19 is extremely contagious and is spread mainly from person-to-person contact. As a result, the Pueblo of Zia recommends social distancing and prohibits the congregation of groups of people. The Pueblo of Zia has put into place preventative measures to reduce the spread of COVID-19, however, the Pueblo of Zia cannot guarantee that you or anyone else will not become infected with COVID-19.

Contractors will be responsible for all its employees and agents and shall be required to inform each of this policy and its enforcement. Everyone entering the Pueblo will be required to have in his/her possession a current letter of negative COVID-19 testing that is current. Contractor and each employee wishing to enter the Pueblo must sign the attached waiver.

Homeowners will be responsible for informing their contractors of this policy and providing the necessary documentation to the Contractor and forwarding the information to the Pueblo. The

Pueblo will be the final authority to grant or deny access into the Pueblo.

ACKNOWLEDGEMENT AND ASSUMPTION OF THE RISK, WAIVER OF

LIABILITY, RELEASE, AND INDEMNITY AGREEMENT

In Consideration of being permitted to enter the Pueblo of Zia, I, for myself and for any personal representatives, assigns, heirs, and next of kin:

ACKNOWLEDGE, agree, and represent that I understand the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by entering the

Pueblo of Zia and that such exposures or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 does exist throughout the State of New Mexico, The United States of America, and is not limited to the Pueblo of Zia. I further agree and warrant that if I become infected, exposed or otherwise come in contact with the COVID-19 virus, I will immediately cease entry and/or leave the Pueblo.

I fully understand and voluntarily agree to assume all of the foregoing risks and dangers and accept sole responsibility for any injury or illness to myself, including but not limited to, personal injury, disability, death, illness, damages, social/economic loss, liability, healthcare, or expense of any kind, that I may experience or incur in connection with my providing services on the Pueblo of

Zia.

I hereby release, covenant not to sue, discharge, and hold harmless the Pueblo of Zia, its employees, tribal officials, officers, agents, representatives, and tribal members, of and from any claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or related to the COVID-19 Pandemic. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the Pueblo of Zia, its employees, tribal officials, officers, agents, representatives, and tribal members, whether a COVID-19 infection occurs before, during, or after entering the Pueblo of Zia.

I further understand that I am not liable for any exposures or risk of exposures I may cause while

I am on the Pueblo of Zia. I further agree that if, despite this Acknowledgement, Assumption of the Risk, Waiver of Liability, Release, and Indemnity Agreement, I, or anyone on my behalf makes a claim against any of the Releasees, I WILL INDEMNIFY and save and HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as a result of such claim.

I further agree that I will comply with all instructions issued by the Pueblo or their Agents, and that I will use caution and care during entry to minimize personal contact and risks associated with

COVID-19.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND

THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, HAVE FREELY

SIGNED WITHOUT INDUCEMENT OR ASSURANCE OF ANY KIND, AND INTEND IT TO

BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE

GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS

AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL

CONTINUE IN FULL FORCE AND EFFECT.
